Dan had a good argument to put Wendi's license in jeopardy ~ censure & sanctions. "unclean hands" is a big deal to the bar. Y'know the man was only trying to do what was right & fair for his kids & himself as far as time between parents, fair distribution of assets & the ring she took from the safety deposit box that had $$$ value to her, but much sentimental value to his family (Holocaust)

I'm sure there will be a similar notice filed for Luis Rivera. I will be anxiously awaiting the same for the Adelsons.

"Let me be clear,” said Fort Lauderdale attorney Michael D. Weinstein. "Dr. Adelson is denying any participation in this death whatsoever.”

Adelson, a cosmetic dentist from Broward County, and his mother, Donna Adelson, have been implicated by investigators in Markel’s murder-for-hire plot. Charles Adelson has not been questioned by investigators, Weinstein said.

“They don’t even know who killed Danny Markel,” Weinstein said. “They know two people went to Tallahassee and then radio silence. They want to make a connection to the family without any actual evidence.”

Investigators say Katherine Magbanua, a former girlfriend of Charles Adelson and the mother of two of Garcia’s children, was the connection between the Adelsons and the two alleged hitmen.

Weinstein said Magbanua and Charles Adelson dated. She worked in the family’s Fort Lauderdale dental office after they broke up.

Prosecutors last week called Magbanua a suspect and witness in the case. She was one of Charles Adelson's top cell phone contacts around the time Markel was killed.

Bet she made top salary & bonuses ~ 'cause everyone hires their ex AFTER they break up. Mom A was office manager/book-keeper & probably dropped a little petty cash on KM...... this is coming together nicely.

Dice we are going to get our wish.

I hope so. The good thing is there seems to be enough people outside the family involved that the Adelson's will have a tough time hiding their involvement.

    Markel murder marks two years

    http://www.tallahassee.com/story/news/2016/07/18/break-case/87156124/
    http://www.tallahassee.com/topic/dan-markel

In late May, the case erupted in a flood of details with the arrest of two men and police for the first time calling Markel’s killing a murder for hire.

On May 26, 34-year-old Sigfredo Garcia was picked up near his home in Miami Beach in a swarm of federal, state and local police.. But investigators remained mum about his possible connections to Markel’s killing almost two years earlier.

TPD legal officials had argued successfully to have Garcia’s arrest affidavit sealed from the public. They were concerned other wealthy co-defendants would flee if details of the case were released. But once he was transported to Leon County, documents were released containing details that connected the family of Markel’s ex-wife to his murder and also revealed a rift between State Attorney’s Office investigators and police. The documents named a second suspect, 33-year-old Luis Rivera, a Miami leader in the national gang syndicate the Latin Kings serving a 12-year sentence for a racketeering conviction. He and Garcia were indicted on first-degree murder charges in mid-June. The state is seeking the death penalty for both men.

The motive for Markel’s murder, court documents say, “stemmed from the desperate desire” of the family of his ex-wife Wendi Adelson to allow the couple’s two young sons to move to South Florida. Wendi Adelson and Markel had an acrimonious divorce and the two sparred until he was slain. Documents implicate Adelson’s mother Donna Adelson and brother Charlie Adelson as co-defendants in the plot. Police say more arrests are expected.

Both Charles Adelson and Donna Adelson work at the family’s South Florida dental office. The link between Markel, the Adelson family and the two alleged hitmen, prosecutors say, is Katherine Magbanua, a woman who worked in the Adelson’s dental office and is a former girlfriend of Charlie Adelson. She is also the mother of two of Garcia’s children and in late June was named as a suspect.
Magbanua was one of Charles Adelson's top cell phone contacts around the time Markel was killed and was the first person Garcia called after the murder.

Police say email evidence indicated Adelson's parents, particularly her mother Donna Adelson, wanted her daughter to “coerce” Markel into allowing the boys to move to South Florida.

Rivera and Garcia were “enlisted” to kill Markel, court records say. Investigators say the two men drove from Miami in the rented Prius two days before the killing and stayed in a series of hotel rooms.

Garcia will appear in court today for a case management conference. Rivera’s next court appearance is scheduled for Aug. 1.

    excellent aricle from Sun-Sentinel
    7/16/2016

Daniel Markel said it was his worst nightmare.
The Florida State University law professor returned from a short business trip in September 2012 and found the home he shared with his wife and two children empty and devoid of most furniture. Then he found the divorce papers his wife, Wendi Adelson, had placed on their bed. What followed, according to divorce documents, was a court battle that raged for nearly two years, a clash over parental rights spiced by allegations of impertinent in-laws, hidden assets and stolen heirlooms. The conflict came to a shocking end — Markel, 41, was shot in his garage on July 18, 2014. He died at a hospital the next day.

