Girl last seen in Manchester in October 2019; police seek tips from public

Manchester police are seeking tips from the public about the disappearance of a girl not seen in more than two years.

Harmony Montgomery, 7, was last seen in a home in Manchester in October 2019, when she was 5, police said.

Police said they first learned Harmony went missing earlier this week. Chief Allen Aldenberg did not specify who reported the girl missing but said his department has been in touch with multiple family members and will continue to speak with them.

Aldenberg said police are not searching for any adult or vehicle in connection with the case. Investigators are focusing on the whereabouts of Harmony.

"No time is a good time for a child to go missing," Aldenberg said. "I'm begging the community. I don't care if you saw this young girl a year ago and you think it's irrelevant. Call us."

Aldenberg said at a news conference Friday his detectives are working to confirm where Harmony is from and where she went to school before her disappearance.

Harmony is estimated to be approximately 4 feet tall and 50 pounds. Investigators said she has blonde hair, blue eyes and should be wearing glasses.

"We need help," Aldenberg said. "This remains a very active investigation."

A mystery caller dialled into a tip line with information about the Harmony Montgomery case amid her father’s New Hampshire trial over the little girl’s alleged murder.

The developments were revealed by Adam Montgomery’s defence attorney at the end of his second week of trial in Manchester. Montgomery, who is accused of beating Harmony to death in December 2019, is facing a count of second-degree murder.

Last week, he conceded to two lesser charges of abuse of a corpse and falsifying information. Montgomery only appeared in court during the first day of jury selection and has not returned since.

The prosecution has argued throughout the two weeks of trial that Montgomery killed his daughter after he became enraged because she had a bathroom accident. Jurors have heard from more than a dozen witnesses about the horrific ways he worked to conceal, reduce, and destroy Harmony’s remains.

Montgomery then disposed of what was left of Harmony’s body at an unknown location in March 2020. Despite massive multi-state searches and a $150,000 reward for information, her remains have never been found.

On Friday, attorney Caroline Smith brought up a tip made by an unknown individual.

“During the course of the trial, apparently somebody contacted the tipline and was interviewed, gave information,” Ms Smith told Judge Amy Messer. “The state has given us a recording of the interview. I have not [gone through it.] We certainly have somebody trying to go through it. I don’t know, and I don’t need to name this person. I don’t know if we’ll be seeking to call this person [to testify].”

Senior Assistant Attorney General Ben Agati later explained that the call was placed by a woman on Tuesday after she had spent several days watching the trial. Manchester Police only notified the prosecution the following day.

“She came into the station to be interviewed and provided a statement,” Mr Agati said.

Mr Agati said that a written report and the taped interview were sent to his office and then forwarded to the defence. Judge Messer asked Ms Smith to expeditiously file a motion seeking to have the mystery called on her witness list if the defence wished to call her to the stand.

The judge also asked the prosecution to advise the individual against watching the remainder of the trial.

I wonder what she said in the interview.

Hmmm. Have to kind of try to read between the lines here. Anyone's guess.

My first instinct would be it is someone he put up to it and it is to help him or did I miss something? I lean that way because that is how I see him. He is the type to intimidate, threaten or control witnesses and so on. From Kayla to his own family I see fear of him in them all. And Bandero.

However, maybe it is some good news and will help with conviction but a bit hard to figure if so.

Just reading between the lines it must not be some ridiculous tip that has no substance like some social media fanatic that thinks she cracked the case based on her psychic abilities and testimony she saw.

Or would they have to listen to, investigate and disclose even a whacky one? Probably so these days...

Seems though there must be something more to it for it to be taken this seriously and have the person advised to quit watching the rest of the trial.

But maybe not, lots of b.s. these days that for some reason is allowed that should be thrown out or dismissed. Hard to say. Some years ago I'd say such would never be entertained nor even needed to go further but not these days.

Seems to be the defense that may "want" the person. Prosecution didn't say such. If I had to bet it is someone Adam put up to it. Don't know of course, just going with the likely odds. If if is anyting about Kayla (his defense, that she did it) then I'd saiy it was obviously him that put someone up to it. Or his defense did. I wouldn't have said that some years ago either but I would now watching a ton of more and more defense attorneys with serious lack of ethics who actually pull illegal imo and underhanded stunts and disobey court orders and the works these days.

Testimony is expected to resume at 9 a.m. There were no proceedings on Monday because of the federal holiday.

Before jurors were dismissed for the day Friday, Judge Amy Messer told them the trial is moving a bit faster than anticipated, and that it was possible all testimony would conclude later this
week.

10 a.m.

From Amy Coveno:

The suspect currently on trial is a no-show again today.

Crystal Sorey, Harmony's mother, is here. She is seated next to Harmony’s foster dad. Harmony's foster mom is still sequestered so she is outside the courtroom.

