Sheriff on death of Tristyn Bailey: ‘This is a cold-blooded murder’​

St. Johns County Sheriff Rob Hardwick said 13-year-old Tristyn Bailey’s killing was “not an accident,” calling her death a “cold-blooded murder.”

“This is a cold-blooded murder of a 13-year-old young girl who did not deserve to die,” the sheriff said Tuesday.

The St. Johns County Sheriff’s Office said Tuesday that the chief medical examiner determined the teenage girl’s death was a homicide caused by “sharp force trauma by stabbing.”

“That being said, I don’t wanna mention the number of times, but it is horrific. It is horrible,” Hardwick said. “And the word accident is nowhere involved in this case.”

Hardwick said Aiden Fucci, 14, is the only suspect detectives have in the case.

Fucci, a schoolmate of Bailey’s at Patriot Oaks Academy, is charged with second-degree murder in connection with her death. He appeared in court Tuesday for the first time. The 7th Circuit State Attorney’s Office has not yet decided if he will be charged as an adult. While the State Attorney’s Office makes that determination, Fucci was ordered to be held in Department of Juvenile Justice custody for the next 21 days.
 

Tristyn Bailey: Missing girl’s cause of death, video clues revealed​

An arrest report obtained by Jacksonville TV station WJAX said surveillance video from 1:45 a.m. Sunday recorded two people walking toward the end of the Durbin Crossing cul-de-sac where Tristyn’s body was later found. One of them is dressed in black clothes matching those Tristyn wore, and the other is in a light-colored hoodie and shorts.

A little more than 90 minutes later, the person in the shorts returns, walking alone and carrying a pair of shoes.

During a conversation with his mother at the sheriff’s office later Sunday, the suspect spoke of walking home barefoot because his shoes were uncomfortable, the arrest report said.

The boy also reportedly made “admissions during questioning” that led deputies to search his home and turn up “items of evidentiary value” including clothing that appeared to be bloodstained, the sheriff’s office said. Investigators have not said whether they believe they’ve found the murder weapon.

The boy’s home is about a quarter-mile from where the body was found. Both suspect and victim were students at Patriot Oaks Academy, a public K-8 school.

The suspect is currently facing charges of second-degree murder and was ordered Tuesday to remain in juvenile custody for 21 days.

At a press conference Monday, Hardwick said the charge could be upgraded to first-degree murder if the evidence warrants it and that it had not been determined whether the boy would be charged as an adult.

Emotions in the neighborhood — where residents turned out in force for Sunday’s search — have been inflamed by teenagers’ social media posts. A Snapchat image posted Sunday was an apparent selfie of a boy in the back of a squad car with the caption “Hey guys has inybody seen Tristyn lately?” A sheriff’s spokesman confirmed the boy was the suspect.

On Tuesday, the sheriff’s office issued a statement decrying social media posters “using this case to try to gain fame and followers.” Several people, apparently teenagers, were making claims on Instagram about alleged details of the crime; the sheriff’s office said they “had nothing to do with this incident.”

Rumors are circulating alleging Aiden Fucci had a prior juvenile record. Juvenile records are sealed. However, First Coast News has confirmed with law enforcement sources that this is not the case.
A petition circulating with more than 100,000 signatures as of late Wednesday afternoon alleges a sexual assault occurred. Officials said Tristyn was found clothed, and so far, there is no indication of sexual assault.
There are also certain social media accounts that have published posts suggesting they were part of the crime, according to the Sheriff’s Office. These accounts have been investigated. The St. Johns County Sheriff’s Office said “they had nothing to do with it.” The sheriff’s office says at this time, there are no other suspects to the crime, but they are investigating the possibility that someone could have been involved as an accessory after the fact
Finally some have said the case was moved to Volusia County because the suspect’s family has connections to law enforcement. That is not true. Aiden Fucci was moved because there is not a pretrial juvenile detention facility in St. Johns County.

WHAT WE DON’T KNOW AT THIS TIME
Has the murder weapon been recovered? The sheriff says he hopes his team has collected it, but deputies won’t know until forensics come back.

Wow.

Well depending on whether he always carried a knife and what kind it was, I think there is a chance such answers could upgrade this to first degree.

I feel so old as one of my thoughts right off was why would kids this age be allowed out at this time of night/morning even but perhaps I am just being old school.

What I am most surprised about is the airing of the juvenile proceeding. I don't know that I have ever seen such done before in any state at all?? It also surprises me how things vary state by state. Think of Daybell, the DEFENDANTS are not even required to appear. Here, the parents had to and were shown. Not only that but did anyone notice that the next case was named after this one was concluded and before they shut sound and cameras off? I assume that is the name of someone else's juvenile child on another case. They are not waived into adult court yet so I am very surprised.

As far as the case itself, the motive is not clear yet. One thought that came to mind is bullying or picking on another and perhaps they weren't friendly at all and yet it sounds like she was with him/walked off with him willingly. Friends apparently said they were not in a relationship but were friends. Hard to say what that means these days, again I am pretty behind the times most likely with such. There also thus far appears to be no sexual assault.

I will stop there as her family, this community and his family as well have to be reeling. I am sorriest as always though for the victim and her family.

Yet seeing the age he is as well, wow. It said he appeared to be struggling not to cry and I guess at times it looked that way when he looked up toward the ceiling, etc. but one never knows if that is for themselves or remorse, and he did not cry. He shook his head at one point and I wonder what that was about, toward a parent perhaps? It was not in response to being asked anything nor to the judge/presiding official.

A girl is dead at his hands it appears and he is now in a very serious adult world regardless of whether he is tried as an adult or what the ultimate charge will be.

Even though she was stabbed, the article Mel posted said she had brutal trauma/injury to her head. I don't think of the head as a stabbing area. This girl poor girl went though a lot it sounds like.

I too would like to know if he regularly carried a knife, had other incidents or issues, etc.

They aren't charging him as an adult?. They should!
 
Even though she was stabbed, the article Mel posted said she had brutal trauma/injury to her head. I don't think of the head as a stabbing area. This girl poor girl went though a lot it sounds like.

People do get stabbed in the head and it can penetrate the skull. If someone gets stabbed at the base of the skull in the back. You're dead. Temple. Goes deep enough into the eye it will penetrate the brain.
