Missing toddler last seen in Virginia Beach considered to be in ‘extreme danger,’ state police say​

Police are searching for a 3-year-old North Carolina girl said to be in extreme danger after she was believed to have been last seen Friday morning at her grandmother’s house in Virginia Beach.

According to a news release from the Virginia Beach Police Department, Samalea Monet Daniels was taken from her father’s house in Mecklenburg County, North Carolina, by her mother, who also lives in Virginia Beach.

Samalea is said to be with Tianna Mila Daniels, 29, in a grey 2011 Ford Escape. The vehicle’s tag number is N4M45T3. Samalea is said to be 2 feet, 10 inches tall with brown eyes, but is is unknown what she may have been wearing. She is estimated to weigh about 25 pounds.

Tianna Daniels is 5-foot-6 and 130 pounds. She has hazel eyes, and it is unknown what she may be wearing.

Police say Samalea was initially reported missing in North Carolina on June 20.

Samalea's father contacted Virginia Beach police detectives on July 14 about the missing report he had filed in North Carolina, according to officers, and an order was issued by a Virginia Beach judge for Samalea to be returned to her father.

Virginia Beach police say Samalea was taken from her home in Mecklenburg County, North Carolina, where she lives with her father who is her legal guardian.

Samalea was taken by her mother, 29-year-old Tianna Daniels, according to police, and was last seen at her grandmother's house on Stonington Court in Virginia Beach.

The two may be traveling in a gray 2011 Ford Escape with Virginia plates N4M45T3.

 

Search continues for endangered toddler from Mecklenburg County​

The last time three-year-old Samalea Daniel’s father saw her was June 19 in the Steele Creek area.

The father tried to report her missing several days later July 1, according to a police report obtained by investigative reporter Madison Carter.

The Charlotte-Mecklenburg Police Department closed on the case on July 5 after determining the child was likely not in its jurisdiction.

There is a nearly two-week gap before her father showed up at the Virginia Beach Police Department on July 14 with a court order stating the child should be in his custody.

The girl was last seen that morning at 9 a.m. at her grandmother’s Virginia Beach home.

Police think the girl’s mother, Tianna Daniels, took her that day at some point after the court order was secured.

Virginia State Police announced an endangered person alert later on July 14 with information about the disappearance and what kind of car the mother might be driving.

Carter asked the agency why an Amber Alert was not issued and learned authorities did not believe this case met the criteria for one.
 
They keep saying this child is in EXTREME danger and yet she is with her mother and they couldn't issue an Amber Alert. They fail to explain why they think the mother would put her in extreme danger or why she is.

I want her found don't get me wrong but the use of these words makes them start to lose their meaning and grab attention when something is. She may very well be but they should be explaining why. And it should be on some MAJOR alert and news status etc. And a PD closing on a case as not their jurisdiction and a two week gap before notifying another seems also to not fit extreme concern...

In one breath, they say she is in EXTREME DANGER, and then in that same breath that she does not qualify for an AMBER Alert.
If she is in extreme danger, she certainly meets the criteria.
The father was given custody for a reason. And I don't think we need to know the details. But the contradiction is something else.

Exactly. Entirely contradictory. They are overusing these words OR she is in extreme danger in WHICH case this isn't being alerted widely nor with an Amber alert or pushed.

I don't need to know why he has custody, but whether she is likely in danger because mom is a danger OR if he simply won custody in an ORDINARY custody battle, it isn't unheard of, with mom upset no danger to her child at all. There are such scenarios. They are hot battles, emotional with one side often lying or even both in the battle for the child/ren and courts are largely worthless in assessing such imo.

To not sidetrack further, YES, they are talking out of both sides of their mouths.

It appears the father, Jalen Davis, who has custody of the child, was last with his daughter on Father’s Day, June 18.

He said the biological mother, Tianna Daniels then took off with Samalea the following day.

Jalen Davis told 10 On Your Side that he would follow Tianna from North Carolina to Virginia Beach, and said he saw her going into Tianna’s grandmother’s home on Stonington Court.

He called police, and when they showed up, Daniels and Samalea were gone.

“Tianna and Jalen’s relationship is toxic,” said Daniels’ grandmother, Greer Long. “They should never have been together. As a couple, they tried and tried to be a family, but it never worked. Sometimes, it’s best to go your separate ways.”

10 On Your Side asked Davis about whether he really thinks his child is in extreme danger, as noted in the messages from police.

“The police at first used extreme danger,” Davis said. “I wish they would still use that because that would give the go ahead for the Amber Alert, but right now, they do not think it meets the criteria for an Amber Alert. They changed it to endangered. Either way, it’s been dragged out a long time.”


Long remembered when Davis and the officer came to the door.

“It was one officer and Jalen was with her,” Long said. “I didn’t let them in. They wanted to know if Somalea was there, and I said no. Last time I saw Tianna was when I took her to court.”

That was a court hearing dealing with this issue.

The mother (Daniels) and the father were to appear in court July 14, but she left before court was to begin, and Virginia Beach issued a missing child report.

“She was supposed to get served on that Friday with an affidavit to give me my child,” Davis said, “and for her to get remanded, but by her leaving before she actually had a chance to go into the courtroom, it pretty much set in motion everything else that has happened.”

Long and other family members insist 3-year-old Samalea is not in danger, or extreme danger or at-risk.

“No, she is not in danger at all,” Long said.

Why are they putting out there that she is extreme danger when she is in the company of her mother?

“I have no idea,” Long said. “That’s their side to this.”

The problem is that Daniels disappeared from a court hearing, and she’s been in court before.

