WAYNESBORO, Va. (WHSV) - An Augusta County girl who is presumed to be dead would have celebrated her fifth birthday on Monday, Dec. 5.

A group of community members plan to gather this weekend to honor her.

“When I first heard her story, I just felt like there were a lot of people who didn’t care about her. I just feel like god placed her in my heart, and then I felt like the least I could do was to try to get her story heard and advocate for her,” said Erin Landes, one person who tries to raise awareness for her story.

She said learning more about Khaleesi’s story will help other kids in the future.

Court documents show evidence to be used in the case of Khaleesi Cuthriell

Court documents have revealed some of the evidence that will be brought to light once the trial in the death of Khaleesi Cuthriell begins.

The Virginia Department of Forensic Science searched Candi Royer and Travis Brown’s home in Augusta County in 2022.

Multiple items of evidence were reportedly taken from the home, and three came back to be positive results for Khaleesi Cuthriell’s DNA.

Hair samples were taken from a wire handle wrapped in tape, and a blood sample was taken from two wall swab samples.

The DNA for all three of those items are believed to be Khalessi’s, after matching it with her biological parents’ samples.

Brown’s five-day jury trial is set to begin on Aug 28. and last through Sept 1.

Royer’s trial is set to begin on Oct 16 and go through the 20.

Wow I can feel hatred for some. Just LOOK at this little girl and her sweet face. Just a BABY. Now she is just DNA found on evidence of brutal wrongdoing to her.

Community pushes for justice in Khaleesi Cuthriell case and child protection

People are keeping hope alive in the case of Khaleesi Cuthriell. The disappearance of the 3-year-old girl hits home for some wanting justice, whether they have a personal connection or not.

Attendees of the justice walk described the timing as a perfect day for outreach. They said they find strength through their peaceful assembly.

The Justice for Khaleesi organization believes the maltreatment that happened could have been prevented.

The movement is not only for justice in this case but to encourage others to stop incidents like this from happening again.

“Everybody needs to stick together, become as one and not divided, and we need to pay attention to our surroundings, and what’s going on around us,” Thompson said.

The scheduled jury trial that inspired this walk has been postponed to October. Advocates want to be heard in the meantime as they anticipate justice will be served.

“Even though everything was delayed, we still care about Khaleesi and the children that are missing. We are their eyes and we have to keep moving on,” Thompson said.

One of the organization’s next steps is planning a trunk or treat to honor Khaleesi, aligning with the new court date for one of the offenders.

First Khaleesi Cuthriell case headed to trial this month

One of the suspects in a three-year-old's death is slated to face an Augusta County jury later this month.

Travis Ryan Brown is one of two people accused of killing three-year-old Khaleesi Hope Cuthriell in early 2021. Brown and his co-defendant, Candi Jo Royer, had been caring for the child in their home outside of Waynesboro.

Brown appeared in court on Tuesday morning in an orange jumpsuit and handcuffs, and pled not guilty to eight felonies. He is facing charges of felony homicide, aggravated murder, concealing a dead body, child abuse, child cruelty, and conspiracy to commit several of those crimes. If found guilty by the jury, he opted to have the judge choose his sentence.

Also on Tuesday, Judge Shannon Sherrill heard arguments in two motions relating to the case. In one, he ruled that four exchanges via text and social media messages between Brown and Royer were admissible as evidence. Brown's attorney, Dana Cormier, had argued that the communications amounted to hearsay.

In one, Royer wrote to Brown,

"I hope you rot in hell. … Do you lie in bed at night thinking about what you did to that little girl?"

Assistant Commonwealth's Attorney Alex Meador told the court that at that time Khaleesi had been dead for months. Meador added that Royer would bring up these accusations when she was upset by Brown getting together with other women.

Judge Sherrill did not yet make a decision regarding the other motion, which had to do with limiting which prior bad acts could be presented to the jury. The trial is scheduled to begin on Friday, August 25th. Royer's trial is currently scheduled for October. The judge noted that witnesses and attendees would not be allowed to wear customized apparel with Khaleesi's name or photo, or carry banners.

Candi Royer’s legal team asks for trial venue to be moved, judge holds off on decision

Candi Royer, a woman accused of killing an Augusta County child, Khaleesi Cuthriell, appeared in court Tuesday afternoon.

During Tuesday’s pre-trial motion hearing, Royer’s legal team asked to move the trial out of Augusta County.

Ultimately the judge ruled this motion as advisement, meaning he isn’t ready to make a decision on it yet.

The judge said he has confidence in the court to find an impartial jury.

He said he wants to wait and see how Brown’s case goes.

He differed his decision until after that time.

We weren't allowed to either. Even worse, they couldn't even show the jury a pic of her alive and smiling in life.

How much do you want to bet though if a defendant had a family or group proclaiming his innocence that they would be allowed as after all, defendant's rights, ya know, to wear a button, t-shirt, etc.