Tension seems to be increasing between the state and the defense. Motions filed over the holiday weekend ask the court to exclude Kayla Montgomery’s testimony from consideration from the jury. The motion is titled, "State’s Effort To Influence Kayla Montgomery’s Trial Testimony."

The state’s objection calls the defense motion "fantastically mistitled."

News 9 has learned Adam Montgomery’s father died over the weekend. A close relative told News 9 he overdosed.

He was living in Florida and had four children -- the youngest are 3-year-old twins.

Wow! A lot of excitement this morning. First of all, Kayla was there. She gets to testify. She was there before Harmony went missing and after Harmony went missing. End of story.

Secondly, I wonder if Adam was raised in a house where the adults were using drugs on a daily basis? Whatever it was, may his father rest in peace.

State has rested their case. Defense is still considering whether they will or not present any defense at all/witnesses tomorrow. Judge is releasing jury until tomorrow. Court will begin Wednesday at 10:00 AM EST

Judge and lawyers going over some motions. Defense, motion to dismiss being argued now. (Second degree murder charge and one other that I didn't catch)

After the state rested, the judge dismissed the jury for the day. Proceedings will resume at 10 a.m. Wednesday.

11:40 a.m.

From Amy Coveno:

The state ended their case with Adam Montgomery in his own words.

It was a recorded phone call with a police detective.

11:39 a.m.

The state has rested its case.

10:39 a.m.

From Amy Coveno:

Harmony's mother Crysal Sorey is sobbing in court. The witness testifying is Rebecca Maines.

She testified that Adam Montgomery was her best friend in 2021 and that he told her that he had given Harmony back to her mother at a rest stop because she was wetting herself and having toileting accidents all the time.

The witness told the court that Adam Montgomery told her that Harmony reminded him of her mother (Crystal Sorey) and that he "hated" her.

This testimony bring tears for Crystal Sorey and prompts and objection from the defense attorney James Brooks. It was overruled.

10:16 a.m.

From Tim Callery:

Adam Montgomery is not in court again today. WMUR has learned that his father died over the weekend. A close relative told us that Adam Montgomery's father died of an overdose. It's unclear if this is why Adam Montgomery is not here today. He has not shown up in-person since jury selection.

10:13 a.m.

From Tim Callery:

Court is in its first 15-minute break for today. It is possible the judge will take up this motion at some point today.

10:12 a.m.

From Tim Callery:

If the judge does not approve the defense's motion to fully exclude Kayla's testimony, Adam's attorneys are asking the judge to instruct the jury that the state attempted to influence Kayla Montgomery’s trial testimony.

10:08 a.m.

From Tim Callery:

In its objection, the state calls the defense's motion, "fantastically mistitled." Prosecutors say the state did not direct Kayla Montgomery's attorney to speak to his client. Rather, the state provided Attorney Garrity with information to adequately represent his client.

10:03 a.m.

From Tim Callery:

In their motion, the defense says prosecutors informed Kayla Montgomery's attorney that Kayla Montgomery being alone with Harmony would be “an area of attack by the defense” during cross-examination and asked Garrity to “discuss that with Kayla, to apprise her of it.”

10:02 a.m.

From Tim Callery:

Adam Montgomery's attorneys claim his rights were violated during Kayla Montgomery's testimony. They also accused prosecutors of trying to influence Kayla Montgomery's testimony by informing her attorney of information in the defense's opening statements.

12:05 p.m.

From Tim Callery:

Adam Montgomery's attorney has also filed a motion to dismiss the charges of second-degree assault, second-degree murder and witness tampering. The judge has denied the motion.

11:58 a.m.

From Tim Callery:

The judge is now hearing arguments on the defense's motion to exclude Kayla Montgomery's testimony from jury deliberations.

11:48 a.m.

From Tim Callery:

After a few witness on the stand, the state tells the court that it rests.

Lawyers for Adam Montgomery will get their chance to present their case, with jurors set to bet at court at 10 a.m.

On Tuesday, prosecutors finished presenting their evidence to the jury. The state said Adam Montgomery called the search to find Harmony a waste of taxpayer money through a recording of a phone call he made from jail.

They also presented their final witnesses, including a woman who said Adam Montgomery was her best friend. She told the jury that Adam Montgomery said he "hated" Harmony because she reminded him of her mother, Crystal Sorey.

Two people are expected to take the stand in Montgomery's defense, including Harmony's foster mother Michelle Raftery, who already testified, as well as an inmate at the Hillsborough County Jail.

The defense also wants the judge to throw out the testimony of Adam Montgomery's estranged wife Kayla Montgomery, claiming the state unfairly prepared her for cross-examination. Prosecutors called the claim "fantastical." The judge has not yet made a ruling on that motion.

