Police believe missing Winona woman’s disappearance ‘involuntary and suspicious’​

Madeline Kingsbury, 26, has been missing since the morning of March 31 when she was last seen at her home in Winona. She was supposed to show up for work that morning but didn’t. Numerous calls and messages from friends and family went unanswered.

A $50,000 reward is now being offered for any information on Kingsbury’s whereabouts.

During the course of the investigation, Winona police know that Kingsbury returned to her residence in Winona after dropping her kids off at daycare around 8:15 a.m. on March 31 in a 2014 dark blue Chrysler Town and Country minivan.

The father of Kingsbury’s children said he left in her minivan around 10 a.m. and when he returned later in the day, she was not home.

Police believe a similar van was seen driving on County Road 12 and Highway 43 in Winona County and then southbound on Highway 43 through the eastern part of Fillmore County. Later, a van similar to Kingsbury’s drove back towards Winona on Highway 43. This occurred during the timeframe of 10 a.m. and 1 p.m.


Police said the van has been parked in her residence since 1:30 p.m. on March 31 and they are not currently looking for the van.

Authorities located her phone, the jacket she wore earlier that morning and her wallet inside the home.

Nothing to date indicates that Kingsbury left on foot or in another vehicle.

Winona Police believe Kingsbury’s disappearance is suspicious and involuntary.

Law enforcement have searched near her residence and along Highway 43 in both Winona and Fillmore counties.

Winona Police have been assisted by other agencies and volunteers. Search efforts included people on foot, in vehicles, on water and air.

Prosecution responds to Fravel’s motion to exclude police interview​

Prosecutors in the case against Adam Fravel, who is accused of killing of Winona mother Madeline Kingsbury, filed an opposition to Fravel’s motion to exclude a police interrogation from April 2, 2023.

In January, Fravel filed a motion to exclude the statements he made during an interview just three days after Kingsbury disappeared claiming that officers never read him a Miranda statement.

In the opposition filed on Friday, May 17, the prosecution argued that Fravel was never read the Miranda statement during the April 2, 2023 interview because he was not in custody at the time of the interview.

A person is not given their Miranda rights until they are in custody and being interrogated, and Fravel had not been arrested at the time of the interview, according to the prosecution.

Fravel reportedly agreed to an interview with the detectives at the Rushford Police Department, drove there in his own vehicle, was never put in handcuffs and left the police station when the interview was finished, according to the prosecution.

Fravel was not placed under arrest until June 7, 2023, more than two months after the interview in question.
 
Here we go again where they are trying to argue noncustodial interviews where they can leave at any time and agree to talk/dont' disagree. Being arrested TWO months later says enough imo in this one and drove there himself and so on. Much the same in Delphi. Not all but much. Of course the goal of all defense is to get their client's lies thrown out. Or confessions if such would be the case.
 

Most residents think Adam Fravel is responsible in Kingsbury death: Court docs​

As the defense argues for the case to be moved out of Winona County, attorneys for Adam Fravel say a survey shows most Winona County residents believe he was responsible for the death of Madeline Kingsbury.

In January, Fravel's attorneys filed motions to dismiss the case and move the trial out of Winona County. In briefings filed on Wednesday, the prosecution laid out their arguments against moving the trial to another venue.

According to the briefing filed by the prosecution, Fravel's legal team commissioned a survey that showed the vast majority of Winona County residents (89%) were aware of the case and, of that group, 74% had "formed an opinion that [Fravel] caused the death of Madeline Kingsbury."

In response, the prosecution points to the decision in the Derek Chauvin trial for the murder of George Floyd – which was not moved out of Hennepin County.

"A fair trial does not mean jurors must be ‘totally ignorant of the facts and issues involved’ in an important criminal case,'" writes the prosecution, citing precedent.

Under that reading, prosecutors say the survey doesn't show that future jurors will be prejudiced in their deliberations or what knowledge of the case they have.

A trial date has not yet been set in the Fravel case. It's unclear when the judge will render a decision on the change of venue request.
 
Well he IS GUILTY. OBVIOUSLY. Why is he even fighting it like they all do. Sigh.

For God's sake just change venue. Use those taxpayer dollars for something other than dumb stuff or pocket lining and move it so they can't whine later about a lack of changed venue on appeal and prejudice, etc. If the judge doesn't want to lose a big case, judge can go with. If prosecutors don't want to, they can go with.

So far beyond ridiculous these days like jurors don't take their jobs seriously and set out to be fair even if they HAVE heard of it. There are victims and victims families while all this stupid bs goes on for years and is fought. MOVE IT. I don't think it needs to be but just DO IT. Instead of wasting days, weeks and months arguing such. Make the arrangements, get hotels or buses, decide if juries will come from another county into yours or move the whole thing.

