Bellefontaine man accused of a sex charge against the woman who became his wife had his bond reduced Tuesday.

Lawyers for Joseph Pilkington successfully argued that a $100,000 bond was too high.

The judge agreed to reduce it to $10,000. As of Tuesday night, Pilkington was still in the Logan County Jail.

Brittany Pilkington attorney request to have trial moved

The attorney for 23-year-old Brittany Pilkington says in court filings that extensive media coverage would prevent a fair trial in Logan County. The prosecutor says an impartial jury can be seated there.

Pilkington confessed to killing her three sons in the last year and has pleaded not guilty to all the murder charges. She is currently facing the death penalty. She remains in jail on $1-million bond.

Court considers nearly 50 motions filed in Bellefontaine mom’s case

Lawyers for the Bellefontaine mom who faces the death penalty for allegedly smothering her three sons to death continue their quest to have her trial moved out of Logan County.

Some of the requests include moving the trial out of Logan County, removing the Logan County Prosecutor’s Office from the case and not letting jurors see pictures of Pilkington’s deceased sons during the trial.

O’Connor didn’t make any decisions in the conference Tuesday but said he would like to try to seat a local jury first before considering whether to move the trial or not. The judge and lawyers will next meet on Jan. 5 to discuss whether or not the Logan County Prosecutor’s Office should be removed from the case.

The case is scheduled to go to trial in early March, but Goslee has said he expects that date to be pushed back.

Defense not sure it wants blood sample taken from Pilkington

Defense attorneys for Brittany Pilkington will have until June 15 to determine whether or not they agree a DNA test proposed by prosecutors is the best available option and necessary.

Chief Assistant Prosecutor Eric Stewart said prosecutors want a blood sample from the 23-year-old defendant to definitively disprove genetic defects led to the deaths of her three sons over a 13-month period.

He said Ms. Pilkington and her husband, Joseph, made claims Niall, one month, and Gavin, 4, may have died from genetic defects.

A blood sample has been collected from Mr. Pilkington, but prosecutors need the mother’s sample to complete the tests which take five to six weeks.

Husband of woman accused of killing 3 sons pleads guilty to misdemeanor sex charge

Joseph Pilkington’s wife sits in jail, awaiting trial on aggravated murder charges that accuse her of intentionally suffocating the couple’s three young sons in a span of a little more than two years.

On Monday, the 44-year-old Pilkington put his own criminal case behind him by pleading guilty in Logan County Common Pleas Court to a misdemeanor charge for having sex with Brittany Pilkington, who is 20 years his junior, when she was underage and not yet his wife.

Joseph Pilkington, who now lives at Buckeye Lake, won’t have to serve jail or prison time but must register as a convicted sex offender annually for the next 15 years.

Bellefontaine mom charged with killing 3 sons not opposed to testing

Defense attorneys for the Bellefontaine mother accused of smothering her three young sons to death over a 13-month-period aren’t against genetic testing for Pilkington, according to court documents.

Prosecutors filed a motion in May requesting a blood sample from Pilkington in order to rule out genetic disorders as the cause of death for her sons.

The defense initially responded to the request, stating it violated her rights. But in a supplemental response filed last month, defense attorneys wrote, “Ms. Pilkington does not oppose the state investigating the possibility of a genetic disorder as a cause of death.”

In the same response, Pilkington’s defense requests any testing of her be done with counsel present. It also asks that if testing is done, husband Joseph Pilkington and their 5-year-old daughter are also tested, in addition to her three dead sons.

Tape of Bellefontaine mom’s alleged confession shown in court

A taped police interview where a Bellefontaine mother allegedly confesses to killing her sons was shown in open court Tuesday for the first time since her arrest last year.

The video was shown in a Logan County Common Pleas Court as part of a hearing to consider the defense’s motion to throw out Brittany Pilkington’s alleged confession.

The trial is scheduled to start Feb. 27, 2017.

Brittany Pilkington’s husband, Joseph Pilkington, was charged with felony sexual battery and arrested in September 2015 for allegedly starting a sexual relationship with then Brittany Cummins while she was a minor and he was a step-father figure living in her home.

He pleaded guilty earlier this year to a lesser, misdemeanor charge of sexual imposition, according to Logan County court records. He must register as a Tier One sex offender for 15 years and he received no jail time as part of his sentencing

Logan County judge OKs Brittany Pilkington confession tape for trial

A Logan County judge ruled Friday that a recorded police interrogation showing Brittany Pilkington appearing to confess to killing her three children can be used in trial.

Lawyers for Pilkington, 24, had requested that her statements to police after the death of her third son in August 2015 be suppressed because her rights were violated in the interview and they said she didn’t understand the context of her discussion with police.

As far as I'm concerned, that man is every bit as responsible for the deaths of those children as their mother.

True justice here would be jail for him, and also for Brittany's POS mother. At least he's a RSO now, as he so richly deserves to be but IMO it just is not enough.

Those poor little boys never had a hope of a normal life. Sad that social services didn't intervene in time to save them. Every single person who should have helped them, nurtured and cherished them, failed them miserably.

Bellefontaine mom’s murder trial pushed back again

The trial of Bellefontaine mother Brittany Pilkington, who has been charged with aggravated murder in the death of her three sons, has been pushed back again at the request of her lawyers.

Following a hearing in Logan Common Pleas Court on Wednesday, the judge vacated the final pre-trial date set for February and rescheduled the next hearing for March 20. The trial was previously set to begin in early March.

No new dates for the trial, expected to last four weeks, have been set.

Legal proceedings in the capital murder case against Brittany Pilkington continue and it appears she will celebrate a third anniversary in the Logan County Jail next year before she goes to trial.

She faces the possibility of a death sentence, but her trial has been delayed as her attorneys have appealed an order from presiding Judge Mark S. O’Connor.

Ohio court declines appeal from woman charged with killing 3 sons

An Ohio woman accused of suffocating her three young sons over a 13-month period has unsuccessfully appealed a court order that she undergo a psychiatric evaluation.

At issue is whether a confession made by defendant Brittany Pilkington can be used at her trial.

Pilkington’s attorneys argue the confession should be tossed after their experts concluded Pilkington has brain damage and a low IQ. Logan County Judge Mark O’Connor has ordered an independent psychiatric evaluation.
