    Police seek info on movements of Lumberton teen's murder suspect

    Lumberton police are specifically seeking to determine McLellan's movement between Nov. 4 and Nov. 13. Those dates are the day before Hania was kidnapped to the day McLellan was booked into the Robeson County Detention Center on an unrelated charge.

    The info they seek is related to the ongoing investigation into Hania's kidnapping, rape and murder, and they ask anyone with information on the following instances to call investigators immediately.

    • Mr. McLellan possessing a weapon.
    • Mr. McLellan possessing a yellow bandana.
    • The location of a yellow cinch sack Mr. McLellan is known to carry.
    • Photos of McLellan in possession of the yellow cinch sack.
    • Photos taken by you or by a direct contact of yours of Mr. McLellan in September, October, or November 2018.
    • Mr. McLellan in possession of two small TV monitors that fit in the headrest of a vehicle.
    • Mr. McLellan possessing white Adidas sneakers with three black stripes and distinctive, colorful stitching.

    Autopsy finds Hania Aguilar most likely died from suffocation

    Hania Aguilar, who was kidnapped from her Lumberton home in November 2018, most likely died from suffocation, according to a report just released by the Office of the Chief Medical Examiner.

    In it, the medical examiner says the autopsy was unable to specifically determine how Aguilar died. However, due to the circumstances surrounding her death and the evidence gathered during the autopsy, the medical examiner determined Aguilar's "means of death was most likely a form of asphyxia."

    The report also stated that the medical examiner found evidence consistent with that of a sexual assault.

    The naked body of 13-year-old Hania Aguilar was discovered in a pit of muddy water in the woods, covered with a plastic table and a tire, an autopsy report says.

    The N.C. Office of the Chief Medical Examiner released an autopsy report for Hania on Tuesday. The cause of death is listed as “homicidal violence of undetermined means,” likely by some form of asphyxia.

    Hundreds of unsealed documents shed light on Hania Aguilar kidnapping, murder

    More than 500 pages of documents unsealed Thursday by the Robeson County District Attorney’s Office are shedding light on what happened before and after 13-year-old Hania Aguilar was kidnapped and killed last year.

    Documents show that one woman reported seeing a man in a dark hoodie walking in the neighborhood at about 6:15 a.m. on Nov. 5. The woman said she felt uncomfortable and pretended to make a phone call in order to avoid him.

    Another resident in the mobile home park said she saw a man in a mask standing on her porch, potentially trying to break into the home. The man fled from the home, and the 911 call reporting Hania’s kidnapping came nine minutes later.

    The documents also show that several witnesses reported that McLellan had discussed his plans to commit a crime.

    The witnesses said that McLellan had identified three potential targets for “a lick,” which, according to the documents, is a slang term for committing robbery. One of the targets McLellan had identified to witnesses was an area described as the mobile home park by the Kia dealership, which investigators believe referred to Rosewood Mobile Home Park.

    Investigators also found McLellan’s DNA on the steering wheel of the SUV, although he denied ever being in the stolen vehicle.

    Other items taken from the SUV included a photograph of a female and white rope.

    Documents provide details on Hania’s alleged killer

    The man charged with kidnapping, raping and killing 13-year-old Hania Aguilar was within reach of law enforcement in the days after the kidnapping, but kept slipping away.

    That information was included in more than 500 pages of documents filed by investigators for 23 search warrants that covered cell phone records for McLellan and others identified as “material witnesses;” GPS coordinates from Google accounts; a sport utility vehicle; and a residence on Atkinson Road in Orrum.

    Josh Allen lives in the park and told investigators that he and his brother had an encounter with McLellan about two hours after Hania was kidnapped, according to the documents. Allen said McLellan, dressed in black clothing and wearing a yellow bandana, approached them. His clothes were wet, according to the documents. McLellan asked if he could wash his clothes at Allen’s house.

    Allen identified McLellan, who has teardrops tattooed under one eye, from a photograph.

    The same day the SUV was found, Allen saw McLellan in the mobile home park. McLellan asked Allen if he could use his phone. As McLellan was wrapping up the call, Allen said four police officers walked in the park. McLellan, whose back was to them, turned around to give Allen the phone “and looked directly at the four officers,” according to the documents.

    McLellan ran away before he could be seen.

    A day later, on Nov. 9, an unidentified woman called a tip line after seeing video footage released by investigators, the documents show. She identified him as “Michael Ray” and said she knew him from frequenting Lambeth Street when she lived there. He later was identified as McLellan.

    The woman said that on Nov. 8, the day the SUV was found, she heard helicopters flying around the Deerfield Mobile Home Park area. She went to see what was happening and saw McLellan running to a wooded area as law enforcement approached, the documents reveal.

    Attorney for man charged in Hania Aguilar case appears in court; court date for 2016 charges set

    The attorney for Michael McLellan apeared in court on Monday.

    McLellan was charged with the kidnapping and death of 13-year-old Hania Aguilar on Dec. 8. He was arrested for her murder shortly after forensic test results were processed.

    Hania was forced into a family member’s idling SUV and kidnapped from her driveway in the Rosewood Mobile Home Park in Lumberton on Nov. 5. After weeks of searching, the FBI located her remains in a body of water off of Wire Grass Road on Nov. 27.

    McLellan's attorney appeared in court at 9 a.m. Monday in Robeson County.

    A court date for McLellan's 2016 charges was set for June 3.

    In January, a grand jury returned an indictment against McLellan in connection with a 2016 rape case.

    According to the indictment, a grand jury returned a true bill of indictment against McLellan on January 7 in reference to a 2016 rape case. The hearing was held at 10 a.m. on January 7.

    The offenses listed in the indictment include first degree rape, first degree burglary, and robbery with a dangerous weapon. The indictment says McLellan broke into the victim’s home and did “ravish and carnally know” the victim by force and against her will.

    The man accused of strangling 13-year-old Hania Aguilar has been indicted in the case.

    Michael Ray McLellan, 34, faces charges of first-degree murder, first-degree rape and first-degree kidnapping (among others). He has been in custody since Nov. 13, but court officials confirm his case was recently seen by a grand jury.

    That grand jury indicted McLellan in the case. That is a procedural step in moving the case forward in the court system.

    Prosecutor to seek death penalty against Michael McLellan in murder of Hania Aguilar

    The Robeson County District Attorney said during a hearing Thursday that the state will seek the death penalty against the man accused of killing Hania Aguilar, according to ABC affiliate WPDE.

    Michael Ray McLellan, 34, faces charges of first-degree murder, first-degree rape and first-degree kidnapping (among others). He has been in custody since Nov. 13, but court officials confirm his case was recently seen by a grand jury.

    Man accused of killing Lumberton teen appointed second attorney

    Michael McLellan, 34, has been appointed a second attorney in the killing of 13-year-old Hania Aguilar last November in Lumberton.

    McLellan was listed on the Robeson County Court docket for this week, but Robeson County District Attorney Matthew Scott said the case won’t be heard. Scott said McLellan’s attorneys have been given his case file to prepare for his defense.
