Leon Circuit Judge James C. Hankinson set an April 13 trial date for Katherine Magbanua, whose charges in the murder of Florida State law professor Dan Markel ended in mistrial earlier this month.

Magbanua, wearing a blue Leon County Detention Center jumpsuit, appeared in the courtroom with her attorneys, Chris DeCoste and Tara Kawass. Hankinson asked about her legal representation moving forward; DeCoste said he and Kawass intend to continue defending her.

 

Judge in Donna Adelson murder trial disqualifies her new attorneys over conflicts​

Just three weeks after Donna Adelson’s murder trial unexpectedly unraveled when her lead lawyer withdrew, the judge presiding over the case ordered that her two new attorneys can’t represent her either.

Leon Circuit Judge Stephen Everett on Monday issued an order disqualifying Robert “Alex” Morris and Adam Komisar over actual and potential conflicts of interest.

It also likely means further delay in Donna Adelson’s trial as her new lawyers will have to spend time getting up to speed on the evidence. After her trial was postponed last month, the court was eyeing a window between November through early 2025, though even that seemed optimistic.
 

Donna Adelson hires former judge, local defense attorney to represent her in murder trial​

Donna Adelson, whose previous attorneys had to withdraw or were disqualified because of conflicts of interest, has hired a former prosecutor turned judge and a well-known local lawyer to represent her.

Court documents filed Wednesday show Adelson hired Jackie Fulford, a former circuit judge and chief assistant state attorney in the 2nd Judicial Circuit, and Josh Zelman, a Tallahassee criminal defense and DUI lawyer.

Fulford and Zelman, who each have their own firms, filed notice that Adelson is pleading not guilty to charges of first-degree murder, conspiracy and solicitation in the 2014 contract killing of Dan Markel.

The defense also demanded a jury trial and asked the state to hand over discovery, which it did earlier with her previous lawyers.
 

Donna Adelson back in court for first time since trial was derailed​


Wearing a purple Leon County Detention Facility jumpsuit, handcuffs and leg shackles, Adelson spoke softly with her attorneys but was otherwise silent during the short proceeding.
Her new lawyers, former Circuit Judge Jackie Fulford and Josh Zelman, both of Tallahassee, appeared with her for the first time since taking over her case .Both said they had no conflicts of interest in their representation of Adelson ― which was the issue that derailed her trial in September.

Fulford said that the defense, prosecutors and witnesses would be available for trial during a period between June 16 and July 2. Everett said he would need to check his personal calendar before scheduling the trial. "I want to be clear on this ― it's going to be firm," Everett said of the trial date. "There's too much logistics that are involved with moving prisoners, with everyone who needs to be brought to here for making this trial actually happen. So when that trial date is set, it is going to be firm."

 
Not surprised more attys gone by the wayside. I've stayed pretty abreast of this one although not in the past week or so.

She's going to run out of Tallahassee lawyers sooner or later.

And we will see I guess if it goes off on time.

She allegedly wants it tried and over but somehow I doubt it will be.

Who knows. I sure don't.
 

Appellate court ruling: Trial court won't hear conflict claims by Charlie Adelson​

The 1st District Court of Appeal has rejected a request by Charlie Adelson to allow his case to go back to a lower court — where he was convicted in the 2014 murder of Dan Markel — so he could raise conflict of interest claims in hopes of securing a new trial.

Adelson’s lawyer, Michael Ufferman of Tallahassee, asked the appeals court in October to temporarily relinquish jurisdiction of his appeal because of conflicts involving Miami attorney Dan Rashbaum’s representation of both Adelson and later, his mother, Donna Adelson, after she was charged in Markel’s murder following his conviction in 2023.

Last September, Donna Adelson’s murder trial abruptly imploded on the first day of jury selection.

Ufferman announced that his client wouldn’t waive conflicts involving Rashbaum. At the time, Charlie Adelson was listed as a state witness in his mother’s trial, setting up the possibility that he could be cross-examined by Rashbaum, his previous attorney.

Ufferman, in his motion before the appeals court, said Rashbaum’s conflict of interest “also infected” Charlie Adelson’s murder trial. He asserted that Donna Adelson, who was listed as a defense witness in her son’s trial, was removed from the witness list to protect her and not her son.

In a one-paragraph order Thursday, the 1st DCA denied Ufferman’s motion without elaboration.
 

Still a path forward for Charlie Adelson appeal after unfavorable court order​

The court denied Adelson's motion to relinquish jurisdiction back to the trial court.

But, local criminal defense attorney Don Pumphrey says he still has a path forward in his appeal.