According to Norfolk court documents, she is on a deferred disposition for assault and battery on a family member until next April, when the charge could be dropped on good behavior.

This incident doesn’t help her cause.

“She has a tendency to make rash decisions and none of them make sense,” Davis said. “When she took my daughter, she had no reason to.”

It sounds to me like the father did not have custody until this hearing that day AFTER she took the child so it has been a bit muddled likely mostly by one side as if the mother had no right to her child when in reality it was likely being fought both ways and actively so by the minute.

Since he had not had the child since almost a month before, clearly she had a right to the child or was keeping the child from him while both were fighting that in court most likely.

If you ask me the child isn't in a great place whether with mom, with dad or both in such a relationship as both parents are making her life he77.

Whether she is in danger or not remains debatable but clearly no reason has been shown to show she is in extreme danger. NONE. They shouldn't use these words and such should be saved for those who clearly are. and not overused with no reason.

Normally though they have found the child and parent in something like this by now and in short order. And they haven't.

Newly released footage shows 3-year-old Samalea Daniels' mother, Tianna Daniels, loading up her car near Charlotte's Steel Creek community.

Samalea's dad, Jalen Davis, told 13News Now that Tianna took Samalea from his North Carolina home while he was at work. He reported Samalea missing out of North Carolina exactly a month ago, on June 20.

Davis said Samalea has been in his care for two years and he's been trying to get law enforcement involved in this custody battle. After Samalea's disappearance, a judge filed a court order for Tianna Daniels to return the 3-year-old to her father.

Davis said he's worried about the living conditions his daughter could be in.

"I don't think that [Tianna] would hurt her on purpose," Davis said. "But I do believe that she could hurt her accidentally or hurt her indirectly."

 
I don't know what's going on here but I'm liking him less and less. Most likely scenario is both parents need to quit their b.s. but he is striking me wrong.

Been trying to get LE involved in the custody battle or so it sounds or in this taking of the child, I sure don't know what he means. She IS the child's mother and it is very unclear if she is even in the wrong here.

He says she has been in his care for two years but does not say he had CUSTODY. We also know or so it was said the last time he'd been with her was Father's Day. Sure doesn't sound like someone who had her for two years. And is he saying he had her for two years and mother was never with her or had her in those two years?

Clearly this was an ongoing hearing after hearing probably custody battle. Hard to know where the truth lies.

IS mom in violation of something that was in effect at the time? There seems to be little indication of that I can see. Do we have any warrants, etc.?

You know I hate to say it but I'm not sure she is breaking the law or that they can investigate or charge her with anything.

To me it sounds as if there was a heated custody battle, and probably before some hearing, their lawyers went back and forth and maybe reached some tentative agreement and told the court SO either they reached one and he means papers weren't drafted when she took off OR they hadn't reached one. In either case, she likely isn't doing anything wrong.

IF there is a current order in place as to her visitation time or custodial time and she took the child against that and on his time then she is violating the visitation agreement, etc. but that is IF there is or was one.

I think he's had so much trouble establshing it because HE is the one saying it only.

Is there proof that she went missing with the child? I forget.

Yet in this same article it says the same day the father established legal custody. That'doesn't line up with an "agreement". It would line up with a court order to be issued over a hearing where he was granted custody.

Something isn't making sense here is all I'm saying. And if he and her made some agreement and it was never signed or incorporated as an order of the court, then there is no agreement or custody for him.

That depends. If they had a custody arrangement of any kind, she can be charged. Even if it was an implied arrangement in some cases.

You may be surprised at the number of parental abductions where sole custody is NOT established prior to the child going missing. But if a parent breaks a custody agreement where the other parent is supposed to see the child (at all), a judge will often award sole custody to them after the fact. It happens all the time.

She may have had rights to see Samalea and even care for her at times. But the second she took her away from her father, who also has rights, it's a crime and a judge awarded custody to her father.

Maybe with interference of child custody or violating visitation rights or some such, not so sure of kidnapping or anything even approaching a felony and giving it that kind of status and investigation I guess is more along the lines I am talking of.

And most of the info comes from him not LE. And clearly he had to run around and wasn't getting anywhere, probably for a reason and not just jurisdiction but because it isn't a clear cut matter by a long shot most likely.

Then there was the whole "endangered" thing when not a thing indicated that.

I can't know of course but he just comes across as a certain type and part of a big reason this child was in such a messed up fight. While she may well lose out due to her action, I certainly as a judge wouldn't be granting this man custody the way all looks either right now.

She very well could be in danger and very well not being taken care of well, so I'm not denying the need for concern just because they haven't been found though, but that remains to be seen.

I'd say both parents better shape the he77 up if they don't want their child in the system and in control over their child and them, a very imperfect system, with neither parent being able to have a say. Is that what they want? Imo that's where it is headed.

I don't see any reason to think he is fit just because mom took her that she should go to him.

I think they are in a grey area as to court orders or agreements most likely and that's also why they use words like endangered and stuff or did but can't and won't go all out. Was she really this successful at eluding LE and still? Chances are they don't even have enough cause to track her accounts. Possibly.
 

Missing child last seen in Virginia Beach reunited safely with father after several months, police say​

A 3-year-old reported missing from Mecklenburg County, North Carolina, and last seen in Virginia Beach has been returned to her custodial parent, police said.

Tianna Daniels, the mother of the child, Samalea Daniels, was taken into custody Wednesday at the Mecklenburg County Courthouse for an outstanding warrant, the Virginia Beach Police Department said on Monday.
