NOAH THOMAS: State of Virginia vs. Ashley White for child abuse after Noah found in septic tank

    The evidence presented in the case so far leaves open the possibility that Noah somehow got into the septic tank himself. An investigator testified Wednesday that the lid to the tank wasn’t heavy.

    After several hours of testimony Wednesday, White’s attorney — public defender Kelsey Bulger — made a motion to dismiss the felony homicide charge, saying that the prosecution hasn’t presented enough evidence to prove Noah’s death was directly a result of the neglect that would be needed to convict.

    According to Virginia code, felony homicide is the “killing of one accidentally, contrary to the intentions while in the prosecution of some felonious act.”

    “Where is the connection between child neglect and the death?” Chitwood asked Pulaski County Commonwealth’s Attorney Mike Fleenor".

    So..........the septic tank wasn't secured properly or what?

    I've been wondering for a while now what, if any, relationship there is between members of this family and local LE. Is all I am going to say on that point.

    As adventurous as I full well know little kids can be, I find it VERY hard to imagine a little 5-yo voluntarily opening & climbing down into a dark septic tank full of probably nasty water just for a lark. You know? It just doesn't seem very feasible.

    Maybe it's just me. I feel something's very off here.

    TIFM, definitely something is off. I don't for one minute believe this child crawled into the septic tank.

    better to drop the charges now than risk a loss that will present double jeopardy I think. :(

    Good point...

    I have a few scenarios (with questions) in my mind, right now:

    -- It was an accident (how heavy was that lid? did the tank have an odour? what would be appealing about it about it for a 5yo, as opposed to say, cartoons or climbing on something?)

    -- He was put down there for punishment or some such, while the parents were gone

    -- He was drowned or rendered unconscious elsewhere, and placed in the tank (was the water in his lungs the same water as the tank?)

    -- Somebody other than the parents put him down there.

    Whichever is true, this dear little boy did not have to die, and had no business being anywhere near that horrid tank. Will be doing a deal more reading on this one.

    I was very interested in the post earlier, re the man who found him - also, how the police missed the cell phone on Noah's body! I would love to see the autopsy report...

    One more thought.. compare LE and their presence in the media in this case, to that of Chief Tom Hackney in the Lonzie Barton case. Apples and orangutans!

    Noah Thomas case: Grand jury indictments include new charge against mother

    A grand jury indicted the parents of Noah Thomas on Tuesday — the latest turn in the child’s death case.

    Paul Thomas, Noah’s father, was indicted on two class 6 felony charges of abuse and neglect relating to Noah and the care of his infant sister. Class 6 felonies are punishable by a minimum of one year and a maximum of five years on each charge.

    Ashley White, Noah’s mother, was also indicted on two class 6 felony charges. Additionally, the grand jury indicted her on a new class 4 felony charge for abuse and neglect relating to the care of Noah Thomas. A class 4 felony is punishable by two to 10 years in prison.

    Noah Thomas case: Trial set for January in father's case

    The father of 5-year-old Noah Thomas is scheduled to face trial early next year.

    Paul Thomas made a brief court appearance on Wednesday, when a judge set Jan. 25 for a one-day bench trial on two class 6 felony charges of child abuse and neglect in the care of Noah and the boy’s infant sister.


    Trial set for Noah’s dad; no date yet for mom

    The father of 5-year-old Noah Thomas, who drowned in a septic tank in March, will be tried in January.

    A Jan. 25 court date was set Tuesday for Paul Raymond Thomas, who faces two counts of Class 6 felony child abuse and neglect for leaving Noah and his infant sister home alone. The trial is set to begin at 9:30 a.m.

    A court date hasn’t been set yet for Noah’s mom, Ashley Jennifer White. She faces the same charges as Thomas, plus Class 4 felony child abuse and neglect because of the child’s death.

    Ashley White’s attorney files change of venue request

    According to the Pulaski County Circuit Court, White’s attorney filed for a change of venue on December 9. As of right now, a jury trial is scheduled to begin Feb. 8 in Pulaski County Circuit Court.


    Judge denies social media expert request in Noah Thomas case

    A judge denied a motion Wednesday to appoint an expert witness in the case of Noah Thomas.

    The attorney for Ashley White, the mother of 5-year-old Noah, asked the court to cover $14,000 to hire Mosaic Data Science.

    Mosaic Data Science is a company in Northern Virginia that was to analyze thousands of social media posts in this case.

    The company claimed it could identify posters and their locations.

    On Wednesday, White’s attorney said there are “thousands and thousands of Facebook posts and comments that are threatening and violent.”

    She said many of them call for White’s execution, and she has concerns that people would attempt to be seated as jurors who have no intention of being impartial, but rather want to convict White.