During a news conference June 2, police said they think Markel was killed in a murder-for-hire plot. They said it appeared to be tied to his bitter divorce from Adelson, her parents' "desperate desire" for her and the children to move to South Florida, and a court hearing that may have restricted access to their grandchildren, according to unsealed court documents.

Eventually, he found out she had run home to her parents in Coral Springs; he made her come back with the children until a judge ruled in the case. Adelson's "abrupt and cruel departure" — as Markel called it — shocked him and set the tone for the way their divorce played out. Adelson had the upper hand and, Markel said, she tried to take advantage of him. In court documents, he said Adelson wanted to tie the children's time-sharing to resolving their property issues, "which basically means she put them up for ransom."

    a few new tidbits released

    Documents reveal early Markel investigation

    http://www.tallahassee.com/story/ne...s-reveal-early-markel-investigation/87680046/

The documents obtained by the Tallahassee Democrat on Thursday outline the dozens of leads investigators chased. Some came from friends of Markel; others came from a dedicated hotline investigators set up.
They show that within days police began looking at the Adelson family. Investigators also had surveillance footage of the Prius following Markel as he went to the gym and traveled home the day he was shot.
One of the reports describes an investigation into Jeffrey Lacasse, a former boyfriend of Wendi Adelson. Lacasse, an FSU professor, was cleared as a suspect a few days after Markel’s death.
There are text messages between him and Wendi Adelson - he and Adelson made reservations to travel to California July 11 to 17. She canceled plans on June 4 – two weeks before Rivera and Garcia traveled to Tallahassee during what investigators say was a botched first attempt to kill her ex-husband.

Lacasse said Wendi and others had told him that three weeks after Markel was killed, her brother Charlie Adelson contacted her and asked her to go out and celebrate. That dinner was memorable. Wendi Adelson vomited on the table. Lacasse found that highly suspicious. “He believed that Wendi Adelson may be indirectly responsible for the murder of her ex-husband, Daniel Markel," the Dec. 4, 2014 TPD report says. “When I informed him that Wendi was not a suspect, he stated ‘well she should be.’”

Within hours of Markel's death, investigators had begun to look at his ex-wife. Three days after Markel was killed, a judge signed a search warrant for information on Wendi Adelson’s phone and investigators began searching her Web browser and email records. On her computer, investigators found Google Chrome keyword searches for Markel’s girlfriend Amy Adler, Adler's ex-husband and Adler's brother. They also found that Wendi Adelson had searched several porn sites for “teacher/student porn.”

Other reports detail a tip from a woman who lives in Ashford Club apartments, a complex adjacent to a wooded trail that abuts the rear of the Markel home. In her July 29 call to the hotline, the woman said two days before Markel was killed, she saw two men who police say matched Garcia and Rivera’s descriptions. She saw them park and walk along the trail. Moments later, they returned soaking wet from the waist down.

The just released reports also detail the phone conversation interrupted when Markel was killed. Markel was asking a School of Arts and Sciences teacher about Wendi Adelson seeking to enroll their two young children without his knowledge. The teacher said he and Markel spoke for several minutes when he heard him say “hold on a second, there is someone in my driveway that is unfamiliar to me.” The man told police he then heard a loud grunt, which did not sound good, muffled voices and then labored breathing. He asked if Markel was OK, but got no reply.

Wendi speaks about the murder in two segments in the writing class podcasts below:

    http://www.tallahassee.com/story/news/2016/06/07/adelson-speaks-markels-death-podcast/85575308/

Her segment of the podcast starts with the moments following the murder.

"Police picked me up from a lunch date I was having with two girlfriends and insisted that I come with them back to the station and then interrogated me for eight-straight hours, because it’s usually the ex-wife," she said........... hates the question: "What does your husband do?" “I haven’t yet said ‘he doesn’t do much because he’s dead,’ but I think it sometimes. I find when I tell people that my children’s father died I feel sad. But when they ask the follow-up questions and find out we weren’t married, they seem to feel better. I don’t.”

She mentioned her fondness for her mother, who was helping her take care of the couple's two young boys. She described her mother as "selfless, generous, loving and beautiful."

Cold-hearted much? I don't know the color of the sky in her world, but I sure hope she spends a long time in a cell painted institutional grey-green.

