Bigsby murder trial updates: Mother of missing Codi says Cory ghosted her after handing kids off to him in 2020

Jury selection wrapped up first thing Wednesday morning, as the Hampton murder trial of Cory Bigsby entered its third day.

On the third day of the trial for Cory Bigsby in Hampton, testimony is underway.

Jurors are hearing from the mother of Codi, Dina Abdul Kareem after prosecuting attorneys called her as their first witness.

She took the stand and appeared to be struck by emotion — having to identify the defendant and her ex, Cory Bigsby, as well as a photo of her missing son Codi.

They share four children, including Codi, who Bigsby reported missing in January 2022.

In court Wednesday morning, Kareem spoke about custodial disputes with Bigsby. Those ultimately led to what she calls an agreement on co-parenting. Kareem, who moved to DC, testified she handed off their four children to Bigsby at a halfway point from Hampton in November 2020.

From then on, Kareem testified Bigsby, for the most part, ghosted her. She said she didn’t have access to her children, despite her attempts to reach Bigsby.

I'm sure others here are praying for justice for this boy too. Pretty darned silent thread though.

Hopefully others are praying for justice though with a trial that is now active and underway.

Cody MATTERED. Trial is underway and justice needs to result. RIP Cody.

HAMPTON, Va. — The Hampton man accused of murdering his son, 4-year-old Codi Bigsby, and hiding the body is in court this week for what is expected to be a week-long trial.

It's one of the more significant trials for the city of Hampton in recent years, and not just because of the high-profile nature of the case. It is also one of just four 'no body' murder trials to ever take place in the Hampton Roads region – a trial that goes before a judge or jury without the physical evidence of the victim’s body.

Here's a closer look at the judge presiding over this trial, as well as the prosecuting and defending attorneys.

Hampton Circuit Court Judge James Hawks

The judge presiding over the trial was assigned to this case in July 2022. Judge James Hawks is a retired judge and was brought in specifically for this case. He spent more than 30 years as a defense attorney in Portsmouth. He also served 8 years on Portsmouth City Council before ending his career in that city as a Circuit Court Judge from 2006 to 2016. Both the Commonwealth’s Attorney and the defense attorneys are familiar with Judge Hawks by now. They have gone before him a number of times for different motions in this case. Notably, Judge Hawks decided last summer to grant Cory Bigsby bond after he had been denied bond six times as he awaited trial.

Cory Bigsby's defense team

Cory Bigsby's defense team includes Amina Matheny-Willard, who has really been the face of the defense up to this point. Matheny-Willard started representing Bigsby in April of 2022, after his previous attorney filed a motion to withdraw because of “an ethical conflict.” However, this week, Curtis Brown is the lead trial counsel. He is joined by Ken Singleton and Peter Hansen.

Hampton's prosecuting attorneys

On the other side of the courtroom, the prosecution is led by Hampton Commonwealth’s Attorney Anton Bell. Bell has led that office since his election 12 years ago, and this is possibly the highest-profile prosecution of his career. He brought charges in a similar case against Julia Tomlin for the 2019 murder of her 2-year-old son, Noah Tomlin. But that case never went to trial. Tomlin pleaded guilty and is now serving 55 years in prison.

HAMPTON, Va. — Jury selection wrapped up first thing Wednesday morning, as the Hampton murder trial of Cory Bigsby entered its third day.

Bigsby is accused of murdering his 4-year-old son, Codi Bigsby, and concealing his body roughly seven months before filing the missing person report to Hampton Police Division in early 2022. The boy’s body has never been found.

On Monday and Tuesday, court officials examined a group of 68 potential jurors with the goal of selecting 12, as well as two alternates. That process was completed Wednesday, and opening statements as well as witness testimony got underway.

The prosecuting attorneys for the case are Hampton Commonwealth’s Attorney Anton Bell and Senior Assistant Commonwealth’s Attorney Dylan Arnold. On the defense representing Bigsby are Curtis Brown, Amina Mathey-Willard, and Kenneth Singleton.

3:45 p.m. — Officers testify about responding to missing report for Codi

Two responding officers testified they met Cory Bigsby at 9 a.m. on Jan. 31, 2022 to field his missing persons report for Codi.

After speaking with Bigsby, the police officers said canines assisted in the search through the apartment and nearby areas. One of the officers testified they searched through the entire apartment, in places where a little kid could be hiding, as well as nearby woods. They also knocked on neighboring doors and searched through garbage cans.

