Andrew Freund's parents killed him days before they reported him missing, police say

Andrew Freund, the 5-year-old whose body was found Wednesday buried in a shallow grave, was murdered by his parents three days before his father reported him missing, according to police.

Andrew was killed on or about April 15 after his parents, JoAnn Cunningham and Andrew Freund Sr., beat him and forced him to remain in a cold shower "for an extended period of time," according to the criminal complaint.

He wasn't reported missing until April 18 by his father, who is also accused of burying the body.

The McHenry County Coroner's office on Thursday ruled Andrew's cause of death as craniocerebral trauma as a consequence of multiple blunt force injuries.

This poor little boy.....Five years old and beaten to death by someone who should have protected him from any and all harm. I just cant comprehend how those who were supposed to protect him from this woman who gave birth to him failed him miserably. I know he had to be so confused. This tears my heart to pieces.

I'm sorry but you have a child at the doctor's office with a LARGE bruise, who the mother said the dog jumped on him yet when he's alone he says' to the doctor,“Maybe someone hit me with a belt. Maybe Mommy didn’t mean to hurt me,” Freund then told the doctor, according to records released Friday."

That wasn't enough to figure out what happened, especially when you add in the previous abuse!?

A small child doesn't say something like that out of the blue. They were innocently telling you the truth, because they knew their mother was lying and so not wanting to be part of a lie but to tell the truth, he tells them the TRUTH and they don't believe him.

Illinois boy told doctor ‘maybe Mommy didn’t mean to hurt me’ months before beating death, records show

Months before his body was found buried in a shallow grave, a 5-year-old Illinois boy had disclosed information about possible abuse to a doctor — but his alarming words weren’t enough to place him in protective custody, records showed.

Andrew “AJ” Freund, who was found dead on Wednesday a few miles from his house in Woodstock, was at the doctor’s office with a large bruise on his right hip on Dec. 18, 2018, the Chicago Tribune reported. Freund and his mother said the family dog jumped on the boy, causing the injury, but the doctor was still suspicious.

“Maybe someone hit me with a belt. Maybe Mommy didn’t mean to hurt me,” Freund then told the doctor, according to records released Friday.

To expand on this thought is that by HIPAA laws, the Dr would not be able to share this info with just anybody.

What I'm saying is that since we know about it, is that because the Dr did actually report it and the report is how we know about it. How row would we even know about it if not? The Dr wouldn't be able to tell anybody else about it besides reporting it.

I am so angry about this little boy's death, cause they had so much WARNING. Heavy Drugs and prior abuse were noted in the case and SS didn't move the children. If a child dies in a social workers care, the social worker should have some charges in relation, this is just awful. SS should yank kids out of homes the SECOND drugs are found and it's not medically given to a parent, I do not care. JMO

    I totally agree!

BUT! There's so much else going on and it's sickening. In Oregon, social workers have 3 times the caseload they should have and are sending kids to other states, which has caused a whole NEW set of problems!

Video of beaten 5-year-old AJ Freund on mom's phone helped crack case, search was made for 'child cpr,' authorities say

A video of a badly beaten 5-year-old Crystal Lake boy on his mother’s cellphone helped crack the investigation into his killing, according to court documents.

The two-minute video on JoAnn Cunningham’s phone, taken more than a month before Andrew “AJ” Freund’s death, showed the boy with severe bruising on his face and body as he was being berated for urinating in his bed, the documents alleged.

His mother also allegedly searched online for “child cpr” the night of AJ’s death, according to the documents. The boy’s father, Andrew “Drew” Freund, told police that the search, which took place at 3:17 a.m., was related to Cunningham’s current pregnancy, though he could not provide a further explanation, the documents say.

The father also said AJ was forced to take a long, cold shower and was put to bed “cold, wet, and naked” before being found dead, the documents indicate.

The statement alleges AJ’s younger brother told investigators that his mother told him AJ “fell down the stairs and had a lot of owies.”

The turning point in the investigation described in the affidavit appeared to be when a forensic analysis discovered the video, recorded March 4, during a search of deleted files on Cunningham’s phone.

“AJ is seen to (be) naked except for some small bandages around both wrists and circling his hips,” the affidavit stated. “AJ is seen to be holding an ice pack to his face and when he removes it he is seen to have deep red bruising around his eyes, and yellowish-green bruising around his neck and upper chest. It did not appear from the video that AJ received professional medical attention.”

When FBI and Crystal Lake police investigators confronted the father with the video at 2:40 a.m. April 24, Freund blamed AJ’s injuries on Cunningham, and then gave an account of what happened the night AJ died, the documents alleged.

