CA MAYA "MAY" MILLETE: Missing from Chula Vista, CA - 7 Jan 2021 - Age 39 *ARREST*

Maya “May” Millete, 39, was last seen Thursday evening in her Chula Vista home near the San Miguel Ranch area, according to her loved ones. Family and friends said her car is still at her home and her phone has been going to voicemail since her disappearance.

Hospitals, jails and morgues have been contacted by the woman’s kin, but they said she has not been found at any of those locations.

Maya and Larry Millete are high school sweethearts married for 21 years with three children — ages 4, 9, and 11.

Maya has been missing from her Chula Vista home since last week. Millete says they had argued the night before.

"We had problems this year, up and downs," Millete told ABC 10News.

He said his wife has left before for the night to blow off steam, but he became worried when she didn't show up for their daughter's birthday on Sunday.

"If she didn't have her car, a friend would have to pick her up. That's the only reason I was like, 'maybe she's wine tasting or hiking with a friend,'" says Millete.

Maya works as a defense contractor at Naval Base San Diego and didn't show up for work on Monday.

"I called her boss, she didn't even log in. And that's the other alarming part, because work for her is like a party ... that's her outlet," Millete says.

Millete says he will continue to search, anxiously waiting.

Now he wants to control the minds of his kids!!!!

I love the judge’s comment. Glad he stood his ground.
I love the comment too.

He's been controlling them for a long time until they put a stop to contact and it shouldn't have taken what it did. I don't like how they make it sound in the article as if his parents were forced by him to put his kids on the phone. HOW SO? A man in jail can't FORCE someone on the phone to do anything.

His parents should NOT have these children, and never should have. The Milletes should and I don't like this remark of them being "forced". If Larry can force his parents to do things then that's even more proof these children should not be in the hands of grandparents who also disobey court orders, etc. and make bad decisions.

It’s quite telling that they said he forced his parents to do something over the phone. Sounds like he’s been dominating his parents for a very, very, very long time.

Yep. And it also means they aren't strong enough wise grandparents fit to rise MAYA'S children letting her killer talk to them for hours and tell them to watch a show of how bad it is in prison and will be or is for dad, etc.

I can't recall if it was fact or rumor but his father was said to be involved or to have helped with things after the fact, I think relating to all the guns or some of them or some such. I just can't recall.

They are all bad news imo.

Larry Millete murder trial could see another delay

The trial for the Chula Vista man accused of murdering his wife, May “Maya” Millete, could be delayed again after multiple months-long delays last year over issues funding his defense.

During a hearing on Thursday, the attorneys for the 42-year-old Larry Millete, who were appointed to his case by a judge in October, said they would not be prepared for the August trial date as they are currently engaged in trial for another case and do not know exactly when it will end.

The judge presiding over the case, Enrique Camarena Jr., appeared to be annoyed by the hold up before setting a final hearing on April 2 to schedule when the trial will begin.

“We have to pick a date, soon. We put it out eight months at the last continuance and so we need to know,” Camarena said. “If we don’t get a date that we can realistically try this case, I’m just going to pick one and then we’ll go from there.”

While Thursday’s hearing was intended to provide an update on trial readiness, prosecutors also used the time to ask the court to reaffirm the protective order placed on Millete that prevents him from making any calls from jail to people other than his attorney.

However, deputy district attorney Christy Bowles said that between Feb. 2 and Feb. 27 Millete had made 11 video calls through the San Diego County Sheriff’s video visit system to people other than his attorneys — something she said was a clear violation of the court order.

“At that hearing, the court was in very clear, no uncertain terms with the defendant present stated those visits — the video visits — were prohibited,” Bowles said, adding that the calls were hard to monitor for possible contact with his children since they operate like a FaceTime.

“For whatever reason, he was given the opportunity to conduct these video visits and he took advantage of that opportunity,” she continued. Bowles also said she would be also be speaking with jail personnel about the issue later Thursday.

Millete’s defense attorney Colby Ryan pushed back, saying the violations were “not necessarily Mr. Millete’s fault” and had more to do with the sheriff department’s recent switch to a new communication system.

“I don’t believe he had any intent to violate this court’s order, because he actually asked us and it was our understanding that this is how the jail is going to do it,” Ryan said. “Moving forward, we will make sure that Mr. Millete only does social visits and that the jail is made aware that he cannot do these video visits.”

The judge ultimately confirmed the restraining order blocking Millete from making jail calls applied to the video visits, although he disagreed with his defense attorney’s argument.

“The one that makes the decision on who gets the phone call and accepts the phone call is you,” Camarena said. He added that Millete’s multiple requests to modify the protective order to allow for more outside contact “did not help.”