A handler for a tracking dog testified his canine didn't pick up any scent belonging to Codi – despite saying he received a pillowcase from Bigsby that the child allegedly used just the night prior.
However, a handler for a cadaver dog testified his canine alerted to the scent of human decomposition or remains in one of the bedrooms inside the Bigsby home. That cadaver dog, according to the handler, also detected negative results from some rancid animal meat in a mini fridge.

The witnesses so far are all from the prosecution side. Witness testimony should continue at 9 a.m. Thursday.

Appreciate the updates, they are a Godsend when no time. Same with Harmony's case, I counted on them even though Id I'd have chances here and there to see some of that and made a point to watch a lot each night.

Is this one televised? I am assuming not?

HAMPTON, Va. — Witness testimony is expected to continue Thursday in Hampton Circuit Court, as the murder trial of Cory Bigsby enters its fourth day.

10:00 a.m. - Testimony continues, Codi's 7-year-old brother expected to testify

It's the fourth day of trial for Cory Bigsby in Hampton. We're expecting prosecutors to call more witnesses to the stand, with Codi's 7-year-old brother expected to be the first on the stand.

It all comes after the boys' mother testified yesterday. At one point, she said her ex, Cory Bigsby, threatened to hurt Codi.

Kareem said an email from Bigsby on April 2021 read, "I do not want to severely hurt him to protect my babies. He needs to see a psychiatrist. He needs to come with you."

Kareem also told jurors she emailed Bigsby on January 15, 2022, saying in part, "Where are my kids? I just want to ask if they're alive."

12 p.m. - Codi's 7-year-old brother testifies

In court, the child described his missing brother Codi as his "best friend," sharing that he nicknamed Codi "Coco."

The boy testified he was four when he last saw Codi. At times, the boy rubbed his eyes while appearing to cry. The jury and court spectators are seeing him testify through a webcam feed.
This testimony comes a day after his mother also took the stand.

On Wednesday, Dina Abdul Kareem said in court Cory Bigsby kept their four children away from her in Hampton. While in Bigsby's custody, the now 7-year-old brother said he couldn't play with Codi sometimes because Codi was "on punishment."

The boy recalled his father spanking Codi often, and only Codi out of all the siblings.

During opening statements, prosecutors said evidence in this case will show the "systemic abuse" Codi faced while in his father's custody – and ultimately his death.

Meanwhile, defense attorneys say there's no evidence to prove a murder took place, which is the charge Bigsby's on trial for this week.

I couldn't swear to it but thought it was not going to be live for some reason. Should be, all should be imo. I agree though, I don't think it is. Thank God for reporters that attend, sometimes we don't even have that.

Mom's testimony breaks the heart and apparent PROOF of emails and such.

I couldn't decide between a hug,a sad or an angry face.

He is SEVEN. He himself is a baby but not, because he got stuck into real adult sh*t. He's a hero imo.

I don't think any of these kids had it great from things I recall early on but Codi was probably the one he couldn't handle, tame, make obey, leave home alone with all the others.

This man and this case isn't it the one where one judge recused himself and every single county judge? And where one of his attorneys quit because of what was it, I just read it earlier today... I think he is bad news all around. AND his family defends him if I recall as if they all and he think I don't know what... That THEY hold the power or watch out or something... Hard to read between the lines on that sh*t...

And they had to bring in a reserve or retired judge or whatever...

JUSTICE for this BABY I pray. And prayers for his siblings in being in a better place and getting through all this. Thank goodness they let this 7 year old testify by cam because it did not used to be that way and still is not in many cases YET the defendants recently can choose not to appear. Smh.

Appreciate the updates or I'd know nothing. Haven't seen anyone covering it although haven't looked hard either and I don't Twitter/X, etc.

12:30 p.m. - 7-year-old brother testifies Codi was found unresponsive, bruised at one point

Editor's note: We want to warn you that some people may find the details of the boy's testimony that we report here disturbing.
The now-7-year-old brother of missing Codi Bigsby testified that at one point, he wasn't able to wake Codi up. He said he shook Codi, but he never responded, and that his face was red and bruised.

When the child went to tell his father, Cory Bigsby responded with "Nothing is wrong with Codi."

It's unclear when this incident happened.

The defense is in the middle of asking questions to the boy testifying right now. Bigsby's attorney appears to paint the boy's recollection of events as inconsistent.

I put the short update version of Codi's brother under a spoiler because of the editor's note. We have read/heard much much worse. Just click on the maroon box to read.

My heart goes out to this very young lad, to even have to be there to tell his story about his brother. So very sad.

Do I follow this correctly? He/his atty claims his confessions well over six months later were due to trauma from his days at the PD more than six months earlier? Well that's a great argument. Not. Smh, his son is the one who underwent TRAUMA..

