JOSHUA "JJ" VALLOW, TYLEE RYAN, TAMMY DAYBELL, & CHARLES VALLOW: State of Idaho/Arizona vs. Lori & Chad Daybell *GUILTY*

Police seem to be no closer to finding 7-year-old Joshua “JJ” Vallow and 17-year-old Tylee Ryan than they were when this story began months ago.

Since that time, the story has gained international attention as it’s taken twists and turns involving a purported cult, dead spouses, delusions of divinity and preparing for the end of the world. Despite all the angles, and the ever-growing number of people related to the case, the facts remain essentially the same as when it was first announced.

The two children remain missing and the parents, Lori (Vallow) Daybell, and her new husband, Chad Daybell, refuse to disclose their whereabouts to police. Both have been named persons of interest in the disappearance of the children. Law enforcement is also investigating the deaths of the Daybells’ previous respective spouses, Charles Vallow and Tammy Daybell, though neither Chad nor Lori have been named suspects in those cases.

I'm not sure what the planned result will be.

Maybe Prior can write a book and donate the house back to them.
Yeah he can have Chad the great author help him write the book lol.

I don't see Prior giving the home back to the kids. He and Chad would more likely pull a Murdaugh and do a TV or Netflix etc. thing. Once Chad is convicted. It will all be about how he was led around by his Storm and bamboozled by an aging, anorexic fake blonde former hairdresser and Wheel of Fortune runner up, bodybuilder runner up, etc., etc.

Sorry but I don't practice niceness for people that slaughter children, etc. and so while I'd never personally insult another soul in that shallow way ever, it is no limits when it comes to evil pieces of murdering sh*t.

I do though don't think Chad just ran out of money and so Prior was probably cutting a break to a point.

Wasn't there also talk of the life insurance company coming after Chad to pay back the insurance, I can't quite recall. I don't imagine they can put a lien on the property if Prior is sole owner but chad deeding it to him imo is also questionable when it is using his and Tammy's assets for his own defense in his murder of her but no conviction yet so not sure how much they could do BUT the life insurance thing would be civil not criminal... Wasn't there talk of some such case also going on or am I mixing it up with something else...

Not sure.
I do think Prior has cut slack or donated time and representation here. I honestly do not see how Chad could not have been broke long before now. But whether he does that from the goodness of his heart and love of Chad and his children OR because this is a high profile case, etc. one of the highest, that's hard to say. Jmo.

This is worth watching. It isn't exciting but that's because it is about the legal issue of John Prior withdrawing or the court"s options, legal stuff, but just 20 minutes and she explains it well in an easy way to understand it all.

Boyce (and the State) are in a tough position. I called a few things right lol. I was left at the end of this thinking the most viable option they have is to toss the DP and that bites.

A few things of many--Chad was determined to be indigent by the Court in January of 2023. NOT of 2024, at first I thought it was a typo in the filing but I guess not. I do vague think I recall that now that it is mentioned. So if true, Prior has represented him for free for a year.

Second, an option would be for the Court to appoint Prior as state paid and have him paid by the state BUT he does not qualify.

Third the State would have to find TWO if I have right DP qualified public defenders and it isn't that easy to find one.

There's more. She goes through each scenario and worth understanding it imo.

She did not talk of strategy to speak of but all she made clear made it clear to me this is strategy. Prior could have done this not so last minute as Chad was indigent a year ago. He did it because the DP was not taken off the table imo.

I do think and it seemed familiar when help or one or two additional attorneys were needed that Chad and Prior asked for this some time ago. Why the heck did Boyce not do somehing about it then? It seems to be confirmed here they were asked for about a year ago.

Anyhow, there's more. She explains the spot the judge is in and the state is in and each possible option or scenario. Again worth a watch and understanding it.

I guess the value of the house signed over to Prior has ran out.
I was just coming to post this and that is immediately what I thought. I see everyone knows about this now but I will post this Independent news article in case there is anything new in it.

Another case that has activity of course of several. The hearing in this one for Prior's motion to withdraw is the 18th.

Who knows if Boyce will make a decision the same day at the hearing. He pretty much never has yet on any motions in all these years.

Here is Linda on it.

Well i don't get enough time and Delphi was on this morning at the ISC but Chad also had a hearing today about Prior withdrawing. I've had no time to look for news but I do know already that Boyce appointed co counsel for Prior BEFORE this hearing today. I have no idea what happened at hearing, does anyone??

Clearly if he gave co counsel he isn't going to let Prior off...? And will the DP be lost/vacated or no? Not that Boyce generally ever makes decision on the day of or at the end of a hearing...

Anyone know? I don't have time right now to look at.

Thanks!

It still isn't real clear how this works. Per Prior unless he withdrew Chad couldn't get any state paid help or help appointed. I just watched Linda and it wasn't really explained either and have seen a good portion of the hearing now.

