Davenport Police need help locating missing child

The Davenport Police are asking for the public’s help in locating a missing child.

Breasia Terrell, 10, was last seen in the 2700 block of East 53rd Street in the early hours of July 10.

Davenport Police are searching for a missing 10-year-old girl by the name of Breasia Terrell.

The last time anyone saw her was this morning on E. 53rd St., near Lorton Avenue.

She has been reported missing since around 3 a.m. and was last seen wearing a white t-shirt, shorts and flip-flops.

Early Friday night, around 4:30 p.m., police brought their search to Credit Island at the family’s request.

They say this was a frequent fishing spot for Terrell and her family.

Police were joined by the Davenport Fire Department in this investigation.

Crews brought out a boat, used sonar equipment and took pictures of the area, looking for any signs of Terrell’s whereabouts.

Man charged in death of Breasia Terrell has trial moved to Linn County​

The trial of Henry Dinkins, accused of kidnapping and killing 10-year-old Breasia Terrell in July 2020, will be held in Linn County.

According to a court filing Wednesday, Iowa Supreme Court Chief Justice Susan Larson Christensen wrote that the trial had been moved from Scott to Linn County.

She further wrote that the presiding judge, Henry Latham, and an official court reporter “shall be reimbursed necessary and actual travel and subsistence expenses while on the above assignment.”


Dinkins’ trial is slated to begin in October.
 

Judge postpones by a week the trial of the Davenport man accused of killing Breasia Terrell​

The Scott County judge overseeing the murder case of Henry Dinkins has postponed his October trial by about a week because of a scheduling conflict.

Dinkins’ trial has been moved to Linn County and was originally scheduled for Oct. 17, but the conflict caused District Judge Henry Latham to move the proceeding to Oct. 25, according to court records filed Tuesday. A hearing on pretrial motions has been scheduled for Oct. 24.
 

Davenport School’s Memorial To Breasia Terrell Unveiled Today​

Students at Davenport’s Monroe Elementary School will be unveiling a special memorial to the late Breasia Terrell at 3 p.m. today at the school.

Last fall, with her mother’s blessing, students began creating a memorial to Terrell. Green Thumbers on Brady St in Davenport donated a healthy young maple tree and our friends from One Eight helped to get it into the ground. This spring, the non-profit, Project 15:12, provided funding for a beautiful stone bench engraved in Breasia’s honor and the boulders lining the perimeter.

Breasia’s mother created a cross covered with pictures and we’ve installed it in a place of honor opposite a butterfly wind chime that welcomes visitors.

Thursday at 3:00 will be the culminating event as some of Breasia’s classmates and friends will be adding their own personal touches to the stones surrounding Breasia’s tree and garden.

New defense team requests to push back trial of man accused of murdering Breasia Terrell​

The defense team representing Henry Dinkins has requested to push back his trial which was already pushed back once and is currently scheduled to start on Oct. 24.

Dinkins is accused of murdering and kidnapping 10-year-old Breasia Terrell in July 2020. Judge Henry Latham approved a new defense team for Dinkins, after there was a "breakdown of the attorney-client relationship," and now the new defense, which was appointed in April, is arguing they have not had enough time to prepare.

The defendant's motion states that “At the time of the undersigned’s appointment, no pretrial discovery had been conducted,” and that there is over a terabyte of material including depositions of State's witnesses, documents and video.

The state requested the Court to deny the defendant's motion, and says that Breasia's mom has waited long enough for this trial and that the delay would "significantly disrupt the orderly process of justice in this case and cause prejudice to the state."

"The delay will almost certainly cause the necessity for a new prosecution team on a very complex case," the state's motion says. "The passing of time may affect the ability to locate witnesses as well as their memories of the event."

The defendants get all their precious rights. Enough! What about her right to live. Her family's right to have this done as soon as possible. This is just prolonging it for them for a sense of justice. And a lifetime of pain that won't go away.

I miss it here too. Hoping life settles enough that at least I can have a moment at night and weekends to keep up some and be on here. Not happening yet.
 

Judge grants trial delay for man accused of killing Breasia Terrell​

A Scott County judge approved a motion to delay the trial of a Davenport man charged in the shooting death of 10-year-old Breasia Terrell in 2020.