“Maybe someone made a mistake, but it’s on you to make a decision whether or not to make that phone call or make that video visit and frankly I think the DA’s office could charge you, if they wanted to,” he continued. “We’re not there … but violating a restraining order is a violation of a court order, which is a new crime.”

When the trial may begin is unclear at this time, but prosecutors say testimony will likely take upwards of four to six weeks.

No need for my comment on another delay and NO TRIAL DATE YET IN THIS CASE. Sure my opinion is KNOWN.

Like he didn't intentionally violate his order and know exactly what he was doing as against it. The fact his children are still in his parents' hands is beyond okay. Parents violated all and let him I guess more so. Now this. And at the same time they asked for modification when he violated it repeatedly already.

DA should darn right charge him with this clear violation of a court order. Why not??

And it sounds like jail employees are cutting him slack and access they shouldn't be OR they need to be CLEAR on who can and can't make calls and to who and perhaps don't understand it themseles, duh.

Maya's family don't have Maya or her body, they don't have her children and have to watch this b.s. and they STILL do not even have a trial date! All while her children grow up in the wrong hands.

\Every single bit of this is sooooo wrong.

CHULA VISTA, Calif. — The murder trial date for the husband of missing Chula Vista mother, Maya Millete, has been moved again.

The trial is now set to begin on January 6, 2025, almost four years to the day that Maya went missing.

During a hearing Tuesday in Chula Vista court, defense attorney Colby Ryan told the judge his co-counsel, Liann Sabatini, was out of town because of a death in the family.

“There's some things going on in the background specifically to Ms Sabatini. There's a sudden family loss, actually two losses in the past month, that we've been kind of dealing with. So, given that we are going to need some additional time. But I do believe the court is ready to set a trial date,” Ryan said.

This is the fifth time a trial date has been set for Millete, 42, who is accused of murdering his wife on January 7, 2021. Her body has not been found despite multiple searches by family members and supporters.

The couple's three children are still living with their paternal grandparents in the family's home in Chula Vista, as a guardianship case continues in probate court.

Judge Enrique Camarena set the new trial date for one day before the four-year anniversary of Maya going missing.

“I’m picking a trial date only because I think by January 6, I think Ms. Sabatini and Mr. Ryan will have had the case I think close to a year and I think that's sufficient time to prepare,” Judge Camarena said.

Millete hired new attorneys in October of 2023, which delayed his trial until August of 2024. The judge’s new date of January 6, 2025 means the defense team will have four additional months to get ready.

Millete faces 25 years to life in prison if convicted. His next court appearance is set for August 5 in Chula Vista.

The FIFTH time it has been changed. Kids still living and reaching an older age with HIS parents who violated every term of everything just as he did with proof of major influence by dad.

Such a system. It's just freaking great.

It's only lives affected for good and forever after after all. No urgency or even how about a realistic time frame. Nope. And the kids and their custody? I've seen PLENTY of reason they should not be where they are.

But who cares in the system right or will do the right thing right?

This one will reach a point if it has not already who cared will give up if smart on the kids because they will be so ruined and programmed there will be no undoing it. That's just more loss and grief and all one can do is hope they reach an age and have an intelligence beyond what's been progammed into them to question themselves the truth.

FIVE times delayed.

Attorney: Maya Millete’s property missing from home

A court-appointed attorney representing missing mother, Maya Millete, says there are concerns about her personal property going missing from her home.

CBS 8 was in probate court on Monday, where a battle is brewing over Maya's share of the estate.

The mortgage on the Millete home in Chula Vista has not been paid since November 2021, according to court records. Attorneys representing her share of the estate want the house sold as soon as possible.

“The reason we're really here today is that when the conservator was appointed, there was an understanding that the home needed to be sold to avoid a foreclosure,” said Lisa Roper, an attorney representing the conservator of the Maya Millete estate.

Roper is asking a judge to order the $1.4 million home sold on the open market and the proceeds placed in a holding account.

“There may be a concern about the personal property of Ms. Millete in the home, how it's been handled, taken care of, and whether there should be an accounting,” said Judge Olga Alvarez in court on Monday.

“There was a lot of stuff inside the house when we viewed it, but then I also understand there's a lot of stuff that is missing,” said attorney Olga Nazimova during the hearing.

At the probate hearing, attorney Steven Brumer told the court he is now representing the grandparents, replacing attorney Bonita Martinez, who previously dropped out as Larry Millete's defense attorney.

Brumer said he will oppose a court order to sell the Chula Vista home.

