Girl last seen in Manchester in October 2019; police seek tips from public​

Manchester police are seeking tips from the public about the disappearance of a girl not seen in more than two years.

Harmony Montgomery, 7, was last seen in a home in Manchester in October 2019, when she was 5, police said.

Police said they first learned Harmony went missing earlier this week. Chief Allen Aldenberg did not specify who reported the girl missing but said his department has been in touch with multiple family members and will continue to speak with them.

Aldenberg said police are not searching for any adult or vehicle in connection with the case. Investigators are focusing on the whereabouts of Harmony.

"No time is a good time for a child to go missing," Aldenberg said. "I'm begging the community. I don't care if you saw this young girl a year ago and you think it's irrelevant. Call us."

Aldenberg said at a news conference Friday his detectives are working to confirm where Harmony is from and where she went to school before her disappearance.

Harmony is estimated to be approximately 4 feet tall and 50 pounds. Investigators said she has blonde hair, blue eyes and should be wearing glasses.

"We need help," Aldenberg said. "This remains a very active investigation."

Defense attorneys for Adam Montgomery have filed a motion to delay the start of his trial on weapons charges or preclude certain witnesses, News 9 Investigates has learned.

Attorney Caroline L. Smith filed motions Monday to delay the weapons trial to August 2023 if the judge does not preclude testimony from two possible witnesses for the upcoming trial set to begin May 31.

Smith argued in the motion that her team does not have adequate time to review interviews with two witnesses, including one brought to the defense team's attention on Saturday.

May 31 is nine days away. How long does it take to listen to two interviews? It is for the weapons charges so I'd almost doubt they are very long and even if they are some hours long, again it is well over a week away. Poor excuse imo for a delay and screwing up court calendars that as it is are always inefficient and backlogged.

MANCHESTER, NH — In the gun theft trial of Adam Montgomery, a woman told the jury that Adam was in her apartment the night two guns were stolen from underneath her bed.

Kim Fran told the jury that while her ex-husband, Chris Frain, was in New York on a construction job, Montgomery was in her living room where the two wanted to buy drugs, but they passed out.

“We went into the living room, I remember just sitting on the couch,” Frain said. “Then I looked over at him, he was half asleep. I had been up for three days at that time, and I remember closing my eyes. When I woke up in the morning, he was gone.”

Montgomery is accused of stealing a shotgun and an AR-15 assault rifle from the Frain home and offering it for sale in late September and early October 2019.

Frain testified that even though she pawned off her husband’s wedding ring and other objects, she didn’t move the guns.

She said she grew suspicious about Montgomery when she heard others talking about him possibly stealing the guns.

But under cross-examination, Frain had difficulty answering questions from Montgomery’s lawyer.

Another witness, Mark Reed, told the jury that Adam Montgomery reached out to him on Facebook Messenger, offering to sell him two guns.

In the exchanges, Montgomery said he needed money because his family was facing eviction from their Manchester home.

This was only months before Harmony Montgomery disappeared.

In her opening statement, Montgomery’s lawyer, Caroline Smith, said Frain actually gave the guns to her drug dealer in return for drugs.

She pointed out that Frain had pawned off her husband’s wedding ring and other personal items to feed her drug habit, although Frain told jurors she has been sober for three years.
 
When I came across this trial this morning, I only had a few minutes but did hear ten or so of the defense's opening statement. Maybe less. It was largely about the female changing stories how many times for one. I didn't hear the whole thing.

Hopefully they have some proof he was trying to sell these guns and that it was the specific guns or types at least...

Kimberly Frain took the stand as the second witness. After being sworn, in she was asked to remove her N-95-style mask so that she could be heard. She told the judge she worked in a hospital and wanted it to remain on but was told to remove it. Frain also told the court that it was the last place she wanted to be.

Frain said she was in a very bad place in the past when the incident with the guns occurred. She said she used multiple drugs and had several people she would contact to get drugs when she had cash. Frain when asked about a missing silver wedding band that belonged to Chris and she said she had sold it to a pawn shop to get cash for drugs. She also shared with the court while testifying that she had worked with Adam and Kayla Montgomery at the Dunkin's on Beech Street.

Frain said while Chris was out of town, she would let her friends borrow the car, and some of the guns, in trade, for drugs. She indicated sometimes a man she referred to as “Ish” would not bring the car back when asked.

The night that the guns disappeared, she was hanging out with Adam at her house on Russell Street. They were trying to get drugs to use and Frain pointed out she had been up for three days straight due to the drugs she had used.

Frain said she fell asleep while Adam was still there and when she woke in the morning, she found a pipe with drugs and the backdoor open. She realized at that time some of the guns were missing.

Under cross-examination by defense attorney Carolyn Smith, Frain contradicted several of the statements she made to the prosecutors.

Frain was visibly annoyed with the cross-examination and appeared to be uncooperative and sarcastic at times.

As Smith asked about statements Frain made to the grand jury she conficted what she had said under oath.

Frain pointed out she was clean and sober now and back when things happened with the guns, it was hard to remember. Smith reminded her when she testified to the grand jury that was in a time period where she said she was sober.

