    Missing Diana Alvarez's father not interviewed due to 'miscommunication'


    The suspect in her disappearance is in jail accused of child pornography, but there's still no sign of Diana.

    We learned that no law enforcement has spoken in person with Diana Alvarez's father who lives in Mexico.

    Reportedly, the FBI requested Mexican authorities visit Diana's father Marteen, but because of what's being labeled a miscommunication, that has not happened.

    Really makes me wonder if the Biological father is indeed involved..... I hope and pray he is....Because being hidden out in Mexico with him would actually be a blessing IMO...As I had much rather this all be a parental kidnapping than a.... well.... never mind...... you all know what I mean ......#PrayingForDianasSafeReturn

    I have believed that the father is involved. Why would he not take the call from the mother? She could have been calling with news about Diana? He didn't know, unless maybe he does know.

    LCSO seeks new leads in Diana Alvarez case amid drug bust

    Deputies continued to pursue leads in the case of missing 9-year-old Diana Alvarez on Thursday during the arrests of suspected drug dealers who lived blocks from her home on Unique Circle.

    Deputies did not say whether there was a link between the suspected drug dealers who were arrested and the missing girl, but they had investigators at the scene Thursday conducting interviews “in an effort to develop new leads,” according to the Lee County Sheriff’s Office.

    Family of missing Diana Alvarez still wants father investigated

    The family of a 9-year-old who went missing from her San Carlos Park home in May is still begging investigators to look into the girl's biological father in Mexico.

    Jorge Guerrero was arrested after an Amber Alert identified him as a suspect in the Alvarez kidnapping.

    He's in federal custody accused of possession of child pornography, but Guerrero, who at one time lived in the mobile home where Alvarez and her family lived, has never been accused of taking the child.

    Rita Hernandez, Diana's mother, is begging for investigators to go to Mexico and search for her daughter.

    Alvarez's biological father lives in Mexico, and Hernandez believes he may be behind her daughter's disappearance. She said investigators have never been to the city where he lives or questioned him in the case.

    Hernandez said in July that Guerrero told her Diana isn't dead but when she asked him if he knew where the girl is or anything about her disappearance, she claimed he was unclear, babbling and rambling while answering, covering his face and refusing eye contact.

    Guerrero told Hernandez that Alvarez may be in Puebla, Mexico. The girl's biological father, Martin Alvarez Moreno, who lives in Tehacuan Puebla, said he does not have her and has not seen her since she disappeared.

    NBC2 learned in August that the FBI reportedly requested Mexican authorities visit Diana's father, but because of what's being labeled a miscommunication, that had not happened.

    Lee County Sheriff’s Office mum about missing 9-year-old

    The Lee County Sheriff’s Office refused to provide a fuller narrative Thursday about the action they took at the beginning of their search for missing San Carlos Park 9-year-old Diana Alvarez.

    Details about the investigation into the girl’s disappearance emerged from emails WINK News obtained Wednesday through a Freedom of Information Act request, but the sheriff’s office wouldn’t comment further. The emails showed the sheriff’s office had identified 28-year-old Jorge Guerrero as a possible suspect hours after Alvarez vanished on May 29.

    FBI looking into new leads in Diana Alvarez case

    A Lee County family could be one step closer to finding their daughter, nearly six months after she mysteriously vanished.

    The prime suspect in her disappearance, Jorge Guerrero, remains in jail on federal child porn charges. He has not been charged in her disappearance.

    According to Thomas Busatta, the family's attorney, they've heard from sources that Diana was recently seen in her father's village in Mexico.

    Busatta has been pressuring authorities to search in Mexico but the Lee County Sheriff's Office has refused to do so because Mexico is out of their jurisdiction and for the safety of their officers.

    Now, the FBI plans to work with Mexican authorities to resume the search for Diana in Mexico.

    "Ms. Hernandez was very excited at the thought of finding out that her daughter may be in Mexico and that law enforcement will follow that up in the near future," said Busatta.

    Family facing first Christmas without Diana Alvarez



    The are still no answers for the family of missing 9-year-old Diana Alvarez and now there is no end in sight with delays in the federal case.

    Jorge Guerrero, the man suspected of taking Alvarez, appeared in court Monday morning accused of possessing child pornography that was discovered when he was arrested in late May in the search for Alvarez.

    Alvarez’s mother and family attended Guerrero’s hearing and pleaded for any information.

    “I opened my home to you,” Rita Hernandez said via a translator. “I never did anything to you. How could you do this to me?”

    The family learned the trial is moving slowly and one attorney predicted a start date of May.

    “It may take another year before this gets to trial,” said Tom Busatta, the attorney for the Alvarez family.

    As the Alvarez family prepares for the holiday season, their hearts are heavy and they don’t feel like celebrating. Hernandez said she hasn’t even put up their Christmas tree.

    “She doesn’t know if her daughter is eating,” Busatta added. “If someone is taking care of her. If something has happened to her.”

    Unendurable pain for Diana Alvarez's mom, girl still missing

    The last seven months have been unbearable for Rita Hernandez.

    Her daughter, 9-year-old Diana Alvarez, is still missing with no indication she will be found anytime soon. Mexican authorities have spoken to Diana’s father, who Hernandez believes had a hand in taking the girl. Martin Alvarez Moreno denies this.

    The holidays came and went without a trace of a Christmas tree at her Sheltering Pines home in San Carlos Park where Diana was abducted May 29. Hernandez, who has six children, had difficulty mustering any Christmas spirit for her other children.

    Her most recent baby, Natalia Jimenez-Hernandez, was born almost two months after Diana disappeared. The 5-month-old baby girl, with a round inquisitive stare, fidgeted on her mother’s lap during a recent interview at Thomas Busatta’s law office in south Fort Myers.

    Last week, Hernandez, 34, took her children to a church in Estero where they were given presents. Her children cried.

    Until there is proof that Diana is no longer alive, Hernandez said she’ll continue to have hope.

    “Sometimes the sadness takes hold of me,” she said.

    She tries to calm herself, she said, because the tears are unending.
