Savannah : Police searching for missing 20-month-old toddler​

The Chatham County Police Department is searching for a missing toddler.

Twenty-month-old Quinton Simon was last seen at his home in the 500 block of Buckhalter Road at 6 a.m. this morning, and was reported missing at approximately 9:00 a.m.

He was wearing a light blue Sesame Street shirt and black pants.

Leilani Simon, accused of killing her toddler son Quinton Simon, will be back in court Wednesday to review DFCS documents related to her family.

Simon's lawyer filed the motion earlier this month pleading the court to allow an "in camera" inspection involving herself, her three children — including Quinton — each of their fathers and Simon's mother, Billie Jo Howell, who was Quinton and his little brother's legal guardian.

Public defender Robert Attridge wrote in the motion that Simon wants to review these records to find out if disclosing them would ensure Simon gets a fair trial.

According to NITA — the National Institute for Trial Advocacy — an in-camera inspection is a "trial judge's private consideration of evidence." That means the judge will be the only one who looks at the files.

The state is fighting that, filing a motion to deny access and for a protective order.

They say these documents shouldn't be released unless an in-camera inspection reveals information that will prove the state's case against Leilani Simon or that those files will lead to further evidence discovery.

Prosecutors have subpoenaed a local dentist office for Leilani Simon's records after she was accused of murdering her son Quinton and then discarding his body in the trash.

The State of Georgia has subpoenaed a Savannah Aspen Dental for 22-year-old Simon's dental records for any treatments she's received between October 1 and October 5.

Her son Simon, one, was reported missing by his mother on October 5 and his remains were found in the Chatham County landfill over a month later.

Simon was supposedly high on drugs when she used an unidentified object to beat her son which caused 'serious bodily injury' and led to his death, prosecutors revealed in December. She reportedly met with her drug dealer right before the murder.

In addition to the dental records, prosecutors have also subpoenaed the alleged murderer's mother Billie Jo Howell as they are seeking Simon's journals or similar writings, Fox 28 Savannah reported.

Both Aspen Dental and Howell required to appear at Chatham County Superior Court on February 13 for a status check.

SAVANNAH, Ga. — The defense team for Lelani Simon, the mother of Quinton Simon charged in the Georgia toddler’s death, filed a motion to quash a subpoena to turn her dental records and personal writings over to the court.

The motion was filed Wednesday after the prosecution was granted a subpoena earlier this month, according to court documents.

According to the new motion, the defense argues the subpoena violates Simon’s Fourth Amendment rights to unreasonable search and seizure.

Assistant Public Defender Robert W. Attridge, Jr. wrote in the motion that the subpoena asked Howell to “act as an agent of law enforcement and forces her to unlawfully search for evidence that the defendant enjoys as ‘expectation of privacy.’”

In a ruling Wednesday, Judge Tammy Stokes ordered DFCS to produce all files involving Leilani, Quinton, her mother Billie Jo Howell, Leilani’s other two children and their fathers.

These files will be analyzed by the judge to determine if there’s any admissible evidence.
 
The 22-year-old mother, accused of killing her 20-month-old son Quinton, will enter the plea in her murder case on the morning of March 23.

SAVANNAH, Ga. (WTGS) — A bond hearing has been scheduled in Chatham County Superior Court for Leilani Simon, the mother accused of killing her 20-month-old son, Quinton.

The hearing is set for March 20 at 8:30 a.m. before Judge Tammy Stokes.

Simon was denied bond on Nov. 23 when her attorney entered her into a not-guilty plea at a hearing in the Chatham County Recorder's Court.

As the trial of a Georgia woman charged with murdering her 20-month-old son nears, the judge in the case has put forward unusual restraints on the media.

In advance of that, the Chatham County judge issued rules for members of the media covering the trial, according to WSAV-TV.

Any outlet covering the trial must agree to the 15 rules in advance, obtain prior permission to bring cameras into the court and agree to allow for the option of pool coverage.

Videos or images of Leilani Simon in handcuffs are banned, as are images of Simon that show her speaking with her lawyers or the reactions of family members to what goes on in court.

Superior Court Judge Tammy Stokes had earlier ruled she would allow cameras on a case-by-case basis, according to the U.K.’s Daily Mail.

