Judge will allow use of confessions Cory Bigsby made about his son Codi's disappearance

A judge denied a motion to suppress confessions made by Cory Bigsby — the man accused of killing his 4-year-old son Codi.

Cory Bigsby's attorney argued that the confessions he gave to officers at the Hampton Roads Regional Jail in August and December of last year were made due to trauma Bigsby experienced in his four days at the Hampton police department in January and February of 2022.

Additionally, a judge granted the defense's request for all the body camera footage from the day Codi was reported missing when officers responded to Cory Bigsby’s apartment. The prosecution has seven days to get it to Bigsby's legal team.

Do I follow this correctly? He/his atty claims his confessions well over six months later were due to trauma from his days at the PD more than six months earlier? Well that's a great argument. Not. Smh, his son is the one who underwent TRAUMA..

Ya know, defendants have and should have rights but I am so sick to death these days of this new wave of it is NOTHING but the defendant. It already was not about the victims and all about the defendants but it has become WAY worse and who would have thought that possible. Oh it always is though.

Things that are RIDICULOUS should not even be allowed but they ARE. I am not even talking about only this case, there is a wave of it lately.

Why are they even fighting it, just plead guilty. Someone will let them out after one year in prison anyhow.

Cynical? Me? Yah.

Poor little boy along with all of the rest of this man's children. I don't know where the rest of his family was but they back the man it seems and not the child. Or the other children.

We don't know all and never can but this child is dead. That is NOT MINOR. And there is not one HINT anyone but dad was responsible in this one. And yah we have confessions that he now wants to make excuses for.

This is the case if I am not mistaken and I don't think I am, that the main judge recused himself and ALL of the other judges in that county. Never have we known why and I can only guess that it is due to this man and his family and prior dealings and knowing what would come. Only a guess. Who knows. Never before, it was discussed, has such been seen where an entire slate of judges take themselves off of being able to be put on the case before they even are.

Taking a moment this dark more to think of this LITTLE BOY. In wanting justice, one wants an arrest but from that very point, it becomes about the defendant entirely and not about the victim. In that, there is NO balance--yes defendants have rights and should--but the victim more or less disappears and it is now the show that has one single star and rights on only one side, the defendant's. And the delays and the new wave of ridiculous stunts and defenses have gone beyond the pale and make nothing but a joke of the system. It has gone way too far.

But in this case, at least, the confessions stand.

Tribute for missing Hampton boy Codi Bigsby to be taken down

A tribute for a missing Hampton boy will be coming down, nearly two years after the child's disappearance.

Posters and toys currently sit along the fence at Hampton's Buckroe Apartments in honor of Codi Bigsby. The tribute went up days after the boy's father, Cory Bigsby, reported him missing on January 31, 2022.

No one has seen Codi since.

Now on what would be his sixth birthday, a notice hangs on the fence, saying all items will be removed by February 5, 2024.

Some community members say it's upsetting.

"It's very heartbreaking because that's the only thing we have left of Codi," said resident Nancy Strickland. "Until he is found... that's it."

City of Hampton spokesperson Mike Holtzclaw said signs typically are not allowed at city parks without prior approval, but officials had allowed the memorial display to stay up due to the "strong community response" for the search of Codi.

"Now that an arrest has been made and the case is in court, the City decided it is appropriate [to] enforce the rules and remove the objects," Holtzclaw said in a statement. "Notice was posted on January 2, 2024, that any remaining items will be removed on February 5, 2024, to give people time to remove any items they want to keep."

Cory Bigsby is accused of killing his son, and is scheduled to go to trial in March on charges of murder and concealing a body.

I don't know that this is a big deal or not at this point but if this was okay and not a problem before now then why is it now. Justice hasn't been served yet where they talk as if an arrest changed the need for this but I don't see how any of that relates.

This child's body has still not been found and justice has still not resulted.

Also isn't this the case where like the top judge recused himself and every judge in the county....

Virginia lawmaker introduces missing child alert after Codi Bigsby's disappearance

The disappearance of Codi Bigsby left a mark on Hampton Roads and the rest of the country. Nearly two years later, one Virginia delegate created a new proposal aimed to make sure Codi's story is not repeated.