On Sept. 27, Chad and Jennifer Frese, attorneys for Henry Dinkins, filed a motion seeking to continue the trial, which would have begun Oct. 24 in Linn County. According to court documents, resistance to the motion was filed by the state also on Sept. 27.

“We handle complex cases,” Defense attorney Jennifer Frese argued during a hearing Friday. “All the time. But this is an extremely complex case. And despite the fact that we plan to try this in October, I don’t know what to say your honor other than we need more time. We need more time to effectively represent Mr. Dinkins.”

Assistant Scott County Attorney Caleb Copley said prosecutors are prepared to try the case in October, but said he does not want to have this case come back to trial because the defense was not ready.

Dinkins with his attorneys requested a four-month delay.

A pretrial conference is set for Nov. 18. District Court Judge Henry Latham said he would like to see the new trial date set for “late spring or early summer at the very latest.”

This week marks a dark and troubling anniversary.

On July 10, 2020 Breasia Terrell was reported missing. In the days, weeks and months that followed, multiple law enforcement agencies, including the FBI, searched fields and waterways throughout Scott and Clinton counties in a desperate search for the 10-year-old.


His trial for Breasia's murder is to get underway in Cedar Rapids on Aug. 8.


 
Any idea of whether this will be televised?

IF that is it goes off on time. Being this close one would think it would but who knows the way things go nowadays, his attorneys could have been not doing anything recently and come in last minute and say oh we have a conflict (as they didn't do their job and aren't ready) but hopefully the fact is i this close means the opposite and all pretrial stuff has been going on and it is set to go.

This one really sticks with me as I know the cities and areas of it, etc. so it brought interest to me from the start.

To this day though, I am unsure someone else shouldn't also be charged. He was a sex offender not at his own registered address and she was allowed to go with her brother to his house (he was the father of the brother if I recall). Neither child should have went imo with him NOT where he was registered to be but CERTAINLY she shouldn't have been allowed to/sent there.
 

Trial of Henry Dinkins in death of Breasia Terrell expected to take 5 weeks​

The final pre-trial hearing for Henry Dinkins was held virtually on Tuesday. The hearing went over how many witnesses the prosecution plans to bring forward — a total of 122 people. Scott County Attorney Kelly Cunningham said those witnesses will be narrowed down before the trial begins in just a few weeks.

Cunningham also noted that one of the key witnesses, Jared Brink, passed away in June. Cunningham said he had pulled Dinkins out of the mud in the area where Terrell's body was found. The witness had been deposed in late May, so the prosecution motioned to introduce his testimony anyways.

Dinkins' lawyers Chad Frese and Joel Waters also appeared virtually on Tuesday. Dinkins sat next to Waters during the entire hearing, however, he did not speak during it.

Ahead of the trial, both the prosecution and defense will meet to go over the motions each side has filed. That meeting is set for the Monday before the trial begins. Jury selection is to begin on Aug. 2. Overall, the entire trial is expected to take five weeks.

According to the motion, she said that she later saw him grab an item from the closet, but couldn’t see what it was. She added that Dinkins and Breasia left again after that.

According to court documents, Dinkins crashed his vehicle into a ditch on Highway 61 in Clinton County. Dinkins got help from a man who assisted him with getting the car out of the ditch, according to the motion.

The man who helped Dinkins said that he didn’t know what was in the vehicle when asked by police, according to the motion.

In June, the man who helped Dinkins died, but prosecutors say they want to use his earlier testimony at a deposition at Dinkins’s trial.

Also, according to court documents, Dinkins’s phone records show searches for child pornography before Terrell’s death.

A hearing on these motions is Aug. 7 and the trial is set for Aug. 8 in Linn County.

I'd just like to remind of other failures of the justice system these days and this one is nothing new. That a registered sex offender was not living where he said he was. I can't remember if he was on any parole or probation but regardless, he is another one who arguably shouldn't have been free to begin with and no one was checking on complying with the registry which we have heard countless times over many years. Actually one doesn't hear much of it any more, not sure why, I guess because it pales in comparison to the worse sh*t going on. As if it isn't bad enough or something.

And then since this case never got near the exposure some do, let me add that at least two women here were part of this in one way or another or made bad choices. Iowa has public court records and an online system for most counties last I knew and that's a long time ago that I last knew and used it. We have a mother who shared a son with him if I recall correctly AFTER he was a sex offender and had her daughter around him, whether she let her go that night or not, it's a fact. We have a girlfriend who sounds like a material witness so I give her that but she too had to know he was a sex offender imo. We have drugs at least with him, there were other things that came out and I think charges after Breasia's, disappearance.

