This is getting ridiculous in all cases/the system.

It's starting to scare me that our justice system is getting more broken. Where does that leave law-abiding tax-paying citizens?
Well I can tell you how it affected us and even now is affecting me with regard to just a divorce. It is absolutely ridiculous so just imagine it with the criminal justice part of the system... If they don't stop these delays whether Covid related or whatever (it was bad enough before), I honestly don't see ever coming back from it...

I don't agree with just letting everything go but I think more minor things need to be dealt with in a different way and perhaps in a different place. In our areas the same judges handle everything from minor traffic ticket court to murders on their dockets and the DAs do as well.

I think it would take a lot more than just changing that though. Jmo.

Preliminary hearing for man accused of raping and killing teen pushed back to August

An Inglewood man who police say admitted to raping and killing a Bakersfield teen had his preliminary hearing postponed four months Wednesday.

Cruz’s preliminary hearing — where a judge determines if prosecutors have enough evidence to hold a defendant for trial — was postponed from Friday to Aug. 12 during a brief hearing Wednesday morning.

The defense has moved to block media access to the proceedings. A hearing on that motion is also set for August.

What happened in this case sounds atrocious and it was a fast arrest and as it says here, they have an admission so what is the problem and why is the case always so hush/hush? It certainly appears they have plenty to go to preliminary hearing and August is months away... Pretty substantial delay and preliminary is like in the start of the case and process, not the tail end... This case has not even gotten going then...

The community gathered this afternoon to honor the life of Patricia Alatorre, who is known as “Bakersfield’s Daughter.”

Yesterday marked what would have been Alatorre’s 14th birthday, before her life was tragically cut short. Alatorre is the young girl who investigators believe was kidnapped and murdered by a man who allegedly drove from Inglewood to Bakersfield to meet her after they connected on social media.

The birthday celebration was held in Downtown Bakersfield at a mural paying tribute to Alatorre. Thee Next Steps organized the birthday celebration to show that through community engagement we are able to bring healing.

March in Downtown Bakersfield remembers and demands justice for slain teen Patricia Alatorre

A year after the disappearance and killing of Patricia Alatorre, family, friends and community members gathered together to honor the teen known as Bakersfield’s Daughter.

Alatorre was reported missing on July 1, 2020. The group Thee Next Steps held Friday in Downtown Bakersfield to demand justice in Alatorre’s case.

“The community needs to be aware of what’s taking place in our community,” Ali said. “Obviously this is not something that’s new in Kern County but also to remind the community that we are still fighting for accountability on Patty Alatorre’s behalf.”

The group gathered to remember Alatorre but also got together to demand justice. Cruz's pre-trial proceedings have been postponed multiple times, and they want to know why.

Eyewitness News reached out to the Kern County District Attorney's Office who told us, "COVID has affected more traditional timing on a lot of cases, from court availability to witness and attorney availability. We are committed to moving forward on the case, and look forward to recently relaxed Covid precautionary measures in the courts resulting in more efficient handling of all criminal cases, including this one."

The people who gathered also wanted to warn the public about the dangers of online chatting, which is believed to have played a role in how the suspect allegedly lured Alatorre before kidnapping her.

The founder of the group gathering said, "we have all been young and careless and that doesn't mean someone should lose their life."

The Police Department has also asked parents to be mindful of their child's online activity.

Hearing for accused killer of Patricia Alatorre pushed back to October

It will be at least a few months until the man arrested in the rape and killing of 13-year-old Patricia Alatorre has a hearing to determine if prosecutors have enough evidence to go to trial.

Attorneys for Armando Cruz said in court Tuesday there have been additional motions for discovery and more time is needed before the preliminary hearing proceeds. It had been scheduled for Thursday.

Judge Eric Bradshaw set a status conference for Oct. 22. A new hearing date may be set at that time.

Grand jury indicts man accused of raping, killing Patricia Alatorre

The Kern County Grand Jury has handed down an indictment against the Inglewood man accused of raping and killing 13-year-old Patricia Alatorre.

Armando Cruz is scheduled to be arraigned on the indictment next week, District Attorney Cynthia Zimmer said in a news release.

A gag order has been issued in the case and Zimmer said she could not provide further comment.

With an indictment, it’s not necessary to hold a preliminary hearing and the case, which has received intense media coverage, can proceed to trial.