Hampton Delegate, AC Cordoza, introduced a bill called "Virginia Critical Operation for a Disappeared Child Initiative (Codi) Alert Program."

If passed, the bill would create an emergency alert system aimed at helping individuals under the age of 18, whose whereabouts are unknown, and their disappearance is under suspicious circumstances or poses a threat.

It's something those in Hampton said is badly needed.

"How many kids a year go missing; how many more could we be helping?" questioned one Hampton resident. "We need our legislators to do something in Richmond. I need for them to vote for this."

"As a father of two girls, who are both under two years old, I would gladly support something like that," said another resident.

Currently, there are several alerts in place to find abducted children or people. The Amber Alert deals specifically with abducted children, and the Ashanti Alert is for abducted adults.

Lawmakers are set to take up the bill during the 2024 Virginia General Assembly.

I have several thoughts on this. While it sounds good, there are how many different alerts in some areas and the criteria differs in all. The Amber Alert started out as a sweeping HUGE beneficial deal and we've come to find out in years later how it has changed and changed state to state also.

All mean well I'm sure. I don't think the problem is the people, it is the b.s. of the system.

I find it heartless. Justice has NOT been served!!! Not disclosing the location of his body. And the trial isn't even over. They allowed it there was a strong public reaction. They will get one NOW!!!! It really is his temporary headstone

It is heartless. If it hurts nothing then leave it and be gracious and caring. Stupid world, major b.s. about something that doesn't affect anything greatly, just a tribute for a CHILD. What is the big deal.

Dad knows where Cody is. Evil loser. But many in his own family support him AND all county judges were recused in this one. Something more goes on there... Have to only try to imagine what...

Maybe he and family make huge waves and none want to deal with them? What's the deal with that? Seriously.

Get this man convicted already!

You know what? It isn't right but I am all for offering them like pizza on Fridays and a thermostat in their cell IF they give them the info to find the childs' bodies to bury properly and return to loved ones.

‘CODI Alert’ hopes to fill gaps left by Amber alert system: Hampton Del. Cordoza

There are nearly 500 missing children in Virginia. Not all are covered under the Amber Alert—as we saw with Codi Bigsby, the four-year-old who was never found after being reported missing January 2022.

However, a House Bill, named in his honor was introduced recently and would help with those who fall through the cracks.

After Codi went missing, there was no Amber Alert issued, which upset many people. What they didn’t realize was that certain requirements must be met for an Amber Alert to be sent. And Hampton Del. A.C. Cordoza wants to help fix that.

“So, I remember my mother used to tell me back in her time that the entire community looked out for people’s children,” Cordoza said. “We kind of lost that in the digital age.”

Now, Cordoza wants to improve the solution for the digital age. He introduced the CODI Alert bill that would widen the parameters of what’s required to report a child missing.

The CODI Alert steps in, he says, where the Amber Alert falls short. For instance, an Amber Alert commonly deals with people witnessing the abduction of a child.

“This one can pretty much cover every missing child but runaways. It doesn’t necessarily only speak of ‘we’ve seen someone snatch a child,’” Cordoza said.

A CODI Alert also would allow law enforcement to trigger the alert right away—popping up on phones in a 10 mile radius of where the child lives and where they were last seen. Plus, every 10 minutes after that, the alert would be updated to include to a larger radius, making the alert, Cordoza said, much more effective.

“That’s the whole thing, we’re trying to save some children’s lives, get them back home with their families, make sure everyone goes home every day,” Cordoza said.

State Sen. Danny Diggs introduced this same bill in the Senate, where it has passed 40-0. Cordoza hopes the delegation can pass it soon. It could be law as soon as July 1.

Codi Bigsby disappearance: Wednesday marks 2 years since 4-year-old was reported missing from Hampton

Wednesday night, dozens gathered to light a candle in honor of Codi Bigsby, two years after the 4-year-old boy was reported missing from his home in Hampton.

“Codi’s a very special baby. I think he captured the hearts of a lot of us," said Nancy Strickland, who started the Facebook group "We Are Codi's Voice."

The candlelight vigil was held at Buckroe Pointe Apartments, where a tribute for the boy has stood since 2022. The memorial is known as "Codi's Fence."

But as the night came to an end, people removed the tributes they placed years ago.

