Police: 6-year-old boy missing in Middletown
Middletown Police are searching for a missing 6-year-old boy named James.

He was last seen in the area of Crawford Street, though new information to police has led them outside the city limits.

James is approximately 3’ tall and 42 lbs. He has dark blond/reddish hair and blue eyes.

He was last seen wearing a red shirt with blue and red Batman pajama pants.


Middletown police expand search for missing 6-year-old​

A 6-year-old boy is missing from Middletown, Ohio, police said in a Facebook post on Sunday.

The child, who was identified only by his first name, James, was last seen in the area of Crawford Street, police said initially. Police now say new information has shifted the search outside the city limits.

$2 million bond set for Middletown mother accused of killing 6-year-old​

The mother who police say admitted to killing her six-year-old son had her bond set at $2 million Monday afternoon. She entered a plea of not guilty.

Brittany Gosney and Hamilton face a combined 31 felonies in the death of James Hutchinson.

James Hamilton also pleaded not guilty. His bond was set at $750,000.
 

Mother charged with James Hutchinson’s murder not eligible for death penalty​

The are still many questions surrounding the punishment for the Middletown mother charged with the murder of James Hutchinson. While it is unknown currently how many years she could face if found guilty, one potential punishment is off the table: the death penalty.

Brittney Gosney, 29, was indicted on 16 felony charges including murder, involuntary manslaughter, tampering with evidence, child endangering, kidnapping and gross abuse of a corpse following the murder of her 6-year-old son on Feb. 27.

Hagel explained that for a case to be eligible for the death penalty in Ohio, the defendant must be charged with aggravated murder.

“To charge and convict somebody with aggravated murder, you have to prove that the killing was purposeful; meaning that the person had specific intent to kill the person,” Hagel said. “Plus, there has to be the presence of what’s considered an aggravating circumstance.”


Hagel’s took Gmoser’s explanation and said he was saying “killing or causing the death of if you will, of this child, was not purposeful.” Without the purpose to kill, Gosney cannot be indicted on aggravated murder.

“It may be reckless, it may be negligent, what have you, but it’s not a purposeful killing,” Hagel said.
 
And here I sit, not even sure if I even buy into her original "plan". I have a big problem believing everything that comes out of the mouths of the perps, even when a confession, I feel it is often not a full one or they whitewash some... Even so, yes, she should have reasonably known dragging him or him hanging onto a moving vehicle could kill him or cause great bodily injury--that might be a bit different than actual intent though to murder him?

Finding him could lead to other charges but the condition with time passing he might be found in might make that unlikely too.

I wonder what the other children had to say...

North Star International and Ohio LandSAR were unable to locate the bodies of 6-year-old James Hutchinson and 3-year-old Nylo Lattimore after they conducted a 6-hour search in Lawrenceburg Saturday.

Gmoser said a group of divers are on the scene and will be working to locate any body.

Multiple law enforcement agencies were on site where crews have been searching for the body of a 6-year-old Middletown boy who police said was killed at a Preble County park, before his body was dumped into the Ohio River.

Sonar technology used by Boone County Water Rescue and the Hamilton County Police Association Team alerted authorities to an area of the river near the Carroll Cropper Bridge near the Ohio-Indiana border.

“There was a target of interest that we felt important to fully review,” said Michael Gmoser, Butler County Prosecutor.

Authorities have been searching this same area for the body of James Hutchinson.

“We had a high level of confidence that this target would be the remains of a human being,” Gmoser said. “Under the circumstances, I and my staff wanted to be present with the hopes that that would pan out.”

A body has not been recovered at this time, however there are still additional areas that need searched.

Search for boys’ bodies ends for now on Ohio River after sonar indicates body possibly in water​

The search is over for now on the Ohio River for 6-year-old James Hutchinson and 3-year-old Nylo Lattimore after divers spent the day searching the murky, rapidly-moving water.

Sonar imaging indicated there was a high degree of confidence there was a body below, according to Butler County Prosecutor Mike Gmoser, who was on scene most of the day.

“Search operations have concluded for the day on the Ohio River,” Preble County Sheriff Mike Simpson said in a news release Wednesday night. “Multiple agencies converged in the Lawrenceburg, Indiana area and were on the river nearly all day. They were searching for James Hutchinson and Nylo Lattimore. Neither of the boys were located.

The rapidly moving water made conditions difficult Wednesday evening.

“The river is flowing at at least two miles an hour,” Butler County Prosecutor Mike Gsmoer said. “Ordinarily, the divers don’t get in the water if it’s over one mile an hour.”

It’s not clear when divers can return to the swollen Ohio River, which is expected to rise in the coming days as rain moves in tonight with severe thunderstorms possible Thursday.

“Teams will continue to monitor the weather and river conditions over the next few days and will return as soon as they can safely do so. Divers still face difficult conditions on the river. Our efforts will continue as soon as possible.”
 

Ohio mother charged in 6-year-old son's death seeks insanity plea​

The attorney for an Ohio woman charged with the murder of her 6-year-old son is seeking to enter an insanity plea, court records show.

Brittany Gosney, 29, was indicted earlier this month on 16 counts, including murder and abandonment, in the death of James Hutchinson, 6, who police say was dumped in the Ohio River and has yet to be recovered.

"[Gosney] struggles to assist in her defense, and counsel has serious concerns regarding defendant's mental health," her attorney, David Washington, wrote in a motion filed in Butler County court Wednesday requesting leave to file a plea of not guilty by reason of insanity and ask for a competency evaluation.

Gosney's boyfriend, James Hamilton, 42, was also indicted on 15 counts in connection with the first grader's death. He has pleaded not guilty.
 

Gosney's lawyer, David Washington, told Judge Noah Powers on Monday that he intends to file a "not guilty by reason of insanity" plea for Gosney. Prosecutors did not object.

Powers said Gosney's sanity at the time of the offense as well as her competency would be evaluated. The judge scheduled a competency hearing for 9 a.m. April 26 to examine the result of psychiatric evaluations.

"(The) Defendant struggles to assist in her defense and counsel has serious concerns regarding defendant's mental health," Washington wrote in court documents.

A Preble County Sheriff’s report says Gosney claimed she was under pressure from Hamilton to get rid of the children.

Both Duraleano and Marlene are traumatized by the loss of their nephew. They are unable to wrap their heads around Gosney’s actions. The aunts are bracing themselves for the worst as this case unravels.

“I know there's more to it,” said Marlene.

The prosecutors submitted a mound of evidence on Tuesday, including, but not limited to, jail phone calls Gosney and Hamilton have made since they were arrested and several video recordings from their Middletown residence.

Both Gosney and Hamilton are looking at felony crimes against all three children, including murder, kidnapping and abuse of a corpse.

I can't say I am surprised sadly. Both of these two need to rot. Lord knows what all these children went through.

I'm pretty sure this goes against her not knowing right from wrong. Covering up whst happened sure seems to mean she knew what she did was wrong.

I agree she knows right from wrong. They keep stating that she seems incapable of helping in her own defense but imo there is no defense!

Exactly!!!!!

The Insane defense is not working for me. If The judge allows this, I’m going to be so furious. I’m sure all of you will be too.
