Police seem to be no closer to finding 7-year-old Joshua “JJ” Vallow and 17-year-old Tylee Ryan than they were when this story began months ago.

Since that time, the story has gained international attention as it’s taken twists and turns involving a purported cult, dead spouses, delusions of divinity and preparing for the end of the world. Despite all the angles, and the ever-growing number of people related to the case, the facts remain essentially the same as when it was first announced.

The two children remain missing and the parents, Lori (Vallow) Daybell, and her new husband, Chad Daybell, refuse to disclose their whereabouts to police. Both have been named persons of interest in the disappearance of the children. Law enforcement is also investigating the deaths of the Daybells’ previous respective spouses, Charles Vallow and Tammy Daybell, though neither Chad nor Lori have been named suspects in those cases.

Chad and Lori to be tried together once Lori is deemed competent

Seventh District Court Judge Steven Boyce has agreed that murder suspects Chad Daybell and his wife Lori Vallow-Daybell should stand trial together.

Boyce made the decision during a hearing held Wednesday via a Zoom broadcast.

“I am going to set one trial — one trial for both defendants. We’ll hope that we can get both defendants to trial,” Boyce said.

Madison County Prosecutor Rob Wood and Fremont County Prosecutor Lindsey Blake filed paperwork on Wednesday asking Boyce to try the couple before the same jury.

That won’t happen anytime soon as Vallow-Daybell’s case has been placed on hold for at least six months while she undergoes restorative treatment. Vallow-Daybell’s ongoing treatment means Chad Daybell’s trail is also on hold.

In Wednesday’s filing, the prosecutors said that the Daybells “were properly joined in one indictment and no grounds for severance have been provided.” In May, a grand jury indicted the couple for the murders.

Prosecutors cited an Idaho Supreme Court ruling stating the following.

“(The) joinder of two or more defendants is proper if they are alleged to have participated in the same act or transaction or in the same series of acts or transactions constituting an offense or offenses,” it said. “Joinder under a common scheme or plan theory requires ‘Two or more crimes so related to each other that proof of one tends to establish the other.”

Wednesday’s court filing alleges that data compiled in the Daybells’ case shows the couple conspired together to commit the murders of the three victims.

So I guess there was another hearing yesterday. Scott of Crime Talk aired it and I am linking in this post. Not overly long, lots of grandstanding imo. It appears there will be a change of venue or partial one as both sides agree on that although the Judge has to agree there is need for it. There is now argument on whether the jury from another county should be brought to their county or if the trial should be held in another county and then about sequestration or at least it appears this will all be argued.

Prior is upset being given documents, motions, pleadings or whatever at the last minute and then expected to have an argument filed or ready in short order, in this case for instance by Tuesday and he just hears this now.

Anyhow, it is kind of interesting. I still have to say this thing about defendants not having to appear I really don't understand. Same thing just happened with Leticia didn't it?

I haven't watched this yet. Just into the first few minutes so sharing. So far it is an interview of Lori with Chandler Police Department. My guess is it is from the releases mentioned above. This is from Crime Talk/Scott Reisch who I think is pretty well respected and a good source. He airs a lot of hearings, videos, etc. This one starts out straight to a PD interview of Lori...

This is the interview of Mel Gibb with Rexburg PD. I wonder why it is they released these all now, glad they did though. I only wish I had time to watch them all but don't right now. Going to have to be in bits and pieces for me. Pretty long this one.