“I represent Larry’s mother, Judith. At this point, I believe there would be an objection. Of course, I haven't reviewed fully the pleadings. I'd like to have an opportunity to do that to be able to file that objection,” Brumer said in court.

The judge set a hearing on the petition to sell the house and an asset accounting for August 12.

The Millete family home could be ordered sold by the end of August. The guardianship case involving the three children also should be resolved by the end of August. Larry Millete's murder trial is set for January 6.

Tha effing nasty family. I hope they get theirs after death. Not the Judge but there IS one.

Larry and his mom and pop. BAD news. And WAY too much leeway has been given them when they have BROKEN COURT ORDERS. You know what is SO UNFAIR? Maya's family may as well give up on getting her kids because by now with the b.s. allowed to go on and how old they are, they will have totally poisoned children who will act out on them and then they will be in trouble. They have been screwed in EVERY way possible and it's unconscionable and damn the judge who has done so.

And now it is any share of what HE thinks is all his but is half Maya's at LEAST.

So ma and pa have a lawyer. Well hang onto him. I wonder why Bonita dropped out...Maybe I know but forgot.

The ONLY thing right there is that the man IS in jail. All else is WRONG.

I'd hug her family if I could. They have put up with SOOOOOOO MUCH B.S. and her loss and no body either back home to them.

Trial begins for guardianship of Maya Millete’s three children

The battle over guardianship of Maya Millete's three children has been happening in downtown probate court since November 2021.

Maya's sister, Maricris Drouaillet, filed a petition for custody of the kids months after Maya went missing from her Chula Vista home in January 2021.

The 39-year-old’s body has not been found. Her husband, Larry Millete, remains in jail, waiting to be tried for his wife's murder.

The husband appeared in Chula Vista court Monday afternoon for a hearing in advance of his murder trial, currently set for January 2025. But the judge said the defense intends to file a written motion to continue the trial to a later date. Both sides will argue that motion on September 10, the judge said in court.

Meanwhile, Maya’s children – now ages 14, 13 and 8 – are still living with their paternal grandparents, Benito and Judith Millete, in the family's Chula Vista house on Paseo Los Gatos.

No cameras were allowed in probate court Monday for opening statements in the guardianship trial.

Attorney Scott Finkbeiner, who represents Maya's sister, told the judge the grandparents have "tried to poison the relationship with the maternal family" by creating a "toxic emotional environment" for the kids.

Finkbeiner said a forensic psychologist has concluded Maya's sister should be granted guardianship, and that the grandparents had been coaching the children to stop mental health treatment.

After that, the grandparents spoke. They had no attorney and were representing themselves.

Benito Millete told the judge, "the kids are healthy" but "they wish their mom and dad would return to the house."

"We love our grandchildren.” Benito said. "We're old but God will give us more life to take care of the children."

Family members on both sides declined to comment to CBS 8 until after the judge issues his ruling in the case. The guardianship trial could stretch into early next week. Regardless of who wins custody, the other side likely will be granted visitation.

Those kids should be with her family and should have been placed there a LONG time ago. He has pulled much sh*t and so has his parents.

If they do get them, the poisoned beliefs they have by this point are going to truly be a hard thing to handle. There have been many cases where the kids end up with the murderer, or his family, because charges can't be brought, etc. and the remaining parent is gone so can't have custody so the father who killed the mother does. Or his family. I can name several.

This though is one of the worst. There has been AMPLE reason to take these kids from this family. They broke every rule and so did he. Many a time. But ya know, he killed her (I believe) and they still had a father with rights I guess... And he was not charged yet and then now is not convicted yet BUT they have broken the RULES.

I think in the one decision in recent years or a year or two ago, it was the sister didn't have a big enough house, had her own kids, and whatever. THAT means nothing compared to who would do right and wrong and love them instead of manipulate them. And again, he and his family had outrageously broken the rules...

HIS father even plays into the case re the guns and things they probably did to help him cover and more...

Since we know his parents are so easily manipulated, they definitely need to be with another family member. I don’t care where but somebody strong who can give them a stable life. These kids have been through hell and back.

Exactly. Her sister is strong and she's the one who has never ever given up and I truly believe they would not poison them either but follow the best interests of the kids. They have demonstrated that time and again. Imo.

NOT his parents. They are manipulated by him, they enable him, there is nothing they would not do for him and they are old.

The sad side is that no judge ever did anything about this long ago and whoever will be getting kids that have been fed and taught and manipulated one way for years now.

Imo.

Sister of Maya Millete granted custody of missing woman's 3 children

After a week of court argument and testimony in a guardianship trial, a San Diego probate judge has granted custody of Maya Millete’s three children to her sister, Maricris Drouaillet.

