    Judge rules Md. mother incompetent, notes case ‘coming up on 5 years’

    While going along with doctors’ conclusions that Catherine Hoggle remains incompetent to stand trial for the murder of her two young children, a Montgomery County judge noted “we’re coming up on five years” and shortened the period before her next review.

    In her first court appearance in almost a year — since shortly after being indicted for the murders of Sarah Hoggle, 3, and Jacob Hoggle, 2 — judge Robert Greenberg said doctors at Clifton T. Perkins Hospital determined on Nov. 26 that “she remains incompetent and dangerous.”

    However, noting that another medication is being used in her treatment, Greenberg — in his first time hearing the case since the retirement of Judge Michael Mason — shortened the time period before Hoggle’s next review to 90 days and set the next hearing for March 6.

    In addition, Greenberg noted: “We’re coming up on five years, although this is a different case, arguably.”

    ‘Getting away with murder’: Deadline could jeopardize prosecution of Md. mom charged with killing kids

    September will mark five years since 3-year-old Sarah Hoggle and her 2-year-old brother Jacob were last seen — WTOP has learned the children’s father is concerned time may be running out for Catherine Hoggle to stand trial for their children’s murders.

    “She is literally getting away with murder,” said Troy Turner, who fathered the two missing children, as well as a third child, with Hoggle.

    Turner and Montgomery County prosecutors have maintained that Hoggle is feigning mental illness while being treated and evaluated at Clifton T. Perkins Hospital in Jessup, Maryland.

    “It’s incredibly scary that she could kill two children, and then the system would just allow them to malinger, when there’s clear evidence that she’s been competent pretty much this entire time,” Turner said in a WTOP interview.

    Troy Turner said he is fearful that Catherine Hoggle may be released into the public.

    “There’s the possibility that she could be walking the streets in a few months,” Turner said. “It’s more than just a scary thought for our family at home, I think for the entire community.”

    Even if charges were dismissed against Hoggle, she could be civilly committed to Perkins, or another institution if she is determined to be a danger to herself or others.

    It has been nearly five years since the disappearance of Sarah and Jacob Hoggle, two Montgomery County children who were last seen with their mother Catherine who has since been indicted in their murders.

    Sarah and Jacob's father, Troy Turner, says he's frustrated that Catherine remains mentally unfit to stand trial. Turner says he is fearful of a law in Maryland that could allow Catherine to one day be released from custody without ever facing the charges in court

    Rockville criminal defense attorney David Felsen is Catherine's attorney and says she is expected in court in June to face a competency hearing.

    Hoggle Again Ruled Incompetent; Prosecutors Seek Independent Evaluation

    A Montgomery County judge ruled Tuesday that Catherine Hoggle, who has been accused of killing her two children, remained incompetent to stand trial.

    The decision was the latest in a series of rulings where Hoggle has been brought before a judge and found unable to assist in her defense based on reports of her doctor at the Clifton T. Perkins Hospital Center in Jessup.

    What followed in court was a discussion between Greenberg, McCarthy, Assistant State’s Attorney Ryan Wechsler and Hoggle attorney David Felsen on whether McCarthy had filed a request in March for an independent mental evaluation and whether the judge ruled on it. Greenberg said he had never seen the request.

    Later, McCarthy said the request was lost in the “paper flood” that passes among offices at the Montgomery County Circuit Court courthouse.

    Ultimately, the sides agreed that McCarthy would file a new request and Felsen would respond. On July 3, the prosecution and defense would appear before Greenberg, who would rule on whether to allow the independent evaluation.

    ‘Remains dangerous’: Second-opinion exam of Catherine Hoggle says she remains mentally unfit for trial in case of missing children

    A new psychiatric evaluation of Catherine Hoggle, the Maryland woman who has been locked in a hospital for five years since being accused of killing her two young children, found she remains mentally unfit, a blow to prosecutors’ hopes to finally take the case to court.

    “Ms. Hoggle is not currently competent to stand trial and remains dangerous,” the Montgomery County State’s Attorney’s Office acknowledged in a court filing this week, citing the findings of psychiatrist Christiane Tellefsen.

    The prosecutors had retained her to provide a second opinion to the years-long assessments from doctors at the state’s Clifton T. Perkins Hospital Center, where she has been held, who found Hoggle was not able to aid in her defense.

    Tellefsen said Hoggle was improving, prosecutors stressed, and that she is “approaching a level of understanding in which she could be considered competent.”

    “In the U.S. and in Maryland, we don’t try people who can’t defend themselves,” Hoggle’s attorney, David Felsen, said Friday, repeating comments he has made for five years.

    But some of those close to Hoggle, including her ex-boyfriend Troy Turner, have long maintained that Hoggle, whose IQ was once tested at 135, has exaggerated the extent of her illness to avoid facing a jury. Montgomery’s top prosecutor, John McCarthy, suggested as much three years ago in court papers.

    McCarthy said Hoggle began a new medication trial — with the drug Clozapine — six months ago.

    “Evidence that the defendant is improving is clear from a review of the medical records,” McCarthy wrote. “Dr. Tellefsen describes the defendant as bordering on competency.”

    McCarthy suggested that additional time on Clozapine and perhaps a higher dosage might result in competency. He asked the judge, Greenberg, to allow Tellefsen to evaluate Hoggle again in several months before holding a competency hearing in December.

    Hoggle Kids' Vigil Marks 5 Years Since Their Disappearance

    The father of two children who went missing nearly five years ago will hold a candlelight vigil in their honor on Saturday evening. Every year since Sarah and Jacob Hoggle disappeared in September of 2014, Troy Turner has held a vigil for them — hoping to spread the word about their case.

    The vigil is scheduled for 7 p.m. at Chick-fil-A, 19945 Century Blvd. in Germantown. It's where Turner's search for the children began.
