JOSHUA "JJ" VALLOW, TYLEE RYAN, TAMMY DAYBELL, & CHARLES VALLOW: State of Idaho/Arizona vs. Lori & Chad Daybell *GUILTY*

Police seem to be no closer to finding 7-year-old Joshua “JJ” Vallow and 17-year-old Tylee Ryan than they were when this story began months ago.

Since that time, the story has gained international attention as it’s taken twists and turns involving a purported cult, dead spouses, delusions of divinity and preparing for the end of the world. Despite all the angles, and the ever-growing number of people related to the case, the facts remain essentially the same as when it was first announced.

The two children remain missing and the parents, Lori (Vallow) Daybell, and her new husband, Chad Daybell, refuse to disclose their whereabouts to police. Both have been named persons of interest in the disappearance of the children. Law enforcement is also investigating the deaths of the Daybells’ previous respective spouses, Charles Vallow and Tammy Daybell, though neither Chad nor Lori have been named suspects in those cases.

  • April 3, 2018 - Tylee Ryan's father, Joseph Ryan, dies. Death ruled heart attack.
  • December 2018 - Chad Daybell & Lori Vallow make first appearance on Preparing a People podcast.
  • February 2019 - Charles Vallow files for divorce from Lori, claiming she viewed herself as a god preparing for the second coming, and she would kill him if he got in her way.
  • February - April 2019 - Lori disappears for nearly two months, leaving her children with others.
  • June 2019 - Lori's niece demands a divorce from her husband, who says she shares similar beliefs to her aunt.
  • July 11, 2019 - Charles Vallow shot and killed by Lori's brother Alex Cox. Shooting initially ruled self-defense.
  • August 2019 - Lori moves to Rexburg, Idaho with kids
  • September 3, 2019 - Joshua "JJ" Vallow enrolled in school
  • September 23, 2019 - JJ last attended school
  • September 24, 2019 - Lori unenrolls JJ from school, saying she would be homeschooling him.
  • September 2019 - Tylee also seen in September, but it's unclear when and where (she had graduated early)
  • October 2, 2019 - Lori's niece's ex-husband was shot at, missing his head by inches. Shooter was driving a vehicle registered to Charles Vallow.
  • October 9, 2019 - Tammy Daybell, Chad's wife, called 911 and said a masked man shot at her with a paintball gun.
  • October 19, 2019 - Tammy Daybell dies, death is ruled natural
  • October 25, 2019 - Tylee, or someone using her phone, texts a friend
  • Late October / Early November 2019 - Chad Daybell & Lori Vallow get married
  • November 26, 2019 - Welfare check requested for JJ at the request of extended family - police are told he is in Arizona with family, but he is not
  • November 27, 2019 - Police return to serve a search warrant, finding the Daybell's gone
  • December 12, 2019 - Lori's brother, who had shot her ex-husband, dies mysteriously in Arizona
  • December 20, 2019 - Search for JJ and Tylee goes public
  • December 30, 2019 - LE says Lori knows where her children are but will not cooperate

Don't worry as he says, not going to deep into the romance/Storm thing. He thinks prosecution may rest this week or next.

A new one to me talk was getting married on a Tuesday and they did, and the color green.

Won't have time probably to watch it all myself but a new one so sharing. Talk of the angel sblessing their wedding, give me a break.! They have devil and angel and other terminology mixed up I guess. [Chad and Lori or James and Elena0

2:30 p.m. Attorneys are back at their tables. The state says their witnesses have gone more quickly than they anticipated, so they are concluding court for the day. They will pick up in the morning with Dr. Marsden. Nate will be doing Courtroom Insider at 6:30 p.m. MST.

2:25 p.m. Wood is done questioning. Prior has no questions, and Ballance will remain under subpoena. Wood has asked for a sidebar, and Boyce is meeting with the attorneys.

2:24 p.m. Lots of back and forth with the dates and times of phones and text messages. On Oct. 15, Alex Cox was near Chad’s house around 1:41 and 1:52 p.m.

2:23 p.m. Ballance says Lori and Tylee’s phone were “consistently together after (Tylee) was believed to be deceased.”

2:22 p.m. Tylee and Lori’s phones were used days later in Arizona, then on November 4 in Hawaii.

2:20 p.m. Ballance was asked to look at Tylee Ryan’s phone and for any instances in which it was used in the same place Lori Vallow’s phone was used. Lori and Tylee’s phones were both used in Northeast Kansas. On Oct. 16, Lori and Tylee’s phones were both used in Rexburg.

2:19 p.m. Chad’s phone was near a cemetery and a Holiday Inn on the day of Tammy’s memorial. He was texting Lori that day.

2:17 p.m. Alex Cox’s phone was last near the Salem church around 10:45 p.m. Tammy Daybell died either late that night or early the next morning.

2:15 a.m. There was also a 16-minute call between Alex and Lori around the same time. Lori’s phone was in Hawaii.

2:13 p.m. Looking closer, Alex’s phone was near the Salem church between 10:07 p.m. and 10:45 p.m. Chad was texting Lori around the same time.

2:11 p.m. The next slide shows the Google location history of Alex Cox between 10:05 p.m. and 10:07 p.m. He moved from Rexburg up to the Salem church near Chad’s house.

2:10 p.m. The next slide shows more texts and calls exchanged between Lori, Chad and Alex.

2:09 p.m. Lori and Chad were texting on the day Tammy Daybell died. Lori was also texting Alex Cox.

2:08 p.m. On Oct. 19, Ballance heard Tammy had been found dead. Chad’s phone was at his house between 10:40 a.m. and 11:22 a.m. Chad texted Alex Cox around 10:40 a.m. He later called Lori Vallow around 11 a.m. Between 11:21 am and 12:11 p.m., Chad’s phone made an outgoing call to a number Ballance does not know. On Oct. 18, Alex’s phone was at Lori’s apartment between 11:02 a.m. and 12:20 p.m.

2:06 p.m. There are multiple texts between all three people that night. There are 4 texts sent between Chad’s and Alex’s phones between 5:28 and 8:43 p.m. At 9:30 p.m, there are texts between Chad and Lori. There are then more texts between Chad and Lori.

2:05 p.m. Ballance says Chad’s phone and Alex’s phones were both activated between Oct 8 and 9, 2019.

2:04 p.m. Chad, Lori and Alex are all exchanging text messages around 5 p.m. that night.

2:02 p.m. Alex’s phone is at his own apartment between 5:16 p.m. until 11:53 p.m. that night.

2:01 p.m. The next slide shows that Alex’s phone was on Highway 20 at 4:57 p.m., then was driving westbound at 5:03 p.m, ending at the Salem church near Chad Daybell’s house. The church and Chad’s house are about 2 1/2 miles apart.

1:59 p.m. Around 4:47 p.m., Alex’s phone was tracked around Highway 20 toward Chad Daybell’s house.

1:58 p.m. Alex’s phone then was seen at Sportman’s Warehouse in Idaho Falls between 3:42 p.m. and 4:12 p.m.

1:57 p.m. Alex’s phone then traveled from Lori’s apartment to his own apartment. His phone then traveled northwest, away from his apartment, then around 3:14 p.m., the phone went from Rexburg to Idaho Falls.

1:55 p.m That day, Alex Cox searched for “Auburn, Alabama zip code.” Ballance says this is significant because the Tracphone he was using had an Auburn, Alabama area code.

1:53 p.m. The next slide shows more Google location history on Oct. 9, 2019. between 12 pm and 1:23 p.m., Ballance says Alex Cox’s Google account showed him at Lori Vallow’s residence during those times. Ballance says he was asked to look at this due to an attempted assault on Tammy Daybell that occurred that day.

1:52 p.m. Ballance is showing how cell phone towers work and describing a slide showing the overlap in cell phone tower coverage in Rexburg.

1:50 p.m. Ballance says there was an incoming call received at 1:11 p.m. from Lori to Chad. The call was 513 seconds, which is about 10 minutes. There were then text messages between Chad and Alex Cox on October 9, 2019.