This was all known about by the Court AND Chad at least a year ago...

My guess is it was an attempt to get the DP withdrawn.

How is it Boyce can get paid help when it was said by Prior that that's not an option unless he withdraws... WITHOUT Prior withdrawaing?

At this point all I can figure is Boyce called up the State or some power that is and said HELP I am in a spot again and may have to dismiss the DP against Chad like I had to with Lori unless you fund and get him some help pronto for Prior...

This was an effort in my opinion to force DP removal for Chad.

This should have been seen ahead of time for a mile just as it should have with Lori. Imo.

I'm still listening to Linda who held this live earlier and so when it was live she is waiting for them to come back from private chambers meeting to continue the hearing.

Tammy's aunt, today. I've watched a few minutes and find it worth continuing.

Tammy is represented but I'd say not nearly as much as the other victims in this case.

She thinks Chad is scared to go to prison.

Just sharing and glad to see her representing Tammy.

This was good and worth listening to. It really puts the human thing to it and what such does to family and she talked of Tammy's children too and all of it

I don’t know what to think of this Prior thing. I worry that Chad will be able to appeal his probable conviction because his attorney wasn’t being paid enough and “didn’t give it enough attention”.

I think he was again trying to force removal of the DP BUT they had nothing to lose in a way. If the DP wasn't removed, Chad could end up paid or with additional help OR removed and in that case, Boyce would be taken away Chad's "chosen" counsel like we saw in Delphi. Although his motion said otherwise, in court he said he wanted to stay on and Chad wanted him.

Boyce's only other option would have been to remove him and delay the trial for probably a least a year.

If I have it right, an atty can only be non death qualified and represent Chad if private paid and chosen. BY making the issue he was not being paid (and hasn't been for at least a year or longer and the court having declared Chad indigent), he would no longer be a privately retained/paid attorney no?

I don't know how they got around it and got paid help for Chad but they must have made Chad a state paid attorney I assume. I saw a good portion of the hearing but did not see all of it.

I will probably sound like a broken record but I am very unenamored with Boyce. He should have seen this coming and he should have seen the things coming with Lori. I'm sure he was loathe to remove the DP yet again and be known for losing it against both of them. He did all right in the trial but it was a largely uncontested no defense case in Lori's. Other than that I have nothing complimentary to say about him and that even isn't a compliment.

If he had simply severed the cases years ago when attempted time and again by Prior, none of this would likely have ever happened although it may still have happened in Lori's as he took way too much time for everything and she was under speedy trial rights. Refusal was I'm sure likely to save the county and ID some $$$. But look at what other great cost in the long run!! Loss of DP on Lori and now this.

The sad fact IS we may still see a delay as we all know defense gets its way with delays quite often for fear of appeal and I'm sure Prior and his new help will be able to throw a kink in somehow if they want another delay. I expect it in fact and get ready for a ton of motions to bury the prosecution and court as we get closer and we are already CLOSE to trial in terms of what close is in the justice system. Two months plus and he is not prepared.

While I am all for the DP with these two evil creatures, I have to wonder if it is worth it. You need a death qualified jury also and at least some jurors may struggle with conviction even though they ARE to be okay with the DP. None hardly get executed these days anyhow or it takes years and families deal with tons of appeals and more. More like it takes decades and Chad isn't some 20 year old.

Again Boyce should have seen this coming from a mile away. And in the usual games our system allows, Prior did it now when he could have said a year ago the same thing and was not getting paid. Our system will never be fixed in our lifetime nor do I think ever.

People really need to stop and think who they vote for. Many a judge ending up on the county bench doesn't belong there. However, in many cases it gets circumvented by one stepping down and another being appointed.

In summary, the issue I guess has been fixed but imo never should have occurred in the first place. That still, however, doesn't mean this trial will go off on time. Just about two months and a few days for a new added attorney to catch up and know the case but after all Prior should be more than ready to be lead attorney right after all this time? I guess it will depend on whether Chad and Prior want it over with or want to delay further to keep Chad in county and the court and prosecution off balance. I myself FULLY expect other motions, more cost and attempts to delay right up to the last minute.

I think Boyce basically accused Prior of trying to delay as well.

That could be, but I’m reading it as though the judge is trying to figure out if Prior wants out of the case because he just doesn’t want to represent the client anymore. Just because maybe he’s tired of the whole thing. I don’t know? I don’t think we’ll ever know what Prior is thinking.

Nate does a good job of covering this and clearing it up. I saw a fair amount of the hearing but not all by a long shot.

I did hear Prior giving different info than his motion stated.

I gather they went into a sealed hearing for a bit and then prosecution came out and Boyce met ONLY with Chad and Boyce which is ex parte. I'm still watching Nate myself.
