Teen accused of killing Tristyn Bailey will now be represented by public defender​

Aiden Fucci, the 14-year-old charged with second-degree murder in the death of 13-year-old schoolmate Tristyn Bailey, will now be represented by the Public Defender’s Office after a judge granted his attorney’s motion to withdraw as counsel on Thursday, according to News 6 partner WJXT.

Public Defender Josh Mosley will be the lead attorney on the teen’s case, said Public Defender Matt Phillips, who will also be involved.

State Attorney R.J. Larizza is expected to give an update on the investigation into the murder of St. Johns County teen Tristyn Bailey “towards the end of the week.”

“State Attorney R.J. Larizza will conduct a press conference towards the end of the week regarding the Murder of Tristyn Bailey. We appreciate the patience and support from family, friends, neighbors and all of the folks who have been following this disturbing case. We are in the final stages of our comprehensive review of the facts, circumstances and the law. It is Mr. Larizza’s intention to address several questions/issues that surfaced as a result of this brutal homicide at that time.”
 

State attorney: Tristyn Bailey stabbed 114 times​

The teenager initially charged with second-degree murder in the death of 13-year-old Tristyn Bailey, is now being tried as an adult for first-degree murder.

R.J. Larizza, state attorney for Florida’s Seventh Judicial Circuit, said during a Tuesday afternoon news conference in St. Johns County that the decision to upgrade the charges against Aiden Fucci, 14, was appropriate based on the circumstances surrounding Bailey’s death.

Bailey, the state attorney said, was stabbed 114 times.

“To say that it was horrific could arguably be made as an understatement,” Larizza said.

He said at least 49 wounds were to Bailey’s hands, arms and head and were “defensive in nature.”

“The bottom line is that premeditation, could be inferred, certainly from just the sheer number of stab wounds that Tristyn Bailey had to suffer,” Larizza said.

The state attorney said there was more that led them to the decision to charge Fucci as an adult. He said the decision came after information investigators gathered from witnesses and that Fucci made statements to several people “that he intended to kill someone.” Larizza said it was never specified who.

“He indicated to several witnesses that he was going to kill someone by taking them in the woods and stabbing them, which are certainly the facts of this case,” Larizza said.


‘Horrific would be an understatement:’ Tristyn Bailey stabbed 114 times while fighting killer, prosecutors say​

State Attorney R.J. Larizza officially announced Thursday a grand jury in St. Johns County had indicted Fucci on first-degree murder charges. The state attorney’s office also filed a transfer order to move him to the adult court system. He will be moved out of a juvenile facility to one outside of Volusia County where he is currently.

Larizza laid out the evidence against Fucci Thursday revealing the 13-year-old girl was stabbed a total of 114 times with at least 49 to her hands, arms and head that were defensive in nature.

“We can’t see what happened at this pond but we know there was a struggle,” Larizza said, also saying “To say that it was horrific would be an understatement.”

The murder weapon was found in a nearby pond not far from where the fatal attack took place, Larizza said. The hunting knife recovered was missing a tip and that piece was found on Bailey’s body, according to the state attorney’s office.
 
The public defender representing 14-year-old Aiden Fucci entered a written not guilty plea on his behalf Thursday in the murder of 13-year-old Tristyn Bailey. The plea was accepted by the court.

The move cancels Fucci’s scheduled arraignment in St. Johns County, which had been set for June 10.

He is now slated to appear in court for a pretrial hearing at 9 a.m. July 28.

Fucci, who is now in the juvenile wing of the Duval County jail, will be tried as an adult in the stabbing death of Bailey. St. Johns County’s jail does not have a juvenile wing.
 
According to the warrant, Crystal Lane Smith, 35, was arrested Saturday after investigators reviewed video surveillance obtained from the home on the day the 13-year-old girl was reported missing that showed Smith going into the boy’s room to get a pair of blue jeans and took it to the bathroom to scrub them in the sink. She then took the jeans to the master bedroom “for a period of time,” according to the St. Johns County Sheriff’s Office.