Think about it. Our buttons said prayers for ______ not justice, not that he did it, etc. She was the VICTIM. We wore them everywhere outside of court and long before trial. Not t-shirts, not a protest. The trial is about that dead person and again they didn't say he did it or a word about him. And weren't a protest, big group or anything but nope. And imagine this, no pic of her in life, just autopsy pics of her body. Can't make the victim real to the jury I guess. It may affect the defendant's rights and appeal or something even though again she is dead and again nothing said about him doing it, forget the buttons, why can't she be shown in life to a jury?!!!
Another poor little girl here stuck with monsters. MONSTERS.

RIP Khaleesi. At least when public people can see a pic online of you in life. Too short of a life.

225 jurors called for Augusta County murder trial in killing of Khaleesi Cuthriell

Nearly two years after it was announced that a Staunton girl was dead, a much-anticipated trial for one of the two suspects accused in her killing is set to begin Friday in Augusta County Circuit Court with jury selection.

Because of the amount of media publicity the case has generated, a total of 225 potential jurors have been summoned, well over the usual amount of people called for a jury trial.

Travis Brown, 31, of Waynesboro, is charged with aggravated murder, murder, child abuse, concealing a dead body, conspiracy to commit aggravated murder, conspiracy to commit child abuse and conspiracy to conceal a dead body. Candi Jo Royer, 43, who was Brown's live-in girlfriend, faces identical charges and will head to trial in October.

Justice for Khaleesi Cuthriell still demanded days before defendant’s trial

Khaleesi Cuthriell of Augusta County was reported missing at just three years old in 2021. As Travis Brown awaits trial for her murder, activists held another “Justice for Khaleesi” walk to honor the child and raise awareness of the tragedy.

“Justice is coming, but Justice is not here yet and I think it’s still important to keep her story out there she still has not been found,” Justice for Khaleesi Leader Erin Landes said.

The walks are described as a symbol of Khaleesi not being forgotten.

The jury has been selected for Travis Brown’s five-day trial starting August 28. With the Travis Brown trial underway many of Khaleesi’s biggest advocates feel that every march organized is one step closer to justice being served.

The jury selection took hours to complete on August 25. According to the judge, at least 40 people are willing to testify.

“I pray that the jury is able to see the truth through the evidence, and I just pray for everyone that’s involved in this case,” Landes said.

Suspect in toddler's killing in Augusta County claimed child 'liked to be smacked'

When Khaleesi Cuthriell went to live with Travis Brown and Candi Jo Royer in October 2020, the toddler had thick hair, was in good health and her cheeks still carried hints of baby fat.

"She was so beautiful," said Augusta County Commonwealth's Attorney Tim Martin during his opening statement Monday on the first day of Brown's murder trial.

But less than three months after moving in, evidence showed most of her pale body was already covered in bruises, scrapes and burns. Large swaths of hair were also missing from the 3-year-old. Video of Khaleesi taken Jan. 12, 2021, perhaps her last day alive, according to Martin, showed a frightened and confused child being verbally berated while made to stand naked in a dry bathtub in her own feces.

Brown, 31, and Royer, 43, both face murder charges in the toddler's killing. Her body has never been found.

About 30 witnesses are expected to be called for the week-long trial in Augusta County Circuit Court.

In 2020, Khaleesi's mother, Amanda Arey, was struggling with drug use. After violating her probation, she was headed back to jail and wanted to hand her daughter over to a family member. But Child Protective Services in Augusta County, a division of Shenandoah Valley Social Services, stepped in and blocked the move, testimony showed. Arey then opted for Royer, who has a young daughter with Brown who is slightly older than Khaleesi. The couple lived together on Cattle Scales Road in Augusta County.

Evidence showed that a police officer and a CPS employee took Khaleesi over to Royer and Brown's home just outside of Waynesboro in October 2020. At the time, Royer was on home electronic monitoring for an unspecified criminal offense. After the CPS employee left, she never went back to the residence on Cattle Scales Road, according to her testimony. Within weeks, Khaleesi was referring to Brown and Royer as "Mommy and Daddy," evidence showed.

While behind bars at Middle River Regional Jail, Arey testified Monday she spoke to Khaleesi about every two weeks by phone until contact became infrequent and then stopped altogether. "She was my whole world," Arey said. "My best friend."

Arey said she was given a number of excuses as to why she couldn't speak with Khaleesi when she contacted Brown and Royer, such as the pandemic or that Khaleesi was sick. But most times her calls went unanswered. Arey's relatives then provided Royer and Brown with a phone in a failed effort to facilitate further communications, according to testimony.

Arey said she wrote a letter to CPS in an effort to have them do a welfare check on Khaleesi, but said she never got a response from the government agency. "No one ever contacted me back," she testified.