The ex-wife of a slain Florida State University law professor and her family on Wednesday denied having any involvement in an alleged murder-for-hire plot to kill him, according to a statement issued by their lawyers.

Attorneys for Wendi Adelson and several family members said in the statement that speculation they had a role in Daniel Markel's killing is "categorically false." Authorities have previously said there may be a link between Markel's July 2014 death and the couple's contentious divorce.

    another article, same news:

    http://www.tallahassee.com/story/ne...arkel-accusations-fanciful-fictions/88007822/

The family of Dan Markel’s ex-wife called accusations they were involved in the Florida State law professor’s shooting “fanciful fiction.”

The statement, from the attorney of Wendi Adelson, Donna and Harvey Adelson and Charlie Adelson, states flatly, “There is a reason that the police have not arrested any of the Adelsons – They weren’t involved in Dan’s death.” Attorney said the statement was in response to repeated media stories that suggest the family was involved.

(Well, we didn't expect defense attorneys to say they are shaking in their boots, knowing they are caught.)

    The entire statement is below.

"On behalf of the Adelson family, we continue to send our deepest condolences to the Markel family. Dan's death was a tragedy, and the loss is profound. Although Wendi and Dan were divorced, he was the father of their two children, who must now grow up without their dad.

There has been a lot of unsupported speculation that the Adelsons had something to do with the murder. That speculation is categorically false. To be clear, none of the Adelsons – Wendi, her brother Charlie, or their parents Donna and Harvey – had anything to do with Dan’s murder.

We respect the process and the enormous amount of work that the Tallahassee police department has done in this case. They have spent the past two years reviewing every shred of evidence out there -- every phone record, financial record, text message, email, internet search, everything. We understand why the government has put the Adelson family through this type of severe scrutiny. But nothing has turned up that supports this fanciful fiction that the Adelsons were involved. The investigation has gone so deep that it employed FBI agents, undercover agents, and a tip line. There is a reason that the police have not arrested any of the Adelsons – they weren’t involved in Dan’s death.

We are issuing this statement because the media continues to run stories suggesting – without any support or evidence – that the Adelsons were somehow involved in Dan's murder. Again, this is simply not true. The Adelsons were not involved. We share in the hope that those responsible will be brought to justice."

On behalf of Wendi, John Lauro.

On behalf of Charlie, David Oscar Markus and Margot Moss of Markus/Moss and Michael Weinstein.

On behalf of Donna and Harvey, Daniel Rashbaum and Jeffrey Neiman of Marcus, Neiman and Rashbaum.

The clock is still ticking as far as I am concerned . Why did the two arrested with ties to the Adelsons kill Dan? The attorneys would have served their clients better by not releasing theis statement. They just put the spotlight back on the Adelsons.
    I'm anxiously awaiting more arrests.

The dispatch agency for Tallahassee and Leon County agreed on Monday to pay that amount to the estate of Daniel Markel. The Consolidated Dispatch Agency conceded that "human and technical errors" delayed authorities from showing up promptly to his home.

No assurance he would have lived if 911 had functioned properly, but Markel's home was so close to the hospital & a fire station - less than 1 mile to either.

A little more info about this in an email from The Democrat.

The Consolidated Dispatch Agency will pay the family of slain Florida State law professor Dan Markel $40,000 to avoid litigation over his 2014 death.
The money will be paid by the CDA's general liability insurance policy to Markel's sons.

It took ambulances 19 minutes to arrive at Markel's Betton Hills garage on July 18, 2014, when he was shot in the head by an alleged hitman.
The CDA claimed an error by dispatchers led to the delay. In a presentment, a Leon County grand jury said the response simply took too long. "A quicker response may have led to the apprehension of the suspect in that case," grand jurors said.

The settlement was approved Monday morning by the CDA board — made up of Leon County Administrator Vince Long, Leon County Sheriff Mike Wood and Tallahassee City Manager Rick Fernandez. The settlement was recommended by the CDA's attorney David Marsey, of the Rumberger Kirk & Caldwell law firm, following an investigation and negotiations with the estate's attorneys.

Marsey said the CDA had strong factual and legal defenses. However, he said the settlement was agreed to because it is in the best interest of the CDA and would provide settlement money to Markel's sons. Attorneys for Markel's estate did not return calls for comment.

CDA officials also touted on Monday the success of its software upgrades and improvements in call taking and dispatching. CDA director Dee Crumpler said processing and dispatch times are about half of the national average. The agency, he added, is answering 56 percent of more of its calls in under 20 seconds.
