JOSHUA "JJ" VALLOW, TYLEE RYAN, TAMMY DAYBELL, & CHARLES VALLOW: State of Idaho/Arizona vs. Lori & Chad Daybell *GUILTY*

1580704661510.png

Police seem to be no closer to finding 7-year-old Joshua “JJ” Vallow and 17-year-old Tylee Ryan than they were when this story began months ago.

Since that time, the story has gained international attention as it’s taken twists and turns involving a purported cult, dead spouses, delusions of divinity and preparing for the end of the world. Despite all the angles, and the ever-growing number of people related to the case, the facts remain essentially the same as when it was first announced.

The two children remain missing and the parents, Lori (Vallow) Daybell, and her new husband, Chad Daybell, refuse to disclose their whereabouts to police. Both have been named persons of interest in the disappearance of the children. Law enforcement is also investigating the deaths of the Daybells’ previous respective spouses, Charles Vallow and Tammy Daybell, though neither Chad nor Lori have been named suspects in those cases.

Written timeline of events

He didn't look at Lori?

Didn't his kids say that she lured him, or something to the effect? I'm thinking he is showing complete detachment. I wonder if that's why she wanted these meetings together. Something's up. I can smell it in the internet air.
Chad's defense: the harpy lured me in. She took my teachings and bastardized them. She told me that there were certain people who needed to die in order for our lives to be complete with each other. Her well known charms work. She got her brother to kill her husband, and she got me Errrrr... someone to kill her kids. This 144,000 crap?! Where'd that come from, I never psh.. never would write something that silly.

Curling iron? I'm assuming, maybe wrong, she could get her hair fixed before court.

Defense lawyers are allowed to fix up their clients for court. The kid who was assisting in selling crack for my trial (Errr... the trial I was a juror on, my trial hasn't started yet. They're still looking for the gold and until they find it, FREE MAN!!) Back to topic. The kid who was accused of helping sell crack in that trial looked like a U of R medical student who would be a kindly old doctor in thirty years.

IIRC, some prosecuting attorneys have used mugshots to show what the person really looked like when they were booked. I don't know if the angelizing begins with pre-trial hearings, but it is a thing.

Lori Vallow asked Idaho Judge Steven Boyce in a Thursday motion to dismiss her case after she has spent 1,169 days in jail for her alleged role in the murders of her two children, as well as her husband's ex-wife, Tammy Daybell.

Vallow's defense team is arguing that the court has violated her right to a speedy trial. Her joint murder trial with husband Chad Daybell was initially set for 2021 but has been delayed due to her competency examinations and the coronavirus pandemic, among other factors.

"The first trial setting in this instant case was for October 11, 2022, since that was within six months of April 19, 2022. The government then asked for more time and the Court granted the request and set trial for January 9, 2023. This violated her right to a speedy trial," the motion states.

Thursday's motion to dismiss includes a timeline of events in Vallow's case, including her initial arrest in Hawaii in February 2020, when she was held on $5 million bond; her indictment in May 2021; her arraignment in April 2022; her first trial setting on the indictment in October 2022; her second trial setting on the indictment in January 2023; and her third trial setting on the indictment, which is scheduled for April of this year, totaling 1,169 days in prison.

Vallow's defense argues in the motion that her "constitutional rights, including her right to be presumed innocent and her right to a speedy trial, have been ignored by the government."

Meanwhile, Daybell has waived his rights to a speedy trial and has asked the state to delay the trial set for April in Fremont County.

The court will hold a hearing to discuss Vallow's motion to dismiss and other motions on Feb. 9.

So what exactly is holding up this trial? The Covid outbreak, I understand, and the competency evaluations but it should go ahead in April right? I followed the case very early on, before they were arrested and when they found the bodies. Evil pair.

In the US legal system rules & procedures are established in what we refer to as codes or statutes. These codes must be followed to ensure a defendants right to a fair trial. This case is complicated because of many factors.

Review the case from a legal perspective from the link below. Each time counsel for either defendant files a motion the case cannot legally proceed until the judge makes a ruling. Look for 'motion' in the link below which may help explain the slow (ish) process.

I think part of the reason for the time taken is putting the two defendents together. Didn't Chad's attorney ask for more time?

