Missing San Antonio Mom And Baby May Be In Danger, Police Say​

San Antonio police believe a young mom and her baby who have been missing since January may be in danger.

Twenty-year-old Dlanny Chairez and her 18-month-old son, James Avi Chairez, were last seen January 4 in a store in the 7100 block of Marbach Road.

“Through the investigation, detectives now believe they might be in danger and urge anyone with information to contact the San Antonio Police Department Special Victims Unit,” said SAPD officer Alisia Pruneda.

A mother and baby’s disappearance has a family member fearing the worst​

A San Antonio woman is hoping for the safe return of her niece and 18-month-old great-nephew after the two disappeared last month.

San Antonio police said Dlanny Chairez,20, and her son James Avi Chairez, were last seen in the 7600-block of West Military Drive.

Mariesol Gomez said she has tried constantly contacting Chairez but has not received a response.

“She left everything behind,” Gomez said. “It was all in drawers and on the floor. James’s clothes, diapers and toys. Everything.”

The family of missing toddler James Avie Chairez is waiting for answers after investigators said an autopsy of the human remains that were found last month won’t happen until at least July 1st.

The human remains have not yet been identified by the medical examiner.

James’ great aunt, Mariesol Gomez, said the remains were found underground, near the walkway of the main entrance to the mobile home. She added that the DNA of the remains should be revealed soon, but the autopsy isn’t expected to take place until at least July 1st.

“We want the public to know that we’re fighting still for James,” Gomez said. “Right now, not knowing what happened to him and not knowing that it’s him, it already hurts.”
I am guessing they just mean that results of the autopsy overall will not be released until all is back, whether tox, further exam by perhaps a specialist of sections/slides, etc. If that is not the case, I don't understand it either. Autopsies are usually done almost immediately.

If the remains are "unidentified" I wouldn't think they'd need consent or anything for autopsy...


I would think GrandmaBear would probably right, that the autopsy itself has been done, but the results of it will not be released until July. But the exact wording said "the DNA of the remains should be revealed soon, but the autopsy isn’t expected to take place until at least July 1st". Which throws me off. It could just be that someone is misunderstanding or mis-relaying the information. But I can't imagine having a child's remains sitting around for months prior to autopsy...

The search for missing baby James Chairez is over, according to the baby’s family.

In a statement, the family confirmed that human remains found in April inside a West Side mobile were identified as James.

“This is a really hard video to do right now,” James’ great-aunt, Mariesol Benavidez-Gomez said in a Facebook video she posted Wednesday. “It’s a positive test. The remains that were found at the mobile are James.”

Benavidez-Gomez said authorities did not give her any additional information. Investigators are still working on determining on when the baby died and what his cause of death was.


Police also confirmed the news of the remains on Wednesday.

“This is an ongoing investigation and at this time we have no further information or comment to release,” the department released in a statement.

Family of baby James Chairez disappointed at possibility of D’Lanny Chairez being released from jail​

The family of baby James Chairez protested outside the Bexar County Courthouse Wednesday over the possibility that the baby’s mother, D’Lanny Chairez could be released from jail.

“Her silence has shown me no other reason to believe that she’s guilty, and for her to have the opportunity to walk with me and you next to each other, you know, that’s just disgusting,” baby James Chairez’s great-aunt Mariesol Benavidez-Gomez said. “I’m not saying I’m wishing her ill will but she is safer in there than she is out here.”

Benavidez-Gomez told KSAT that D’Lanny Chairez’s attorney contacted a family member asking if they could take her in if she was released from jail in the coming weeks, but the family member refused.



Before his remains were found, D’Lanny Chairez was already in custody on a charge of tampering with evidence and had her bond reduced to $150,000.

She has not been charged with the baby’s death.

The hearing has been reset for a later date.
 
What? Released? I get for some reason they do not have a murder charge on her yet but is this not the case where she said he was adopted out or with someone caring for him or some such and then they found his remains on her property?! And she was seen riding a bus when they could not find her without her child with her?? And LE called in the zoo of all places when they found him?! I get innocent until proven guilty but our system needs some darned common sense that does not tie LE's nor judge's hands and if, God Forbid, a judge had a choice and is letting her go anyhow, then I fail to understand that. Did someone pay her bond or they just can't keep her or make anything stick?? She lied as to his whereabouts and whether she did it or not (I have my opinion on that but not proven), she is involved and he was not adopted nor did she place him with someone and she KNOWS it. Lord Have Mercy. Where are the rights of victims and some common sense in the law and procedures?

You know if she lost it, then give it up and feel some remorse and plead for mercy when it was first realized there was a missing child--her own baby boy, a year and a half old. Face it and deal with it, it still wouldn't be right but take accountability young, stressed, etc. Continued lies and a hiding of the body.

And I still wonder what this zoo sh*t is. Never ever have I heard of a zoo being called in!!! Not a happy camper this week. Apologies.

A custodial battle has started over the cremated remains of baby James Chairez.

The toddler's remains were found in May at his mother's trailer several months after he was reported missing.

His mother, D'Lanny Chairez, is charged with evidence tampering, we're learning his autopsy is complete but the results are still pending as the investigation continues.