You know it is all ridiculous as the only way to maybe not have anyone know of some case at times is to move it to another state but that can never be done BECAUSE states are separate which I both good and bad. But if this case could be moved to say California or Louisiana you may have a few like us that follow crime who MAY have heard of it but the full area would be almost all people who have never heard of it as to a jury pool. Moving a county over though, many often will have.

Even so, jurors set out to be fair, almost all.

Ridiculous.

It's all just games and bluffs and time taking that will go on for years in most cases. So you know what? JUST GRANT IT. And DONE. Next up defense for your next delay now that that one was granted and no time wasted on it?

I'd add that most probably do feel he is guilty. I sure do. The facts in this one are pretty indisputable so he is just wasting everyone's time and money.

Sickening. Left his kids parentless. Loser. Had to even steal her vehicle to dispose of her because he didn't have a pot to pis* in and doesn't know what work is.
 

Winona community holds candlelight vigil for Madeline Kingsbury's 28th birthday​

Four domestic violence advocacy groups hosted the vigil to help the Kingsbury family honor Madeline for what would've been her 28th birthday.

Organizers invited community members and survivors of domestic violence to attend the Saturday evening vigil. The organizations offered safe spaces for open conversations surrounding different types of abuses and provided domestic violence resources.

Madeline's father says he hopes her survivor story will encourage others to speak up about any abuse they have faced or are experiencing.

"Unfortunately, she thought she could handle it, but she didn't have a safety plan. Domestic violence awareness is why we are here," said David Kingsbury.

The Kingsbury family says the vigil was an opportunity to reflect on the legacy she has left.

"That's one big part of her legacy, her kindness. Also, her strength and her courage to decide to change her life for the better to get out," said David Kingsbury.
 

Fravel's attorneys look to get trial moved​

Adam Fravel is charged with murder in the death of Madeline Kingsbury, and Friday his defense filed a nine-page document to move the case from Winona County.

June 7th is also the day Madeline Kingsbury's remains were found north of Mabel in Fillmore County, one year ago.

Previously, Fravel's team had filed his motion for a change of venue on January 19. It argued a fair trial cannot be had in Winona County due to potentially prejudicial pretrial publicity. The case was wide-spread on media outlets throughout Minnesota and the country.

On May 29th, the State requested Fravel's trial stay in Winona County.

"From the evidence and testimony presented, Defendant has failed to provide sufficient evidence from which the Court can properly assess whether there exists a reasonable likelihood that a fair and impartial jury trial cannot be held in Winona County. Therefore, Plaintiff requests that the Court deny Defendant’s motion for a change of venue." - Filed in District Court 5-29-24

In Friday's response, Fravel's defense says a public opinion survey is not sufficient, and that the public and potential jurors will remember the media coverage from early on.

The filing says the state claims because the qualified public opinion survey is a snapshot in time, future facts and circumstances may cause opinions regarding the case to change as potential jurors forget the contents of early and more recent reporting.

The defense is "vehemently opposing the state's venture to argue hypotheticals," the documents read.

The reply also states screenshots of media reports were not totally accurate and could mislead a jury.

Also, Fravel's team argues signs with statements like "Justice for Maddi" and "End Domestic Violence" at the Steamboat Days Parade in Mabel could mislead a jury. A social media post from Winona County's Emergency Management was also mentioned in the document.

These among other items have Fravel's attorney questioning whether prospective jurors can set aside their opinion and impression of the case to render and impartial verdict.

A Winona County judge ruled Wednesday to move the trial of Adam Fravel, who is accused of murdering ex-girlfriend Madeline Kingsbury, out of the county.

District Court Judge Nancy Buytendorp cited ongoing media coverage and a public opinion poll supplied by Fravel's lawyers in granting the change in court venue, arguing the community's awareness would make it difficult to try Fravel in the area.

"It is evident to this Court that a fair trial cannot be ensured within this county," Buytendorp wrote in her order.

Attorney Zachary Bauer, representing Fravel, and Winona County attorneys headed up by special prosecutor Phillip Prokopowicz butted heads over whether to move Fravel's trial in pretrial motions made earlier this year. Bauer wrote in a brief this month that Fravel couldn't expect a fair jury as ongoing media coverage would likely keep the issue fresh in residents' minds.

"This is a society where news articles are posted online indefinitely and circulated on social media," Bauer wrote. "Whether fortunately or unfortunately, we are not in a society where materials and publications are altogether forgettable."

Buytendorp denied other motions from Fravel's attorneys to dismiss first-degree murder charges against him and suppress comments Fravel made to police several months before his arrest in June 2023. She also signed off on the prosecution's request to seek harsher sentencing for Fravel if he's convicted based on the deliberate concealment of Kingsbury's body, which was missing for several months.

The judge ordered Winona County to work with state officials to hold the trial elsewhere. It's unclear whether it will affect the scheduling for the trial, which is set to start this fall.
 