1:49 p.m. Two phones associated with Lori Vallow were being used southeast of Chandler, Arizona, around this time.

1:48 p.m. Ballance says Verizon did not include the cell site and sector associated with the text messages. This means if a customer sends a text message, you’re not able to see what tower was used to send it.

1:46 a.m. At 10:27 a.m, There was an outgoing call from Chad to Lori. Chad’s phone later received a call from a number that Ballance says he doesn’t recognize.

1:45 p.m. The following text was sent at 10:26 a.m. says, “I will call right now from a 401 number.” They were sent to a cell phone associated with Lori Vallow.

1:44 p.m. We now see text messages from a cell phone with an Idaho area code (208). Ballance says these were returns from Verizon, showing the text messages that are associated to Chad Daybell. The text says – “Gonna stop by the store right now to get that other number working. Hopefully won’t take long.”

1:42 p.m. The phone was at Walmart between 2:59 pm and 3:37 p.m, according to WiFi GPS data. Ballance says this does not include all of the activity of the phone, because there is a margin of error.

1:41 p.m. The homerjmaximus email account, Alex Cox’s email account, was associated with the Tracphone. We now see a map of the Walmart in Rexburg, showing the location of the phone.

1:39 p.m. Ballance says the phone was purchased from Walmart in Rexburg. The number was attributed to Alex Cox.

1:37 p.m. The receipt is from AT&T from October 8, 2019, for changes made to an account. Ballance says this shows a return from Tracphone, a company that provides wireless service. They don’t have towers, so they rely on a larger provider with a cellular infrastructure to carry calls on their network.

1:35 p.m. Wood asks Ballance about Sept. 9 and Sept. 23. He brings up two dates on the screen – October 8 and 9, 2019. We now see the screen a receipt provided to Ballance that is associated with “Boyd Dial.” Ballance says this was attributed to Chad Daybell.

1:34 p.m. Wood will be questioning Ballance.

1:32 p.m. The state has called FBI CAST Agent Nick Ballance to the stand. Ballance has previously testified.

1:31 p.m. Court is back in session. Jurors are being brought in.

1:03 p.m. Kaitlyn Hart here with EastIdahoNews.com. Nate is feeling a little under the weather, so I will be taking over the live updating duties for the rest of the afternoon. Nate is planning to be back for Courtroom Insider tonight.

12:26 p.m. Prior has nothing further. Wixom has a brief re-direct. He asks if there is no question that some type of tool was used to injure Tylee and her bones. He says absolutely. That is correct. Lunch break until 1:30 p.m.

12:23 p.m. Prior asks about Halepaska not being able to make source determinations. He says he couldn’t do any source determinations – tracking the marks back to an individual tool. Halepaska says individual characteristics are critical.

12:21 p.m. Lunch for the jury is late – so Prior is going to cross-examine now.

12:18 p.m. Overall, the majority of the injuries came from a chopping-type action. Halepaska says if he had been provided tools, he would have been able to make test marks to narrow down the tools, but he would not have been able to conduct the second level of the exam. Wixom has nothing further.

12:17 p.m. Most of the injuries to the hip came from the front side – not the back, Halepaska testifies.

12:14 p.m. A small channel was formed in one part of a bone that was consistent with an ice pick being used.

12:13 p.m. The next image shows tool marks that were generated on bones using excessive force. Another mark was caused by a stabbing-type motion.

12:08 p.m. The jury now sees a photo of a bone that was fractured and shattered. Halepaska says the tool that was used cut into the soft tissue. It was consistent with being from a cleaver, machete, hatchet, etc.

12:06 p.m. Halepaska continues to describe more chopping and stabbing-type actions on the bones.