In her last phone call from jail, which was played in court, Arey told Khaleesi, "I love you! I can't wait to see you. Mommy misses you."

By September 2021, Arey told a jail officer she'd lost contact with her child, and the Augusta County Sheriff's Office immediately started an investigation. That same month Brown and Royer were captured at a Knights Inn motel in South Greensburg, Pennsylvania, and Augusta County Sheriff Donald Smith announced Khaleesi was dead.

Martin said investigators, who served more than four dozen search warrants, combed through nearly 50,000 photos, videos and communications connected to Brown and Royer. In one video, Royer is filming the toddler when she's heard telling the somber child "nobody likes you, Khaleesi." In another video where Khaleesi is shown in the dry bathtub, her thin body covered in bruises while she stands in her own feces, Royer repeatedly screams at her. After Royer sent Brown the same video, hours later he responded, "What if our girl looked like that hahahahahah."

Photos showed Khaleesi had a battered and bloody face, and also injuries to her feet several weeks after arriving at the couple's home. In another photo, the toddler was shown slumped over a toilet.

Following his arrest in Pennsylvania, when asked if he knew where Khaleesi was, Brown told two Augusta County investigators that a CPS employee had picked her up in a state car, but said he didn't actually witness it. "It was such a relief," he said on the video that was played in court.

Brown made a number of outlandish claims during questioning, telling investigators the toddler "liked to be smacked" and that she acted like she was "possessed." Brown also claimed he woke up one night to grab a bite to eat from the kitchen when he spotted Khaleesi choking his daughter. He also claimed she was sexually aware, told investigators she rubbed her genitals, was prone to falling, and said the toddler was suicidal.

Monday was the first day of a scheduled five-day trial, and the defense has yet to call any witnesses. But during his opening remarks, defense attorney Dana Cormier made it clear who he feels killed Khaleesi.

"In October, Candi Royer will answer for what she has done," Cormier said, alluding to her scheduled trial.

No offense intended but I wish that had had a trigger warning. I am shaking after reading it and can't even let myself think about what I just read. HORRID. Can't go there.

Was he her father? Or was this just some couple the mother knew?

I have to stay on outside thoughts. HAVE TO. Like this seems to be another case where a CPS employee or two should be imprisoned along with the perps!!!!!!!!!! The mom wanted the child going to a relative and they blocked it, WHY? I want the reason!

CPS dropped this child with a couple where the woman was on an ANKLE MONITOR for a crime!!! And NEVER checked back. The mother at a point couldn't reach or talk to her daughter or they gave excuses yet NOTHING was done about it forEVER. Heads should be rolling in that system.

What this baby went through I can't even talk about. It's all there in print and it sounds like sick videos of torture. She was a BABY. SICK. SICK TWISTED PEOPLE. How did they treat their daughter in comparison? And again, who were they to Khaleesi? I likely should know but don't recall and I can't read any more.

Some days I just can't get over the evil in this world that exists these days. This day is starting out to be one of them, reading this this early in the morning. I wish I could unsee it and unknow it. This poor child.

Mom's drug abuse may have landed the child there BUT not entirely because at that point the SYSTEM has a responsibility to ensure the safety of the child. What a joke these days and in almost all cases. Mom clearly cared about the child and wanted her placed with a family member. IMO they always SHOULD BE SHORT of some very serious reason not to, when possible. It must have been bad to approve two MONSTERS one of which was on an ANKLE MONITOR!!! I need to get away from these thoughts. So stopping here but I could lose it and would if I went on.

Imagine being on a jury and hearing this guy said a 3 year old was sexual, she killed herself, and MORE. He is done for imo. Disgusting example of what vermin is. And HER? Oh yes. Her too.

‘It’s eating me alive”: jury hears from experts, investigators

Since September 2021, Khaleesi Cuthriell’s story has, slowly but surely, unfolded.

A little girl from Waynesboro disappears and isn’t reported missing for months. By the time she is reported missing, investigators learn she’s dead and likely has been for months.

Almost two years after the public learned her name, a man accused of abusing and killing her, Travis Brown, appeared for the second day of his jury trial on Tuesday, Aug. 29. Brown’s codefendant, Candi Royer, will face a jury in October.

Investigators have had to keep most details about Khaleesi and what happened to her very quiet.

When Brown was arrested in September 2021, he was interrogated by Trevor Rexrode, formerly with the Augusta County Sheriff’s Office, and Michael Roane, who is still with ACSO.

Jurors watched about half of the Sept. 19, 2021 interrogation on Monday, Aug. 28 and the other half Tuesday morning. In that, Brown first told investigators that Khaleesi was alive.

Rexrode and Roane at some points pleaded with Brown to tell them where Khaleesi was.

“We cannot lose sight of a three-year-old baby girl,” Roane said.

However, after a while, he said Khaleesi died after she hit her head -- an injury sustained in one accident. He said he panicked and did not call for help.

