12:04 p.m. Time for lunch recess. Back at 1:30 p.m.
12:03 p.m. Going through the iCloud took a lot of time and a lot of search warrants, Duncan says. He was aware that Adam and Charles were talking about an intervention. The same day Adam and Charles were talking, Lori was telling Alex about the fact that they are planning an intervention.
12:02 p.m. Lori and Alex then had a conversation for nearly an hour. Duncan says he knew that Nephi was a figure in the Book of Mormon but did not understand the significance. He did research to figure out who Nephi was.
12 noon At 9:50 p.m., Lori texts Alex, “Getting sleepy. So I’m going to need you to stay close to me the next few days. Mel too. She can’t go to Utah. They are planking (sic) some kind of intervention…Lots to do. Thank you for standing by me. It’s all coming to a head this week. I will be like nephi I am told! And so will you.”
11:59 a.m. The text messages are from July 8. Lori tells Alex that Mel is coming over. Alex asks for the home address. They go back and forth – and then Lori sends a message around 9 p.m. saying, “So the plot thickens. Call me when u can.”
11:58 a.m. Treena moves to admit an exhibit showing some text messages between Alex and Lori that were found on the iCloud. Treena displays some of them on the screen.
11:55 a.m. Duncan went through “many, many” text messages between Lori and Alex. They were saved in the lollytime account. Lori gave Alex the new address for the home and Duncan saw messages leading up to July 11. The “be like Nephi” text message was sent on July 9 and was stored in the cloud. On July 12, she sent a text message talking about going to Social Security.
11:53 a.m. “This person was found to be Chad Daybell. In addition to that, we received an audio recording from a local business in which Chad contacted the business and listed this as his phone number,” Duncan says.
11:52 a.m. These messages were sent on July 28, 2019. Treena says, “Did you guys want to find out who Bubby was?” “Absolutely,” Duncan says. A warrant was obtained for the search records to find out who Bubby was.
11:50 a.m. Lori sent photos of the beneficiary form to a person named “Bubby.” The first photo shows she is the primary beneficiary of Charles’ life insurance policy. The next photo shows information about the policy. The next photo is a picture of a computer screen that shows Kay Woodcock is the new beneficiary – the form Charles used to change the policy.
11:48 a.m. Duncan found the change of beneficiary life insurance documents in the iCloud.
11:46 a.m. A lollytime email account was created after Charles contacted Chad and Tammy Daybell about the affair his wife was having with Chad.
11:45 a.m. There were other messages between Lori and Alex about Ned through March. On March 26, Lori wrote, “No one has seen him, right? Just talked to him??” Alex responded, “Correct. Charles body is alive. What did you learn?” Lori responded, “Still working on it. Will call you later.” There were a lot of records of Lori telling people to call her. There are no recordings of those calls.
11:43 a.m. Lori sent a message to Alex on March 2, 2019, saying, “Ned just came by and Tylee unleashed on him. He came to my house and he went to Summer’s first. He ran up in a rental car.”
11:42 a.m. Treena shows text messages sent between Lori and Alex. Lori sent a message on Feb. 15, 2019, saying “Ned was at the temple yesterday looking for you. He thinks you are staying with me.”
11:40 a.m. Duncan found text messages between Lori and Alex. Duncan became aware of the name Ned. “Ned was the name of a dark spirit that had taken over Charles’ body and in knowing this, I went through these records looking for a mention of Ned.”
11:38 a.m. Treena moves to admit exhibits from the lori4style iCloud account. Duncan says he found recordings related to Chad Daybell in the account. There was one from Nov. 17, 2018, of Chad in Arizona speaking at Preparing a People.
11:36 a.m. We see the lease agreement for the Phoenix home on the screen. Lease was from June 22, 2019-June 30, 2022. In June and July 2019, Charles was living in Houston. Charles flew to Phoenix on July 10, 2019.
11:34 a.m. Treena asks if Duncan ever found a copy of a lease agreement for the home when he was going through the iCloud. Duncan did.
11:32 a.m. Duncan says call records show Adam was trying to reach Alex when he arrived in Phoenix. A text message was sent at 3:23 p.m. on July 10 from Adam to Alex. Alex never responded to Adam either via phone or text. At 6:28 p.m., Adam sent another text. Alex never responded.
11:30 a.m. Lori returns to the home at 8:48 a.m.