Maya’s children, now ages 14, 13, and 7, had remained at the family’s Chula Vista home with their paternal grandparents as a nearly three-year guardianship battle continued in court. The grandparents failed to make mortgage payment on the house, which is expected to be sold by the end of the year, according to court testimony.

Judge Ronald Frazier ruled Monday that the children must move into the Drouaillets' home in Riverside County by noon on Sunday, August 18.

There will be a six-week pause in visitation by the paternal grandparents, to give the children a chance to settle into their new home and enroll in school. The grandparents will be allowed to text the children two times per day, the judge ordered.

Guardian ad litem, Kelly James, represented the interests of the children during the guardianship case. James told the judge she recommended Drouaillet be granted custody of the children, even though the children told James they wanted to stay with their grandparents.

“These two sides of the family cannot work together in the best interests of the children,” James said in court.

She said the grandparents, Benito and Judith Millete, had not supported the children to attend therapy or visitations with the maternal side of the family.

Judith Millete texted the oldest daughter during visitation days with the Drouaillets, telling her to “lock the doors when Richard is around,” according to testimony.

A note was found in the child’s bedroom instructing her how to get out of visitations, James recalled.

Additionally, the children were told “spy” on the maternal side of the family, by texting photos to the grandparents, it was alleged in court.

During closing arguments, Benito Millete, the grandfather, told the court he loved his grandchildren and had taken care of them for 14 years in the Chula Vista home.

“We never once said a bad word about Maricris to the children,” he told the court.

Millete said the children were unhappy during visitations, and they wanted to remain with the grandparents.

Judge Frazier issued an oral ruling immediately following closing arguments, saying to the grandparents, “You have failed your grandchildren emotionally by not supporting their therapy and visitation.”

He also questioned the grandfather about what he planned to do with the children if the Chula Vista home fell into foreclosure. Benito Millete told the judge he had an offer to move into a next-door neighbor’s house with the kids.

“If you’re moving from house to house. If you’re sponging off of the neighbor’s goodwill, how can you say that is stable?” Judge Frazier questioned.

The judge said he would sign a formal, written ruling within 10 days.

Welll THANK GOD. FINALLY. The above is the perfect show of what has been seen by these grandparents all along and why it took three years Lord knows.

They sabotage the other side, poison the children and get them no help. How the grandfather can say he took care of them in that home for 14 years I don't know because they HAD a MOTHER.

This is Larry's home is it not? The children's home or no?

Seems like that's what I'd heard prior.

Let me tell ya, he probably broke them and expected them to carry a mortgage they could not afford. Is his lawyer a private one, I can't recall. Also he probably hocked it although you can't get a mortgage without a job so it likely was done while he was free and spending all the money that also belonged to his DEAD WIFE.

Then they have to fight for the kids for years and THAT probably took MONEY...

All because of Larry. However, I don't forgive the grandparents as everything they were doing with these kids was WRONG. The mother and her family did NOTHING WRONG and she is a dead VICTIM of their father. The grandparents are idiots and honestly where are they now at in life likely thanks to him as well...

I tell ya I dont' even know about allowing contact with them... And it should not be unsupervised.

I still think the sister and her hub are going to have a time with these kids, especially the teens, because look at what they believe and the fact they wanted to stay with their grandparents. I am still GLAD they got them but years after it should have happened.

You know the grandparents should have all contact ceased imo. Grandparents don't have much for rights no matter what anyone has heard. However on neither side is there a parent thanks to evil Larry.

And yeah, they should have made the mortgage payts but I wonder if they could. That's bad of course re stability but it is far from the worst thing they've done and there may have been reason for that. Hard to say.

They need to get a clue about their son, he doesn't care where they end up, he only cares about them imo when he needs their help. That man cares about no one but himself.

I am glad for the win but the kids have been poisoned, they have to now change schools, homes and live with a family they've been told bad things about--I don't care what grandpa claims, I do not believe him.

His parents would go so far for him as to move or help hide the body imo.

They are just that type and do anything he asks. IMO of course.

Yeah, these kids are going to have a difficult time transitioning because they’ve been brainwashed. But hopefully, through therapy, they will get the help they need!
Yes, and I'm sure the sister will comply with counseling where the grandparents did not. I think such is pretty slow going though...

It will take some time to make headway most likely is what I mean.

You know, I wonder if they can even get help to get this paid for because it crossed my mind that of course there's no child support, the only surviving parent is in jail. I don't know their circumstances but I know one time they weren't granted custody was due to some things like size of their home (they have kids of their own), change of school district and some reasons like those. I can't recall but think she then went to try to meet the criteria, did they add on or buy something else, I can't recall...

