PAUL & MAGGIE MURDAUGH: South Carolina vs. Alex Murdaugh for Double Homicide of wife & son *GUILTY*

This case is being kept pretty quiet, no major details released to speak of (other than it does say there were two different guns used), but no info regarding who found them, who called 911, very little else.

Of interest, the grandfather died just a few days after these murders and it sounds as if he was ill from various articles so probably not unexpected. I think of the typical motives, did grandpa have a big estate? How big in the overall family of grandpa's on down? They sound like a pretty well known family and a powerful one in their state, more on that in the article.

Financial crimes.
Ok I thought that was what you meant. He has not yet been tried on the financial crimes and we already discussed that a jury is likely not to know that he admitted the financial crimes when he testified. They may not even know beforehand about his murder conviction. However, the feds appear to be indicating he is cooperating, so I think he will take a plea as his fellow lawyer friend, Cory Fleming has done. I think Fleming only got 5 years but will have to check on that again.

Just checked on Cory Fleming. He pled guilty yesterday to stealing $4m from the Sattersfields. He is out on bail for $25k, which like Russell Lafitte, I do not understand. They should be sentenced immediately. He is going to be hit with more charges in September apparently. So maybe he will be hit with all the remaining $4m too? They will then deal with Murdaugh's charges, I bet, which could then be a done deal.

News 4 spoke to the federal prosecutors about the timing of these new indictments and Fleming's plea deal.

One of Alex Murdaugh's best friends, Corey Fleming, pleaded guilty on May 25 in federal court. He admitted to taking part in one of Murdaugh's financial schemes. (WCIV)
"We have always intended to charge those who are responsible for these financial crimes accountable in federal court," US Attorney Emily Limehouse said. "We enjoy a really good working relationship with the South Carolina Attorney General's office and South Carolina Law Enforcement Division (SLED). SLED played a really important part in the investigation."

"We, out of deference to our state partners, delayed charging these crimes until the murder trial was finished and now we are moving forward with charging these financial crimes," she continued. "Our main goals are to hold people fully accountable for their crimes and to do our part to make these victims whole."

With this deal, Fleming could face up to five years in federal prison and have to pay a fine of up to $250,000.

Part of the plea deal means Fleming will turn over his law license both here and in Georgia. He's also agreed to polygraph tests.

He was released on a $25,000 unsecured bond today, but Fleming has more legal troubles ahead. In September, he goes to state court on more charges associated with the Satterfield case.

See whole article at link above.

This is from a week ago and I posted another article about it. However, this article has a copy of the actual motion from the Defendant for relief of judgement in the Sattersfield case. The motion can be read within the article in the link. I have started reading but it is 27 pages long, so I am parking it here for review. I have read the first few pages so far.......

I fail to see why any of them should be out on bond. And if a deal was made, execute the deal and give the sentence, what is this fooling around and letting them out on low bond? i also think that up to five years is a joke for what was done to this family and for the crimes committed. However he will face more charges but still that's not much of a sentence.

And I don't know what kind of a deal is being looked at with Alex but in NO WAY should it be anything similar with the number of charges and how many laws he broke and people he swindled or stole from. What was it, 22 new indictments or charges?

His testimony at the murder trial about the financial crimes can definitely be used in the financial crimes trial.

HAMPTON COUNTY, S.C. (Court TV) – Detectives have been making progress in their investigation into Stephen Smith‘s death, and have been serving warrants and subpoenas as part of it, Smith’s mother’s attorney told Court TV.

<snip>
In an interview on Thursday night with Court TV’s Julie Grant, Smith’s mother’s attorney, Eric Bland, said that the investigation is moving forward. Bland said that police told him that investigators have met with the state’s Attorney General to give them the full briefing on the case. Bland said that warrants and subpoenas are being issued, but he did not specify any people who may be receiving them. Bland also said that he believes a grand jury has been impaneled in the case.

“It would not surprise me that over the next couple months, we would near something regarding Stephen Smith and the decision South Carolina reached that he was killed by homicide,” Bland said.

These are the two people involved in that murder. And LE have known this since 2015. I don't know why they weren't arrested then but maybe they are now waiting for the phone evidence to confirm their locations.

From the below link-

It was Dec. 18, 2015, when SCHP Corporal Michael Duncan reported a phone conversation with Darrell Williams, the stepfather of Patrick Wilson. Duncan stated that Williams had been informed by his stepson, Patrick Wilson, that Shawn Connelly had struck and killed Smith. Wilson had been riding with Connelly that evening.

According to recent news releases, SLED now views Wilson and Connelly as persons of interest.

Smith’s body was exhumed over the weekend and a fresh autopsy was conducted before the body was placed back to rest.

In the meantime, a further development has occurred. According to Eric Bland, of the law firm Bland Richter LLP, which is representing Sandy Smith, SLED has now been able to have gained access to Stephen Smith’s cell phone and are working on opening the iPad tablet.

