DYLAN GROENE: United States vs. Joseph Edward Duncan III - *GUILTY* *Sentenced to Death*

    Hopefully this guys "saga" will be coming to an end very soon. His appeal on his death sentence has been rejected.

    He plead guilty to the murders of Sammiejo White, 11, and her sister, Carmen Cubias, 9 in Seattle, WA in 1996 - No charges filed

    As part of a plea deal, he plead guilty to the murder of Anthony Martinez, 10, in Beaumont, CA in 1997 - Sentenced to Life In Prison w/o Parole x 2

    In addition, he received 6 life sentences for the kidnapping/murders of Brenda Groene, Slade Groene, and Mark McKenzie through Idaho. He received 3 more life sentences for the kidnapping and sexual assault of Shasta and Dylan Groene. And he received 3 death sentences for crimes against Dylan, including his murder.

    After initially dismissing his attorneys and saying that he had no interest in appealing his sentences, he later changed his mind.

    Appeal seeks to overturn death sentence for child killer Duncan


    “The record is very clear that in November of 2008, this defendant did not wish to appeal,” Olson said.


    Schlesinger told the 9th Circuit panel Tuesday that Lodge’s 2013 ruling focused on Duncan’s comptency in planning the crimes, interacting with jail guards and others instead of his state of mind when he waived his right to appeal. Schlesinger also has requested the 9th Circuit to allow Duncan to appeal even if they agree he was mentally competent, saying he was “clearly a disturbed individual” whose waiver was “very peculiar.”

    Court rejects Duncan's death sentence appeal

    A federal appellate court has dismissed the appeal of a man who was sentenced to death for kidnapping, torturing and killing a young northern Idaho boy after killing several members of his family.


    Duncan represented himself at his sentencing hearing and later waived his right to appeal. But he has since changed his mind and his defense attorneys say he wasn't mentally competent to waive his rights.

    On Friday, the 9th U.S. Circuit Court of Appeals rejected that claim. The court said a lower court had correctly found Duncan competent. The justices said it was too late for Duncan to change his mind.

    Today marks 10 years since the tragedy that affected so many, yet no one more than the Groene & McKenzie families themselves. We remember them today and hope that they may have some level of peace and comfort. Today we remember Brenda, Mark, Slade, and Dylan, and keep Shasta and the rest of the family forever in our thoughts.


    Sheriff Wolfinger remembers day community innocence was 'stolen'

    May 16, 2005, a dark day in Coeur d'Alene. It's a day Kootenai County Sheriff Ben Wolfinger would go on to describe as the day the innocence of the community was stolen.


    Duncan's trial revealed gruesome details of murder and molestation. After killing Brenda, Mark and Slade, Duncan took Dylan and Shasta to a cabin in the Montana mountains where he sexually assaulted both of them for weeks before killing Dylan. Duncan plead guilty to three charges of first degree murder and three counts of first degree kidnapping. He was given three consecutive life sentences.

    "I've been here over 32 years," says Wolfinger. "I've never seen anything match the Duncan case and I hope to never see anything like it again."

    Duncan's crimes in Idaho also landed him in federal court and details linked him to multiple crimes in different states. In total he's been sentenced to death multiple times and has 11 life sentences. He currently sits on death row in Indiana with no execution date set.

    I understand how you feel. I think jd is the most evil man. I got so overly emotional when this creep first killed the family members and took D and S, that I had to take a break from even reading about it.

    Diary of a madman: Duncan manipulates from death row

    Ten years ago today, Joseph Edward Duncan III’s heinous spree of killing and raping had almost come to an end.

    Despite since admitting to being a serial killer, Duncan continues to receive unexpected help from the outside. As he did before his 2005 arrest, he maintains a blog. In it, Duncan rationalizes his horrific crimes against children one minute and pleads for love and acceptance the next. He speaks as casually about sexually abusing a young murder victim as he does getting a traffic ticket while riding his bike. It was updated as recently as last week. He corresponds via mail with about a half-dozen friends and a girlfriend—one of whom, presumably, maintains the blog on his behalf.