    Lawyer: Community "obsessed" with conviction and punishment of Noah Thomas' mother

    In court paperwork filed Tuesday, White's lawyer, Kelsey Bulger, says hundreds of television stories and dozens of newspaper articles have been a "continuous barrage of highly inflammatory media reports that far exceed the standard of fair and balanced coverage." Bulger subpoenaed news coverage of the case from WDBJ, WSLS, The Roanoke Times and The Southwest Times. Those efforts produced 250 broadcasts relating to Noah, Ashley White or Paul Thomas. The newspapers produced 65 articles.

    Bulger wrote that White cannot get a fair trial in Pulaski County. "Social media demonstrates a community that is warped by its desire for perceived retribution, one that is incapable of remaining unbiased in the face of continuing media reports and speculation fueled by social media." She will make that argument before a judge on Monday morning.

    Ashley White's trial is currently scheduled to begin February 8th. Paul Thomas' trial is scheduled for January 25th.

    Noah Thomas case: Jury selection to continue Tuesday

    PULASKI — The trial for the mother of Noah Thomas got off to a slow start on Monday, as lawyers spent the day interviewing potential jurors and eliminating those believed to have biases.

    The process was unusually meticulous, as the process involves the impact of extensive media coverage the child’s’ death drew in March when the 5-year-old’s body was found in a septic tank near his Dublin home.

    The defense has argued Ashley White’s trial shouldn’t be held in a community that has been exposed to what it says have been months of prejudicial news coverage. But a judge ruled that there will be an attempt made to seat a jury in Pulaski County — and that process began Monday morning.

    Pulaski County Commonwealth’s Attorney Mike Fleenor said he’s only seen one other county case use this kind of rigorous jury selection process, and that was for the 2000 slaying of Tara Rose Munsey.

    A total of 140 potential jurors were subpoenaed for the scheduled White trial — more than 100 of which appeared in court on Monday morning. Jurors have been questioned in groups of three, with each session lasting about 30 minutes.

    The court concluded for the day about 5 p.m. Monday, after 15 of 30 jurors questioned made it through the first round of screening.

    Jury selection will continue on Tuesday morning. Once 22 jurors have been selected, Fleenor said both the defense and prosecution will choose four that they wish to strike. That will leave 14 jurors, two of which will be alternates who will sit through the evidence but won’t help render a verdict unless called to fill a vacancy on the jury during the trial.

    Breaking: Ashley White Will Have a Bench Trial

    Ashley White, the mother of Noah Thomas, 5, will be tried in Pulaski County after all, but not by a jury of her peers.

    White is charged with felony child abuse and neglect in the death of her son and care of her baby daughter.

    After a two day struggle to seat a jury, Judge Bradley Finch granted the defense counsel request for a change of venue.

    Citing Virginia case law, Finch noted the quote "difficulty in seating the jury" and the extremely large percentage of jurors that have knowledge or connections to the case beforehand, weighed heavily in his decision to ensure White receives a fair trial.

    After the ruling prosecutor Mike Fleenor asked for a bench trial - a trial by judge, as opposed to a trial by jury:

    White and her attorneys agreed and the new trial date is set for Thursday at 9 a.m.

    Prosecutors expect to bring some twenty witnesses to testify.

    Ashley White trial: Investigator says there was small marijuana growing operation inside home

    The investigator did not see the evidence in person. However, based on photos and experience, the investigator felt there was a small growing operation in the home.

    Investigators found a fluorescent light and lining inside of a closet. They also found dried leaves on the floor and other marijuana inside the house.
    Carolyn Guerin with the FBI testified that when she arrived at Ashley White’s home and opened the door of the trailer, smoke came out. Guerin arrived at the home around midnight March 23, several hours after Noah Thomas went missing on March 22.

    Guerin said she searched inside the home and found a wooden box in a kitchen cabinet. The box contained a substance and a pipe.
    Amy Tharpe, the assistant medical examiner, said again that Noah died from drowning, with hypothermia contributing.

    She couldn't confirm Noah actually drowned in the septic tank where he was found dead, but said foreign material was in his lungs. She said he had three cuts on his left side that were recent and bruises on his legs.

    PULASKI COUNTY, VA (NEWSPLEX) -- The mother of five-year-old boy who was found dead in a septic tank has been convicted on three charges.

    According to WDBJ, Ashley White was found guilty Friday on three counts of child abuse and neglect for the death of Noah Thomas.

    A Pulaski County judge convicted her after two days of testimony.

    Earlier this week, attempts to seat a jury for the case failed, and lawyers from both sides agrees to proceed without a jury.

    Thomas was found in the septic tank near his Dublin home in March 2015, days after he disappeared.

    White is scheduled to be sentenced May 16.

    Her boyfriend, Paul Thomas, will stand trial next month.

    Will this be it unless they get more evidence?
    Perhaps an unattended child could accidentally fall into the septic tank, but he did not replace the cover from inside there. So who did?