12:03 p.m. Halepaska describes the next item on the screen – a portion of the hip bone that was black and burned. A number of tool marks were located on the item.
12:01 p.m. Halepaska goes on to describes more injuries on the bones that were caused from chopping type actions. He was unable to determine if the injuries matched individual characteristics of a specific tool.
11:56 a.m. Another photo is shown of the hip bone. Halepaska says there was a stabbing action performed on the bone and it was so hard, it caused a fracturing on the back side. The hip bone cracked.
11:53 a.m. This particular injury could have come from a cleaver, machete, etc. Halepaska describes more bones that have fracture marks caused by tools.
11:51 a.m. All of the bones were labeled when they came into the FBI office. Wixom shows another photo of fracture marks caused by a tool with a chopping action.
11:49 a.m. Halepaska describes a zoomed in image of fracture lines and cracks on the hip bone. You can see the fracture of the bone caused by the tool.
11:48 a.m. The marks were such that even if he had the tools used to produce the marks, he couldn’t 100% say which tools were used.
11:45 a.m Another tool mark is pointed out and Halepaska says it was a chopping type action. This could have come from a machete or another type of similar tool.
11:43 a.m. Halepaska says the tools consistent with producing this type of mark was a single-bladed knife or a comparable tool. Other possibilities can not be ruled out.
11:39 a.m. Halepaska generated a digital box around each of the tool marks and labeled them. The first one was from a stabbing action. Halepaska says he uses a casting substance, puts it on top of the tool marks and then removes it. He can then compare to tools that may have caused the action.
11:37 a.m. Halepaska describes an image showing tool marks that were on the hip bone. They are action-type tool marks – stabbing and chopping.
11:35 a.m. Wixom moves to admit an exhibit showing a photo. Halepaska says they images of two portions of a hip bone and an intact portion of a spine.
11:33 a.m. Wixom asks what a pattern examination is. The exam process is broken into two separate levels – doing the first, he makes observation using a low level magnifying glass. He is making notes and documenting what he see. The second half is make the identification. He uses a comparison microscope and looks at two samples under the same viewing field.
11:32 a.m. We are back. The photos will be shown to the jurors and parties but not on the livestream or to those of us in the courtroom.
11:15 a.m. Boyce says we will take a brief recess while the courtroom is shifted around because the photos are graphic.
11:12 a.m. Wixom moves to admit photos of Tylee Ryan’s remains. Boyce calls for a sidebar.
11:07 a.m. Halepaska performed a tool mark analysis on the tools found on Chad’s property. He says there are two types of tool marks: impressed and striated. Impressed are like a hammer hitting a surface. A striated tool mark is produced when a tool is placed against another object and moved parallel to and across the object with pressure applied.
11:06 a.m. Halepaska says evidence often arrives via Fed Ex. Sometimes law enforcement drop it off. It is inventoried and entered into an evidence management system.
11:05 a.m. Halepaska says the majority of cases he works concern firearms but over the year, he has worked a number of tool mark cases too.
11:04 a.m. Doug Halepaska is an FBI forensic examiner in the firearms and tools division.
11:02 a.m. Wood has nothing further. Next witness will be called and questioned by Rocky Wixom.
10:58 a.m. Wood shows the satellite image from Sept. 9, 2019. He flips back to Sept. 2, 2019. Wood points out a small bush/tree, a standalone fence, the fire ring and the hitching post. On the Sept. 9 image, there are clouds that obscure some features. Wood points to the hitching post. There was no discoloration in the previous two photos on this spot.
10:57 a.m. Prior asks about an email between Chad and Tammy regarding burning some limbs. Prior has nothing further. Wood will re-direct.
10:53 a.m. We now see a satellite image showing snow on the property. Prior asks Kunsaitis to point out the fire pit and the location of Tylee’s remains.
10:52 a.m. Prior shows another satellite map and asks about a round circle north of the tree. It’s the fire pit. Prior asks where the remains of Tylee were found. Kunsaitis points it out on the map.
10:50 a.m. Prior asks Kunsaitis to point out a few things on the map and asks what they are. There is a standalone section of fence and the fire pit.
10:48 a.m. Prior shows a satellite map on the screen. He asks Kunsaitis to point to the white barn. He asks what a dark mark is near the barn. Kunsaitis says it’s a hitching post. He asks for his glasses.
10:45 a.m. Prior asks Kunsaitis about the number of images from Apollo. He says there were four. Prior asks if the area Kunsaitis pointed to was close to the fire pit. Kunsaitis says it was about 10-15 yards from the fire pit.
10:43 a.m. Kunsaitis says he personally removed the remains of Tylee Ryan as he wipes tears from his eyes. He points to the area of discoloration on the map. We now see an image from Oct. 25, 2019. Wood has nothing further. Prior will now cross examine.
10:41 a.m. Wood displays the first image on the screen – the one from Aug. 22, 2019. We see a picture of Chad’s property from a satellite. Wood then shows the image from Sept. 2, 2019. The third image is from Sept. 9, 2019. On the third image, Kunsaitis uses a laser to point out the area where Tylee was discovered. There is a discolored mark on the map. The previous two photos did not have the discoloration.
10:39 a.m. The last image was taken on Oct. 25, 2019 at 12:42 p.m.
10:36 a.m. Wood moves to admit an exhibit. There were four photos of satellite images. The first one was taken Aug. 27, 2019 at 12:33 p.m. The second image is from the same satellite company. It’s a high resolution image of Daybell’s property. The third image is from Sept. 9, 2019, a high resolution image was taken at 12:32 p.m. That’s the day Tylee was buried.
10:33 a.m. Kunsaitis has worked at Rexburg police for 34 years. Wood asks Kunsaitis if he reviewed satellite imagery of Daybell’s property. He did. He monitored social media and found an image of a satellite photo of Chad’s land. Kunsaitis followed up on it and reached out to Apollo Mapping – the company that did the satellite photo.
10:30 a.m. State calls Rexburg Det. Chuck Kunsaitis to the stand. He previously testified in the trial. Wood will question him.
10:29 a.m. Wixom has nothing further and Prior has no questions. Sincerbeaux is free to go.
10:28 p.m. The can contained gasoline and compounds indicative of decomposing flesh.
10:26 a.m. Sincerbeaux has been involved in 50-100 cases where he had to determine the accelerant of a fire. He worked on the Tylee Ryan case. He received a can from law enforcement and asked if he could find any ignitable liquids on the inside of the can. The interior contacted decomposing flesh and debris.
10:24 a.m. Sincerbeaux explains how products were tested to see if they had ignitable liquids. He says a special oven was used.
10:22 a.m. Sincerbeaux was responsible for investigating suspected arson cases. Cans would come in to his office containing burned stuff and they he would do his analysis on it to determine if it contained an ignitable liquid.
10:20 a.m. Next witness is David Sincerbeaux. He will be questioned by Rocky Wixom. Sincerbeaux is retired from Idaho State Police and was a forensic chemist. He did that type of work for 26 years.
10:19 a.m. Prior has nothing else. Batey has no re-direct.
10:17 a.m. Prior asks how many times Ashlynn saw Alex interact with Tylee. She says more than six times because Alex was living with them. Prior asks if JJ relied on Tylee for a lot of his basic needs. “I would say he wasn’t relying on her but she was there for him. He was going for anybody who was going to provide for him but Tylee was the one who would always show up,” Ashlynn says.
10:16 a.m. Ashlynn says Tylee moved to Texas and then returned to Arizona. She then said they were moving to Idaho. Ashlynn tried to stay in touch with Tylee after she moved to Idaho but it was for only two weeks. Batey has nothing further. Prior will now cross examine.
10:15 a.m. Ashlynn might see Alex once every six months. Alex and Tylee joked around a lot and Alex offered her a place to stay when she needed it. She felt comfortable with Alex.
10:14 a.m. Ashlynn visited Tylee a few times a week. She met Charles, Lori, Tylee, JJ and Alex. Ashlynn says Tylee’s relationship with JJ was maternal. She was always caring for her little brother.
10:11 a.m. Next witness is Ashlynn Rynd. She will be questioned by Ingrid Batey. Ashlynn lives in Chandler, Arizona. She knew Tylee. “We were best friends in high school,” she says. They met in 2016.
9:46 a.m. Morning break. Back in 20 minutes.
9:45 a.m. Some parts of the body were more thermally altered than others. Wixom has nothing further.
9:44 a.m. Prior has nothing further. Wixom has some brief re-direct. He asks if some of the bones had been severely damaged. She says there was a number that were so thermally damage that she couldn’t tell if they were human or not.
9:43 a.m. Christensen says a number of parts of the skull were missing. She does not know why they are missing. Portions of the bones had burn marks on them.
9:41 a.m. Christensen says what she and Bartelink do is highly specialized. Prior asks about the carnivore marks. Christensen says typically it’s postmortem – after someone dies. She does not know where the carnivore animal made the remarks on the bones.
9:39 a.m. Prior will now cross examine. Christensen says she has published a book with Dr. Eric Bartelink. He is the defense expert. She has reviewed his report and says there were no significant discrepancies with her report.
9:36 a.m. Wixom moves to admit the FBI lab report issued by Christensen. This is a summary of her findings. Wixom has nothing further.
9:35 a.m. Christensen prepared a report after she received and evaluated Tylee’s remains. Christensen turned her report over to the Idaho Medical Examiner.
9:32 a.m. Christensen did remove tissue from the ankle and foot but none of the bones we have seen so far.
9:31 a.m. Wixom asks if it’s common for tissue to still be attached to the bones when they are received. Christensen says it’s not common but it happens. Christensen did not remove the soft tissue from the bone because she could see everything she needed to see.
9:30 a.m. We now see photos of the sacrum – the bottom of the spine – which is still attached to some vertebrae.
9:28 a.m. The next exhibit shows a sharp trauma from the previous bone. The photo also shows the bone was in a fresh state.
9:26 a.m. There is thermal damage on this bone consistent with fire or heat.
9:24 a.m. We now see photos of the right hip bone. There are six sharp trauma locations on the bone.
9:23 a.m. Christensen designated every bone an item number. There was thermal alteration to the top part of the hip bone.
9:22 a.m. More than 100 bones were submitted to Christensen. Some were more broken and thermally damaged than others.
9:21 a.m. None of the marks were consistent with dismemberment, Christensen says. You wouldn’t see sharp trauma on the pelvis area if someone was trying to dismember.
9:20 a.m. Wixom asks if the sharp trauma could have occurred naturally or disease. Christensen says no – sharp trauma happens from an external force. Wixom asks Christensen if she has experience identifying injury to bone that could occur from dismemberment. She does.
9:19 a.m. The next photos document detailed views of the same sharp trauma locations we saw on the previous slide. The bone was in a fresh state, Christensen says. She does not know whether the trauma occurred before or after death. The marks are consistent with both.
9:17 a.m. We now see a CT scan of the pelvic bone and Christensen points out sharp trauma locations. There are several spots.
9:15 a.m. Wixom asks Christensen to describe trauma as photos of the left upper hip bone are shown on the screen. They are brown and black. Christensen says there were numerous sharp traumas on Tylee’s bone. On the photo on the screen, there are five blunt and sharp trauma locations.
9:13 a.m. I’m aware there is no sound on the live feed. We have told court staff. We see part of the upper and lower jaw on the screen. There are signs the bones have been burned.
9:09 a.m. Wixom shows a diagram of a skeleton. Christensen points out where the femurs are on the graphic. The bones are burned and Christensen says that is consistent with thermal damage – it’s discolored, black and gray. Christensen is not able to say whether the burns happened before or after Tylee’s death but she says burning normally happens after death. One of the femurs have evidence of carnivore scavenging.
9:05 a.m. Boyce back on the bench. The photos will be shown to jurors and those of us in the courtroom but they will not be shown on the livestream. The first picture shows Tylee’s left femur and right femur.
9:02 a.m. Wixom moves to admit photos of Tylee’s remains and a demonstrative exhibit. Boyce asks for a quick sidebar. The attorneys leave the courtroom with the judge.
9 a.m. Christensen did an analysis of Tylee’s remains. She examined the remains visually, microscopically, by taking measurements and by using x-rays.
8:58 a.m. Bio-mechanically fresh bones still have the bending quality. Older bones fracture in different ways. She compares it to a fresh twig versus a dry branch, Christensen says.
8:56 a.m. Wixom says the skeleton can be analyzed visually and under microscope to determine if they were damaged. Thermally altered means bones have been damaged by heat or fire. Signs include discoloration and easily fractured.
8:54 a.m. Christensen works at the FBI laboratory in Quantico, Virginia. She analyzes human skeletal remains.
8:50 a.m. FBI Forensic Anthropologist Angi Christensen is called to the stand. Wixom will be questioning her. Boyce asks for a brief sidebar.
8:48 a.m. Blake follows up by asking if both Chad and Lori were looking for malachite when their spouses were still alive. Heideman says they did. Nothing further.