Meanwhile, D'Lanny's aunt wants possession of the remains for a funeral, but until she is charged with her son's death, D'Lanny still has parental rights and doesn't appear to want to sign them over.

"I wrote to her and I told her, are you serious to me, You know you you want his remains I said what are you planning on doing with them," Aunt Mariesol Gomez said. "Please don't do this to us you, know please let him come home, let us have him, and I even, I even offered to pay for him. If I have to pay for him. I'll pay for him, if that's what she wants, but that's just going to show how evil she is."


This July 16 would have been Chairez's second birthday.

"I want him to know that just because he's not here doesn't mean that he's forgotten. He will be celebrated every year. So, my last breath, I will always celebrate his birthday."
 

Mother of baby James Chairez in court Friday, attorneys requesting a speedy trial​

A quick Zoom hearing took place for D’Lanny Chairez on Friday about the status of the tampering with evidence case against her.

In Friday’s hearing, that took place on Zoom, Chairez’s attorney William Simmons said they were ready for trial and want it to happen immediately.

“We are ready as of today on the tampering with evidence charge,” Simmons said.

144th District Court Judge Michael Mery said he respected Chairez’s right to a speedy trial but couldn’t set a trial date yet because of the current moratorium restricting in-person jury trials from taking place.

Last month, Chairez’s attorneys requested a PR bond, but Mery denied it.

D’Lanny Chairez has not been charged with the baby’s death.
 

Remains of baby James Chairez released to family members​

The ashes of baby James Chairez were released to his family Tuesday, nearly four months after the remains were found.

Baby James was first reported missing on Jan. 4. His body was found on April 28 in the trailer where he lived with his mother, D’lanny Chairez, in the 7600 block of West Military Drive, though police had searched the home multiple times before that date.

D’lanny Chairez was arrested for tampering with evidence. No other charges have been filed against her.

The family says they are planning a funeral for baby James next month.
 
It’s been nearly sixth months since the remains of Baby James Chairez were found by investigators.

His relatives remain hopeful one day answers will come.

The boy's mother was arrested in connection with his disappearance, but in-person jury trials have been on hold since august due to the recent COVID surge.


Online court records show a trial date was set for August 20th.

But surges in COVID cases halted in-person jury trials earlier that month.

“I’m hoping that yes they do open up soon so we can start getting this rolling,” Gomez said. “Let’s figure out what’s going to happen, find out what happened to James.”

In-person jury trials are on track to get started on October 4th.

Gomez says she hasn't gotten word of a new trial date yet.


All the judges pool everything together and they try cases back to back to back.

He estimates it shouldn't take more than a year to catch up on the case backlog.
 
You know, maybe the courts start needing to think what they are going to do if Covid and such shutdowns and other things would continue to occur as they have. I mean I'm sure there is some alternative that would work like a compartmentalized plexiglass jury box or something. I have no bright ideas but sure there are people out there that could come up with the perfect answer. Jmo.

There are definitely options. I think people are scared to try any of them. They're afraid that someone will be able to come back with an appeal and say that they didn't get a "fair trial" because of various atypical regulations. But it's getting to the point where they're going to have to start doing something or this "year to catch up" will turn into much longer than that.

I agree. Not to go too off track here but if this is going to be a reality or stay a reality at least for a while, shutdowns due to Covid or any virus, etc. need to not be the only answer and not just courts but deliveries, businesses, people need to find a way for things to continue despite it and adapt safety measures or something so life can proceed. As long as jurors can be seen, are present, can discuss, etc., then I would hope any judge worth their salt on appeal would deny such a ridiculous claim.
 
Felony charges pending for baby James Chairez's mother, family waiting for answers
Devastating news for the family of baby James Chairez, the 18-month-old whose remains were found underneath his home in May, has come in.

We spoke with the baby's aunt who says new charges are pending against her niece.

"She would have a felony charge, but that's only because of that, she had something to do with James's death," Gomez said.



The next big step, laying Baby James to rest later this month and keeping his legacy alive making sure no other child suffers the fate he did.

Her plan is to create the James Avi Scholarship.

"We're gonna hand it out to one recipient that has come from an abused home,” Gomez revealed. “Hopefully you know, somebody's story can reach someone else's family in hopes that this won't happen to them again.”

We've reached out to the detective on the case, asking what charge D'Lanny will face and are waiting to hear back.

For now, family is opening up baby James' services to everyone. The service is Oct. 22 at 4 p.m. at St. Gabriel’s church.
 

San Antonio says goodbye to James Chairez, baby found dead in west-side mobile home earlier this year​

On Friday the San Antonio community said its final goodbye to young James Chairez, the baby whose remains were discovered in May at the west-side mobile home park where he lived with his mother.

Funeral services were held at St. Gabriel's Catholic Church. Mariesol Benavidez, James's great-aunt, said it was her way of honoring his short life.

A mother accused of tampering with evidence in the death of her infant son was in court on Thursday.

D’Lanny Chairez now has a trial date set for next year.

So far, D’Lanny Chairez has been charged with tampering with evidence with intent to impair. During Thursday's hearing, her defense lawyer said that they are still waiting on evidence and discovery.

The judge ordered that evidence to be expedited.

A trial date has been set for Jan. 13.
