Indiana State Police revealed Jamey Noel mishandled his brother Leon’s estate and deprived his three heirs of tens of thousands of dollars in early February. Now, the heirs have filed to reopen the estate and award them potentially hundreds of thousands of dollars.
Jamey Noel was named as his brother Leon’s executor in a will created on Dec. 1, 2018. Leon Noel died three weeks later. His will directed that all of his estate was to be divided equally among his three children, and directed Jamey to hold part of the estate in trust for two of Leon’s minor children. State police records, and the heirs’ legal filing, indicate no trust accounts were ever created.
Search warrants filed by state investigators in early February showed Noel sold his brother’s house to his daughter Kasey and gifted her $36,000 in equity for her down payment, rather than crediting the full sale to the estate. The heirs said beyond the down payment, the house was significantly undervalued when he sold it to her, further reducing the amount owed to the heirs.
Investigators also found Noel spent $16,000 on repairs to another home, covering half the bill with money from New Chapel Fire and EMS, which he did not reimburse to the estate. Investigators also found Noel paid himself $52,000 from the estate.
The heirs are seeking $68,504 back from Noel, and have asked the judge to assess additional damages for triple the amount based on a finding of fraud. Trial is set for May.