8:45 a.m. Heideman says she could not tell if Chad’s intent was to write a book. Prior asks about Chad searching for malachite in March 2018. He didn’t know Lori Vallow at that time. Prior asks if Lori Vallow did most of the Google searching for malachite. Heideman says she would need to check her records. Heideman says Chad regularly attended the temple “regardless of his infidelity or affair.”
8:44 a.m. Prior asks Heideman if she could determine whether there were chapter breaks in the Chad and Elena story. She says in the emails that were sent, it appeared there were chapter breaks in some but not others. Prior asks if this could have been another book Chad was writing. “I don’t know if he intended to publish it,” Heideman says.

8:41 a.m. “Elena’s magic hand has gripped the storm and they stare into each other’s eyes as intense waves wash over them,” a text reads. Blake asks Heideman what storm meant. “It appeared to be a name for Chad’s penis.” Chad is smiling.

He held her tightly before they began another round of pleasurable bonding,” reads one of the texts from Chad to Lori. “That is pretty incredible,” followed by fire emojis. This is what had occurred to me. I don't remember Alex phone records for the 9th, only the raccoon text that Chad sent.

Also, it seems like they may have made a mistake not seizing all the tools at the search IMO.
 
Tonight I've caught up with nothing. Not becaus there is a lot in many cases but because I simplky haven't had the time. Maybe halfway through the tweets here. [what do they call Tweets now that it is X and not Tiwtter :thinking: ]

Anyhow my normal way is to catch up here while listening to something on YT. And I miss most lives but in the case others like them as I do where you can ask a question, etc. Nate is still on live.

Monday 29th - 1st update

1:30 p.m. Blake says their next witness will not be here until Wednesday. She requests that court dismiss for the day and we reconvene Wednesday. Boyce says it is complicated and complex to schedule for a trial of this length. He says we will break early for the day. I’ll recap everything tonight on ‘Courtroom Insider’ at 6:30 p.m. MT. Hope you’ll tune in.

1:27 p.m. Defense and prosecution having a sidebar with Boyce. Wanted to point out that while the Daybell home may not technically be two stories, there are stairs up to a second story loft above the garage.

1:25 p.m. As Patricia left the witness stand, she looked over at Chad. He was focused on his laptop and did not look at her.

1:23 p.m. Prior asks if Patricia recalls any discussion at the viewing about Tammy or Chad going upstairs or downstairs in the house. Patricia doesn’t recall. Prior has no further questions. The state may recall Patricia later. She is dismissed for now.

1:21 p.m. Wixom has no further questions. Prior will now cross-examine. He asks Patricia if it would surprise her to learn that in the last year of Tammy’s life, phone records show there was no communication between Patricia and Tammy. Patricia says that’s not correct – they would message on Facebook and text. Patricia says Tammy would call her.

1:21 p.m. Patricia would stop by a quick visit but would end up staying hours. They’d chat about their kids and life. Chad would eventually get home and sit down to chat with them but she always got a feeling she needed to go home when Chad showed up.

1:19 p.m. Patricia says she felt Tammy had to hide what she was doing so she wouldn’t get in trouble with Chad. When Patricia and Tammy both lived in Springville from 1995-2015, Patricia would visit Tammy at least once a month.

1:17 p.m. Patricia says after Emma told a story about Tammy wanting more pets, Patricia looked at Chad and he looked a little concerned but then laughed. Garth told a story about Tammy playing video games and she would be the lookout for when Chad got home. Chad looked concerned “for a split second” but then started to laugh, Patricia says.

1:16 p.m. Patricia went to the funeral the next day. “There was a couple things he said that I thought weren’t very nice,” she says, referring to Chad. “The first thing he said was she wasn’t easy to live with, she was lazy and she had depression, which she did but to say it out in front of the whole congregation was embarrassing for her.”

1:15 p.m. Chad told Patricia that Tammy went to bed around 10 p.m. and he stayed up working. He went to bed later and he woke up the next morning to the sound of Tammy rolling/falling out of bed. He told Patricia Tammy was half on/half off the bed.

1:14 p.m. Patricia and Hanna, her daughter, went to talk with Chad. Patricia said she was sorry for his loss and they hugged. She asked him what happened. “He said that Tammy wasn’t feeling well and she was coughing a lot. He asked if she was ok and she threw up. She said she was going to bed. He asked her if she was ok and she said yes. She was feeling better after she threw up and then she went to bed,” Patrica recalls Chad telling her. Chad told Patricia, “Tammy loved you so much.”

1:13 p.m. Patricia says when she was going through the line, she noticed Chad talking with people. When someone would cry, he would cry – but he was mostly just visiting. “I felt like he should have been more sad,” Patricia says.

1:11 p.m. Patricia says it was confusing because Tammy was so young and healthy. She went to the viewing on the Monday following the death and the viewing before the funeral the next day. On Monday, Patricia went alone to the viewing. When she walked in, she said she was really upset. She and Hannah went through the viewing line.

1:10 p.m. Wixom asks about Oct. 19, 2019 – the day Tammy died. Patricia says her mom called her and was crying hysterically. She told Patricia that Tammy passed. “It didn’t register who she said because it didn’t make sense my cousin Tammy had passed,” Patricia says. “It didn’t make sense.”

1:09 p.m. Wixom asks how often Patricia spoke with Tammy after the Daybells moved to Idaho. At first, they spoke every few weeks and then it went down to a month.

1:07 p.m. Patricia taught school and so did Tammy. Tammy would leave little notes for her in the classroom. “I still have one,” Patricia says through tears.

1:05 p.m. Patricia would spend weeks during the summer with Tammy and they wrote letters back and forth. Tammy and Patricia were best friends and drove to school every day. Tammy encouraged Patricia to join the school band and take classes with her.

1:03 p.m. Next witness is Patricia Later. She is Tammy’s first cousin. Wixom asks if they had a strong relationship when they were younger and Patricia starts to cry. She says they are seven months apart and they were like sisters. They grew up with each other.

1 p.m. Prior asks Hannah if she is aware the home is one story. Hannah says she has never been to the house. Wixom has one follow-up question. Wixom asks Hannah if she or her dad asked Chad any questions about the layout of the home. Hannah says no. There is no doubt in her mind that Chad talks about going downstairs.

12:58 p.m. Prior asks if Hannah ever gave a report to law enforcement. She said she did in August 2020. She has met with investigators twice.

12:57 p.m. Hannah didn’t ask any questions to Chad but felt confused and uncomfortable. That night, Hannah spoke to her mom about the inconsistencies and then later mentioned it to Samantha Gwilliam, Tammy’s sister. Rocky Wixom has no further questions for Hannah. Prior will now cross-examine.

12:55 p.m. Around two hours later, Hannah went through the funeral line with her mother. She says Chad told them what happened – Tammy had been coughing violently and he was worried about her. Between 9-10, she came down to his office and said she was going to bed. Chad said he was worried about her and went to bed with her but around midnight, Tammy rolled out of bed. Hannah was confused because the stories were inconsistent.

12:55 p.m. Hannah says Chad appeared calmer than she would have expected. He would only get emotional when Hannah’s dad got emotional and then would stop when her dad stopped crying. “It stood out to me because I would have expected someone who just lost their partner to be a little more distraught.”

