Megan Boswell’s attorney files motion to withdraw as her counsel​

The attorney for Megan Boswell, the Sullivan County woman accused of killing her 15-month-old daughter, has filed a motion asking the court to let him withdraw as her counsel.

Brad Sproles, Boswell’s public-appointed defense attorney, filed the motion on Wednesday claiming that “the attorney client relationship has deteriorated to the point that counsel is unable to effectively and zealously represent the Defendant in this matter,” according to court records.

“Despite the efforts of counsel and the Defendant to rehabilitate the same, the attorney client relationship is not salvageable,” Sproles said in his motion. “Therefore, counsel respectfully requests that he be relieved from further representation of the Defendant, and that the Court appoint her suitable counsel to continue in her defense.”

Sproles is also requesting to stay on the case temporarily in a pro bono status in order to help Boswell’s new attorney with the transfer and organization of case materials.

Last month, the judge over the case denied a request by Boswell to part ways with Sproles.
Very common way to delay things. Not saying there might not be reason, hard to say but also is a delay tactic. New atty. needs to get up to speed, etc. He is willing to stay on free of charge to get new attorney up to speed... Or I assume. Pro bono. Defendant and counsel have tried to rehabilitate the relationship so what is the problem if both are willing?

Another case that is taking far too long.

The murder trial of a Tennessee woman accused of killing her 15-month-old daughter has been postponed for another two years.

In October, Boswell and her defense attorney, Brad Sproles, parted ways.

Her new attorney, Gene Scott, asked Wednesday for the trial to be postponed until 2025.

He said he needs the time to look over the massive amount of evidence in the case and talk to multiple experts before they'll be ready for trial.

"We wouldn't have asked if we didn't think it was absolutely necessary,” Scott said. “Obviously, Megan is in jail and can't make bond, so we didn't want to put if off any longer than we have to, but at the same time, the case is so complex, and there's a lot that needs to be done, so essentially it's a 24-month continuance from where the trial is set right now."

Sullivan County Deputy District Attorney William Harper said prosecutors were prepared to go to trial in February 2023.

"Delay is generally not good for the state,” Harper said. “We've now got a lot of witnesses that we're going to have to keep tabs and keep them on the hook so to speak for several years until it does go to trial."

Boswell's attorney also filed a motion asking the judge to allow her to wear civilian clothes during her court appearances.

He argued that given the media attention on the case, she should be brought in wearing street clothes.

Boswell's next motions hearing is scheduled for April 21.

BLOUNTVILLE, Tenn. (WJHL) — Megan Boswell, the Sullivan County mother charged with murdering her toddler daughter, appeared in court Friday morning at 9 a.m.

On Friday, Judge Goodwin listed the following reasons to deny the previous request by Boswell’s legal team for her to wear civilian clothes.

  • “The state points out correctly that no jury has been selected to hear this case at this time and any prejudice that might arise can be fleshed out during voir dire.”
  • “This Court does not find that this defendant [Boswell] should be treated any differently than any other inmate in the Sullivan County Jail.”
  • “The defense has not provided any case or statute that specifically requires the relief [request] sought.”

What in the HELL? Usually I say what in the he77 but no hockey sticks on this one. There is NOTHING so complex in this case that requires TWO YEARS. YEARS!!! I and a few other gripe about the slower and slower moving legal system but this is BEYOND and if this is allowed and no one gripes about it, one may as well give up! Cases can go on for years on end due to motions, etc. and prep but each time it is how many months out, then another, etc. NEVER have I seen one set for TWO years out after all this time already. This can't stand. I'm not kidding. This case isn't Vallow for goodness sakes. How darned complex could it be to be given TWO YEARS?? Linda covered this one. She hasn't been real active in the last months but I HOPE she gives one on this.

true but i doubt with evidence she would be free anyhow. two more years in county, gravy as opposed to prison. it just isn't right. have you ever seen a single case that gets granted two years? it cannot become a thing. our system is enough of a mess and snail/turtle.

It only brakes one juror to set her free, so I am fine with her where she is right now. At least we know she'll get 2 more years in jail.

I assume you mean "takes" and not brakes? Not being snide, I have plenty of typos myself lately.

Two more years in jail or prison is fine but delaying a case two years for what? To review evidence? For TWO YEARS?? That isn't acceptable no matter how it is played or what case as far as I'm concerned and shouldlnt' become a thing or be acceptable. A two year time period is unacceptable for ANYthing and nothing in this case merits it. Or any case for that matter.

Exactly. That's what I was trying to say. You don't GRANT a two year delay up front. And yes, the b.s. may wind along and take two years but it is part by part. You give them a couple of months and then proceed or see why they can't. They can't read and have to go to elementary school first or WHAT??!!!

This can't and shouldn't be allowed or we will start seeing this all of the time now. Our courts are enough of a mess.

The latest hearing for Megan Boswell lasted just a few minutes.

Boswell is facing more than a dozen charges, including two counts of felony murder in connection to the death of her daughter, Evelyn Boswell. Investigators say the 15-month-old was last seen alive by family members in late 2019 but was not reported missing until early 2020. The remains of Evelyn Boswell were found on family property in March 2020.

"We are in the process of getting motions ready to file soon," said Gene Scott, the attorney representing Megan Boswell. "Substantive motions that will, I think, shed light on new issues in the case and kind of have it in better posture to go to trial."

