This contrasts what they said with what Suzanne said as to how things were and WHAT the girls KNEW. About 20 minutes.

Tisha Leewaye, an acquaintance of Suzanne Morphew, says the $15 million lawsuit filed by the missing Colorado woman's husband Barry Morphew against Colorado prosecutors is "bogus."

Morphew, 55, who was accused of killing his still-missing wife in 2020 before charges against him were dropped in 2022, filed the lawsuit on May 2, arguing 11th District prosecutors violated his civil rights with the accusations made against him.

"I think it's pretty bogus," said Leewaye, who worked at a tanning salon where the whole family used to go. "... Right now, he's still a suspect. Just because the charges were dropped doesn't mean he's not a suspect.... I'm not saying that the D.A. did that perfect job on this because I don't believe they did, either. I think it's been kind of a messed-up case from day one. But your wife is still missing, and you're suing for money."

CHAFFEE COUNTY, Colo. (KRDO) -- Attorneys for Barry Morphew, the Chaffee County man previously arrested and charged with the murder of his wife Suzanne, are trying to change his dismissal ruling from without prejudice to with prejudice.

Cutting through the legal jargon, the main difference between the two dismissals is whether or not a person accused of a crime can be re-tried in a court of law. In April 2022, a Fremont County Judge ruled that Morphew can be re-tried by dismissing the case without prejudice.

Now, in a motion filed on April 18, elected District Attorney Linda Stanley states that Morphew's Attorney Iris Eytan is asking for a judge to set a date when this dismissal ruling can be changed. Stanley argues in the motion that, "Crim. P. Rule 55.1(7) in no way states a court can change a dismissal without prejudice to a dismissal with prejudice at a date certain," Stanley's motion reads.

13 Investigates spoke with Colorado Springs attorney Jeremy Loew, who states this kind of change in ruling would be "almost unheard of."

"I really can't think of a situation where the judge has dismissed a murder case with prejudice, but this case is different than almost 99% of other cases. This is a no-body homicide. There are discovery violations and it's one thing after another," Loew said. "So while it would be shocking that the judge would convert this to a dismissal with prejudice, it's not necessarily surprising given how much just weirdness has surrounded this case."

Court documents say Morphew's attorneys are also trying to limit public access to certain court records. While the contents of those documents remain a mystery, the motion filed by Stanley says they involve "whether the victim’s statements may come in under CRE 807, after a case has been dismissed."

"CRE 807 are statements that Suzanne made. What happens is if you are charged with somebody's death, those statements that person made are an exception to hearsay. So if she made those statements but you made her unavailable by killing her, then her statements are an exception to hearsay. Hearsay is an out-of-court statement that goes to the truth of the matter asserted made by somebody," Loew explained.

What statements Suzanne made are unclear. None of the court documents filed in the case since it was re-opened on May 23 outline what specific statements the victim made that the defense wants to keep out of the public eye.

Loew said he believes Morphew's defense team's posturing to get the dismissal ruling changed is because he could be subjected to depositions after filing a $15 million dollar civil lawsuit against various prosecutors and investigators last month.

FFS! I'm so tired of crap that is tried to be used as reasoning now in almost every case. There have been plenty of no body, Convicted anyway, Murder cases. It's more difficult. But it's been done. A "Mountain Lion". Right Barry.

The attorneys in this law firm are slime and it isn't the first case I've seen them in. They are purportedly high powered Denver defense attorneys but that just shows you how sick our system is that they are thought of that way.

Murder has no statute of limitations and he was NOT tired and of COURSE they should be able to recharge it. In my unprofessional opinion.

This is probably their issue:

Loew said he believes Morphew's defense team's posturing to get the dismissal ruling changed is because he could be subjected to depositions after filing a $15 million dollar civil lawsuit against various prosecutors and investigators last month.

Maybe they should have thought about the fact he could be deposed BEFORE they filed such a thing SUING for MONEY, the same reason he KILLED. Imo.

If a judge agrees with this, count on the fact there is corruption. He already imo sided with the defense a few too many times AND sealed the affidavit with, for one excuse, the sake of the girls for God's sake. And he couldn't see through the b.s. of the other DNA that even media fell for, most of them. Lauren Scharf is one reporter that knows?knew better as do some of the retired LE on YT.

'She is in a very difficult spot': Prosecutor says about suspected location of Suzanne Morphew's body

It could be months, or even years, before prosecutors have enough evidence to prove Suzanne Morphew was murdered and bring the case to trial.

"That could be a long time. It could be quick, it could be long. It depends on a lot of our investigation," said 11th Judicial Deputy District Attorney Mark Hurlbert in court Monday.

In one of the boldest statements made in open court regarding the struggling case, Hurlbert insisted that investigators suspect they know where her body is located.

“She is in a very difficult spot. We actually have more than just a feeling … and the sheriff’s office is continuing to look for Mrs. Morphew’s body,” he said.

"We are going to continue to look for her body," said Hurlbert. "We are simply trying to get this case prosecutable, whether that is against the defendant or against somebody else."

FREMONT COUNTY, Colo. (KRDO) - Details from newly released court documents in the Suzanne Morphew disappearance case shed light on her apparent rocky marriage with Barry Morphew.

Suzanne went missing on Mother's Day 2020. Her body has never been found.

<snip>

Nearly a year after the case was dismissed without prejudice, 11th Judicial District Court Judge Amanda Hunter denied the motions to limit public access, unsealing the documents.

“While it may be legally possible for Mr. Morphew to be tried in this matter, whether and when he will be tried is a matter of speculation,” Hunter said in her court order. “The arguments advanced by Mr. Morphew that relate to the proximity of trial and the ability to impanel a jury are significantly weakened by the dismissal of charges.”

After a hearing Monday, some of the documents were released to the public.

