    A former cellmate of Sigfredo Garcia said the accused murderer of Dan Markel believes he's beyond redemption.

    The former cellmate told investigators that Garcia, 35, said “he did not believe he himself could be saved” during a January conversation in which he opened up about the July 2014 murder, according to court records obtained by the Tallahassee Democrat.

    The inmate was released in June after being charged with escape from the community release center in Tallahassee.

    He met Garcia in the Leon County Jail’s L Pod.

    Murder trial set for Sigfredo Garcia

    While they worked out, the conversation turned to religion and salvation. The former inmate, said Garcia said he was facing the death penalty for a murder he was paid to carry out.

    Garcia, who has pleaded not guilty, is one of three people who have been charged with the daytime shooting of Markel, a Florida State University law professor and internationally known legal scholar.

    The mother of his two children, Katherine Magbanua, also awaits trial on first-degree murder charges in the capital case.

    She is accused of being the conduit between Garcia, his accomplice Luis Rivera, and the family of Markel’s former in-laws who investigators suspect financed the murder.

    Donna and Charlie Adelson, the mother and brother of Markel’s ex-wife, Wendi Adelson, have been implicated in the murder-for-hire plot by Tallahassee Police and State Attorney’s Office investigators.

    The killing, police contend, stemmed from the couple’s contentious divorce and the desire of the Adelson family to move their two young boys to South Florida.

    The Adelsons remain suspects but no one in the family has been charged. They, through their lawyers, deny any involvement in the murder.

    In October, Rivera pleaded guilty to second-degree murder. His statement, which he provided in exchange for a 19-year prison sentence that runs concurrently with a 12-year federal term he already was serving, led to Magbanua's arrest.

    The inmate’s statements are consistent with others cellmates of Garcia’s have brought to investigators and with what Rivera revealed.

    Garcia said he had been paid $100,000 incrementally in cash routed from the Adelsons through Magabanua, who was in a romantic relationship with Charlie Adelson, according to court records.

    In February, it was revealed Garcia told two other cellmates similar details of the crime.

    One said he was told by Garcia who paid for the murder, details of Markel’s garage where the shooting happened and the amount of money paid.

    The other, according to court records, said while Garcia was drinking “toilet wine” he said he recruited Rivera, who supplied the gun, to travel from Miami to Tallahassee and wait in the car while he shot Markel.

    Magbanua’s attorneys have maintained she is innocent and have entered a plea of not guilty.

    Both she and Garcia have trial dates set for late January.

    The more people he brags to - the more to testify against him to cement the case. & everyone (named Adelson) that was involved in the murder, will stand before justice. (Wealth & influence may keep them out of prison for now, but their time will come.)

    TALLAHASSEE, Fla. (WCTV) -- A judge has just granted a delay in one of Tallahassee's most high profile murder cases.
    Defense attorneys for Sigfredo Garcia asked for and got a six month delay in his trial.

    Defense attorney Saam Zanganeh called the volume of evidence in the case "overwhelming." He says in addition to video discs, the number of documents is "approaching one million."

    The judge granted the delay. Circuit Judge James Hankinson said he has delayed the trial twice and doesn't intend to delay it again.

    Garcia is accused of shooting and killing FSU law professor Dan Markel at his home in July 2014. Co-defendant Katherine Magbanua is still awaiting trial. Co-defendant Luis Rivera opted for a plea deal and is expected to testify against them both.

    The judge is hoping to set a new trial date for Garcia at a hearing January 3rd.

    Garcia and Magbanua are scheduled to be tried together, but the prosecutor hinted at Tuesday's hearing that she hasn't ruled out asking for separate trials.

    As another year draws to a close, the killers of Professor Dan Markel have not yet been brought to justice. Only one defendant, Luis Rivera, has been convicted — and Rivera did not act alone. Rivera told prosecutors that he acted together with his friend Sigfredo Garcia, under the direction of Katherine Magbanua, who was in turn acting at the behest of… others.

    If anything, it seems that the wheels of justice are turning even more slowly. Judge James Hankinson granted Sigfredo Garcia’s motion to continue his trial for six months from the original date of January 22. But this should be it; Judge Hankinson noted that he has delayed the trial twice and doesn’t plan to do so again. A new trial date should be set on January 3, Garcia’s next appearance in court.

    Why the delay? Garcia’s lead lawyer, Saam Zanganeh, cited the “overwhelming”amount of evidence in the case. That might not be a great thing for defense counsel to say — but Zanganeh actually projects confidence, promising a “very unique and unexpected defense.”