11:29 a.m. At 8:06 a.m., Alex had not called 911. Charles Vallow had been on the floor dead for at least 17 minutes. Alex Cox waits another 30 minutes before he called 911. Lori Vallow never called 911, according to Duncan. She never called on either of her phones or on Charles’ phone.
11:27 a.m. Treena shows a call log made from Alex Cox’s phone. On July 11, he made an outgoing call to Lori at 7:52 a.m. Lori had left the home at 7:49 a.m. with Charles’ phone. Three minutes later, Alex calls. The call lasted for under a minute – 49 seconds, to be precise. Adam’s next call was made at 8:06 a.m. to Lori. It lasted for 55 seconds.
11:26 a.m. From 7:49 a.m. until 8:36 a.m., 47 minutes passed, Duncan says. Treena asks, “Did Charles Vallow just lay dead on the floor before Alex Cox called 911?” Duncan says yes.
11:22 a.m. Treena publishes the first exhibit for the jury. It’s a document showing the extraction report from the iCloud. Alex Cox sent Lori the flight plans for Adam’s trip on July 13 – two days after Charles died. It was sent to Lori prior to Adam’s trip concluding. Adam or Lori got the information from Charles’ phone, likely after he died.
11:21 a.m. Duncan talks about how he got the search warrants for Lori’s iCloud accounts and how they knew it was Lori’s accounts. Treena moves to admit evidence.
11:18 a.m. The Chandler Police Department has had possession of Charles’ phone since around 3 p.m. on July 11, 2019.
11:15 a.m. Treena puts up an image of Charles’ phone. On the screen is a text exchange between Charles and Adam. It shows the information about Charles booking a flight for Adam to visit Phoenix.
11:14 a.m. Duncan found evidence that Lori and Alex went through Charles’ phone on July 11, 2019.
11:12 a.m. The Cellebrite report shows texts Adam was sending to Charles in the morning were read almost immediately. But then the messages were no longer being read. The final message sent from Adam were not read until 12:13 p.m., hours after Charles was dead. “So someone else was reading those?” Treena says. “Correct,” Duncan says.
11:11 a.m. As Charles was arriving at the house on July 11, he was texting with Adam. Adam testified about these messages last week.
11:09 a.m. Duncan found text messages between Adam Cox and Charles. We now see the Cellebrite report on the screen that shows what time a text message was received and what time it was read.
11:08 a.m. Search warrants were executed on two of Lori’s iCloud accounts: lollytime and lori4style. Duncan found evidence that Lori flew to Idaho in March 2019 and Lori and Chad flew back to Arizona the same month.
11:06 a.m. Lori was in Arizona, Charles was in Houston when Charles found the email. The first time Charles and Lori saw each other after he found the email was on July 11. Charles had helped Lori move to Arizona prior to his discovery of the email.
11:04 a.m. There is another email from the account reporting to be from Charles Vallow regarding the Preparing a People conference. Lori was involved in the conference. The email appears to show Charles writing an email to Chad, inviting him to come and write a book. This is the email that Charles found and then reached out to Lori, Chad and Charles about it. Charles also sent the letter to Adam Cox.
11:03 a.m. The email account was used from April through June. Treena now shows emails that were sent starting April 21. The first one was sent to Brother Daybell – to Chad Daybell’s email address. The email says it’s from Karen inviting Brother Daybell to Houston.
11:02 a.m. Treena Kay asks to admit the email as evidence. Lori objects based on relevance. Judge lets the email it.
11:01 a.m. The name of the person subscribing to this email address was Karen Walker. The phone number linked to the email address was linked to an old phone number belonging to Lori Vallow. The email account was opened on April 21, 2019 – when Charles and Lori were in Houston.

10:57 a.m. Duncan found multiple text messages between Charles and Lori related to an email. Charles contacted Chad Daybell and Tammy Daybell after Charles found the email. A search warrant was authorized on the email account.
10:56 a.m. Duncan says there was a change in the communication between Lori and Charles on the iCloud accounts after June 27, 2019.
10:55 a.m. Treena asks what is an iCloud. Duncan says it’s an account that stores information and files from a phone, computer, other electronics. People may be aware the files are being saved, others may not know.
10:53 a.m. Duncan was assigned as case agent in June 2020. He had helped Det. Moffat sort through iCloud data and other parts of the investigation. Duncan reviewed the cell phone extraction data that included emails, text messages, anything you might see on someone’s smart phone.