I don't know what her husband does for a living or if she works at all.

I don't really have a point other than counseling is expensive if not covered somehow.

And then I remembered that of course the kids would be receiving social security due to their mother's death or any guardian would for that. I would assume that payment will change from the grandparents to the aunt now. Does anyone know how much that is? I have no idea. I mean for anyone with a minor child who has one parent who died.

To insure them theirselves I am not sure would be doable? They are not adopted or anything... I have a feeling no change at that will occur until he ends up convicted...

Clearly though finally a judge did not go by anything dad would want here even though dad is still alive.

And I'm sure they ensured the family can take care of these kids as they did so other times. I do wonder why no counseling and/or a foreclosure wasn't long before known of by the judge though? is no one checking things out? Or did it just take that long to bring it all to hearing.

A foreclosure to proceed to sale takes a good year or more. You likely know that.

I know they will take care of the children in every way imaginable and have the resources to do it even if I don't know details.

She is a VERY STRONG woman on behalf of her sister and searches and justice for her and will be a very competent mom for these kids imo.

Next question is WILL the grandparents quit fighting for them back and stop now? Will Larry let them? I will bet they won't behave, parent and grandparents I mean... I can see them looking for things, anything and that's what they were doing all along, against the other side...

Only one side has their best interests and heart imo and always has and will not poison them. I have been on their side with custody from day ONE. Shouldn't have taken this long.

Finally, one possible bright side I can see to maybe it not being entirely troublesome is that kids most kids aren't stupid (I mean we do have Daybell and Morphew kids that can't see straight but most are not) and they maybe well know they were being influenced and manipulated but most too unconditionally love the ones still around... Kids also who have a missing parent wonder about such generally and hopefully they will be partially open to their mom's side and hearing about her from them... Hard to say... They've sure been used and manipulated...

I'm glad this decision was finally made though. A long time coming to do the right thing. Imo. The judge even went against the stated wishes of teenagers and well the judge should imo. In this case.

Judge pushes start of murder trial for Maya Millete's husband, Larry, to next summer

A San Diego County judge on Tuesday agreed to a defense request to reschedule the beginning of the trial of Larry Millete, a South Bay man accused of murdering his wife, the mother of their three children.

In court on Tuesday, the judge granted the defense's request to further delay the start of the trial. The judge in the case has set the new start for the trial to July 7 of next year, almost two years later than the original date that had been set.

Larry Millete's former defense attorney accused of fraud by his new legal team

Defense attorneys for Larry Millete say his previous representation wasn’t just inadequate, it was criminal. That was part of a lengthy motion filed in a successful effort to get his murder trial pushed back to July 7, 2025.

The case has experienced numerous delays, most recently due to a change in Millete’s defense team. Previously, he was represented by private attorney Bonita Martinez. A judge granted her request to leave the case in October of 2023. Millete is now represented by Liann Sabatini and Colby Ryan of the Virtus Law Group.

Sabatini had previously asked the court for the trial to be delayed, citing the large amount of discovery evidence her team would need to review. On Tuesday, that argument for more time included a slew of accusations against Martinez.

Sabatini’s filing states that from the very beginning of her work, Martinez deprived Millete of his constitutional right to effective assistance of counsel. Court documents claim she never showed Millete all the discovery evidence in the case and only visited him in jail when she needed him to sign paperwork.

In California, attorneys are required to get a signed retainer agreement from clients if services exceed $1,000. Sabatini’s filing says Martinez took payments of $5,000 and $10,000 from Millete prior to his arrest without any agreement. Moreover, Sabatini accuses Martinez of never disclosing how much the entire criminal case would cost Millete, and instead asked for money repeatedly over the course of two years.

The court filing states that Millete was concerned about Martinez’s access to his finances and asked his parents not to connect Martinez with over $200,000 in cryptocurrency investments and $40,000 in precious metal and coin collections.

The documents say Martinez persuaded Millete’s parents to give her access to his finances. That included purchasing an iPhone and iPad connected to his mobile account, giving her security authentication to his financial accounts and those cryptocurrency investments.

Sabatani says it’s common in the Filipino community to respect and trust people in positions of authority. She says the Milletes were too deferential to Martinez, who, “...took advantage of that deference, respect, and esteem she was held in by the Milletes and [misled], pressured and defrauded this family to the tune of almost $250,000.”

When asked why she needed so much cash, Millete’s new lawyers say Martinez told him she needed to make out-of-state and international trips to track down witnesses, something his current team says they can’t find evidence to support. In fact, they say there’s no evidence Martinez needed any of that money for Millete's case, writing, “there is absolutely no work product to substantiate her claims that this defense was so expensive.
