    It's sad that it takes the death of individuals to upgrade software and make improvements. How many other poor souls had to die or whose health were impacted by the CDA.

    Markel suspect Rivera moved from Leon County Jail

    Luis Rivera, one of two men facing murder charges in the death of Dan Markel, has been transferred from the Leon County Jail.

    Rivera, who appeared in Thursday’s jail booking report, was released at 3:27 p.m. Wednesday, according to court records. The Leon County Sheriff's Office confirmed Rivera was released to another jurisdiction. His attorney, Chuck Collins, declined comment.

    It is unclear his whereabouts but release information says he was scheduled to return to Coleman Federal Correctional Complex in Central Florida. Rivera was brought to Leon County from the high-security federal prison shortly after he and 34-year-ol Sigfredo Garcia were indicted on first-degree murder charges in June.

    Both Rivera and Garcia will stand trial Nov. 14.

    Suspect in Markel murder seeking bond, again
    A man accused in the murder of FSU law professor Dan Markel is asking to be released on bond.

    Sigfredo Garcia was in court Tuesday afternoon.


    His attorney is demanding a chance to call witnesses to try to prove the state doesn't have enough evidence against Garcia to keep him in jail until trial.


    "The highest burden known is the one that they have to show at a bond hearing," defense attorney Mauricio Padilla said. "That's something we're looking forward to hearing and being able to subpoena our own witnesses to be able to show they're not going to be able to meet that standard."


    The judge has not yet made a decision on the so-called Arthur hearing and prosecutors say they'll fight any bond request.


    Garcia will be back in court September 7th.

    State seeks breast enhancement records in Markel case

    Prosecutors are seeking medical records that show Dan Markel’s former brother-in-law paid for half of a breast enhancement for the girlfriend of one of the law professor’s accused killers.

    In a Leon County court hearing Friday, Circuit Judge James Hankinson approved the subpoena for the medical records of Katherine Magbanua.

    Magbanua is the suspected link between Sigfredo Garcia and Luis Rivera, who have been charged with first-degree murder in Markel’s shooting, and the family of the 41-year-old professor’s ex-wife Wendi Adelson.

    Her brother, Charlie Adelson and mother Donna Adelson are implicated by investigators in Markel’s July 2014 shooting at his Betton Hills home. Attorney's for the family members have denied any involvement in Markel's death.

    Maybe it's me ~ strangely worded piece by Karl Etters. The beginning seems sympathetic to the Adelsons but perhaps that's his way of hinting the absurdity they are not involved.

    It ends with
    "Wendi Adelson remarked afterward to a victim's advocate about her mother’s initial reaction. “My parents sounded really surprised, so that’s at least a relief,” she said. “I’m just trying to think who would be angry enough to do something to him. My parents would be angry, but they’re not capable of this. Thank God. I really couldn’t handle that right now.”'

    Man Accused of Killing FSU Law Professor Back in Court

    Sigfriedo Garcia was at the Leon County Courthouse Wednesday morning for his pre-trial case management hearing involving the murder of Dan Markel. His attorneys said that state prosecutors handed them a new hard drive with information they've gathered as part of their new discovery.


    "The new discovery is something that we have to review and analyze to make a determination as to what we stand, but you know, it's an ongoing process. Discovery is fluid, cases are fluid, so at this point, it's premature to say," said Saam Zangeneh, Garcia's attorney.

    His attorney also said they were told the hard drive has law enforcement reports and possibly wire taps.


    The other man accused in Dan Markel's murder, Luis Rivera, was not present. Rivera's attorneys have requested a speedy trial. Intially, Rivera and Garcia were set to start trial on the same date.

    Garica's attorneys said Rivera's decision does no affect their case one way or another. Garcia is due next in court on Oct. 7th for his bond hearing. As of now the trial is still set for November, though his defense team said that could change depending on how this new information impacts their case.

    It’s a well-known fact that more than 90 percent of criminal cases don’t make it to a jury trial. For better or worse, plea bargaining is an essential feature of our criminal justice system.

    At the current time, however, it looks like the prosecutions of Sigfredo Garcia and Luis Rivera, the two men accused of murdering Florida State University law professor Dan Markel, could wind up in that small minority of cases that actually go to trial.

    TPD releases new probable cause reports in Markel murder case

    September 9, 2016

    TALLAHASSEE, Fla. (WCTV) -- The Tallahassee Police Department has released probable cause reports in the murder investigation of slain Florida State University professor Dan Markel.

    Thursday, TPD released the reports pursuant to a public records request.

    Included in those probable cause reports are Dan Markel's former brother-in-law, Charlie Adelson, and Adelson's girlfriend, Katherine Magbanua. Neither Adelson nor Magbanua have been charged in Markel's murder.

    TPD says during the course of the investigation, their evidentiary findings were submitted to the State Attorney’s Office for review.

    We reached State Attorney Willie Meggs Thursday evening.
    Meggs said "We did not feel there was sufficient evidence to go forward" with charges against Adelson and Magbanua.

    When asked if there will be any more arrests in the Markel murder case, Meggs said "Not unless we get more evidence."