Well good. Less for defense to yell about or appeal. Let it go elsewhere. Often tried to keep I think from egos wanting to be the ones in charge and of course expense to the county.

Pretrial publicity is one thing but I don't think it should apply to FACTS such as what is known that he did. Speculation sure.

Ridiculous. But give it to them, give the defense everything like many do. HOWEVER, I don't disagree with moving it, go for it. I think juries almost anywhere take their jobs seriously. I exempt California from that somewhat and Florida too but overall most are doing their job and intend to do it fairly.

He shouldn't even be defending this but just pleading guilty but that's what they ALL do these days, save almost none.

Looked up the county. So it's county seat is Mankato so they are moving it all the way to the other side of the state right? The murder area is Winona so near the MS River side and Mankato I am sure is the other side as I've traveled that way to SD and stayed there a night.

I wonder how many surveyed were not aware of the case until they got the survey... Seriously.

Oh I most definitely agree. Honestly I am more wondering if the judge wanted off the case... Never seen something granted that easily when it comes to change of venue. Pretty rare actually in cases we see even in ones like Daybell, arguably FAR better known but then they say, the entire country knows of it so what's the difference...

This case is arguably not well known. In fact it is probably pathetically little known.

And yes they have all the rights and they only keep adding and getting worse where now we see things like they don't even have to attend hearings, pretrial things, nothing and can "decide" not to go when THEY are the ones who ASKED for a trial they then don't want to attend...

Idiots run the world. It just gets softer and flat out more ridiculous in the wrong direction.

One has to wonder about this judge. In Kohberger, far better known, the defense actually contacted people and were influencing them as well and that's a largely SEALED case with a gag order. And even though claiming what was said here and MORE, the judge has not just caved to moving it. Not yet anyhow, and I don't think will.

Like I said previously, how many did this D contact in their survey or their hired research team (if using one) and some were unaware of the case until asked such questions....?

Also arguably these days, what's the difference where it is with internet news and all? Like the local newspapers and local news are what most watch or read any longer...? Like people are at church and having coffee on the porch of the general store each week talking this case and gossip? It's ridiculous. Just think about it. Multiple generations now probably have never picked up a local newspaper and read it nor watched any local news... And even if they did, so what?

We know of the case because we follow crime and it was one that came to our attention. Even WE don't know every case. People who don't know even less.

And a jury is to be objective anyhow.

I don't know that I've ever seen a judge cave so easily to a change in venue. I'm thinking she wants to wash her hands of it and just wants some vacation time.
 

Adam Fravel’s defense motions to exclude witnesses from courtroom during trial​

As Adam Fravel’s murder trial inches closer, final pre-trial motions are being filed.


Fravel is scheduled to begin his jury trial on October 7 in Mankato. The trial is expected to take three weeks. Fravel is scheduled for pre-trial hearings in Winona on September 3 and 4.

As both sides work to ensure a fair trial, the defense has made several pre-trial motions ahead of the pre-trial hearings. According to court filings, prosecutors plan to call key witnesses to the stand. Those include family and friends of Kingsbury.

Defense attorney Zachary Bauer has requested be sequestered during the pre-trial hearing. Bauer also motioned to have all witnesses be excluded from the courtroom during the trial process.

I honestly don't get most trials taking more than a week. Maybe two.

Maybe in Daybell where there were tons of crimes and things, etc.

This was one man and one victim tragically. Nothing that convoluted about it.

Unless the court is dong that new thing I never heard of until the Read thing and they have their "dark" days meaning days the court is off. Never heard of that in MN but who knows...

I've been to this area on a couple of day trips in my life, maybe one overnight, I forget. This happened in our Midwest states here. I am waiting for his conviction and a life sentence. No DP in my states. Unfortunately.
 

Two-day hearing in Winona starts Tuesday in Fravel case​

A two-day pre-trial hearing begins Tuesday morning in Winona for Adam Fravel who goes on trial next month on charges he killed Madeline Kingsbury last year.

The hearings start at 9 a.m. both days at the Winona County Courthouse in Winona before Judge Nancy Buytendorp.

As with many cases headed to trial, attorneys on both sides meet for pre-trial hearings, where they may argue for or against pieces of evidence, certain testimony, or other elements of the pending trial.


In the Fravel case, court documents show that his attorneys are looking to block hearsay statements made during the Grand Jury proceedings that prosecutors plan to use at the trial.

The motion also covers other hearsay statements offered at the trial that weren't used at the Grand Jury proceedings.


The defense said in the motion that the statements don't fall within state evidentiary rules allowing them to be used in the trial.

Some of the statements are from Madeline Kingsbury's parents.

Adam Fravel's trial begins October 7 at the Blue Earth County Justice Center in Mankato. It is scheduled to last four weeks.
