Judge denies Kamille McKinney’s kidnapper’s request to declare Alabama death penalty unconstitutional​

A Jefferson County judge has denied Patrick Stallworth’s request to declare the death penalty unconstitutional.

Stallworth, 43, and Derick Irisha Brown, 33, are charged with capital murder in the 2019 deadly abduction of 3-year-old Kamille “Cupcake” McKinney.

Both were found guilty in federal court of kidnapping that resulted in death and conspiracy to kidnap a minor victim.

Now, they face a possible death sentence if they are convicted in state court.

Stallworth’s trial is set for March 11, 2024. Brown’s trial is set for April 8, 2024.

Derick Brown, the woman found guilty of kidnapping a 3-year-old in 2019, has been transferred from Jefferson County Jail to Bryce Hospital in Tuscaloosa in order to be “restored to competency.”

On November 22, 2023, Bryce Hospital submitted a status update on Brown, who, according to documentation, had been committed to the custody of the Alabama Department of Mental Health in July. Alaric O. May, Circuit Court Judge of Jefferson County, had ordered Brown be committed in order to restore her competency; This means Brown was deemed incompetent to stand trial but could be “restored to competency” through outpatient treatment.

According to the documents submitted by Bryce, Brown’s “treatment plan” included addressing her “depressed mood.” Documents state Brown said she feels depressed “all of the time.”

Bryce Hospital reported Brown had scored a 23 on the Beck Depression Inventory – Second Edition (BDI-II), which is a “moderate level of symptoms of depression.”

Furthermore, documents from Bryce stated that Brown was diagnosed with chronic post-traumatic stress disorder (PTSD).

Finally, Bryce reported that Brown had been taking part in Courtroom Education classes as part of her competency restoration and had scored 80% correct on a quiz regarding her factual understanding and the same score on a quiz on her rational understanding.

Documents stated that on November 8, 2023, Jennifer Abernathy-Smith, Psy.D., evaluated Brown’s competency to stand trial.

Mark Schmidt, Psy.D., a licensed clinical psychologist, said he will submit Brown’s report to the court once it is complete.

FFS!!! ALOT of people have PTSD! I was diagnosed. I'm not sure I even agree with that. And I am not in denial. I know quite a few people that have it. What about soldiers that have it?. A judge that said NO to more time wanted from the defense to prepare! I may well be in love. A judge with balls. I mean they've had as much time as the prosecution as is true in all cases so why would that be appellate worthy even?! This child was murdered 4.5 YEARS ago. Yeah, you need more time. B.S.

I am NOT EVEN going to go there or say what I am thinking because the b.s. here is CLEAR and I would not stop and I would lose it.

I remember WELL what was done to this CHILD and we don't know all the graphic details but we know too many. And depesssion and PTSD are no excuse for WHAT SHE DID and was involved in.
These are two of the most depraved and disgusting people I've seen in child cases and my God we have seen some bad ones. This little baby wasn't even THEIRS and they took her and used her like some sexual object for their SICK uses. One day she is home around family cousins and friends and the next she was gone in world and HELL no defenseless child should ever experience. This was a rare one of a stranger abduction by a DUO, one of which was HER.

I don't care WHAT her problems ARE. People like this need the book thrown, the door slammed, the chair plugged in and fired up and to NEVER be in society free again!

Pooor misunderstood DERICK IRISHA BROWN with her issues. Issues that in NO WAY excuse this.

Defendants rights are so over the top but victims and their families should be too. It is time that is seen.
 

Trial involving murder of 3-year-old Kamille ‘Cupcake’ McKinney delayed​

Patrick Stallworth will not stand trial for capital murder next week for the death of 3-year-old Kamille “Cupcake” McKinney. His federal kidnapping conviction involving McKinney’s disappearance and death is still pending before the Eleventh Circuit Court of Appeals, which is creating issues involving evidence needed for this trial.

During a hearing on Monday, March 4, the state and the defense explained some of the physical and biological evidence needed to try this case is still in FBI custody due to the pending appeal. There are lingering questions over how the evidence would be turned over to the state, and then returned back to the FBI should it be needed again by the Department of Justice.

“We can’t try this case without that evidence in hand,” Jefferson County Circuit Judge Alaric May explained. “I can’t take that chance of us going forward.”

The state said they’ve been told the Eleventh Circuit may rule sometime this summer. The trial is now set for September 2024.
 
I'm really sad to say this but I am going to quit commenting on cases no one else does or cares to other than those that are so good to update them Every case should have attention and people that care but it isn't the case quite often is it. Cody's either. Trial is starting. I sure don't have the time. Yet these aren't old cold cases with little new news or nothing to discuss, they are cases with activity going on.

They aren't the ones with the interest on SM right now either but Kamille certainly was at the time it occurred. As was Cody with some.

I wouldn't even know if it were not for updates here and hitting new posts. I sure don't have the time to keep up.

Anyhow, Kamille's was one of the worst stranger male/female perp thing I have ever seen. And I hate hearing it. But it MATTERS.

You know if mental issues or addiction, you shouldn't be going to trial, you should be throwing yourself on the mercy of the public and court saying I did it and I have a serious problem and please help me fix it.