“SLED has his cell phone, and they have cracked it. And they have the tablet and are working on it,” said Bland. He added that the ability to crack open the phone was possible due to new technology.

The attorneys and investigators hope to learn who Smith was talking to, dating and associating with up to the time of his death.

“I think the case will be solved by phone evidence or computer evidence, both before and after the killing,” said Bland

Earlier this week, a reward for information leading to the arrest and conviction of any person or persons involved in what is now termed a homicide is being offered.

Hmmm.....

COLLETON COUNTY, S.C. (WCSC) - A misunderstanding led to the release of unredacted body camera footage from the murder scene at Moselle, according to the South Carolina Attorney General’s Office and the Colleton County clerk’s office.

The mishap was revealed during a hearing in Columbia on Friday to formally seal the evidence.

The records were treated “as if” sealed during the six-week murder trial, but never officially, spokesperson for the SCAG’s Office Robert Kittle confirmed.

The footage was shown in court, but not streamed and redacted versions were released following proceedings.

This was to protect the victims’ family from seeing graphic images.

It was not learned until after the Colleton County clerk’s office sent the videos to Netflix in a Freedom of Information Act request, that these portions had not been removed because they were not labeled as “sealed” clerk of court Becky Hill stated in court.

Judge Clifton Newman ordered they be sealed moving forward. However, concerns still exist among family, prosecutors and the defense that the graphic images may still be distributed.

Hill informed the court that a Netflix producer had promised these images would not be used.

“If you want to take the word of an entity that can make a lot of money off of those images as opposed to some sort of written agreement or something, then you may do that,” defense attorney Dick Harpootlian said. “I would want them to consent to an order by the court for them to return it and any and all copies destroyed.”

Judge Newman stated they’d have to work with Netflix first before any hearing or issuing an additional order.

What a major screw up. I'd like to believe it was a mistake but they were sending to NETFLIX for goodness sakes, wouldn't you be extra careful with what you were sending to such an entity? Then that thought leads me to the thought of just how bad this county was in all that the Murdaughs were allowed to do and get away with through the years in running it or parts of it and how many cronies there were helping do such. I almost wonder if someone didn't pocket some money...

On the other hand, the trial is over so it affects nothing or shouldn't.

Poot shouldn't have a say in this as his client created these images by his acts, and yet here he is spouting off about the money they could make and how you shouldn't take their word for it. That's really funny considering the client he represented and the money he made at other people's expense and harm. It is funnier yet as he and his client would sell such and more if they could to Netflix in an instant if Alex could pocket the paycheck from them and pay Poot as well.

Well then what is the point of the trial? Personally I think he is going to do a deal just like Cory Fleming and the prosecution is just waiting for that to happen, which is scheduled for September.

He's probably leveraging a guilty verdict for some perks in his cell, and they're still working on it.

Netflix requested them via a FOIA request and got them !!! They must have thought it was their lucky day. Even if they return them, they can probably still recreate it for a programme. They've seen them now. The only way they could be prevented from recreating the images is by a court injunction from relatives, I would imagine.

Can they do that? I thought that lifers got perks anyway don't they? Assuming the Sattersfields get their money back from the Moselle proceeds, how are the other victims going to be reimbursed? Surely Fleming and Lafitte will have to contribute to compensation too wouldn't they?

Which reminds me - on the Sattersfield case, that 27 page motion I posted sort of explains why the dogs were said to have caused her fall and death. This is how I understand that document. Murdaugh could claim on one of his policies and that bumped up the claim to $4 m. There was one policy that paid out half a million and one (relating to the dogs) that paid out $3.5m. If someone else wants to read and try and interpret/confirm that was the case, that would be good.

Anyway, my point is that if Alex is now saying the dogs weren't involved, does that mean the $3.5m has to be paid back to the insurance company? If so, then the Sattersfields will only get $500k right?

i have been so very busy but I think it was this case I saw something on the other day but didn't get around to sharing that showed why he definitely would make a deal on these federal charges (I'm not positive it was this one but I think so) because he would be in the federal pen first then where it is better by far before coming back to serve his time in SC prison. That's all this "connected" guy needs imo...

If it wasn't this case it was one of the other big ones but I think it was this one.

Well let's look at the bright side and that is that it isn't anything that can be used for appeal, he was already convicted.

Yes they must have thought it their lucky day or their day was made intentionally lucky by someone. Personally airing such photos wouldn't encourage me to watch something because they had gory things but I guess it could for some.

If they agree not to show them as it sounds like they have and sign something then it shouldn't be an issue at all.

I seriously doubt Alex or his lawyer Poot give one iota about Maggie or Paul being displayed since Alex is innocent in their eyes after all.

My biggest thing with this is are we truly to believe ANYONE in the office who provided this was that clueless not to triple check something being sent to Netflix?? I wouldn't be so sure that county is all cleaned up over there, they've had major corruption for years and many in with Alex or letting him slide by as he and his family had the "power".

If he does a deal then there will be no trial. We also have many trials that only have a trial because the defendant won't plead the very, very obvious guilty.
