    Change of venue motion granted; Madden trial will not take place in Allen County

    A trial date for Timothy Madden, the man accused of kidnapping, raping and killing 7-year-old Gabbi Doolin in November 2015, has been set.

    Madden appeared in Allen County Circuit Court on Thursday for a pretrial conference, during which a motion filed by Allen County Commonwealth's Attorney Clint Willis to set the case for trial was granted by Judge Janet Crocker. The trial is scheduled to take place in February 2018.

    It is possible the date could change, pending the location of the trial.

    A motion for a change of venue filed by defense attorney Travis Lock was also granted by Crocker, and means the location of the trial will not be Allen County.

    Two years have passed since the death of 7-year-old Gabbi Doolin of Allen County

    Two years ago, on November 14, Gabbi Doolin was raped and murdered behind the ball fields at the Allen County Scottsville High School.


    Fast forward to 2017 and Madden is currently in jail for the alleged murder of Gabbi Doolin.

    He is set to make another court appearance this Friday, November 17.

    Trial date set for Kentucky man accused of raping, killing girl near youth football game

    At the pretrial hearing on Wednesday, an Allen/Simpson County circuit court judge sustained the motion to reschedule the trial to July 23, 2018. Attorneys have until April 27 to file pretrial motions with a pretrial hearing scheduled for May 22.

    Attorney Shakeup Causing Delays in Madden Trial

    A capital murder case in Allen County is facing more delays now that the defendant has a new attorney.


    His newly appointed public defender Tom Griffiths told the judge that he had not received any files in the case from Madden’s former attorney Travis Lock.

    "If I have to start over from scratch completely, then it's going to take a lot of time and energy to do it," Griffiths told WKU Public Radio. "In a case like this that's been going for close to three years, it's really not fair for everybody involved."

    Allen Circuit Court Judge Janet Crocker ordered Lock to hand over the documents by August 15.

    "The file belongs to the client, not the attorney," stated Crocker.

    Lock stepped down from the case after Madden’s family ran out of money for a private defense. The 41-year-old Madden was appointed a public defender since he now using public funds to take the case to trial.

    Allen County Commonwealth's Attorney Clint Willis expressed frustration because he thought the family would get a trial date at Tuesday's hearing.

    "It's hard to explain to them that we're going to come back here and try to do the same exact thing all over again simply because a file did not appear to be handed over," Willis commented to reporters.

    Still no trial date for Timothy Madden


    Timothy Madden was back in Allen Circuit Court Tuesday, represented by a public defender after switching counsel.

    In front of Judge Janet Crocker, Madden's attorney argued that a trial date could not be set Tuesday because he has not yet received certain files from Madden's previous representation.

    Tom Griffiths now represents Madden, and on Tuesday he told the court that Madden's prior attorney, Travis Lock, has not been able to provide him with the files he needs.

    "I'm sure that there is a good reason why he hasn't done it," Griffiths said, "but if you're asking me what that reason is, I don't know."

    Griffiths stated Lock was supposed to meet with the new defense team earlier this month on July 10 but Lock did not have files ready.

    Crocker asked prosecution and defense to begin looking at availability for possible 2019 trial dates.

    Gabbi Doolin's parents voice frustrations with case of their daughter's murder

    Amy and Brian Doolin will be the first to tell you that time doesn't necessarily heal all wounds.

    They lost their seven-year-old daughter Gabbi in 2015 when she was kidnapped, raped and murdered in a wooded area behind Allen County-Scottsville High School during her brother's middle school football game.

    Time may heal some wounds, but even three years after her death, no wounds have healed for Gabbi's parents.

    "That beautiful little girl was full of life and her life was cut short," said Gabbi's mom, Amy.

    Her dad, Brian adding, "It's just the constant thought of missing her. She was always happy-go-lucky and always smiling, and most of the time you miss the way things were."

    It's been 1,096 days since Gabbi's life with taken. Since then, there have been three different trial dates, new attorneys for both the defense and prosecution and continuous delays.

    All of that has transpired in 1,096 days, but still no justice for Gabbi.

    "I never knew that our justice system was so slow turning, I just had no clue. Every time that we've been hit with 'It's going to be longer' you're just like 'Wow. Really? Why?'" Amy said of the judicial system.

    The delays and changes have left the Doolin's devastated, having to leave the courtroom at times overcome with frustration. One of those instances, when the defense attorney for Timothy Madden, Travis Lock, was dismissed from the case.

    "As soon as that happened, I mean, common sense just played in. You know it's going to be put off again because the new guy has to have time to do whatever Travis Lock's been doing for the last two and a half years," Brian said.

    "All we have heard is about the criminal we sit in the courtroom with, every time we go in there, all we hear about is his constitutional rights," Amy added. "Gabbi's not really had a voice. We've tried to do our part to give her a voice, but in that courtroom, she doesn't have a voice."




    Three years of pain, agony and suffering through a parent's worst nightmare, Brian and Amy still know that no court and no time can take away their daughter's legacy.

    "She had a smile that would light up a room, and she was just full of life. Absolutely full of life," Amy said about her daughter.

    Why someone would take this innocent soul, no one can answer. Though time will run its course, through due process, justice for Gabbi will come in due time.

    "Her presence made not only our lives but so many other lives, better," said Amy.

    They're right, the victims don't have a voice. And I hate that. And I've another concern, what about the rights of the people who are still living that are preyed upon by these heartless killers? If this guy were set free, he would just do it again.

    Heartbreaking. Gabbi's death was so disturbing & the (blank) who killed her (they have too much on him for me to say "alleged") & his lawyers are playing the system. Disgusting!

    My guess to that is why QUITE A FEW MURDERS HAPPEN ON THE 4TH OF JULY AND HALLOWEEN. LOUD NOISES DROWN OUT ALOT AND SCREAMS ARE CURRENTLY HEARD.

    I HAVE BEEN SOUNDING OFF ABOUT THIS FOR YEARS! THE PUBLIC GETS IT! HOW CAN THE "PAROLE BOARDS" NOT! PSYCHOLOGISTS STATE 99% OF OFFENDERS CANNOT BE REHABILITATED!!!! STOP F'IN LETTING THEM OUT ! MOST MURDERS YOU HEAR "We're Released" after serving---- for a similar Crime. Molestation, Abduction and RAPE. AND THEY LET THEM OUT!!!! ONLY TO MAKE FUTURE VICTIMS. KEEO THEM CAGED!!!!

    Judge grants DNA retesting in case of Kentucky man charged with raping 7-year-old Gabbi Doolin

    A judge has granted a motion for the retesting of DNA evidence in the case against Timothy Madden, the man accused of raping and killing a 7-year-old in Allen County, Kentucky.

    Judge Crocker granted the motion after Madden’s attorney filed it on March 25. According to court documents, the defense has retained an independent lab to act as a defense expert for forensic testing.


    His trial date has been set for September 4, 2019 . Prosecutors said they will be seeking the death penalty in the case.

    I remember one case "The Innocence Project" was working on Years ago. I don't recall his name, But he was on "The Docket" for execution. This Crime occurred before DNA. They got a "DNA" sample. But it didn't get tested fast enough. And he was executed before the DNA results came back. And it was proven, He was GUILTY!