10:52 a.m. The bullet in the floor was “100%” consistent with Charles being shot while lying on the floor, Duncan says. The wood portion was cut out of the floor for evidence. Duncan did not attend the autopsy. Duncan says the rental car was not searched. Lori Vallow had it all day and it was not searched.
10:50 a.m. Treena shows a photo of the floor showing marker #13 next to where the bullet strike was found.
10:49 a.m. The serial number was collected from the gun and it was registered to Alex Cox. Duncan was present when the medical examiner came to collect Charles’ body. Duncan and other crime scene investigators cleaned up the blood under Charles’ body. “When cleaning up the blood, I immediately noticed a defect in the floor consistent with a bullet.” The defect was near where the bullet would have exited out of Charles’ left shoulder.
10:47 a.m. Treena asks about the gun. “When you’re looking at it, did you look at all the sides of it to see if there was any blood evidence on it?” He did look and there was not any. Treena asks Duncan if he knew, when he walked into the scene, that Alex Cox had an injury to the back of his head. Duncan did not know but learned during the investigation. “That made us more aware of potential blood evidence and that’s why we were looking for that.”
10:44 a.m. Treena shows photos of the gun and the single casing that fell out of the gun. Duncan found a gun case inside the orange duffle bag. There were extra magazines inside the gun case. On the outside pocket of the duffle bag, Duncan found a card. It was a Health Savings Account card with the name Alex Cox.
10:42 a.m. There was blood on the faucet of the kitchen sink – like a smear of blood. There were no bloody towels or anything that looked like it had been used to clean up blood. Treena Kay shows a photo of a room with black and white stripes on the wall. There is an orange duffle bag next to a garbage bag and a gun next to the bag. Duncan was responsible to “make the gun safe.” He put on gloves, picked up the gun, looked for blood or biological evidence, removed the magazine, and cycled the gun to remove any cartridges inside the chamber. A single 45 caliber cartridge fell out.
10:40 a.m. There were no cracks or damage on the mirrors. Duncan noticed a baseball bat near Charles’ head. Duncan was looking for blood evidence that could help with their investigation. There was not any.
10:39 a.m. Treena Kay shows a photo of Charles lying on the floor in the house. Kay Woodcock is in the courtroom and is looking down – she is not looking at the picture.
10:38 a.m. Treena Kay asks if Charles Vallow appeared to be fit. Yes. Treena asks if Duncan noticed a lot of blood. He did not, but he noticed some blood in the webbing of Charles’ left hand. Duncan feels that blood came from Charles placing his hand on his chest after he was shot. There was no blood on the floor area around Charles’ body.
10:37 a.m. Before going into the house, crime scene technicians walked through the home. the LizardQ system took pictures of the scene. Duncan remembers white and black checkered flooring and the first room that had no furniture. There were mirrors on the walls. Duncan noticed Charles Vallow’s body lying on the western portion of the room with his head to the north and feet to the south.
10:35 a.m. A search warrant was obtained to go into the house. They entered around 11:53 a.m. At the time, Duncan was not aware of when the 911 call had been made. He is now aware that it was made at 8:36 a.m. He originally noted the wrong time in his report as 8:32 a.m. Alex Cox called 911.
10:34 a.m. When Duncan arrived at the scene, emergency vehicles were already on the scene. Duncan saw Alex Cox from a distance. He was sitting on the sidewalk and did not get close to him. Duncan never saw Lori Vallow when he arrived. Duncan met with other detectives and was asked to assist Det. Coons with the crime scene.
10:33 a.m. Duncan was working on July 11, 2019. His shift was weekdays. He learned of a shooting in Chandler from the police radio. Chandler looks at the jury while answering the questions.
10:32 a.m. Duncan introduces himself to the jury. He has worked for the Chandler Police Dept. for 25 years and is currently in the homicide/robbery unit.
10:31 a.m. Judge just jokingly said to Det. Duncan, “You’re not going to throw up on the witness stand? If so, don’t go my direction.” Jurors are brought in and Duncan is called to the stand.
10:30 a.m. We are in the courtroom. Lori Vallow Daybell just walked in wearing a lilac blouse under her black pantsuit. I overheard a lady in the gallery say, “She looks a lot better in person than on the livestream.”

10:02 a.m. Back in the courthouse waiting for the courtroom to open. Just saw Chandler Det. Nathan Duncan walk in with prosecutor Treena Kay. Duncan was sick yesterday and could not testify. Looks like he will take the stand today.