"This does not mean Charlie Adelson won't get a new trial," Pumphrey said. "They're in the beginning of the appellate phase. It was filed by appellate counsel to preserve the record and give the opportunity for the trial court to address it."

Adelson is appealing his conviction for the murder of his ex-brother-in-law Florida State Law Professor Dan Markel.

His attorney, Michael Ufferman, wrote in a motion filed in October that his client's trial was "infected" with conflict.

He wrote that Adelson's former attorney, Dan Rashbaum, tainted his trial due to his representation of his mother Donna.

Ufferman said Rashbaum operated under "...duties owed to his former client Donna Adelson, whose attorney-client relationship pre-dated Appellant Adelson's."


"If you're representing one person and the timing is that you're now going to represent a second person and you're making decisions that could impact both people, that's not due process," Pumphrey said. "That's not fair to the person on trial."

The state responded to that motion, writing that the motion went around typical criminal appeal procedure.

Tallahassee Bureau Chief of Criminal Appeals Trisha Meggs Pate writes that he could follow a 3.850 ineffective assistance of counsel claim, which she writes ".... should be handled as a post-conviction claim of ineffective assistance of counsel."

"The court may have felt for a number of reasons, may have felt that this is an issue that can be addressed after the appellate process or there may be an issue in the appellate process, but it no way effects if Charlie Adelson gets a new trial," Pumphrey said.

Ufferman has not yet filed an appellate brief to outline any alleged issues with the trial.


I reached out to Ufferman's office Monday to see what his next steps are in the case.

His office did not get back to me.

While Charlie continues with his appeal, a trial date for his mother Donna has yet to be set.
 

Donna Adelson provides testimony in her murder trial regarding inmate witnesses​

The woman accused of murdering Florida State Law Professor Dan Markel gave new testimony.

Donna Adelson said she has met two women in the Leon County Jail that she wants to testify in her trial.

Her audio played in the courtroom as she called in from the jail to testify about two women who told Adelson they were in the Leon County Jail with Katherine Magbanua, one of Adelson's alleged co-conspirators.
 
Gee I guess Donna is making inmate friends. Who would have thunk? I wonder if any incentive changed hands...
 

Donna Adelson moved to protective custody at jail after alleged assault, extortion​

Donna Adelson, an alleged mastermind behind the 2014 contract killing of law professor Dan Markel, claimed she was "grabbed" and extorted late last year at the Leon County Detention Facility.

Shonda Knight, director of community and media relations for the Leon County Sheriff's Office, confirmed Thursday that Adelson complained of the incident Monday, more than a month after it allegedly happened. The Sheriff's Office is investigating the allegation.

"On Feb. 3, Donna Adelson alleged another inmate grabbed her by the arm in relation to an attempt to extort," Knight said. "She said this happened back in December. She said it happened in the bathroom area, not in the shower. She would not provide any information regarding the alleged suspects."

Knight said that as precautionary measure, she was placed in protective custody.

"She's just removed from the general population area so she's not in contact with other inmates," Knight said.

A source with knowledge of the matter said Adelson, who turned 75 on Wednesday, alleged she was assaulted more than once at the detention center. The inmate responsible had been threatening violence if Adelson didn't give her commissary items, the source said.
 

Judge sets bond hearing for Donna Adelson after defense complains about jail abuse​

Donna Adelson, alleging she has been physically abused and extorted at the Leon County Detention Facility, is asking to be released on bond pending her trial on charges she helped orchestrate the murder of Dan Markel.

In a motion filed Friday, Adelson’s lawyers said that the 75-year-old is suffering from a variety of medical issues, from shortness of breath to pain from injuries she suffered during an “attack” by another inmate who has been extorting her.

Her attorneys, Josh Zelman and Jackie Fulford of Tallahassee, wrote that she has experienced other instances of abuse at the jail, that she is getting only a couple of hours a sleep each night and that she hasn’t been able to converse with her lawyers because of jail noise and hearing issues. They said the conditions will result in “her inability to receive a fair trial.”
 

Donna Adelson's attorneys return to court, defense team asks judge to re-depose three witnesses​

The Donna Adelson case continues to move forward.


In court Tuesday, her defense team asked to re-depose three witnesses -- deposed by Adelson's previous attorneys.

Her defense said there was a deep conflict between the former attorney representing Donna Adelson and her son Charlie. The judge mentioned he would need to read the basis of the defense's request before making a decision.

"We’ve been working to schedule depositions with the state and this morning for the first time we learned that the state does object to us redeposing three of the states witnesses," said Jackie Fulford, an attorney for Donna Adelson.

The judge also reviewed the dates of the trial and discovery deadline.

