Evelyn Boswell's Law takes effect Thursday; requires parents to report missing child within 24 hours​

A new Tennessee law taking effect this week will require parents to report their child's disappearance within 24 hours of determining that the child is missing. It applies to children 12 years or younger.

The law is named in honor of Evelyn Boswell, the Sullivan County toddler who was reported missing in February – even though she hadn’t been seen since December.
Such a great law! I wish it was federal. All states need to adopt this law in my opinion.

Megan Boswell is set to face trial in fall 2022 in connection with the death of her daughter, Evelyn Mae Boswell.


During a Sept. 30, 2021, status hearing, Judge Jim Goodwin set a trial date for Sept. 26, 2022.

noted they expected the trial to take three to four weeks, including jury selection.

Goodwin also advised the attorneys to block off the previous week in case the trial is moved outside Sullivan County or a jury is brought in from another county. The child's disappearance was a national news story.

Megan Boswell faces a total of 19 charges in the death of Evelyn Mae Boswell, including felony murder and aggravated child abuse.

Prosecutors announced in January that they will not seek the death penalty against Megan Boswell in her daughter's death.

Friday marks two years since Evelyn Boswell was reported missing​

Friday marks two years since Sullivan County toddler Evelyn Boswell was reported missing.


Last month, a judge decided not to lower Megan Boswell’s $1 million bond. She remains housed in the Sullivan County Jail.

Another court hearing is scheduled for April 7. Her trial is scheduled to begin on Sept. 26.

The prosecution has filed a motion in the case of Megan Boswell to allow photos of the remains of baby Evelyn Boswell to be admitted in the upcoming trial.

"The photographs the State seeks to introduce, to be filed separately and which have been provided to the defense, are relevant to the elements of deliberation and premeditation, and their probative value outweighs the inflammatory nature of the photographs. The photographs are clear and accurate, and testimony alone would be inadequate to relate to the jury the facts illustrated by the photographs."

The next hearing in the case is set for April 7.

There should not even be a QUESTION that such things be allowed. Why IS there? This kind of thing maddens me. The baby is dead. The remains are there because the alleged perp put them there. This is evidence as to how they found the remains. Autopsy photos are also evidence. What is this "inflammatory" sh*t? What is inflammatory is what any perp DID to begin with.

A jury is picked on a basis of being able to take what they are to take from testimony and evidence. If I see a picture as a juror that inflames me as to what was done to the child, of course it would be upsetting but it wouldn't make me convict someone they didn't convince me was the one who did such to the child. Etc.

DEFENDANT'S RIGHTS AGAIN gone too far. You also NEED EVIDENCE. Enough gets barred that should come in sometimes.

I don't know. I think Covid was "used" for one thing and I can't even say if I recall correctly that the defense has delayed it in this case. I think the court just stalled for the most part. After that, the public defender may have asked for some time, I can't recall. But in this one there haven't been any defense games really that I have noticed. And I don't think this young girl who murdered her baby has been anything but cooperative that I am aware aof.

Don't get me wrong, she killed her little girl and lied about it but this one bothers me some in that she sure didn't come from anywhere she could turn. Her mother was arrested during this thing more than once (drugs, stealing from her own father/the defendant's grandfather) and the baby's father was not doing his part although that isn't said or touched on much.

She is guilty don't get me wrong but I don't see her quite as some. And she hasn't as far as I know been any problem once arrested and I'm guessing is realizing she is going to likely spend the rest of her life in prison. I guess we will see what the defense says or does.

She does need to face the consequences though, I don't mean she doesn't, but I don't think she or defense games have delayed this one to speak of.

I think it said the next hearing isn't 'til June and then I think there is one in July. This is another very SLOW moving case. Well past 2 years already...

So the defense argued/complained that it took TBI months to process a crucial peace of evidence. Clearly then the defense thinks it shouldn't take that long.

But in the next breath they need more time and months (shouldn't take that long right) for what? To have their expert give an opinion on the same evidence... Or to find an expert to do so is I guess what they said... Still how long does that take unless of course they mean shop around until they find one to offer a different opinion...

Either way on one hand they say it shouldn't take so long and then they ask for as long or longer... Smh.
 

Forensic pathologist testifies Evelyn Boswell died by asphyxiation​

An expert in the field of forensic pathology took the stand in Sullivan County court Friday afternoon and shared new details in the death of toddler Evelyn Boswell.

Evelyn’s mother, Megan Boswell, has been charged with a string of charges, including two counts of felony murder. At Friday’s hearing, the court heard arguments for certain photographs to be used as evidence after Boswell’s attorney, Brad Sproles, had objected to using some of them.

After hearing testimony from an agent with the Tennessee Bureau of Investigation (TBI), Dr. Darinka Mileusnic-Polchan took the stand. Mileusnic-Polchan is the chief medical examiner for Knox and Anderson counties. She also has an active license to practice medicine in Tennessee.

Mileusnic-Polchan said she found that Evelyn’s cause of death was asphyxia in four different places. She also said that it was, in her opinion, a homicide.

In TBI Agent Brian Fraley’s earlier testimony, he said that Megan Boswell had previously said Evelyn died in an accident while co-sleeping with her and her then-boyfriend.

Mileusnic-Polchan refuted that statement, saying Evelyn was too old at the time of her death to have died in such a manner, and the environment was not conducive to that type of death. According to Mileusnic-Polchan, there was a “mechanical obstruction” to Evelyn’s airway in the form of foil, and a blanket had been tightly wrapped around her head.

In addition, Mileusnic-Polcha testified that being in the trash can in which she was found was another form of asphyxiation.

She went on to testify that the photos being discussed as potential evidence give a complete picture of the manner in which Evelyn died, as well as the placement and condition of her body, which had started to decompose.

I really figured this one was a loss of control but just for an instant, not a continued thing. Not liking these details!!
 

Megan Boswell’s attorney files motion to withdraw as her counsel​

The attorney for Megan Boswell, the Sullivan County woman accused of killing her 15-month-old daughter, has filed a motion asking the court to let him withdraw as her counsel.

Brad Sproles, Boswell’s public-appointed defense attorney, filed the motion on Wednesday claiming that “the attorney client relationship has deteriorated to the point that counsel is unable to effectively and zealously represent the Defendant in this matter,” according to court records.

“Despite the efforts of counsel and the Defendant to rehabilitate the same, the attorney client relationship is not salvageable,” Sproles said in his motion. “Therefore, counsel respectfully requests that he be relieved from further representation of the Defendant, and that the Court appoint her suitable counsel to continue in her defense.”

Sproles is also requesting to stay on the case temporarily in a pro bono status in order to help Boswell’s new attorney with the transfer and organization of case materials.

Last month, the judge over the case denied a request by Boswell to part ways with Sproles.