Thanks for that. Chad's is quite a bit longer than Lori's. The very last item on Vallow's is asking the Church for confirmation of both of their memberships and details of their temple visits between Oct 2018 and Nov 2019. Interesting.

Of course they could have requested this two years ago. I remember this detective's name and he has been on the case the whole time.

Lori Vallow Daybell, 49, a doomsday-cult-connected mother of two dead children, and her current husband, Chad Daybell, 54, appeared in Fremont County court on Thursday to deal with various pretrial motions related to their shared triple murder charges. During the hearing, each side touched upon religion in the cult-connected case.

<snip>
The defense previously argued that Vallow’s speedy trial right had been “violated” even accounting for those 44 days.

On Thursday, the prosecutor said the court itself had already issued an order finding “good cause” to maintain delays in the case. Ultimately, Boyce said he would dispense with the request soon in a written order as the court moved on to other issues, Eaton reported.

Boyce next granted a defense motion for preselection instructions to be given to potential jurors. Both sides will confer and offer input on what those instructions will be. The judge then denied a state motion to compel the defense’s list of potential witnesses – after defense attorneys promised they would give their working list to the state.

<snip>
Vallow’s defense attorneys said they hope to ask potential jurors during voir dire about religion, mental illness, and drug use, according to Eaton. The prosecution, in turn, said they would “object to defense attorneys asking jurors their religious affiliation and what congregation they go to.”

Prosecutors, however, said they would deal with the issue of religion during the trial, saying they had a witness lined up who would testify about hyper-religiosity “versus” using religion “as an excuse or reason to commit a crime,” according to Eaton.

Idaho Judge Steven Boyce on Monday denied Lori Vallow's motion to dismiss her murder case for lack of a speedy trial and set a trial date for April 3 after approximately three years of back-and-forth since her 2020 arrest in Hawaii.

Vallow has spent more than a thousand days in jail as she awaits her joint murder trial with husband Chad Daybell, which was initially set for 2021 but has been delayed due to her competency examinations and an "exceptionally voluminous" collection of evidence, among other factors.

"The delay is, as a whole, minimal given the overall charges and maximum penalties imposed," Boyce wrote in his memorandum denying Vallow's request to dismiss.

Boyce determined that despite the Daybells' repeated requests to push the trial back until later this year or next year, an April 2023 timeframe will "reduce the impact of unnecessary delay."

Even though I don't want to give these people the upper hand in any way, shape or form, it only makes sense that asking potential jurors about their religion is fitting since there are a high number of people who attend the Mormon church in Idaho and the basis for a lot of these case is in the distortion of the Mormon teachings.

ST. ANTHONY — A sudden hearing Monday afternoon regarding DNA testing in the Chad and Lori Daybell case will continue Thursday in Fremont County.
<snip>

Everyone in the courtroom was asked to leave for around 45 minutes until the closed portion was finished. Then, after being invited back into the courtroom for about 10 minutes during a recess, everyone was asked to leave again.

Approximately 15 minutes later, the public was invited back to their seats and Boyce announced the remainder of the hearing would be postponed until Thursday.

"While the court was in recess, the court was advised of another additional report that came through regarding DNA evidence that was received by the state today," Boyce said. "In order to provide time to the defense and prepare the court, this hearing will be continued."

The next hearing will be held Thursday at 9:30 a.m. Cameras have not been allowed into proceedings since Boyce banned them last fall.

ST. ANTHONY — District Judge Steven Boyce has severed the case of Chad and Lori Daybell.

The couple is charged with multiple counts of first-degree murder and conspiracy to commit murder for the deaths of 7-year-old Joshua “JJ” Vallow and 16-year-old Tylee Ryan – two of Lori’s children – along with Chad’s previous wife, Tammy Daybell.

Lori appeared in person in Fremont County court Thursday, alongside Chad who appear over Zoom.

The topic of the hearing was whether the couple’s case should be split into two based on new DNA evidence that was made available to all parties in the case.

This is not the first time the topic of splitting the case has come up, but up until now, Boyce has opted to keep the case together.

EastIdahoNews.com will have a full report on the court hearing later today.

The trial was scheduled to begin on April 3 in Ada County. Lori is still expected to go to trial on that date, but the trial for Chad has now been vacated. It will be rescheduled at a later date.
