    Next court date 1/15/2016

Jenise and Gabriel Gaeta lived nearby in the Steele Creek Mobile Home Park in East Bremerton, and Gaeta was considered a friend of the family.

Jenise was reported missing by her parents Aug. 3. Her body was found in a muddy ravine near the mobile home park on Aug. 7 and Gaeta was arrested Aug. 9. Investigators have alleged they matched DNA material found on Jenise's clothing to Gaeta and during an interview with investigators Gaeta said he alone was involved in her disappearance and death.

Gaeta was charged with first-degree murder, which includes multiple aggravating circumstances, as well as first-degree rape of child. If convicted, Gaeta could face life in prison.

If they confess, why do we need a trial? I'm thinking logically, not legally.

To make sure the confession was not false (which happens more often than ppl think..) ir coerced by LE, I'd presume?

Which I agree with, totally. Even though there's some pedos and killers and rapists (who are very obviously guilty) I'd love to see simply strung up from the closest tree branch.

Gaeta could face minimum of life without parole

If convicted of murdering 6-year old Jenise Wright, a former Olympic High School student who was 17 at the time of her death could face life in prison without parole, a Kitsap Superior Court judge has ruled.

In the lead up to his Oct. 10 trial, Gabriel Zebediah Gaeta's lawyers argued to Judge Jennifer Forbes that recent court decisions about sentencing juveniles meant, if convicted of aggravated first-degree murder, he should be eligible for early release after 25 years in prison. Forbes disagreed.

Gaeta, who was charged as an adult, was 17 at the time of Jenise's death in August 2014 and would have started his senior year at Olympic High School that fall. He is now 19 and has been lodged first in Kitsap Juvenile Detention and then in the Kitsap County Jail since his arrest. Initially he was to be evaluated for competency to stand trial, but his lawyer advised him not to cooperate and stipulated that Gaeta understood the charges against him and was able to participate in his own defense.

Gabriel Z. Gaeta, 19, is accused of raping and killing 6-year-old Jenise Wright, a neighbor of the former Olympic High School wrestler. DNA evidence found on Jenise's body matches Gaeta's, according to court documents. At the time of Gaeta's arrest in August 2014 he was 17, but was charged as an adult.

Attorneys on the case indicated Friday both sides may be interested in resolving the case short of trial after hearing the results of an appeal. His trial date was pushed back from Oct. 10 to March 6.

.. Wait.. what does this mean? Plea bargain of some kind? Why no trial?! I truly hope he's not been offered a lesser sentence to save the state a few bucks. :(

Judge rules Gaeta can be forcibly medicated

A Kitsap County Superior Court judge gave doctors at Western State Hospital the go-ahead Tuesday to forcibly medicate an East Bremerton man who had been found mentally incompetent to stand trial for the rape and murder of 6-year-old Jenise Wright.

A psychiatrist from Western State testified that Gaeta arrived at the hospital from the Kitsap County Jail last week. He did not respond to doctors or voluntarily take medications. After he lashed out Monday at hospital staff who tried to rouse him from his bed, the doctor asked for an expedited hearing for the authority to use intravenous antipsychotics. Unlike pills, injectable medications can be administered without a person’s consent.

Forbes ordered Gaeta be taken to Western State in February, but he was not taken to the hospital until last week. A Western State spokeswoman previously told the Kitsap Sun there is an average two-month wait for admission to the hospital.

The purpose of the “competency restoration” is not necessarily to treat Gaeta’s mental illness but to bring him to a legal standard called “competency,” a distinction where he understands the accusations against him and can participate in his own defense.

“If the defendant is not competent then the case cannot proceed,” Chief Deputy Chad Enright told Forbes. “Obviously, he is suffering from a mental disorder and to a large extent letting him sit in a cell with a pillow over his head is cruel.”

Gabriel Gaeta found competent to stand trial

Gabriel Gaeta, the man accused of the 2014 rape and murder of 6-year-old Jenise Wright, has been found competent to stand trial after an evaluation by doctors at Western State Hospital.

According to Gaeta’s latest evaluation, psychologists found Gaeta “demonstrated a factual and rational understanding of his current charges and of court procedures.” Although he presented “continuous symptoms of an underlying mood disorder,” it was determined his symptoms did not diminish his ability to assist his attorney “with a reasonable degree of rational understanding.” These two factors form the legal criteria for competency to stand trial.

February trial date set for accused murderer Gabriel Gaeta

Gabriel Gaeta, charged as an adult for the 2014 rape and murder of 6-year-old Jenise Wright, now has a trial date scheduled for February, about eight months after he was found incompetent to stand trial.

He is expected to be evaluated again in advance of the scheduled trial. Although the trial is scheduled for Feb. 12, it can be postponed again -- though prosecutors, Kitsap County Superior Court Judge Jennifer Forbes and reportedly even Gaeta have expressed frustration at how long the process has taken.
