Missing San Antonio Mom And Baby May Be In Danger, Police Say​

San Antonio police believe a young mom and her baby who have been missing since January may be in danger.

Twenty-year-old Dlanny Chairez and her 18-month-old son, James Avi Chairez, were last seen January 4 in a store in the 7100 block of Marbach Road.

“Through the investigation, detectives now believe they might be in danger and urge anyone with information to contact the San Antonio Police Department Special Victims Unit,” said SAPD officer Alisia Pruneda.

A mother and baby’s disappearance has a family member fearing the worst​

A San Antonio woman is hoping for the safe return of her niece and 18-month-old great-nephew after the two disappeared last month.

San Antonio police said Dlanny Chairez,20, and her son James Avi Chairez, were last seen in the 7600-block of West Military Drive.

Mariesol Gomez said she has tried constantly contacting Chairez but has not received a response.

“She left everything behind,” Gomez said. “It was all in drawers and on the floor. James’s clothes, diapers and toys. Everything.”

“Justice isn’t being served for James and he doesn’t deserve that, we don’t deserve that,” Benavidez said.

Chairez’s trial, which was expected to take place in early January, was reset for Feb. 17 and will be reset again as in-person trials are on hold until at least March 1.

Believe me, I wouldn't normally ask others to remind me and inform me normally, I hope you know that by now. I just can't take the time much lately. Normally I read the links and try to even bring news here. Right now I just can't, I marginally keep up, and that's about it.

Mother of baby James Chairez takes plea deal in tampering case​

The mother of baby James Chairez, who was found dead after he was missing for more than three months, has taken a plea deal in a case related to the baby’s disappearance.

In a hearing on Thursday, prosecutors waived one count of tampering with evidence in exchange for D’Lanny Chairez pleading no contest on the second count of tampering with evidence.

Prosecutors alleged Chairez concealed the baby’s body in the West Side trailer where they lived.

D’Lanny Chairez will be sentenced in August, following a pre-sentencing investigation ordered by 144th District Court Judge Michael Mery. She could face additional criminal charges as the investigation into baby James’ death continues.

“We want to make sure that everybody understands that this plea agreement in no way acknowledges her responsibility in the death of this child or even a crime being committed,” D’Lanny Chairez’s attorney, William Simmons said.

The third-degree felony is punishable by up to 10 years in prison, according to state law.

Marisol Benavidez, the baby’s aunt, did not agree with the plea deal.

“That doesn’t seem sufficient enough,” Benavidez said. “We don’t have a child here. If tampering with evidence means that she tampered with the body of her own 18-month-old child, isn’t that evidence enough that there’s a child lost? Isn’t that saying, you know, other charges should have been brought?”

Benavidez said she was “disgusted” seeing D’Lanny Chairez in court during the hearing.

“It took a lot in me not to scream at her, say what I wanted to say, because I don’t want to be kicked out of this courtroom, because it’s important for me to follow through with this case, because this is for James,” she said. “You know, I’m going to fight for justice for him.”

Simmons would not comment on the ongoing investigation, but said additional charges would be “difficult” to prove.

It's her defense attorney who said that so no surprise there, it is what they do. I wouldn't imagine he would know all they know since she is not charged with murder yet. He may know some from the tampering charge and related investigation but I would think this would preclude him now from learning anything further as they investigate as her current charge will be concluded right?

While we know why she has a tampering charge and not a murder charge as in some other cases, because they aren't yet ready to charge murder, or don't have enough, I still have to in theory agree with the aunt. No one hides a dead child unless they neglected it, abused it or murdered it, I mean it just would be the rare case anything else would apply and so I get what she means. Maybe tampering should be upped for a sentence too? That seems pretty darned light for doing such a thing.
 

D’Lanny Chairez sentenced to 5 years in prison, could face life sentence after new indictment​

A Bexar County district judge on Monday sentenced D’Lanny Chairez to five years in prison on a charge of tampering with evidence.