Scott says he plans to file those motions in January.

News 5 asked: Are you able to tell us a little bit more about what those motions are?

"Not at this point," answered Scott. "I will file them, they will be available in the clerk's office, when I do -- but right now, I don't want to do that."

Sullivan County District Attorney Barry Staubus, saying this is a sign the case is moving forward.

"We anticipate at the next hearing, there will be actual motions heard," said Staubus. "I think that reflects the fact that the attorney is going through the materials, voluminous discovery, and once they get through those materials, then they will be in a place where they can file motions and we can have hearings and get this case going toward trial."

News 5 asked: Just how is everything going for you? I know there's a lot of evidence, a lot of pieces in this case -- trying to go through all of that.

"Still working on that," answered Scott. "It will be a continual process, probably up until the day we go to trial, but it's going well."

News 5 asked: Do you still think that 2025 date is realistic for this to go to trial?

"I do," answered Scott.

"I hope so, I certainly hope so," added Staubus. "We've set it far enough out that even with the nature of the case and the amount of information that we've provided, we should be in a place where we can start on time."

News 5 also asked Scott how conversations have been going with Boswell when it comes to preparing for trial.

"Going very well," said Scott. "She's been a pleasure to represent to this point."

WHAT?!!!!! 2025?!!!!! Do they have to put the jurors in a "Dead Pool"?. Get alot of alternate jurors just in case. This is ridiculous!!!!! I know it's been delayed at least since last December. This was questionable if it would be ready by then even?! I don't understand that. What have they been doing. And you need another 1 Year+?. I really believe loopholes and continuances are excessively used. What about little Evelyn?. The victim. A toddler.

SULLIVAN COUNTY, Tenn. (WJHL) – Megan Boswell, the Sullivan County woman accused of killing her 15-month-old daughter Evelyn, appeared in court Thursday.

Boswell and her attorney Gene Scott appeared before Judge James “Jim” Goodwin, along with First Judicial District Attorney General Barry Staubus. Boswell faces a slew of charges tied to her daughter’s death, including two counts of felony murder.

Boswell was in court for a motions hearing, one of which was a motion to sever some of her charges and try them separately from her murder charges.

Judge Goodwin denied that motion.

Among the motions discussed was a change of venue filed by Boswell’s former attorney Brad Sproles. Scott was appointed as Boswell’s attorney in October 2022 after Sproles filed a motion to withdraw citing a deteriorating relationship between himself and Boswell.

“I’ve been over most everything in the case at this point,” Scott said in court. “I feel like that’s where we need to start. That needs to be addressed and determined if we’re going to try the case here or what’s going to happen.”

Goodwin said a change of venue would entail handing the case over to another county’s court to handle and preside over. Instead, Scott told News Channel 11 he would prefer a change of venire, which would bring in a pool of jurors from another jurisdiction, but the trial would remain in Sullivan County.

Scott said his only concern is making sure Boswell receives a fair trial, which could prove difficult in Sullivan County due to the notoriety of her case.

“There’s been a lot of chatter. You can read the Facebook comments,” Scott told News Channel 11 after the hearing. “And you can see there’s been lots of people who know very little about the case, who have been quick to condemn her. She must be guilty. And we want to make sure that we get people that [do] not have a formal opinion of the case, will have an open mind.”

Staubus disagreed when asked about the potential for a fair jury selected locally.

“We believe we can get a local jury here from Sullivan County, but we’ll find out and time will tell,” Staubus said.

Goodwin set a hearing for June 20 to rule on the motion to change of venue or venire.

Scott also brought up the process of creating jury questionnaires for the trial, which Goodwin told him was already underway.

“The judge has previously given out a jury questionnaire for jurors to just to get an idea of their knowledge about the case and rest,” Staubus said. “So that will probably be explored at the next motion hearing that I anticipate.”

I don't understand what has been going on in this case or shall we say not going on as it has sat for years basically and now some new charge? From what I've seen it has not even been the usual defense game delays but delayed by all or by the court and prosecution and just no concern about getting it to trial at all. Now this.

WHAT is going on here? I first thought maybe some of it was the Covid thing in the earlier days/years and just a lack of interest by either side to rush it or even calendar it in time.

Unless they just NOW got evidence of intentional premeditated homicide, I never agree with defense generally as most know, but if they've sat on this, I too would have to ask why and I am wondering why right now...? Imo in this case sit it is the prosecution and court that has had no interest in proceeding or pushing this forward and I figured the defense and Megan were just okay with her sitting in county in the meantime. Most defendants if resigned to they may never get out are generally content to sit in county...

Could she have premeditated rather than snapped as a young mother with absolutely no support or help? I suppose. She comes from quiet a rotten example and criminal and drug controlled mother to begin with, raised I am sure with little hope of turning out much better, imo. She stood and flat out lied in news interviews without a pause.

I was thinking the same thing!!! The date, Because my mom had died 12/30/18. This was 12/2019. Dates just always trigger memories for me.

The "Snapped" scenario. I'm not insulting you whatsoever. People use the depressed, Insanity, Etc. Excuse all the time. I hear, "I just snapped" ALOT also. It's just another way of NOT taking responsibility.

Oh I agree but am simply talking of a young mother, probably without the necessities, no job, no help with a baby just snapping from the stress VERSUS premeditating this. I in no way mean it is some excuse, just saying whether premeditated or not...