Honorable Judge Amy Messer took a lunch recess and as Frain walked off the witness stand, she made some statements most people could not hear or understand. Messer reminded Frain she was under obligation to come back to finish her testimony after recess. She advised Frain to speak to the prosecutors and have a clear understanding of the ramifications if she didn’t return.

Frain walked by the prosecutors and exited the courthouse at a fast pace. Agatti and Christopher Knowles of the Attorney General’s Office chased Frain down Chestnut Street until she stopped. They had a brief interaction and Frain got in a car and left the area.

After the lunchtime recess, Frain returned to the courthouse and finished testifying.

Frain’s testimony was crucial in the weapons trial of Montgomery, who faces six charges.

Mark Reed was the third witness to take the stand Thursday. He testified that he was previously addicted to drugs, and during that time “did what he had to get money.” One of those things he said was to buy and “flip” guns. He said he was familiar with Adam Montgomery and reached out to him on FaceBook. Montgomery asked for Reed to buy some guns which Reed identified as the missing guns.

Over one thousand messages sent between Reed and Montgomery were entered as evidence. Some of those spoke about an offer to sell one of the guns for a “finger or stick” of heroin and $80 cash.
 
One can only hope they have enough with her and OTHER witnesses and evidnce due to her not being the most solid. Just a reminder one can't choose your witnesses, you are stuck with what you get/who you have.

Jurors in the Adam Montgomery weapons trial listened to combative and confused witness testimony Friday.

Reluctant witnesses have been a theme of the weapons trial. Many witnesses have been in court under subpoena and openly told jurors they do not want to testify.

But the last two witnesses of the day Friday were cooperative and said they were neighbors of the Montgomerys. Both said Adam Montgomery bragged about having guns.

"That he had guns that he was selling," said neighbor Tarah Hilbert, adding that he described one as an AR-15.

Two witnesses testified that Adam and Kayla Montgomery were their neighbors on Union Street in 2020 and told them he was hiding the guns in the walls and the ceiling of the Gilford Street house.

"He said he had one, and he sold it, and he was scared about the ATF afterwards," said neighbor Joshua Zimmerman.

Seven witnesses have testified about Adam Montgomery bragging or selling long guns in 2019. Witness Kevin Labelle testified under immunity, and News 9 could not show his face.

"No question of that at all," Labelle said. "I bought the gun. I bought it off him."

He said he then sold it back to Adam Montgomery.

"I sold it back to him for a gram and a half of crack cocaine," Labelle said.

An affable but confused Mark Sullivan spent hours on the witness stand. Defense attorney Caroline Smith worked hard to get his testimony to align with a deposition he gave last year that mentioned Ishmael Garcia, but Sullivan said he was sure it was Adam Montgomery.

Prosecutors asked if he said Adam Montgomery seel an assault rifle.

"Yes, right in front of me," Sullivan said. "I was sitting in the back seat. I wanted him to do it too."

The estranged wife of Adam Montgomery testified against him Monday in his weapons trial.

Adam Montgomery is charged with two counts each of being an armed career criminal, receiving stolen property and theft by unauthorized taking. He has separately been charged with killing his daughter, Harmony Montgomery.

His estranged wife, Kayla Montgomery, testified Monday morning that her husband told her he had stolen the guns.

The case is about a stolen shotgun and rifle belonging to a man named Chris Frain.

Kayla Montgomery admitted to the jury that some of her memory is fuzzy because of the drugs that she was doing at the time, but she testified that her Adam Montgomery went over to visit Frain's wife, Kim, shortly before the guns were stolen.

She added that Kim Frain subsequently called her, "freaking out" about the missing guns. Kayla Montgomery also said she observed the guns in her own home and saw Adam Montgomery trying to sell them.

Adam Montgomery is also charged with being a felon in possession of a weapon. Kayla Montgomery said that led to a fight when he was leaving their house with one of the guns.

"Because I was nervous and scared that he would get in trouble," she said. "Because he's a felon and not supposed to have one."

Prosecutors also had Kayla Montgomery testify about pleading guilty to perjury as part of a plea bargain, which included dropping charges of receiving stolen property related to the guns.

As a result of that plea bargain, Kayla Montgomery was under an obligation to testify. She told the jury that it was also an obligation to tell the truth, which she said she did during her testimony.

Kayla Montgomery's story has changed over time, something the defense focused on as they began their cross-examination.

Very little time and wasn't going to read this but did. Does cover key players and I would say most of the testimony. Good article and summary.
 
Hoping someone can watch this all. Don't have time.

I am ten minutes in and it is pretty good. Giving some testimony of the stepmonster in the trial.

Continuing to listen. It's a good show/synopsis either way. I may not be able to continue, the details are hard to hear of this poor child's life and death.

 
In revisiting this, I don't even want to think about it, but where did they keep her after being evicted and when living in their car before the next apartment where the refrigerator was taken? Or was that apartment a prior one? If I have it right and we know of this previously, it was AFTER. They couldn't haul around a refrigerator and keep it plugged in while living in a car...

Of course I have early morning pre coffee fog so I could have it wrong or remember incorrectly but pretty sure that's how they just outlined the timeline in this show too...
