    Sidney Moorer retrial will be held in Georgetown after change of venue granted

    HORRY COUNTY, SC (WMBF) – A change of venue has been ordered in the kidnapping trial of Sidney Moorer, charged in connection with the December 2013 disappearance of Heather Elvis.

    A retrial in the case will now take place in Georgetown, according to an order filed with the Horry County Clerk of Courts.

    The order stated the defendant filed a request for a change of venue on July 26. That request followed Moorer’s June kidnapping trial, which ended with a hung jury and a mistrial.

    Report: Shots fired at home of Heather Elvis' family

    HORRY COUNTY, SC (WMBF) – The home belonging to the parents of missing woman Heather Elvis was shot at Wednesday night, according to an Horry County Police report.

    Police responded to a home in the Socastee area at about 10 p.m. on Wednesday, and met with the victim, who is not named in the police report. He told police he was taking the trash out when he heard a popping sound and felt the trash can being struck.

    The victim then ran behind his vehicles and into his residence, the report states. He told police he saw a vehicle on the road where it intersects with the road that the home is on, but was unable to describe it because it was dark and the vehicle was far away.

    The report notes that there were about four holes in the victim’s trash can, including both entry and exit holes.

    According to the report, this incident is being investigated as an attempted murder.

    The address where the incident occurred is owned by Terry and Debora Elvis, parents of Heather Elvis, who has been missing since December 2013, according to county property records.

    Earlier this week, the re-trial of Sidney Moorer, the man accused of kidnapping Heather Elvis, was moved to Georgetown County after the judge in the case granted the defense’s request for a change of venue. Moorer’s wife Tammy Moorer is also charged with kidnapping. Murder charges for both Moorers were dropped earlier this year.

    Judge denies motion to reconsider change of venue in Heather Elvis kidnapping trial
    Circuit Court Judge R. Markley Dennis says the Sidney Moorer retrial will be held in Georgetown County. Dennis ruled earlier to have Moorer tried in Georgetown County after a jury could not reach a verdict in June. Moorer is charged with kidnapping Heather Elvis. His wife, Tammy Moorer, also faces kidnapping charges but her case has not gone to court. The state argued that a jury could be found in Horry County. However the court ordered the retrial be in Georgetown County partially because of the media attention to the case. The state argued the same media covers Horry and Georgetown counties so if another jury pool is to be used, it should be from an area not covered by the same media. Dennis also denied a request from the state to have an outside jury brought in for two weeks to have the trail at the Horry County Courthouse in Conway.The re-trial for Sidney Moorer, charged in the disappearance of Heather Elvis, will not be moved back to Horry County.

    Family of Heather Elvis speaks about change of venue in kidnapping case trial

    The family of Heather Elvis held a press conference Friday to discuss their feelings on the change in venue for the trial in their daughter’s kidnapping case.

    Ms. Elvis went missing in December of 2013, police say she is presumed dead.

    Sidney Moorer is accused of kidnapping Ms. Elvis. He faced a Horry County jury in June of this year, but the judge declared a mistrial after the jury was deadlocked. A new trial is set for next year in Georgetown County.

    “We’re not happy about the trial being moved. We don’t want to go to Georgetown for the trial, we’d rather it be in Horry County,” said Debbie Elvis, Heather’s mom.

    Elvis family to hold annual prayer vigil

    Christmas is hard for the Elvis family. It was Christmastime in 2013 when Heather Elvis’ parents last saw her. She was standing in front of what may be one of the most recognizable symbols of the season - a Christmas tree.

    “Christmas is hard. The last time I saw my daughter was in front of a Christmas tree,” said Terry Elvis.

    The Elvis family has not given up hope, though, that they will find their lost daughter.

    “She will be found. One day,” said Debbi Elvis, Heather’s mother.

    Sidney Moorer indicted on obstruction of justice charge

    Court documents indicate that Sidney Moorer, whose trial for the kidnapping of missing Heather Elvis ended in a hung jury last year, has been indicted for obstruction of justice.

    The charge, filed on March 27 of this year, appears to be separate from his existing obstruction of justice charge, which was originally filed in 2014, and has yet to go to trial.

    The new indictment states: “That Sidney Moorer did in Horry County on or about December 20, 2013 through December 21, 2013, intentionally do an act which prevented, obstructed, impeded, or hindered the administration of justice, in violation of the Common Law offense of Obstruction of Justice.”

    WMBF News reached out to the 15th Circuit Court Solicitor’s Office for details on this new charge, but because of the active gag order on the case, court officials were unable to comment.

