    Search warrant related to Lizzy Shelley kidnapping, murder unsealed

    The search warrant was unsealed Friday relating to the kidnapping and murder of 5-year-old Elizabeth "Lizzy" Shelley.

    After midnight, Lizzy's parents said as they were headed to bed that they saw their daughter asleep in her bed. At this same time, Whipple was on the couch inebriated and appeared to be going to sleep, the warrant stated.

    When Lizzy's parents went to check on her, they discovered that she was not there and Whipple was gone, too. Whipple's phone was also found at the house. He was identified in the search warrant as a fugitive from Adult Probation and Parole on multiple warrants issued for his arrest.

    The warrant also stated that while conducting a canvas and search of the area to locate Lizzy, investigators located a knife with what appeared to be blood on the blade and handle.

    Jensen said in the press conference, and the warrant confirmed, that the knife found appeared to match the knife set that was in Jessica and Detrich's house.

    Nearby the knife, there was a white PVC pipe and a black bucket that appeared to have blood on them. Later, investigators found a size 5T teal skirt hastily concealed under bark within the block behind 75 S. 400 West. This information from the search warrant is also what Jensen revealed at the press conference.

    Alex Whipple is back in court Monday, but where is the case going?

    On Monday, lawyers for Alex Whipple — the man accused of killing his 5-year-old niece Elizabeth Shelley in Logan — will decide how the case moves forward.

    2News spoke with a criminal law expert on what moves the defense could make.

    The big questions many have had: Can the death penalty ever come back? And where does the case go from here?

    “When a defendant reveals where the body is, he is incriminating himself,” said David Lynch, a criminal justice professor at Weber State University.

    With petitions circling, many have demanded the death penalty be put back on the table for Alex Whipple.

    “He has the right not to self-incriminate under the 5th Amendment,” Lynch said.

    Lynch has seen it all as a criminal lawyer, a public defender and a prosecuting attorney for many years prior to his career at Weber State.

    “He lived up to his part of the deal, now the state has to live up to its part, so they’re stuck,” he said.

    Lynch said unless prosecutors have a genius, clever footnote in the deal, it won’t happen.

    Whipple is facing charges for murdering Lizzy, then hiding her body, leading to a massive five-day search throughout Cache County last month. The death penalty was taken off the table in exchange for Whipple sharing the location of her body.

    Monday, the defense will decide if it wants to go forward with a preliminary hearing.

    “The purpose of a preliminary hearing is to decide if there’s probable cause that you committed the crime that you are accused of,” Lynch said.

    Lynch said at any time, a plea deal could be presented by either side to waive the preliminary hearing or avoid going to trial.

    Alex Whipple, accused killer of his 5-year-old niece in Logan, appears before judge

    Alex Whipple, 21, made his first physical appearance in the 1st District courtroom of Judge Kevin Allen. A previous appearance had been by video link.

    The judge set a preliminary hearing for Whipple for Aug. 13. The preliminary hearing will determine whether there is enough evidence of guilt to continue to trial.

    And police have said the DNA evidence strongly links Whipple to the scene of Lizzy’s death, about five doors away from her house, where Whipple had been staying the night the child disappeared.

    Uncle pleads guilty in kidnapping, rape and murder of 5-year-old Elizabeth Shelley

    Alex Whipple has pleaded guilty to some of the charges filed against him in connection with the rape and murder of 5-year-old Elizabeth Shelley.

    A preliminary hearing on Tuesday in Logan, quickly turned into an announcement of a plea deal. In exchange for pleading guilty to aggravated murder, child kidnapping, rape of a child and sodomy upon a child, other charges were dismissed.



    Prosecutors, for the first time, disclosed how they believe Lizzy was killed.

    In court, they explained Lizzy was stabbed in the back with a knife, which pierced her lungs. Her lungs filled with blood, prosecutors said, causing her to drown.

    They also laid out the evidence found for rape and sodomy. They said they believe Whipple kidnapped Lizzy from her room after Lizzy's mother and mother's boyfriend went to sleep on May 25th. They said Whipple took her to away from the home, then detained her and sexually assaulted her.

    While they've now given a clearer picture on how Lizzy died, there's still no answer to why.

    "I don't think there's a real reason that this happened," said Shannon Demler, Whipple's defense attorney, after the hearing. "There was never a discussion of anybody doing anything to him, or he was paying them back or anything."



    While the death penalty is off the table, life in prison is not.

    Demler said he will argue for a sentence that he feels is "reasonable," and that they will work on mental evaluations for Whipple to present at the sentencing.

    "We expect the sentencing is going to be very difficult for the judge not to give Mr. Whipple the maximum and we know that," Demler said. "But we at least want to provide information to the courts, so that they're well informed when they make that decision."

    Whipple's sentencing is set for September 24 at 1:30 p.m.

    Oh, I'd much rather have him in prison for years and years and years and years of his pathetic life. Suffering in the general population rather than alone on death row.

    Elizabeth Shelley's uncle sentenced to life in prison for her murder

    The man accused of killing, kidnapping and raping 5-year-old Elizabeth "Lizzy" Shelley in Logan will spend the rest of his life in prison without parole, a judge said. He was given maximum sentencing after admitted to killing his niece who was laid to rest in June.

    Victim advocate Terryl Warner spoke on behalf of Shelley's mother, who was not in attendance because she did not want to be in the same room as Whipple.

    I can't blame the mom for not wanting to be in the same room as him. I hope she and her family can now properly grieve this precious child who was taken too soon :candle:.