    In his blog, he has recalled feeling a temptation when he once found himself alone with a young boy in a restroom at a ski hill not far from Fargo.

    Duncan said the predator in him “awakened” when their eyes met and the boy “flinched” like an animal does when it’s afraid. And then:

    “It wasn’t the boy’s appearance, age, or circumstances that aroused me, it was his fear, and his fear alone. As I washed my hands, I metaphorically scratched the predator inside of me behind the ears and thought to it: not yet my friend; not yet... go back to sleep,” he writes.

    Duncan awaits what he calls on his blog his “release day (a.k.a. execution)” on death row in Terre Haute.

    But no one there has been executed since 2003, and there is no date set for Duncan’s death by lethal injection.

    Despite repeatedly waiving his right to fight his death sentences, attorneys continue to pursue appeals to keep Duncan alive, the most recent of which was filed in March.

    Meanwhile, Shasta Groene, the lone survivor of Duncan’s crimes 10 years ago, is now 18, and Maskell said he’s heard she’s having difficulty, including run-ins with police and time in juvenile treatment centers in Idaho and elsewhere. Not surprising, he says, for someone who experienced such horrors firsthand.

    I don't know why I did, but I read it all. Couldn't help myself, I guess. Looking for answers that I knew wouldn't be there.
    But to save anyone else some time, it's mostly mundane and ramblings about nothing.

    He mentions Shasta a few times. He mentions Anthony Martinez, and Carmen and SammieJo.

    Really the only thing of interest was his being absolutely *baffled* that having a picture of a shirtless pre-teen girl was considered... *gasp* ...child pornography! Of course it was, you psychopath! You're a pedophile. That is absolutely the definition of child pornography!

    ETA: The "archives" are a bit more spicy. A letter to Shasta. (Who does he think he is, to think he can speak to her?!) Saying that killing him is just as bad, if not worse, than what he did. Saying that everyone has a part in Dylan's death, it's not just on him. Claims that he killed 7 children, yet we know of 5. (Dylan, Slade, Anthony, Carmen, SammieJo...)

    He reminds me a great deal of Derek Percy, another unrepentant sexual psychopath and child killer from over here in Australia. They actually have a lot in common, in that they both were committing violent child rapes by age 15, both manipulated people to do their bidding while in prison (Percy kept his fantasies in a storage shed outside, rather than a blog, but same intent... to keep the fantasies 'alive'..), both regretted nothing.

    After studying killers of this kind for some years now, one of the several things they all have in common is a record of extremely violent and/or sexual crimes going back to age about 15 (give or take a year or two). And they were all released after these crimes, to inflict further atrocities on innocent victims.

    I fully believe that if more effort and funding went into an early identification process for sexual psychopaths, and those teenagers found guilty of heinous sex crimes and murder were actually kept locked up for the terms of their natural lives rather than set loose to kill and/or rape again (as they inevitably do, because there's NO CURE for what's wrong with them!) then lives would be spared, families would stay whole and terrible suffering would be avoided.

    Makes it even scarier when we're reading about all of these teenagers raping and killing other children recently... If they're not charged as adults, they WILL be out to do it again.

    Such a powerful interview with Shasta.

    She has been struggling a lot over the past years, and this interview shows how much she's turned things around. Going from "victim" to "survivor" is never easy, and I'm so glad that she seems to be jumping that hurdle now. I wish nothing but the best for Shasta and this new chapter in her life. May she find peace and strength.

    Northwest killer denied death sentence appeal

    The U.S. Supreme Court has denied hearing an appeal of a man who was sentenced to death for kidnapping, torturing and killing a young northern Idaho boy after killing several of members of his family.

    U.S. Attorney Wendy Olson announced Wednesday that the high court had made their decision earlier this week.

    The high court’s decision affirms U.S. District Court Judge Edward Lodge’s 2013 finding that Duncan was competent to waive his appeal.

    No execution date has been set, and Duncan’s attorneys may still seek other post-conviction relief.