Instead, he said he wrapped her in her blanket and put her in the trash. Augusta County Commonwealth’s Attorney Tim Martin said Friday, Aug. 25 during jury selection investigators have not been able to recover Khaleesi’s remains.

Major Brian Jenkins with ACSO spoke to that fact, saying investigators tested Brown’s trash can for blood, but nothing came back. Brown estimated Khaleesi died in January, and the test took place on Sept. 20.

Jenkins said it’s possible the trash can was switched out for a new one. He said the landfill where Khaleesi’s remains might have been dumped is bigger than 90,000 cubic yards, which would take about 46 months to fully process.

Just a day later, investigators with Virginia State Police and the Augusta County Sheriff’s Office executed a search warrant at Brown’s home on Cattle Scales Rd.

A handful of scientists testified Tuesday to speak about the findings from that search. Nicole Harold with the Virginia Department of Forensic Science said three dots of blood on the wall were found to belong to the biological child of Ted Cuthriell and Amanda Arey, who are Khaleesi’s parents.

Since Khaleesi’s remains have not been found and there’s no sample of DNA, Harold clarified the sample of Khaleesi’s DNA was formed by mixing Cuthriell’s and Arey’s.

Of those splatters, one was six feet off the floor. Harold said hair found in electrical tape wrapped around a bent wire hanger was also consistent with that same mix of DNA.

Royer’s DNA was also found on that hanger.

VSP’s Special Agent AJ Wouters explained another observation on Tuesday. He is one of the agents who went inside the home on Sept. 20. He said Khaleesi’s bedroom doorknob was backward, meaning the people inside the home would have been able to lock her inside rather than the other way around.

He had photos of other doorknobs in the home - that one was unique.

An expert on child abuse and torture from Virginia Commonwealth University, Dr. Robin Foster, spoke as well, explaining it’s not possible for a child to kill themselves in the way Brown had described Khaleesi’s death. Brown had said in 2021 that Khaleesi was prone to falling and would throw herself down multiple times a day. Foster said Khaleesi’s injuries were not likely a result of a fall.

Travis Brown guilty of aggravated murder in child's death, automatic life sentence awaits

Following two days of testimony, an Augusta County jury found Travis Brown guilty Wednesday in the torture and killing of 3-year-old Khaleesi Cuthriell.

Convicted of aggravated murder, Brown, 31, will automatically be given life in prison with no chance of parole when formally sentenced Feb. 8.

The jury took just less than four hours to reach its decision.

Royer, also charged with aggravated murder, will be tried in October.

More HORRIBLE details. That these two even went to trial is ridiculous, they had NO CHANCE IN HE77. I realize she hasn't been tried yet but this should tell her.

I don't even want to think about what the wire hanger meant. Abuse is bad enough, TORTURE is beyond that. Don't let me near these two pieces of excrement and filth.
Is she really going to waste the public's and court's time and the jury's in October letting all hear about her disgusting acts on this child? Of course she will unless a deal possibly. I say NO DEAL, if she has any decency she will plead guilty and take the max but she won't. These aren't decent people, they are animals. And THAT is an INSULT to animals.

Woman pleads to murder charge in connection with toddler's disappearance

A woman has now pleaded guilty to a murder charge in connection with the disappearance of an Augusta County child.

According to WHSV, Candi Royer pleaded to a first-degree murder charge connected to the death of Khaleesi Cuthriell on Wednesday.

She was facing charges of child abuse leading to serious injury, concealing a dead body, aggravated murder of someone under the age of 14, and homicide, but all of these charges were dropped as part of a plea deal.

Travis Brown, who was Royer’s boyfriend at the time, was convicted of aggravated murder, felony homicide, and child abuse causing serious injury last month.

Petition to investigate CPS division in Khaleesi Cuthriell case gaining signatures

Justice for Khaleesi, a Facebook group that formed after the death of 3-year-old Khaleesi Cuthriell, is pushing for an investigation of the Child Protective Services (CPS) office that placed her in the care of Candi Royer, who pleaded guilty to the girl’s murder.

When the girl’s mother was returned to prison for a parole violation, she asked that Royer be granted custody of her daughter.

Brittany Strickland, who organized a petition drive, says CPS failed miserably when they placed the girl in Royer’s home.

“Candi Royer had a frickin’ ankle monitor on her ankle, and they didn’t really check the house out,” she says. “There were just so many signs that were obvious to me that this was definitely not the place to put her. And I feel that the agency, or at least the CPS worker who placed her there, needs to be held accountable.”

Royer’s partner, Travis Brown, was convicted of aggravated murder in August, 2023. Royer pleaded guilty to first-degree murder in October.

More than 2,200 people have signed the petition. The group has also set up a meeting with Del. Chris Runion to discuss the possibility of an investigation.