    After the hearing, [Zengeneh] declined to elaborate on his defense strategy but said he would be ready within the six months.

    “This is an extremely interesting situation in terms of an evidentiary case,” he said. “It’s a tragic case, obviously, but the way things are unfolding, we’re going to have a very unique and unexpected defense.”


    Could "a very unique and unexpected defense" mean Garcia intends to testify against the Adelsons? I mean, he was seen on video in Tallahassee around the time Dan was murdered, right? So, will he suggest he had another motive for being in Tallahassee? What about Rivera's confession and testimony against him? It will be interesting to see how this progresses in 6 mos.

    The parents of slain Florida State law professor Dan Markel are expressing concern over another delay of another trial of another person suspected of their son's killing. They also say they have not been able to see their grandchildren in almost two years.

    The trial for Katherine Magbanua, an alleged associate in what investigators say was a murder-for-hire plot to kill Markel, was moved to October.

    Magbanua’s attorneys, Christopher DeCoste and Tara Kawass, asked Wednesday that they be given more time to conduct depositions and sort through thousands of pages of documents related to the investigation. The trial was scheduled to begin Jan. 22.

    “With this latest delay, the Markels remain in agony. Dan, their only son, was stolen from them more than three years ago,” said Ruth and Phil Markel’s attorney Orin Snyder in a statement. “Since April 2016, they have not been allowed to see their grandsons, despite their repeated pleas. Throughout this horror, the Markels remain hopeful that they will one day see their grandsons again and that justice will be achieved.”

    Magbanua, 32, is charged with first-degree murder. The mother of Garcia's two children is the suspected conduit between Garcia, his accomplice Luis Rivera and the family of Markel’s former in-laws, who have been implicated in the plot to kill the internationally known legal scholar.

    Investigators say the family of Markel’s ex-wife Wendi Adelson – primarily her brother and mother Charlie and Donna Adelson – paid to have him killed in the fallout of the couple’s contentious divorce.

    The motive for the killing, investigators say, is the family’s desire to have Markel and Wendi Adelson’s two young boys move to South Florida after the couple split.

    Through their attorneys, the Adelsons have denied any involvement in the killing and call TPD’s theory “fanciful fiction.” No one in the family has been charged.

    Rivera, who pleaded guilty to second-degree murder and was sentenced to seven years in prison to run in addition to a 12-year federal sentence on other charges, has agreed to help prosecutors secure convictions. His statements to investigators led to Magbanua's arrest in early October.

    Assistant State Attorney Georgia Cappleman said Rivera’s testimony will be crucial in both Garcia and Magbanua’s trials. She would like to try Garcia and Magbanua together.

    TALLAHASSEE, Fla. (WCTV) -- The state has filed new charges against Sigfredo Garcia and Katherine Magbanua.

    The two - who are awaiting trial later this year in the murder of FSU law professor Dan Markel - are now facing additional charges of conspiracy to commit murder and solicitation to commit murder.

    Lead prosecutor Georgia Cappleman says she filed the new charges, now alleging a conspiracy before and after Markel's murder. She contends Magbanua solicited Garcia's help in committing the murder and he in turn solicited the help of Luis Rivera, who has already entered a plea in the case.

    Cappleman says this does not suggest charges will be filed against anyone else in the case.

    Cappleman continues to say she's considering a motion to try Garcia and Magbanua together. Right now, they are scheduled to be tried separately later this year. Garcia's trial is set for July, Magbanua's for October.

    Garcia and Magbanua both waived their first appearances on Thursday morning, as the judge is allowing them to wait for their attorneys to be present.

    First appearances could be rescheduled for as early as Friday morning.

    TALLAHASSEE, Fla. (WTXL) - The accused triggerman in the 2014 murder of FSU law professor Dan Markel has entered a plea of not guilty to newer charges filed by the state last month.

    Neither Sigfredo Garcia nor his legal counsel were in court Tuesday morning for his arraignment.

    In February, the State Attorney’s Office charged Garcia and co-defendant Katherine Magbanua with “conspiracy to commit murder” and “solicitation to commit murder.”

    The case for Garcia’s new charges will be continued on the same date as his first-degree murder charge. The court granted the state’s request to combine the two cases.

    Garcia is scheduled for a pre-trial hearing on June 5. His trial is set for July 9.