SAVANNAH, Ga. (WSAV) — WSAV now has more of an understanding about what cameras will be allowed to show inside the courtroom as Leilani Simon’s murder case continues towards a trial.

A Chatham County judge has handed down a media order with specific instructions.

The order includes 15 guidelines that journalists covering the case must follow – with an understanding that reporters and photographers will have to agree to these rules, ask in advance for permission to bring cameras into hearings, and possibly be required to work together for pool coverage.

A few unique rules include not being able to display videos or pictures of Leilani Simon in body restraints such as handcuffs. The media also isn’t allowed to show the faces or reactions of Simon’s family or show Leilani Simon speaking with her lawyers.

SAVANNAH, Ga. (WTOC) - Leilani Simon will make her first appearance in court Thursday morning on the 19 count indictment that was handed down back in December.

The indictment says Leilani assaulted her son with an object resulting in serious injury, causing his death, and then placed his body in a dumpster.

The charges against her include one count of malice murder, two counts of felony murder, one count of concealment of the death of another and more than a dozen counts of making a false statements to police.

We are learning that Simon’s attorneys have filed a motion to dismiss four of the counts of making false statements, as well as a motion claiming that prosecutors didn’t share enough information in the indictment to justify the three murder charges.

Simon is scheduled to be in court Thursday morning, and we expect that this is the first time that she will physically be in a courtroom.

Judge Tammy Stokes issued an order earlier this week, allowing Simon to be dressed in regular clothes in the courtroom.

However, as far as recording hearings to be played back later, Judge Stokes said she’ll make a ruling on that later. We expect to hear more about some of those rules Thursday morning in court.

Then, later Thursday morning, Leilani will appear in court for her bond hearing first and then her arraignment.

WTOC will be inside the courtroom as she makes her first appearance on the indictment. We will keep you updated on air and online with what is happening inside. Court is expected to begin around 9 a.m. Thursday morning.

Sounds like what SHOULD be happening in the "West" boys' case. Not just banned as they did but determining if any evidence is relevant/admissible with DFCS.

SAVANNAH, Ga. (WSAV) — Attorneys for Leilani Simon will be back in a Chatham County courtroom next Friday for a motions hearing.

Simon’s attorneys are asking the court to throw out seven of the 19 charges the mother is facing.

Four of the seven charges are for lying to police, the other three are murder charges. Simon’s attorneys say the Chatham County District Attorney’s Office failed to provide enough information in the eight-page indictment for them to defend the three murder charges.

Why would they want HER dental records???? Were there bite marks on this child?? They can't have found enough for that to be it. What am I missing here with my tried brain?

As to the journals it would really depend the purpose and dates imo. How is it even that they know of such?

Oh man. He is a baby. To bite hard enough a baby that something woulds till remain after all that time is horrible.

Thing is they found him in a landfill quite a time after the fact. Not sure how much they had to work with or what was left/found of his remains.
 
Yes. That is true. He was very decomposed. Evil b****. All these cases. Parents, Adoptive parents, Foster parents, Step parents, Boyfriends along with the mother etc. It is absolutely sickening!!! You have to have a license to drive. You should have to, To have a child.

The state has filed a scathing response to a Chatham County woman's request to have the murder charges against her quashed.


On Friday, Assistant District Attorney Tim Dean responded in a filing that said, in part, "One marvels at the brazenness" of Leilani's request.

The filing goes on to detail how Quinton's body was picked up from a neighborhood dumpster, compacted by the trash truck and then repeatedly bulldozed at the landfill.

"Quinton’s body went through a lot," reads the court document. "As a direct result of the Defendant’s deliberate choice not only to conceal Quinton’s death but to do so specifically by subjecting him to the violence of the waste management system, law enforcement did not discover his remains—not his intact body, but his remains—for more than a month after his disappearance."

The severe trauma Quinton's body suffered made it unlikely that a conclusive cause of death will ever be established, Dean wrote, but that more than enough case law exists to show the evidence is sufficient for the state's charges.

"...Her actions in disposing of his body and concealing its whereabouts indicate that her specific intent and hope was that Quinton would never be found at all."

Great response by the prosecution and outrageous by her. No remorse, just her own arse and as they said so BRAZEN to even think such is a possibility. THIS was her SON but nope, just upset at her incarceration. Guessing grandma can't bail her out of this one and honestly grandma should likely have some charges too.