12:51 p.m. Hannah attended Tammy’s funeral and viewing. She went through the viewing line twice with different people. Chad was first in the viewing line. Tammy’s and Chad’s children were also in the viewing line. Hannah and her dad had a conversation with Chad. She says Chad said Tammy had been sick that day and she had been vomiting and coughing and around 10 p.m., she threw up again. Chad said Tammy then went to bed but Chad stayed in his office working. Around 1 a.m., he went upstairs and found Tammy on the floor and she had rolled out of the bed. Chad said he found her cold. As Hannah testifies, Chad smiles.

12:48 p.m. Hannah is a freelance photographer. Tammy is her mom’s cousin. Hannah was with her mom on Oct. 19 when she heard Tammy passed away. “I was very saddened by the news and very confused,” Hannah says.

12:47 p.m. Prosecutors call Hannah Parker to the stand as their next witness. She prefers to go by Hannah Munoz. She lives near Springville, Utah.

12:45 p.m. We are back in the courtroom. Boyce is on the bench and jurors will be brought in.

11:29 a.m. Lunch break now until 12:45 p.m.

11:27 a.m. Prosecution asks for a brief sidebar. White noise is played in the courtroom.

11:26 a.m. Prior wants to re-cross but Boyce says no, Wood did not go outside the scope. He tells Prior he can asks his questions when the agent is recalled. The witness is dismissed.

11:25 a.m. Ballance has been involved in multiple criminal investigations. Wood asks if it’s common for people engaged in criminal activity to opt out of geolocation services on their devices. Ballance has seen that numerous times. Wood has no further questions but intends to bring Ballance back.

11:24 a.m. Wood asks if the geolocation settings can be altered on a cell device. Ballance says a user can make changes about what is stored on a device. Users can opt out of certain services.

11:21 a.m. Ballance looked at the cell tower list of the providers from September 2019 and June 2020. There were no major changes between that time frame. Wood asks about the GAR system. Ballance says it’s made up components and anyone can purchase the primary components. There are civilian companies that do drive testing, Ballance says, not just the government. Ballance says a civilian could take his raw data file and compare it with their own testing.

11:19 a.m. Wood asks Ballance to describe why he uses 100 meters as a margin of error. Ballance says his research can be more precise using 100 meters or less.

11:18 a.m. Prior has no further questions. Wood has some brief re-direct.

11:16 a.m. Prior asks Ballance if we know the content of all of the text messages. Ballance says we do not. He confirms there was a “significant amount” of communication between Chad and Lori. Prior asks Ballance if he’s aware Chad and Lori were having an affair. Ballance is aware.

11:14 a.m. Prior asks Ballance who provided him the phone data. Ballance doesn’t recall specifically but says data was sent to him numerous times from numerous law enforcement agencies.

11:12 a.m. Prior shows another slide from the homerjmaximus account between midnight and 5 a.m. on Sept. 9, 2019. Alex was inside or very close to Lori’s apartment that morning. Prior asks why Ballance didn’t put any cell phone data with Melanie Gibb and David Warwick. Ballance says he was not asked to examine their phone records.

11:10 a.m. Prior brings up the slide showing Chad’s property with a focus on the irrigation pond where the homerjmaximus device was recorded. Prior asks Ballance to point out the fire pit.

11:07 a.m. Prior says there is no way for the public to verify the tests. Ballance says there is a way – the public can go buy the sensors and do a drive test.

11:05 a.m. Prior asks about Gladiator Forensics. It’s a company used by the FBI. They will only sell their equipment to law enforcement, according to Ballance. Prior says only the government has access to the Gladiator tools – not the public at large. Ballance says that is correct.

11:03 a.m. Prior asks Ballance when he did the drive test. Ballance says it was done the week of June 16, 2020 and was over multiple days. Ballance says drive tests are done to show where a phone could be – not exactly where it is.

11:01 a.m. Prior asks Ballance to explain the difference between a tower and a cell site. Ballance says the cell site includes the tower and sector. The tower is just the tower itself.

11 a.m. Attorneys are back and Prior continues questioning. He asks about the other visits Alex’s device recorded in or around Chad’s property.

10:55 a.m. Prior shows the slide displaying Alex’s device on Oct. 9 between 5:16 p.m. and 11:53 p.m. Wood asks for a brief sidebar. Attorneys and judge leave the room.

10:52 a.m. Prior asks Ballance the significance of including Oct. 9 in his report. Ballance says that’s the day Tammy Daybell reported an assault attempt that day.

10:50 a.m. Wood has no further questions. Prior will now cross examine.

10:49 a.m. Several of the jurors are taking notes during the presentation. Others look at the screens in front of them. Chad Daybell doesn’t show much emotion – looks at the computer screen in front of him and will glance up at the projector screen in the courtroom.

10:44 a.m. Wood asks Ballance if he looked at other times where the homerjmaximus account showed up in or around Chad’s property. There are some times: Aug. 7, Aug. 24, Sept. 6, Sept. 25, and Oct. 15.

10:42 a.m. On Sept. 23 between 10:13 and 10:17 a.m., Chad’s device texted Lori. It also called Alex’s device.

10:40 a.m. The next slide shows activity on Chad’s phone the morning of Sept. 23 between 9:30 a.m. and 10:27 a.m. There were multiple calls and texts between his device and Lori’s device.

10:39 a.m. The next slide shows Alex’s device traveled north from his home to Rexburg toward Chad’s home the morning of Sept. 23. His device was in and around Chad’s property between 9:55 a.m. to 10:12 a.m. The device was tracked near the area where JJ’s body was found.

10:38 a.m. On the same day between 9:27 a.m. and 9:57 a.m., three cell phone towers near the Daybell residence picked up activity on the devices. A tower near Lori’s Rexburg house was also utilized for her device.

10:36 a.m. At 9:25 a.m. on Sept. 23, Chad’s device called Alex’s device. The call was 38 seconds.

10:34 a.m. The exhibit now moves to Sept. 23, the day after JJ was last seen alive. The slide shows multiple outbound text messages and one inbound text message between Chad’s device and Lori’s device were made between 3:59 a.m. and 8:35 a.m. Chad sent Lori a text at 3:59 a.m.

10:31 a.m. The next few slides show the cell phone towers that were utilized by devices belonging to Chad, Lori and Alex on Sept. 9.

10:28 a.m. The new slide shows Chad’s device received a text from Lori’s device on Sept. 9 between 12:32 – 12:34 p.m. At 12:39 p.m., a text message was received on Chad’s device from Lori’s device.

10:25 a.m. At 11:45 a.m., Chad’s device called Lori. An outgoing call was also made from Alex to Lori around this time.

10:24 a.m. Alex Cox’s device was on Chad’s property at 11:42 a.m. The device was then traveling southbound away from the property around 11:46-11:47 a.m.

10:22 a.m. The next slide shows Chad’s phone was used between 10:30 a.m. – 12:20 p.m. on Sept. 9. There were multiple text messages and one call with Lori Vallow. The activity was during the same time frame that Alex’s device was on the property.

9:39 a.m. Wood asks how often Chad and Lori communicated with each other. “Pretty regularly,” Ballance responds.

9:38 a.m. The next slide shows activity on Chad Daybell’s phone between 7:20 a.m. – 8:04 a.m. on Sept. 9. There were multiple text messages with Lori and a call at 8:03 a.m.

9:35 a.m. Alex Cox’s device was at Lori’s apartment at 2:42 a.m. on Sept. 9. At 4:37 a.m., his device was at Alex’s apartment.

9:32 a.m. The next slide shows Google location history between midnight – 5 a.m. on Sept. 9, 2019 from the homerjmaximus@gmail.com account (Alex Cox’s account). Tylee was last photographed alive the day before.