According to court records, the next hearing will be held February 26, for three hours. It's a mini trial, called an Arthur hearing. Legal expert Don Pumphrey says it's a common practice.

"When you go to an Arthur hearing, the state has a higher burden so then the burden becomes proof, evident, presumption. So, if there is sufficient evidence under the Arthur standard the state has to prove a higher burden," said Pumphrey.

The judge kept the discovery deadline for April 30th. The trial begins in June.
 

Judge denies Donna Adelson request for bond in Dan Markel murder-for-hire case​

Donna Adelson will not be getting out of jail before her murder trial starts in June.

Last week, a tearful Adelson took the witness stand to testify that she had been subjected to physical abuse, unwanted touching and extortion by fellow inmates during her more than 15 months at the Leon County Detention Facility.

During a hearing that lasted more than three hours, her attorneys asked Leon Circuit Judge Stephen Everett to set bond — an option normally not available to a defendant facing a charge of first-degree murder.

Everett ruled against the motion to set bond on Tuesday, a day after he ruled against another defense request to exclude a potentially damning jailhouse phone call in which Adelson talked about the possibility of fleeing the country before she was arrested in the 2014 murder of Dan Markel.

Judge denies motion to suppress in Donna Adelson case​

A judge denied a motion to suppress evidence in the case of Donna Adelson, the woman accused in the murder of her son-in-law and FSU law professor Dan Markel.

According to court records, Donna received a call from her son, Charlie, who was at the Leon County Jail while she was at her apartment on November 7, 2023.

Before she spoke to him, records show, Donna acknowledged the phone call was not private and that the call was being recorded.

The documents go on to say Charlie was disconnected about eight minutes into the call. Then for the next 15 minutes with her husband, estate planning attorney, and the attorney's husband, Donna alluded to suicide, said she was looking for countries that did not have extradition agreements with the United States, wondered whether Vietnam has an extradition agreement with the U.S., and discussed a conversation she had with her daughter, Wendi Adelson.

Attorneys for Donna argued it was an "unlawful warrantless interception" to record her conversation after Charlie was disconnected because she thought the call and recording had ended.

The court concluded the defendant gave up her reasonable expectation of privacy when she answered her phone and consented to speak with her son. The court added the jail should be able to record for security purposes until both sides of the call disconnect.
 
I wonder if this family still considers it all worth it. I mean Wendy continues on with the sons and Dan out of the picture as they wanted but uncle is convicted, grandma is now in jail and probably headed to prison too, and mom I'd think has to be sweating every day as does grandpa while having to pay attys. and home alone.

THose kids if not already will one day see all there is out there about this case. Was it better for them to kill their father? Still? Really?

This is one EFFED up family. Whether Donna truly is dealing with anything in jail or not, she isn't special and needs to get that through her head. Hey, just pay them to make problems go away, isn't that what you've always done....
 

Motion denied to disqualify judge in Donna Adelson case​

A recent motion by the defense to disqualify the judge overseeing the high-profile case of Donna Adelson is denied.

Court records said the motion had insufficient evidence.

She is set to go to trial June 3, accused in the murder of her son-in-law Dan Markel in 2014.
 
This case is so nuts to me.

I know it, don't get me wrong.

Custody battles, money, etc. All I can say to anyone is IF you can, just get along.

It is better for the kids. What is WRONG with people?? I had an ex who rarely saw our kids and it hurt them badly, and in early days when he did, I for sure worried about what he was doing with them, seriously, BUT better for a kid generally I always figured to have all sides and more that care. But he didn't and quit seeing them, never paid support, hid, worked for cash, made it as hard as he could. Ramifications to this day, the effects.

This case is something else and those kids are NOT better off now. Some day they will read about all of this. It isn't always possible to get along with the other parent, they make it impossible perhaps, or the family does, but all I am saying is IF you can, it is better for the kids. ALWAYS.

This family is beyond. Imo.

YES, that's the kicker isn't it.... The one that deserves it arguably the most or at least as much as the rest... There is dad also but the things I've seen make it a bit unsure how much they involved him but he sure after the fact was about to flee with Donna, and so on. But yes, Wendy is the one everyone wants to see come down too.

I've followed this a lot, but other cases on lately as well, etc. and life.

I can't get over what some will do in custody, marriage, life. Family things are the most heated, marriages, custody sometimes. Here we have an entire family doing this allegedly.

I'd just ask again to them was it worth it? Are the boys better off with all this saga and so many arrested from their family? In prison or headed there? Dad dead? SMH, I could go on but there's no point and I'd just say no, it wasn't worth it. Seriously. WTH.