“Drew also said that he believed AJ died on Monday morning after spending a prolonged time in a cold shower,” the affidavit stated. “Drew explained he wanted Joann to stop with the hard physical beatings and do some less violent form of punishment. Drew said cold showers was decided (as the alternative).

“Drew said on or about … 4/15/19, AJ had lied about soiled underwear and he was subjected to a cold shower. Drew said he helped AJ out of the shower after he’d been there approximately 20 minutes, and put AJ to bed ‘cold, wet, and naked.’

“Drew said Joann got up and checked on AJ and that was when she got Drew and used Drew’s phone to search for child cpr. Drew advised at some point that he believed AJ had died. Drew said the next day he took AJ’s body to the basement and stored him in a tote. He said on the night of 4/17/19 he placed Andrew inside of several trash bags, placed the body in the trunk of his car, and drove him to an area in Woodstock. Drew said he dug a shallow grave for AJ, placed him in it, covered it with straw, and left.”

An autopsy determined that AJ died from blunt force trauma to his head.

The documents said that police found the family home in “hoarder” condition. Freund’s cellphone contained a photo of a handwritten shopping list containing duct tape, plastic gloves, air freshener and bleach, and at least some of those items were found at the house.

Freund said Cunningham believed AJ had “oppositional defiance disorder,” or ODD, and gave a glimpse of the interactions within the family.

“Drew explained AJ thinks of himself as the leader of the home and therefore he is defiant to his parents, lies, disobeys, and thinks things should go his way. Drew explained that, yes, he and Joann lock AJ in his room at night because sometimes he gets out throughout the house. Drew also said sometimes AJ had disciplinary timeouts of a whole afternoon locked in his bedroom, once for 5 hours.

“Drew explained that a short time ago Joann had asked AJ to wash dishes and that AJ did not do a very good job, despite having been instructed the proper way to do dishes. Drew said this minor infraction was compounded by the fact that AJ then lied about some aspect of his dish-washing performance.

“Specifically, Drew explained that AJ stacked the dishes improperly and when asked why he didn’t stack the dishes correctly AJ told his parents that he wasn’t the one who stacked the dishes at all. Drew explained it was this overt lying that was so egregious and needed to be punished and addressed.”

Freund also described the previous weekend, saying that Cunningham stayed at a hotel with their youngest son while AJ stayed with Freund. He said he took the boy to work Saturday but had him go through a separate door so no one would see him.

A forensic examiner said information from Cunningham’s cellphone provider showed she had at least 88 text messages with a close friend that were deleted from April 11 to 15.

Police said they found the missing messages on the friend’s phone — including one on April 16, after police say AJ was killed — complaining about AJ not getting better from ODD.

Granted this was in 2012...before AJ was born. But still. Based on reports it didn't change much. WHYYYYY were they allowed custody of their children? This is not a safe environment.

Shocking new photos reveal the filthy state of murdered five-year-old A.J. Freund's parent's home in 2012 that was littered with piles of clothes, mouse dropping and dog poo

Shocking photos reveal the filthy and deplorable state of AJ Freund's parent's Illinois home in 2012 and 2013, just months before he was born.

Investigators say that the Department of Child and Family Services had visited the Freund home 17 times over the last five years.

In those visits, authorities described the squalid condition of the home, the apparent drug use of the parents who are 'known and self-admitted prior narcotics abusers' and concern for the welfare of AJ and his four-year-old brother [P].

Police said the home was found to be in 'hoarder-like condition' with garbage bags of 'wet refuse' stacked in the basement and garbage area when they visited following reports of AJ gone missing.

Newly released photos offer a look at the Crystal Lake home the parents owned in 2012 and 2013 and offer insight into the dire conditions little AJ likely grew up in.

Parents plead not guilty to killing 5-year-old son AJ Freund

An Illinois couple accused of killing their 5-year-old son because he lied about soiling his underwear pleaded not guilty to murder charges Friday.

Andrew Freund Sr., 60, and JoAnn Cunningham, 36, appeared separately in a packed McHenry County courtroom after prosecutors filed a 30-page grand-jury indictment in the case Thursday, the Northwest Herald reports.

Both Freund and Cunningham requested trials by jury, and a judge approved a request for Freund to be evaluated by a psychologist.

Thursday’s indictment detailed “brutal and heinous” behavior that prosecutors claim led to the boy’s death. He had also been placed in foster care for more than a year after he was born with opiates in his system, the Northwest Herald reports.

A lawyer for Freund said his client cannot get a fair trial because he’s been “tried in the press,” but a judge didn’t rule on the matter, saying the claim was “too broad,” according to the newspaper.

Freund and Cunningham, who both remain held on $5 million bonds, are expected back in court June 18.