9:30 a.m. A list of locations of interest appears on the screen. It’s includes: Burn pit in Chad’s yard, Tylee and JJ body location, Chad’s residence, Lori’s residence, Alex’s residence, the Salem LDS church, Holiday Inn Express in Springville, Utah, Evergreen Cemetery in Springville, Wireless Revolution in Rexburg, Walmart in Rexburg, BYU-I library, Sportsman’s Warehouse in Idaho Falls and Marriott Residence Inn in Kansas.

9:28 a.m. A slide shows the phone numbers Ballance investigated in this case. There are seven phone numbers on the screen. We now see a slide showing the geographical area where he did the drive test.

9:21 a.m. Attorneys are back and the exhibit is displayed. One of the slides shows the locations of cell phone towers in the Rexburg area. There is also a slide showing what cell phone towers look like and how they are split up into sectors.

9:16 a.m. Prior doesn’t object to the exhibit but asks for a sidebar. The attorneys leave the courtroom with Boyce.

9:13 a.m. In this case, Ballance examined numerous call detail records from multiple phones as well as Google location history. He says the records were voluminous. He has prepared a report with his findings. Wood moves to have the report submitted.

9:11 a.m. Ballance says you can not pinpoint the exact location of a phone with Google location services but you can find the general location. Ballance says he looks for devices/phones – not a specific person. The phone could be in the pocket of a person – but he’s locating devices.

9:09 a.m. Wood asks Ballance about Google location services. He says Google provides a service where users can opt in to have their locations recorded. These are tracked using wifi and cellular signals.

9:06 a.m. He used a specialized piece of equipment that had sensors, antennas, scanners, a computer and software to get raw measurements that map out cell phone towers. The equipment is called a GAR – Gladiator Autonomous Receiver.

9:04 a.m. Ballance was contacted by law enforcement in June 2020 after the bodies of JJ and Tylee were found. Ballance gathered up equipment and did a drive test to measure cell towers in the Rexburg and St. Anthony areas.

9:02 a.m. Ballance says in populated cities like Boise, cell phone companies providing overlapping coverage from tower to tower so calls don’t drop. He compares it to sprinklers on grass. If some spots don’t get water, they will die whereas sometimes sprinkler water overlaps to make sure the grass is watered.

9 a.m. Most cell providers capture the majority of user data but Verizon does not capture the location detail of text messages. Cell companies also have lists of all their towers.

8:58 a.m. The phone makes the decision of which tower and sector to connect to – but the phone will choose the strongest tower is can find, Ballance says. Cell companies keep records on their users phone activities.

8:56 a.m. Ballance says towers are divided into three different sectors. He compares it to cutting a pie into three different pieces. A cell phone is constantly scanning the environment to look for the strongest tower and sector.

8:54 a.m. Wood asks Balance to explain what a cell tower does. Ballance says a cell tower is constantly emitting radio frequency in a given area. He explains that cell phone towers connect with each other to enable calls to be made. The range of a cell tower depends on the area – higher populated areas have more cell towers.

8:51 a.m. Rob Wood is questioning Ballance. He asks about the training involved to become a member of CAST.

8:48 a.m. Ballance has been a special agent since June 2016. He works in Washington, D.C. He worked as a US Deputy Marshal for nine years before joining the FBI. He is currently member of the Cellular Analyst Survey Team (CAST). CAST is a group of 70-80 special agents and task force operators who specialize in using cell phone records to determine the general location of a phone that might be of interest in an investigation.

I hope the jury remember this from two weeks ago, because I couldn't remember the dates and times of Alex's phone being at Chad's property. So I am bringing forward this testimony from the 29th April as a reminder because it has the details of Alex's phone at the Daybell property on the 9th Sept. Presumably this is the day that Tylee was murdered and dismembered so Prior will likely blame this on Alex IMO. I have copied and pasted the relevant bit regarding the 9th September 2019 below.

They put a friend of Tylee's on the stand in the middle of LE describing her dismemberment. The friend said that Tylee and Alex had a good relationship. "10:15 a.m. Ashlynn might see Alex once every six months. Alex and Tylee joked around a lot and Alex offered her a place to stay when she needed it. She felt comfortable with Alex." Are they saying Chad dismembered Tylee? Chad did say that Tylee didn't like him, so I'm starting to wonder. Sick monsters - all of them!
I think it very possible Chad is the one who did so and I still think him possibly good for JJ too although LE kind of put that on Alex in some testimony days back but with Tylee, it seems they may be hinting at Chad.

Here's something that I am trying to figure out and that's that this was a vicious attack on Tylee either dead or alive. The one witness said it couldn't be determined if she was burned before or after death but they would guess after. I'd sure hope so, but what about this attack and all these injuries by tools and force? What I'm trying to figure out is are we to assume this was all done in Chad's shed? Wouldn't it be a blood bath? If it was done in one of the apartments, the same... Were they able to clean up so well except for some blood on all those tools and so on? I guess I'm wondering WHERE she was killed, dismembered, body alive or dead brutally and viciously attacked. I guess the shed is the most likely... And I'd say Chad was most definitely THE one or part of the duo at least that did this. Remember his scratches from JJ as well. I think he enjoys vicious attacks and snuffing out life and did a well with Tammy.

Imo there's no way Alex was at the Daybells for hours on his own killing these kids or at least Tylee and using Chad's tools. I find that highly unlikely.

I guess Lori turned that hard on her but I don't see Lori as having ever been capable of real love in her entire life. Maybe Alex too, who knows, sigh. I sure hope the jury can follow all this but the testimony this day shows quite clearly imo the conspiracy and the triangle of Alex, Chad and Lori on very specific dates. It shows if I followed right CHAD got the phone for Alex or got it activated for when Tammy was shot at and all were in contact steady. It TIES Chad to Alex re that imo AND both phones I think we new or just activated--Chad's AND Alex's. FOR that event and plan obviously.

They've tried to drill in I think on this day's testimony with a variety of witnesses TO this but it is still a lot to keep straight. The different numbers, times, whose phone was whose and so on. I think as a juror I'd be where I'm at even knowing more about the case and I'd know they just proved to me the conspiracy BUT that I'll never keep every detail, time, number, etc. and death straight.

I can't stand the gruesome details or thinking of what these kids went through. However, when I do hear some of them I can't entirely figure out especially with Tylee the how, when, where and time frame... Let's remember the green plastic bucket. Was this what she was put in in the send, or scooped from the fire pit? Only an idiot tries to burn plastic like that in a fire pit so I'd assume one or the other although Chad does have an idiot side. Did they all attack her with tools calling her a demon? I'm serious. Where were Tammy and the kids if at Chad's property? Did they or one then try to dismember or burn or all? The sheer NUMBER of force events on her body with some type/s of tools are NUMEROUS.

I feel like there's more and there may well be more than we know that they MAY know but just aren't going to go into at trial for many a reason. To keep it from becoming more than can be handled, understood, and perhaps because it would be theory and not able to be proven. JJ's body as horrible as it was was all in one piece but Tylee was desecrated to no end. With JJ they/or one, probably more pretty much taped and suffocated him alive, another HORRID detail. Because of this brutality and INHUMAN attack, I feel at least the same was likely done to Tylee. In a different way but because someone has this dark viciousness in them to cause aware, pain, fear, suffering and that points to Chad for ONE to me... Much like a serial killer gets their kick from the fear, while victim is alive, and putting the victim through holy HE77 and terror. I just sense this here but probably all put in the guise of getting rid of a demon and they can call it all in the name of a god (not mine) but it is Satanic, occult, etc. or some such. CHAD is the monster here. All were but he's beyond imo. And enjoys/Ed every minute of all of it...

Tools I know you mean Tylee but also lost by what you mean in not seizing all tools? They looked at or took and tested plenty no? What are you thinking was missed?

I'm just not following this post. No surprise. I only now caught up and totally last night gave it up early, long days and lack of sleep caught up and actually went to bed at 9ish and that is NEVER. Allhough I then got up at 3 for today. However, 6 hours is GOOD sleep for me and rare lol. Not that it restores when one has gone on 2-4 all the other days.