I don't even know. I'm just saying there were a lot of failures here. And I'm guessing both women knowing he was out of compliance with his conditions and probably enabling it.

BUT the system also failed. And another child dead because of that too. They are labeled sex offenders for a reason and are to be registered and know to be in compliance as to where they live. Yeah right. That works great and they go check.

I'm just mad as he77 on this child's behalf right now. Sadly, it is when it comes back up I think of it and that alone shows what a sad world state of affairs are and news.

ADavenport man searched online for violent pornographic images days before he abducted and murdered 10-year-old Breasia Terrell, according to Scott County prosecutors.

The new allegation was among several revealed recently in filings by Scott County Attorney Kelly Cunningham in advance of the Aug. 8 start of the murder trial for Henry Earl Dinkins.


Cunningham filed a motion that would allow Breasia’s now-11-year-old brother to testify through closed- caption television or via a videotaped broadcast in the courtroom.

The second motion asks the court to recognize other “crimes, wrongs or acts” and alleges that before Breasia’s abduction, Dinkins was searching pornographic sites and viewing content depicting the sexual abuse of young Black female children.

Cunningham also formally filed the motion, asking for the testimony given during Jerod Brink’s deposition be admitted as evidence. Brink cannot testify during the trial, because he died in June after suffering a heart attack; a fact Cunningham offered last week during a virtual hearing.
 

Dinkins attorneys files to dismiss interrogations, testimony​

Henry Dinkins’s attorneys filed several motions to dismiss anything said during interrogation from the day of Breasia Terrell’s disappearance.

Dinkins’s attorneys in the motion accuse the officers of violating his Miranda Rights in June 2020. According to the motion, he was denied an attorney, had his keys and phone taken away, and was not told he could leave for several hours after requesting an attorney.

His attorneys also filed a resistance to Dinkins son testifying via closed circuit television, instead of openly in the courtroom. Prosecutors filed that motion last week.


A hearing on each of the motions is set for Aug. 7 and the trial is set for Aug. 8 in Linn County.

This is a very BAD man. Bad to the core. This case has had a bit of attention here and there but not nearly enough to make it a drop in the bucket of attention.

I'm interested to see the decisions on these motions. Generally no allowances are made for children, etc. to speak of in that they have to testify in front of the perp generally just as a rape victim does or anyone else. They SHOULD be allowed to not be in the same room imo. It's intimidating enough for an adult.

I have to wonder what the boy knows. I can only guess at it and for one how she came to be there and what was going on before she disappeared. And after perhaps. Or if he suggested she come with him, etc. Or even if he always went where he did to see his dad who was in violation of the sex offender registry.

This was a very heinous crime. He is a BAD man.
 

‘My brother is innocent,’ says sister of suspect in Breasia Terrell case​

“I know that my brother is innocent.”

The sister of a man accused of a terrible crime maintains his innocence.

Henry Dinkins, 50, faces charges of murder and kidnapping in the death of 10-year-old Breasia Terrell in 2020. Days before his trial is set to begin in Cedar Rapids, his sister, Neda McQuay, spoke exclusively to Local 4 News.

“I don’t believe my brother would commit such a crime like that. I feel that only God knows … and the other parties that were there,” she said.

McQuay speaks with her brother, who is incarcerated, about five days per week. Meanwhile, she and the rest of her family have struggled for about three years, ever since the day in July 2020 when Breasia disappeared.

“I have my good days and bad days,” she said. “As long as I can talk to my brother and talk to my family, I’m just fine. It has been hard.”

She says her faith has helped her get through the bad days.

“I believe in God,” she said. “I believe in faith. I also believe in what’s right.”

Meanwhile, she misses her brother, her only sibling.

“Me and my brother always have been close. We did everything together,” she said. “Henry’s always been an awesome brother – always been there for me. I’ve always been there for him. We’re like two peas in a pod.”

The case is so familiar to Scott County residents that a change of venue for the trial was made to Linn County. McQuay asks people not to judge Dinkins until all the facts are in: “Don’t judge until faces are proven. No one’s guilty until proven.”

“Henry is not this monster that they portrayed him to be,” she said. “We all make mistakes in our life, and we all have good done good, bad and ugly.”