“Just surprised that they let it stay this long. Normally memorials don’t last two years…So, we appreciate, we’re grateful, but we’re also sad," said Annette Parker-Williams, who attended the vigil.

“It’s sad, you know, that the fence has to come down, but we kind of knew," Strickland said. "It couldn’t be up here forever.”

A notice on the fence says crews will remove all items next week, but people who attended the vigil say the fence will always serve as an unofficial reminder of Codi.

“I just love Codi, everything about him. He touched everybody’s heart," said attendee Amanda Randall.

“They can take the fence but they can never take your memory from me.” Codi Bigsby memorial removed per city request

The City of Hampton Parks & Recreation posted a notice that said a memorial for a missing boy must come down Feb. 5.

The fence is named after 4-year-old Codi Bigsby, who was reported missing two years ago.

The Codi Fence has become a place for the community to gather and mourn.

But now, all the symbols of hope tethered to it must be removed.

The fence is on Old Buckroe Road along the Hampton Soccer Field, near the apartment where Codi was last seen.

An advocate rallying for justice for Codi said someone on the Parks and Rec board told her the items must be removed because a charge was made in his death.

“I asked him to please, let’s just keep it up for a little bit longer. And he’s like, we are going to leave it up past the two-year mark,” Nancy Strickland, of We Are Codi’s Voice said. “So he was like, it will come down on February 5th. So if there’s anything that you want, go ahead and come out there and get what you need or get what you want,”

She said anything left behind in the city would be put into storage until someone claims it. However, as of Monday morning, all items other than a Merry Christmas sign were removed.

“It breaks my heart that we have to have to take it down,” said Strickland. “They can take the fence, but they can never take your memory from me. I love you Codi Bigsby.”

Cory’s jury trial is scheduled for March 4, 2024.

Memorial for Codi Bigsby removed from Hampton fence

While 4-year-old Codi Bigsby is still missing, a memorial for the boy has been cleared.

"It's heartbreaking to see it gone," Nancy Strickland, with We are Codi's Voice, said. "I'm like now where do we go."

People who searched for Codi two years ago, like Strickland say they are still holding on for hope and want to see how this plays out.

"I understand that life goes on, I do understand that but you can't let him be forgotten about until justice is served," Strickland said.

Judge removes doctors from Cory Bigsby witness list who would've testified about his mental health while in jail

The father accused of killing his then 4-year-old son and concealing his body appeared in a Hampton courtroom on Tuesday morning to determine if two specific witnesses would be allowed to testify in his upcoming trial.

Cory Bigsby’s legal team wanted to have two doctors who had determined if he was fit to stand trial be added to the witness list. They claim they wanted the jury to hear about Bigsby’s mental health while he was in jail.

Prosecutors argued the doctors were only hired to determine if Bigsby was competent to stand trial, and nothing more.

The judge ultimately sided with the Commonwealth and took the two doctors off the witness list during Tuesday's hearing.

His trial is set to begin on March 4 in Hampton.

HAMPTON, Va. — The Virginia General Assembly has passed identical bills that would establish the Codi Alert program for missing children, sending the legislation to Gov. Glenn Youngkin's desk.

Named after Codi Bigsby, the child who was reported missing from Hampton in January 2022, the bills would create an emergency alert system aimed at helping individuals under the age of 18, whose whereabouts are unknown, and their disappearance is under suspicious circumstances or poses a threat.

So not making the Amber Alert an alert for any missing child which I always thought was the original intent which has changed but making another alert.

Then of course there are Silver Alerts and various things for various states and I think some kind of emergency thing some manage to get an alert on if they can claim danger or some medical condition if has to go without medication and so on.

Welcome to government.

I don't know maybe it is stupid versus too much red tape and protocol and ridiculousness but how about an alert for any missing person when first realized missing? At the crucial time and moments that matter (if true and the case of course).

It wouldn't bother me any to get all alerts on my phone and if one doesn't want them or care, let them shut them off.

If like in Harmony's case and this one and so many, the child went missing long before and was never reported so what? Blast it at its earliest reported time in hoipe someone wills ay wth and call in.

It's great that we could have a law under every child or victim's name, what was the other recent one, can't think of it, but there was recently another. State law I think.