There weren't a ton of new posts last night in any case but I didn't even try to read or comment, I was just wiped. I watched a cooking show or two, watched Nate, and went to bed for once. Also of course had the things that hand to handle just for life and work and the day to day but that was it and down for count. I have real trouble with these early shifts and getting ready in the dark. I have no problem working until dark or after, it's the early shifts that I like think it should be daylight before I should have to try to start getting ready. And it's light earlier, not like it's winter when even harder lol.

So I may NOT be with it or following because of my own messed up life schedule and up and down and all over schedule. Add the fact this case/s is/are so hard to follow to beging with or recall all and yeah, just not following this post? I'm sure it's me and I'm just missing it.

Problem was I had just finished the Tweets where they were talking 8th and 9th and phones and Tammy's attack so my thoughts were on that in the latter testimony of the day. YEAH I sure hope the jury can follow all this. Haven't read your excerpt yet but since my brain was on the latter testimony of all the day's Tweets, and from Tylee back to Tammy, back to phone person and so on in those Tweets and testimony, we KNOW the case more and I was confused, jury would be more so imo. I sure HOPE in closing too they can tie this all back and together for the jury in as simplified but things that matter fasion as they can. And next we will have Prior taking it all over the place for weeks.

So I am bringing forward this testimony from the 29th April as a reminder because it has the details of Alex's phone at the Daybell property on the 9th Sept. Presumably this is the day that Tylee was murdered and dismembered so Prior will likely blame this on Alex IMO. I have copied and pasted the relevant bit regarding the 9th September 2019 below.

Okay sorry about the confusion. So you were talking Tylee and in September for the 9th. Still not sure what you meant about all tools but am at least on track with this.

I think Alex took Tylee dead, alive and willing or drugged to Chad's. Probably. Unless we are to believe she was already there and dead and he headed down to help dispose of her. More likely took her there. The thing is this is BROAD daylight, is he carrying a body into the shed or an alive Tylee or maybe a drugged one? Etc. There are neighbors, there is family who lives there, arguaby Tammy was at work but still...

Not that I guess in some ways it matters who did what or how or when, sadly, I think they've SHOWN the conspiracy and that all were involved quite well.
 
Interesting that the P expert and D expert know each other, wrote a book or some such together, etc. She said their things found were largely the same but sounding to me like their reports may differ on overall conclusions maybe? Guessing here. Different focuses. On that order maybe. This kind of tells me Prior didn't go get a junk expert like I suspect the D will don in Delphi.

However, I can't imagine what difference this makes.... Tylee is dead one way or another and these three were part of it/murdered her. In fact, a theme yesterday was Prior did not do much for cross exam.

I'm wondering how much he will do on defense. Oh he will put one on but not sure he will do a ton of witnesses but will just focus on I think that Chad was led on by Lori and her nutty brother Alex and of course he will drill in that Tammy was sick per her kids, etc. I don't think he will touch most personal witnesses from the P side, not even sure he will call the Mels or anyone like that for the D. I think we may be within two weeks of this finishing. Just guessing though.

I really don't see where anything he does is going to fly but let him try.

I read some testimony somewhere, or it might’ve been Lori‘s trial, where they said it would take a very long time to dismember the way that they did. This might come up in testimony today, in fact. From what I’m seeing, Alex was only on the property for an hour and a half. Could there have been the burial hole dug and then her body placed in it and then she was dismembered later? Trying to figure this out. At the same time, I don’t like spending too much thought on it.

This is why I went back for Alex's phone records. If I cannot remember the testimony from 2 weeks ago then will the jury? I don't understand the order that the evidence is being presented in. Its higgledy piggedly. Is someone going to give a summary at some point? In the summing up perhaps?

At present, it seems both Alex and Chad have been involved in all three deaths. As Alex is dead then only Chad is left to carry the can. Alex himself had no motive as he did not stand to benefit from these deaths as Chad and Lori did. Lori has already been convicted so I am pretty sure that Chad will be too but at present they don't seem to have laid everything out very clearly IMO.

For example, why bury them on Chad's property in the first place and did Tammy or anyone else become suspicious at all?

6:45-7:02 p.m. – Buckaroo BBQ in West Yellowstone

10:34 a.m. The device associated to Alex Cox first arrived in Rexburg on Sept. 1, 2019. The morning of the 1st it was in St. George, Utah and then it moved at driving speed toward Rexburg where it arrived that evening. It went to an apartment complex – unit 175. It stayed at 175 until the evening of Sept. 5 when it began to spend nights at apt. 107 – his apartment.

10:30 a.m. Back in court and a presentation is shown on screen. This information came from Alex Cox’s cell phone and homerjmaximus account via wifi, GPS and cell phone data.

9:55 a.m. Morning recess. Back in 20 minutes.

9:52 a.m. Wright’s investigation focused on one of Alex Cox’s devices. Wright requested that Nick Ballance look at location information from the device from September and October 2019.

9:48 a.m. A number of digital devices were recovered and turned over to the FBI cellular analysis team. I did an in-depth story about what happens at the lab where these devices are processed. You can read/watch that story here.

9:44 a.m. The FBI immediately became involved in the investigation. It was classified as a kidnapping in the beginning. Related investigations by other agencies were also happening at the same time by Rexburg police, Fremont sheriff, Gilbert police and Chandler police.

9:43 a.m. The FBI assists in missing children because of the federal kidnapping act. When Rexburg police described the circumstances under which JJ was missing, it met the requirements of the FBI getting involved. JJ was 7 at the time.

9:42 a.m. Wright worked with five agents in Pocatello. He focused on criminal work. Three did criminal work, the other two did national security work. Wright says the FBI was contacted by Rexburg police on Nov. 27, 2019, about a missing child named JJ Vallow.

9:41 a.m. Wright explains his professional background and training. He has an extensive career with the FBI.

9:37 a.m. Wright is a contractor special investigator for the FBI in Pocatello. He was an FBI Special Agent for 24 years.

9:36 a.m. State calls their next witness – Rick Wright. Det. Ray Hermosillo walks in and Prior says, “That looks like Officer Hermosillo.” Everyone laughs. Hermosillo leaves and in walks Wright.

9:34 a.m. Blake has nothing further but ends with this question: “In your experience, do dead bodies roll out of bed?” Marsden says no. Prior asks for re-cross but Boyce says no, the re-direct did not go beyond the scope.

9:33 a.m. Blake asks if the bruises could indicate there was more than one person there. Marsden says yes. It could also indicate someone kneeling on the chest and holding someone down.

9:32 a.m. Tammy’s records did not have any sign of young cardiac deaths in her family that would indicate a genetic sign of heart disease. Blake asks if someone could asphyxia someone else without leaving signs. Marsden says smothering with pillow, putting plastic bag over head, putting weight on chest, etc.

9:30 a.m. Blake asks Marsden if she learned the missing kids were Chad’s new wife’s children. She did. Blake asked if there were any signs of a medical condition that would cause heavy lungs. Marsden says no. The heavy lungs were the result of the cause of death but not the cause of death, Marsden says.

9:29 a.m. Blake asks if content in the stomach tell you whether someone has thrown up or not. Marsden says no. Blake asks if a Big Mac appeared to be in Tammy’s stomach. Marsden says no. Blake asks about Tammy have dizzy or fainting spells. That information was from the police report that contained information given to them from Chad Daybell.

9:28 a.m. Prior asks about what was found in Tammy’s stomach. Marsden says she had 3.5 ounces of a substance that appeared to be potatoes and peanuts. Prior has nothing further. Blake will now re-direct.

9:27 a.m. Prior asks about the cause of death being a subjective determination by her. Marsden says that’s correct. Prior asks what medical records she reviewed. Marsden says she looked at primary care and urgent care records from 2007-2019. She never saw any treatment for low blood pressure.

9:24 a.m. Prior asks about mechanical asphyxia. This could be like if someone was working under their car and the car falls on their chest. The person can no longer breathe. Prior asks if they checked under the fingernails or if there was anything to indicate any sign of a struggle. The bruises could indicate sign of a struggle, Marsden says. The fingers were cleaned prior to burial and there was some mold growing on them.