Motion in Armando Cruz case to be heard next month, judge scolds defense for missing hearing

A Superior Court judge on Monday said a defense motion seeking to bar the public from pretrial hearings in the case of a man accused of raping and killing 13-year-old Patricia Alatorre will be heard next month at his arraignment.

Armando Cruz was indicted by a grand jury earlier this month and is scheduled for arraignment Nov. 4. He was originally charged in July 2020, days after Alatorre’s death, but that case will be dismissed and replaced by the charges listed in the indictment, which has not been made public.

A gag order has been issued in the case prohibiting attorneys from commenting on matters other than scheduling.

After confirming the motion date, Judge Charles R. Brehmer rebuked Cruz’s Los Angeles-based attorneys for their failure to attend a hearing and being unreachable on Friday, and for being late to call into Monday’s hearing. He said court staff repeatedly tried reaching the pair on Friday and had not received prior notice they wouldn’t be present.

Brehmer asked them to explain why they shouldn’t be fined.

Family of murdered Patricia Alatorre pay tribute on All Souls Day

The family of 13-year-old Patricia Alatorre paid tribute to their loved one Tuesday on this All Souls Day.

“When your loved one has passed, you want to do anything and everything to keep their memory alive.

And this is part of it,” said Clara Alvarez, Patricia’s mother. “This is part of keeping her alive and keeping her memory and what she liked and what she loved to do.”

Alvarez decorated her daughter’s gravesite at Greenlawn Cemetery on Panama Lane.

No time to refresh memory at the moment but I do recall this case is odd with the privacy they are affording this creep and facts kept from the public. And I don't mean any gory details, I don't want them nor do I think do most people, I mean the case in general even.

I think something is going on here but not sure what and felt that way early on if I recall. I mean is he an illegal, or should he not have been maybe out of prison and on the streets or a judge let him out and then he did this or what is it? It just seems like the case is being afforded a lot of secrecy for whatever reason, a whole lot more than most. Could be wrong though, no idea of the reasons...

They have been keeping things VERY private. They've never "officially / publicly" confirmed that the remains belonged to Patty.
Very odd. I either did not know that or did not recall that part or know if they since have, fell behind on much when I wasn't on for a time. I have seen info held like arrest affidavits in cases in SOME states, etc. but nothing like this, the secrecy seems beyond just the usual reasons and they want no cameras or coverage, now you said they have not confirmed it is her, etc., etc.

There is some underlying major reason I would think but what IS it?

LA attorneys file motion to continue representing accused killer of Patricia Alatorre

The Los Angeles-based attorneys who have served as legal counsel for the man charged with raping and killing 13-year-old Patricia Alatorre are seeking to continue representing him, and are asking to be compensated by Kern County.

Attorneys Tomas Requejo and Joel G. Garcia say they have gained the confidence of Armando Cruz and his family over the past year-and-a-half and are “quite familiar” with the case, according to a motion filed Nov. 4.

The attorneys say Cruz, 25, is indigent — he was underemployed, has no savings or assets and lived with family at the time of his arrest — and they’re asking the county to pay them as the case moves forward.

“To have another attorney appointed to represent Mr. Cruz at this stage of the case will cost the County of Kern a considerable amount of money in attorneys’ fees in order to have new counsel become as familiar with the facts and evidence in the case as Mr. Requejo and Mr. Garcia are now,” the motion says.

It says appointing new counsel would lead to delays, and that it’s in the court’s and Cruz’s best interests they remain as counsel.

If Requejo and Garcia aren’t appointed, the Public Defender’s office or Indigent Defense Program would represent Cruz.

So why wasn't he appointed a Public Defender, etc. in the first place and how have these guys been paid to date... Just wonder, no opinion really otherwise on it.

The article also makes it even more confusing and gives one the feeling something is up here again because of this continued secrecy and gag order. I almost wonder if there is more to this or other victims... I hope not but he did make her meet him twice by threatening to publish pictures of her so... The main things I can think of are protecting other possible victims, minors or witnesses but even then one often gets some info... Otherwise my mind goes to was he released and shouldn't have been, he might be an illegal immigrant and maybe that creates some issue (not saying he is, I have no idea, just wondering why all so hush)...

In the cases I can think of where things have been sealed, though, the reasoning is usually more so because even though charged, etc., the investigation is ongoing, or to protect names and witnesses, minors, etc... or this is what is given usually as the reasons.