After the defense rests, both sides will make closing arguments. Then, the judge will give jurors final instructions before deliberations begin. All of that could happen as soon as Wednesday.

Meanwhile, Sorey is asking for her daughter to be officially declared dead. Sorey is also asking to be named as the head of Harmony's estate, according to a petition filed in Nashua District Court.

Sorey noted that she is pursuing a wrongful death claim on behalf of her daughter. She did not specify who it was against.

A hearing has been scheduled for March 11.

9:32 a.m.

From Amy Coveno:

There is a large law enforcement turnout for closing arguments.

At one point, about 50-60 members of the Manchester Police Department were on the witness list.

On the stand yesterday, Capt. Matthew Larochelle called it the most important investigation they’ve ever worked on.

Harmony’s foster mother is back inside the courtroom and is no longer sequestered.

The motion to exclude Kayla Montgomery’s testimony is denied.

9:28 a.m.

Court paperwork shows that the defendant's motion to exclude Kayla Montgomery's testimony from the trial was denied.

9:17 a.m.

From Amy Coveno:

The courtroom is open. The lawyers are here and are having a bench discussion with the judge.

Adam Montgomery is not in the courtroom again today. A decline-transport order is in the system.

The jury is due to arrive at 9:45 a.m. for a 10 a.m. start.

We're expecting the judge to rule on the defense motion to exclude Kayla Montgomery’s testimony.

Defense attorney Carrie Smith carried in a large, seemingly heavy cardboard box this morning. It's not clear if the defense will put on witnesses or not.

11:13 a.m.

From Tim Callery:

Smith: "Why does Kayla make up these truths or hide and work hard to make you think a different story? Because the truth leads to her."

11:10 a.m.

From Tim Callery:

Smith highlights lack of blood found inside the family's car where Adam Montgomery allegedly beat Harmony 10-15 times.

10:57 a.m.

From Tim Callery:

Smith says Adam Montgomery was driving Anthony Bodero, leaving Kayla Montgomery alone with the children. She says Adam Montgomery returned to find Harmony was dead.

10:45 a.m.

From Tim Callery:

Harmony Montgomery's mother, Crystal Sorey, leaves the courtroom as attorney Smith goes over the alleged dismemberment of Harmony's body.

10:40 a.m.

From Amy Coveno:

Closing arguments are too much for Crystal Sorey -- the discussion about her decomposing body being rinsed down the shower drain. Crystal left the courtroom upset.

10:40 a.m.

From Tim Callery:

Smith highlights a transcript between Kayla Montgomery and police when investigators asked her if Adam Montgomery ever purchased or stole power tools. Kayla Montgomery told them no.

10:28 a.m.

From Tim Callery:

Smith says when police first spoke to Kayla Montgomery, Adam Montgomery was living in Maine with his girlfriend. She says Kayla Montgomery did not tell police what happened to Harmony. Smith says rather, Kayla Montgomery called Adam Montgomery to get back to New Hampshire. She says the two were partners in this conspiracy.

10:26 a.m.

From Tim Callery:

Smith says Kayla Montgomery's love for Adam Montgomery would have died if he truly beat Harmony. She says no one can maintain love for a man who could do that to a child. Kayla Montgomery testified that she still cares for Adam Montgomery.

10:24 a.m.

From Tim Callery:

Smith says Harmony was already dead in a bag in the trunk of the car. That's why, Smith says, Adam Montgomery was able to remove Harmony from the car without anyone at the intersection seeing the little girl.

10:21 a.m.

From Tim Callery:

Smith brings the jury to the intersection of Webster and Elm, where prosecutors say Adam and Kayla Montgomery realized Harmony was dead. Smith says Harmony died before that moment. She says the Montgomerys were going somewhere to get rid of her body when the car broke down.

10:20 a.m.

From Amy Coveno:

Harmony's mother Crystal Sorey is here. She is weeping. Her hand is over her mouth as she listens to Carrie Smith's closing argument to the jury describing Harmony’s death. Smith is placing the blame on Kayla Montgomery.

The jury is serious and focused.

10:20 a.m.

From Tim Callery:

Smith says Harmony was a loving child. She says instinct would cause someone to protect her if she was being hit.

10:18 a.m.

From Tim Callery:

Smith notes that Kayla Montgomery testified Adam Montgomery beat Harmony 10-15 times around 2-3 a.m. the morning before they went to the clinic. She also testified that Harmony had no injuries when they arrived at the clinic. "How can that be?" Smith asks. "It doesn't make sense because it's a lie."

10:09 a.m.

From Tim Callery:

The judge also ruled that Kayla Montgomery's testimony will not be excluded from jury deliberations. Adam's attorney, Caroline Smith, is telling the jury that Kayla Montgomery lied during testimony.