The Amber Alert was a sweeping win back when and meant to be nationwide and for all missing children was it not? And somewhere along the line in these past years we have learned no, not the same anymore, there is criteria and state to state too and it is not the thing it was when such a big win and passed.

I'm glad Cody may get a law just like Amber and any victim has. It's sad though we should need one for each victim and circumstance, adult or child. It just goes to show how ineffecient and ineffective our government is.

I have always also appreciated most of my life that each state has their individual autonomy over some things unless federal law rules it but in recent years and some long ones now, we also are seeing where that is not a good thing. I do think it better generally when one doesn't run ALL but it can backfire as well.

There is nothing about the original Amber Alert law that is not better for all than how some have amended in years since, other than maybe agencies having to abide by it and do their work. Too many teenage runaways in your area that trigger it? Then DO something about it the problem in your city.

I don't know. I'm happy for Cody's Law but for a long time we all thought we had one til we learned t wasn't thes same any more just as we learn too late sentencing and release, etc. are not the same any more, AFTER the FACT.

A look at the road to trial for Cory Bigsby, the man accused of killing his son Codi

More than two years after reporting his young son missing to Hampton Police Division, Cory Bigsby will stand trial in connection to the child's murder.

Bigsby is accused of killing Codi and concealing his body.

Jury selection is set to begin Monday, where 13News Now crews will monitor developments in the courtroom.

Justice for Cody just as there recently was for Harmony. The both deserve nothing less!

Praying for a well tried case and a unanimous guilty verdict.

Trial begins for Cory Bigsby, the man accused of killing son Codi

The trial for Cory Bigsby, the man accused of murdering his son Codi, began on Monday.

Jury selection began Monday morning at Hampton Circuit Court with Judge James Hawks presiding. During the morning hours, Hawks would not allow the public into the courtroom during the process but he did open the courtroom in the afternoon.

Commonwealth's Attorney Anton Bell and defense attorney Curtis Brown questioned potential jurors, one by one. They would ask questions inquiring about their knowledge of the case including media exposure. They also asked about any encounters with law enforcement officers.

Late Monday afternoon, a potential juror said in court that another potential juror had made a comment about the Bigsby case to her while in the courthouse. Afterward, Brown told the judge, "Your Honor, I'm moving for a mistrial!"

Judge Hawks overruled, and the selection process continued.

Attorney Sonny Stallings, who is not affiliated with this case, recently told News 3 it would likely take a day or two to pick the jury.

"A lot of jurors are going to have heard about this," Stallings said.

The court is trying to pick a potential pool of 24 jurors, 69 were called to Hampton Circuit Court. It will be narrowed down to 14 which would include two alternates. That process will resume Tuesday at 9 a.m.

Bigsby murder trial updates: Jury selection continues in Hampton, Virginia

Jury selection for the trial of the Hampton man accused of murdering his son, 4-year-old Codi Bigsby, is continuing Tuesday.

13News Now's Angelique Arintok reports that attorneys are questioning potential jurors in the first batch of people. The next batch should be called in after lunchtime.

22 potential jurors have been selected, 2 more are needed. Once those two are chosen, a jury will be seated and opening statements will begin.

Jury selection in Bigsby murder case takes 2 days — and counting; trial expected to begin Wednesday

It took two days and lots of questioning, but lawyers in the Cory Jamar Bigsby murder case were able to whittle down a list of about 70 potential jurors by day’s end on Tuesday.

They now have 26 would-be jurors that a judge has ruled qualified to serve.

Attorneys from both sides will make their own “peremptory” strikes Wednesday — with Judge James Hawks ruling that each side will be able to quickly cut six people of their own choosing that they don’t want on the jury.

That process will result in 14 jurors left standing — the 12 required under law and two alternates — to hear the murder case of Bigsby that’s expected to finally get underway Wednesday morning.

Defense asks judge to recuse himself amid jury selection in Cory Bigsby trial

Shortly before noon, Lead Defense Attorney Curtis Brown said to Judge James Hawks, “I’d like to make a motion that you recuse yourself.”

This happened after one potential juror said he would need evidence of a body and an autopsy. The Commonwealth moved that he be stricken from the potential pool of jurors. The judge agreed, and Brown got upset, saying it appeared the judge was siding with the prosecutor.

Judge Hawks overruled that motion and the jury selection process moved forward.