Morphew district attorney now subject of 5 complaints after "outrageous" TV interview

District Attorney Linda Stanley has found herself in trouble again for allegedly improperly speaking publicly about a case before trial.

The controversial prosecutor in the Barry Morphew case was already reprimanded once before for doing a pre-trial television interview about Suzanne Morphew's disappearance on a podcast called "Profiling Evil."

In the latest incident, an attorney has asked for dismissal in a trial involving a baby's death over comments Stanley made on a news program which were so abrasive, a curse word she uttered had to be bleeped out.

During an interview with Colorado Springs' KRDO TV about the upcoming murder trial of the baby's mother and her boyfriend, 11th Judicial District Attorney Stanley said that there was no love between Brook Crawford and William Jacobs. The couple moved in together in a Canon City Motel 6 last May, according to Crawford's preliminary hearing, but Stanley said it was a relationship of convenience and sex.

"Without the caring factor, without the love factor, the baby is a pain in the a__," Stanley told a reporter in an on-camera interview which aired Aug. 1.

I don't know anything about this most recent one but I did watch the Profiling Evil one live when it was on. I was not in agreement with thinking it wise for a D.A. to be on a YT channel and pick one and for the public to see but I can say she said nothing to little about the Morphew case that would negatively affect anything. I did think it inappropriate for an elected offical to do so though. He pushed for her to be elected and part of it it or most of it for the sake of the Morphew case so perhaps she was doing him a favor back coming on his show.

I don't hate him but I dislike his former co host. Not hate, just not fond of. These retired big career cops, there are a few, came onto YT and know the system and laws and advise us on how things work or don't work and what we can or can't do, etc. and then do things like this. They also pretend to undersatnd the public and want to bridge the gap and they do to a point but they aren't nearly as all knowing as to how to relate to the public as they think they are. I quit Duty Ron, I long ago quit the cohort of Profiling Evil but on rare occasion will still watch Mike on PE but really find no reason to for the most part most of the time.

Imo his partner and cohort on PE helped damage the case and certainly added grief to the family (Suzanne's childhood family) in the guise of helping. Mike didn't do much better having her on and some other things. Just gave something for the defense corrupt as they are to latch onto.

I do think these things about Linda Stanley are blown out of proportion but it does go to show you that you had better watch your step in positions like hers.

On the other hand we had someone truly bad and corrupt in office in NY like James Burke who was in office for years and many that get away with such.

I do think it is blown out of proportion and there is definite power and politics behind it all. Chaffee is corrupt imo and it runs to Denver as well. And more. I think she is likely not corrupt or as corrupt as what was in place but she opened herself up here. I think a mountain out of a molehill is being made but only someone like Burke (LISK/Gilgo) can stay in office for how long despite being such a criminal. I could name others but just an example.

UPDATED ON: SEPTEMBER 27, 2023 / 3:38 PM / CBS COLORADO

The remains of missing Colorado mom Suzanne Morphew have been found more than 3 years after she was last seen. The Colorado Bureau of Investigation has positively identified the remains as that of Morphew.

Morphew was last seen on Mother's Day three years ago, May 10, 2020. Her disappearance made national headlines and the investigation was featured on the CBS News show "48 Hours."

Suzanne Morphew left behind two teenage daughters and a husband, Barry Morphew, who was not only the prime suspect in her disappearance, he was also charged with her murder.

According to the CBI, the remains were located during the course of a search on Sept. 22 and those remains were positively identified as that of Morphew of Chaffee County by the El Paso County Coroner on Wednesday.

Investigators were searching in the area of Moffat in Saguache County on an investigation not related to the Morphew disappearance when the remains were discovered.

"While this case has garnered attention from around the world, it has touched our community and the sheriff's office deeply," said Chaffee County Sheriff John Spezze in a statement. "We have never stopped our investigation and will continue to follow all leads in pursuit of justice for Suzanne."

No arrests have been made since the remains have been located.

"Although locating Suzanne's remains is a critical component of this investigation, and for her family, we are left with many more questions than answers, and it would be a disservice to conduct a news conference at this time," said Spezze in a statement.

The public is asked to continue to report any information about this case by calling (719) 312-7530.

Morphew was reported missing from her home in Chaffee County on May 10, 2020.

Investigators were searching in the area of Moffat in Saguache (SUH-watch) County on an investigation not related to the Morphew disappearance when the remains were discovered.

The remains were located in the 12th Judicial District, and District Attorney Anne Kelly has been notified.

HOLY SH*T. This sure made no splash YET as I've just been on YT and this was a HUGE YT covered crime,.This is one case I will turn into a conspiracy or moving the body nut on as there is no way her hub was not involved imo, allegedly, etc. No presser even on finding the remains is unusual.

Regardless of how ANYTHING turns out, I am so happy she has been found, this one is one I would have guessed it would never happen in.

I will say another investigation does not mean it doesn't parallel somehow. Searching a lake or some such for another victim but found her for instance? It doesn't mean it relates to another perp. It also doesn't mean the other investigationw was even a murder. It could be something like looking for a stolen car that ended up in a lake or down a ravine or an accident victim in such. More unlikely though.

This is going to bring so many out and on that covered this with their hearts full into it mo as soon as the news hits and they can get it together.

I did just a quick google on the names I could think of with salida colorado to moffat named where she was found. 46 minutes. It soooo fits with Barry's window of time and speculation. Many go towards where his work was but he well had more time and a window before that where many speculated he could have went in any direction, etc.

Opposite direction from his work job but shorter distance and I personally thought it could be anything but since he used and set up the work job, going in the opposite direction in the many hours and even maybe a day he had made sense too. Im not good at mapping but I will try to post what I have in a very uneducated search mapwise.

Bottom is Moffat, Salida is just above, his job/alibi is way north.