9:21 a.m. Prior asks if there was any damage to bones or muscles in Tammy’s neck. There were not. There were no signs that her neck had been squeezed. There was no indication of chemical asphyxiation. Prior asks Marsden if she did a crosscheck to see if the essential oils or homeopathic remedies could have cause medical issues. Marsden says most of those substances have very low chance of overdose. There was no evidence at the scene that she was overtaking any of those items.

9:20 a.m. Prior asks about the notation on Tammy’s medical records about her family having a history of heart issues. Marsden says she recalls seeing that. He inquires about the bruises on her arms and chest.

9:19 a.m. Prior asks if in a situation where a person just dies, they could have absolutely healthy hearts, lungs, organs “and yet the person could still die.” Marsden says that’s correct.

9:15 a.m. Prior asks about heart rhythm disorders and the foam found in Tammy’s airways. Prior asks if the foam could have caused the heart to stop. Marsden’s says when you have a sudden cardiac death, you don’t have enough time for the pulmonary edema to develop because your lungs essentially stop at the same time the heart stops.

9:12 a.m. Marsden says she can’t determine exactly when the bruises were placed on the body and how they got there. Prior asks about heavy lungs. Marsden says microscopic examinations are done of the lungs. Prior asks if this was the first autopsy Marsden had done outside of a lab environment. She says no – she has done around 500 more.

9:11 a.m. Marsden says Tammy’s death was suspicious mostly because it was a healthy 49-year-old woman who died without any explanation.

9:10 a.m. Prior asks about the suspicious circumstances Marsden was aware of. She says the fact the deceased’s husband has recently remarried and the fact two children were missing.

9:07 a.m. Blake has nothing further. Prior will now cross-examine. Prior asks how long the exhumation took. Marsden says 2-3 hours. She was present for the exhumation but not when she was reburied. She understood that the court order required exhumation and burial on the same day. Marsden did not see anyone from the family who was present for the process.

9:06 a.m. Marsden says there are a number of reasons seizures would be an unlikely cause of her death. Most people who have seizure disorder experience grand mal seizures. It’s extremely unliked a woman of Tammy’s age would suddenly have one seizure and die.

9:04 a.m. When a person dies, blood stops flowing through vessels. A bruise is caused by the rupture of blood vessels beneath the skin so Marsden said a dead person cannot bruise because there is no blood circulation.

9:03 a.m. Marsden reviewed Tammy’s medical records. There was nothing to explain her sudden death and nothing indicating seizures. There was nothing abnormal about possible low blood pressure. Marsden says she would not expect someone with anemia to just suddenly pass away. She would not expect someone using homeopathic medicines to just suddenly pass away.

9:02 a.m. Blake asks if someone is described as stiff and dead for a few hours, would she expect bruises on the body from external factors. Marsden says not at that point.

9:01 a.m. Blake asks about rigor mortis – stiffening of the joints and muscles of a body a few hours after death. The stiffening starts in the smaller muscles and moves to the larger muscles.

9 a.m. When Marsden determines whether or not to do an autopsy, additional factors are considered like police reports, medical records, etc.

8:57 a.m. Blake asks the difference between a coroner and a medical examiner. A medical examiner is a forensic pathologist. Coroners are either elected or appointed. In some places, coroners don’t need any medical training. Idaho has a coroner system. Utah has a medical examiner system.

8:56 a.m. Marsden says there was lividity on Tammy’s body on her back and posterior surfaces.

8:54 a.m. Marsden says the bruises on Tammy’s arms could be consistent with someone being restrained. Blake asks if anything was done to determine the age of the bruises. Marsden says samples of the bruises were looked at under a microscope. All of the bruises were acute – just bleeding and no inflammatory response. This means the bruises were perimortem bruises – they occurred within a few minutes to a few hours of her death.

8:52 a.m. Marsden has conducted 2,000 autopsies in her career. She separate asphyxia in four categories: exclusion of oxygen (choking, drowning, bag over face), neck compression (hanging), chemical asphyxia (carbon monoxide poisoning), mechanical (something placed on the chest that prevents breathing).

8:51 a.m. Marsden says cause of death was asphyxia. Manner of death was homicide. There are five manners of death: natural, accident, suicide, homicide or cannot be determined.

8:49 a.m. Marsden had information that Tammy may have been experiencing seizures or shaking. “It is extremely unusual for a 49-year-old woman to just spontaneously develop seizures without a reason like a tumor,” Marsden says. Tammy’s heart was structurally normal. It was the normal size, and all of her organs were normal.

8:48 a.m. The only thing found in Tammy’s system was fluoxetine in her liver. Fluoxetine is an anti-depressant Tammy had been on for several years. There was no explanation in the toxicology for cause of death.

8:46 a.m. Samples for toxicology testing were obtained. Most of the blood had been removed from Tammy’s body during the embalming process. Liver tissues and eye fluid were taken as well as urine from her bladder. The samples were sent to labs for various testing.

8:45 a.m. Blake asks what causes pulmonary edema. Marsden explains natural things can cause it, like pneumonia and heart failure. Non-natural causes could be asphyxia, drownings, drug overdose.

8:44 a.m. After the external exam, the torso was opened to review all the major organs. They were removed and inspected. The head was then opened through incision. The brain was removed to be dissected at a later date. No cause of death was able to be determined for Tammy’s cause of death through the internal exam. Tammy had a lot of fluid in her lungs – pulmonary edema – and fluid in her trachea.

8:42 a.m. Tammy had been embalmed. There were bruises on her chest and arms. There was no immediate or noticeable cause of death from the external exam, Marsden says.

8:40 a.m. Lindsey Blake is questioning Marsden and asks her to talk us through the autopsy process. As soon as the body arrives, an X-ray is performed. They then do an external examination of the body looking for traumatic injuries or other noticeable marks. An internal exam is then done where all major organs are dissected to look for anything that may have contributed to death.

8:38 a.m. Marsden attended the exhumation of Tammy Daybell. She followed the body during transportation to her office. She worked with Dr. Erik Christensen in performing Tammy’s autopsy.

8:36 a.m. Marsden is the deputy chief medical examiner at the Utah Medical Examiner’s Office. She is a forensic pathologist and explains here background and training.

8:35 a.m. Judge Boyce is on the bench and jurors are seated. First witness today is Dr. Lily Marsden.

8:28 a.m. At the defense table: John Prior and Chad Daybell in a blue shirt and red tie. At the prosecution table: Fremont County Prosecutor Lindsey Blake, Madison County Prosecutor Rob Wood, Fremont County Deputy Prosecutor Rocky Wixom and Special Prosecutor Ingrid Batey.

8:23 a.m. Back in the courtroom this morning. It’s day 23 of the trial. Around 30-40 people in the gallery. Larry Woodcock has a big back of mints he got from Ruth’s Chris Steak House, and he’s passing them around the room. “Here’s a little treat for everyone,” he says.

Ah so they are on Yellowstone today. Maybe they will now explain the bit after Yellowstone and prior to Alex and Chad being at the burn pit/burial site on the day after, for one and a half hours minimum.
 
I read some testimony somewhere, or it might’ve been Lori‘s trial, where they said it would take a very long time to dismember the way that they did. This might come up in testimony today, in fact. From what I’m seeing, Alex was only on the property for an hour and a half. Could there have been the burial hole dug and then her body placed in it and then she was dismembered later? Trying to figure this out. At the same time, I don’t like spending too much thought on it.
She was found in the fire pit right? So they could have burnt her and dismembered her at the same time I guess. Or dismembered in the fire pit area then set alight with branches, petrol etc. Clearly this was done by Alex and Chad based on the phone evidence.

Chad could have had plenty more fires at that same site on other days too, to further burn the remains. Especially after Tammy was killed.

ETA Ah ha - so glad they are going over the Tylee timeline again. Yellowstone/Rexburg apts/Chad's residence. Added to post #6537 above - 3 posts back only.