Ya know, defendants have and should have rights but I am so sick to death these days of this new wave of it is NOTHING but the defendant. It already was not about the victims and all about the defendants but it has become WAY worse and who would have thought that possible. Oh it always is though.

Things that are RIDICULOUS should not even be allowed but they ARE. I am not even talking about only this case, there is a wave of it lately.

Why are they even fighting it, just plead guilty. Someone will let them out after one year in prison anyhow.

Cynical? Me? Yah.

Poor little boy along with all of the rest of this man's children. I don't know where the rest of his family was but they back the man it seems and not the child. Or the other children.

We don't know all and never can but this child is dead. That is NOT MINOR. And there is not one HINT anyone but dad was responsible in this one. And yah we have confessions that he now wants to make excuses for.

This is the case if I am not mistaken and I don't think I am, that the main judge recused himself and ALL of the other judges in that county. Never have we known why and I can only guess that it is due to this man and his family and prior dealings and knowing what would come. Only a guess. Who knows. Never before, it was discussed, has such been seen where an entire slate of judges take themselves off of being able to be put on the case before they even are.

Taking a moment this dark more to think of this LITTLE BOY. In wanting justice, one wants an arrest but from that very point, it becomes about the defendant entirely and not about the victim. In that, there is NO balance--yes defendants have rights and should--but the victim more or less disappears and it is now the show that has one single star and rights on only one side, the defendant's. And the delays and the new wave of ridiculous stunts and defenses have gone beyond the pale and make nothing but a joke of the system. It has gone way too far.

But in this case, at least, the confessions stand.
All about the defendant. Looking for any excuse then can. Not taking responsibility for ANYTHING!!! ITS ALWAYS AN EXCUSE!!!! I'M SICK OF THIS SH*T TOO!!! PAST SICK OF IT!!!

Defense asks judge to recuse himself amid jury selection in Cory Bigsby trial

Shortly before noon, Lead Defense Attorney Curtis Brown said to Judge James Hawks, “I’d like to make a motion that you recuse yourself.”

This happened after one potential juror said he would need evidence of a body and an autopsy. The Commonwealth moved that he be stricken from the potential pool of jurors. The judge agreed, and Brown got upset, saying it appeared the judge was siding with the prosecutor.

Judge Hawks overruled that motion and the jury selection process moved forward.
Geez. Oh shut up whiney.

Yet at the same time defendants do not need to appear.

Kids are braver by far and I think that shows a lot of an adult who won't face their own acts but a kid who has to grow up too fast and too heard and enter a scary world and tell on them.

BREAKS my HEART.

Maybe it isn't bad but I am not going to read the spoiler. Or should I?

I did not read the spoiler but am going to I guess I need to. Animals are way better. Totally agree. It is an insult to animals to call an evil POS an animal. Far WORSE. Wild animals kill to protect or to EAT. Not the same at all as what these monsters do.

Nice to see you! And thank God you are right on the b.s. of it!

It is not graphic. Just heartbreaking. I think the editor was being super cautious.

Geez. Oh shut up whiney.
His name is Curtis Brown. Just for starters I intensely dislike that name and I admit bias to the name. Grrr.

But what a whiney sobby joke. You are right. The juror admitted he would need a BODY and this kind of evidence and all cases don't have it and jurors are advised conclusions can be come to from other evidence and overcoming reasonable doubt and you name it. So CURTIS claims that is bias against the defense BULLSH*T, it is an admission by a juror that only with a body could he convict regardless of jury instructions.

WHINEY is right. Crybaby. Do YOUR JOB and stop the DUMB sh*t going on these days.

thank you. I went and read it. Certainly we all have read and heard far worse. It is sad in the sense that this should hit as bad as it can get. And it is really but we see so much more. This child, this baby, saw his brother like this and dad ignored him and his concern. There have been a streak of wins lately for justice and I pray Codi gets one next.

This child is seven now and would have been five WHEN reported, possibly less. A baby himself with one heckuva life.

Kudos to this little boy, the brother. He took and has faced too much but look at him doing this. I don't think a single child in this home had a stable bit of anything. I forget some things with so many cases but I recall a LOT as well. This man was no father or parent. He is a total loser POS. Imo.

I recall what neighbors had to say for one. No child was taken care of or had a normal life imo.

I do believe Codi was likely his scapegoat.

There is something wrong as well with this man's family. He was their grandson, nephew, etc.

There is a REASON all judges recused. I can only guess there was a ton of history here. And probably b.s.

I don't know. I just know Coid is dead, dad did it imo and even the baby brother at his young age knows this. And that is beyond freaking sad.

This case has NO attention. Out there. Not that I go hunting for such but it doesn't.