    During his trial last year, it came to light that Moorer was originally charged with obstruction of justice for allegedly lying to investigators about making a call to Elvis from a pay phone on the night of her disappearance.

    Moorer is still charged with kidnapping Elvis. After five-day trial in June 2016, the jury was unable to come to a unanimous decision, and a mistrial was declared. A new date for Moorer’s retrial has not yet been announced to the public.

    Family, friends remember Heather Elvis on missing girl's 24th birthday

    June 30 is a day one family will never forget.

    Friday was the 24th birthday of Heather Elvis. It is a day her family and friends have marked each year since her disappearance in December 2013.

    Some area residents gathered at Peachtree Landing in Socastee on Friday – the place where Elvis’ car was found after she went missing.

    Debbi Elvis, Heather Elvis’ mother, said Friday was not a day for celebration. Instead, she used it to promote a cause close to her heart.

    A lot of the people who searched for Heather Elvis back in 2013 were from an organization called CUE, or the Community United Effort.

    It's an organization that helps thousands of people all across the country who have missing loved ones.

    Tammy Moorer to appear in court Monday for contempt of court hearing
    (WMBF) – Tammy Moorer, the woman charged with kidnapping missing woman Heather Elvis, is scheduled to appear in court on Monday for a contempt of court hearing.

    The hearing is to determine if Moorer is in violation of the gag order placed on this case, according to officials at the court clerk’s office. The hearing is scheduled for 11 a.m. No other details on the hearing were made available by court officials.

    Moorer’s husband Sidney Moorer is scheduled to go to trial in Horry County on August 28 on an obstruction of justice charge in connection with the case, WMBF News learned earlier this week.


    Both Moorers are still due to be tried on the charge of kidnapping. Sidney Moorer’s first trial on this charge ended with a mistrial and hung jury after several days of testimony and deliberation last June. His request for a change of venue was granted, and this trial will now be held in Georgetown County.

    There is no indication when Tammy Moorer will go to trial for kidnapping.

    The Moorers were arrested in February 2014 in connection with the disappearance of Elvis, who was 20 years old when she went missing.

    Prosecutors are unable to discuss the case due to a court-appointed gag order that remains in place.

    Moorer actually spent time behind bars for breaking that gag order. He was sentenced to five months in jail last July for talking to the press during his trial, but ultimately only served two of them.

    Tammy didn't have court that day. Many are wondering why? There is an article about Terry Elvis' reaction to Tammy not going before Judge Dennis.

    I wonder since she was very active the days before Sidney's trial on facebook, saying all kinds of stuff up until the night before, if the prosecution wanted to include those posts in her trial so it has been delayed? She or someone took down her fb right before Sidney's trial. Her charges include posts made in July 2017.

    What the heck is wrong with her? Now she's going after Heather's family? First she went after Heather. This woman acts like a sociopath. Early on in the case, I happened to talk to somebody who knew Tammy years ago. She said that she was pretty much a brow beater around everyone. I can see it! Can't you?

    CONWAY, SC (WMBF) – A jury has returned a verdict of guilty in the obstruction of justice trial for Sidney Moorer.

    After deliberating for almost an hour, the jury came back with its verdict.

    The defendant chose not to testify on his own behalf. He appeared emotional at times, dabbing at his eyes with a paper towel.

    Before court wrapped up, Judge Markley Dennis sentenced Moorer to 10 years in prison, the maximum penalty he could receive. He will receive credit for time already served, which was from Feb. 21, 2014 to Feb. 1, 2015, according to the defense attorneys.


    Wednesday’s verdict followed three days of testimony in this trial, in which Moorer was convicted of lying to investigators about making a call to Heather Elvis from a pay phone on the night of her disappearance in December 2013. This was revealed during his first trial last year on a charge of kidnapping.

    In her closing argument, assistant solicitor Nancy Livesay noted that records from the pay phone showed that Moorer was the last person to talk to Elvis, for almost 10 minutes.

    “He was important, he was key, and his first go-to move was to story to the police,” Livesay said in her closing argument.

    During defense attorney Kirk Truslow’s closing, he said he had never seen such an “atrocious” case from the prosecution.

    This was the second time Moorer went to trial in connection with Elvis’ disappearance. His first kidnapping trial in June 2016 ended in a mistrial.

    A second trial will be held in Georgetown, but a date has not yet been set.

    Sidney Moorer’s wife, Tammy Moorer, is also charged with kidnapping. She has not yet gone to trial on her charge and a date has not been set.