D’Lanny Chairez pleaded no contest in May on one count of tampering with evidence. She had been charged with two counts on that charge but prosecutors waived one of them in exchange for the no-contest plea.

She could be facing much more serious time in prison.

Just before D’Lanny Chairez was sentenced, Bexar County District Attorney Joe Gonzales announced that a grand jury Monday indicted her on a new charge.

She is now charged with injury to a child-intentionally or knowingly causing serious bodily injury to a child. D’Lanny Chairez could get up to life in prison if she is convicted on that charge.
 

‘Hope she never gets out’; Two years later and family still fighting for justice for baby James Chairez​

Two years after 18-month-old James Chairez disappeared and his mother was arrested for his death, family members are still seeking justice.

Mariesol Benavidez says she still grieves for her nephew baby James Chairez.

“She failed James as a mother,” Benavidez said. “She was to be his caretaker and his life is no longer here.”


D’Lanny Chairez was arrested and charged with tampering with evidence. She took a plea deal on that charge and was sentenced to five years in prison. On the day of sentencing, more than a year after James was found, D’Lanny Chairez was also charged with injury to a child. She has yet to go to trial on that charge.

Recently, her attorney filed a reduction-of-bond motion in her case. Benavidez is not happy with that filing.

“I hope she never gets out,” Benavidez said. “She needs to suffer the consequences of this.”

D’Lanny Chairez’s next court date is scheduled for March 20 and the bond reduction motion could be considered.

“I hope and pray that the justice system does James right and he deserves justice,” Benavidez said.
 

‘We haven’t had justice’: San Antonio mother charged in 2021 death of her toddler son still has no trial date​

More than three years after the remains of 18-month old James Chairez were found, a trial date has yet to be set for her mother, who is charged in the case.

D’Lanny Chairez is charged with injury to a child - intentionally or knowingly causing serious bodily injury.

She had a scheduled court hearing on Friday, but she just conferred with her attorney and still no trial date has been set in the case .

Marisol Benavidez, the toddler’s aunt, has been pushing for the case to go to trial.

“I should be a little bit more at peace, but I can’t because we haven’t had justice for him,” Benavidez said. “It just hurts all the time.”

A year later, Chairez was sentenced to five years in prison per a plea deal on a tampering with evidence charge. That same day she was indicted on a injury to a child charge, but since then, the case has not progressed much.

“They’re just not finished reviewing,” Benavidez said the Bexar County District Attorney’s Office told her.

The DA’s Office also told Benavidez that a plea deal could be offered, but it is something she doesn’t want.

“They’re not saying that it is or that it isn’t, they will hear me out as far as my feelings towards it,” Benavidez said. “I honestly think that there’s no better than her staying in jail for the rest of her life.”

Going to trial is a risk she is willing to take and a way to have James’ story heard.

“His story needs to be heard for the simple fact that we’re losing too many children in the world right now, and because they take plea deals they aren’t being heard fully,” Benavidez said. “I also want her to be reminded that this was wrong. Put some hurt in her heart, the way I hurt for him. He did not deserve this, and if we take a plea, that’s like saying James’ life didn’t really matter.

For now, Benavidez will continue to wait for the day justice is served for James.

“I don’t know what that justice is,” Benavidez said. “I guess it’s just knowing that she takes accountability and that she serves the time that needs to be served. And that, to me, is life.”
 
Another one not proceeding as it should.

I actually, whatever way I came in here, landed on the first page, where I saw posts I had did and others, before he was found, and I had hope and reason to think her avoidance of family there was a real reason for at that point. It refreshed me on it as I read the first page.

Not to be nitpicky but can news get anything right and where do these people go to school these days? A trial date has yet to be set for "her" mother. The dead child IS A BOYI dumbarses!!!

It may seem minor but it is a dead child, GET IT RIGHT, it matters. He mattered.

Family frustrated by delays, lack of communication in baby’s death case​

Another scheduled court date has come and gone without a trial in the case of a San Antonio mother accused of causing her toddler’s death.

D’Lanny Chairez remains in legal limbo more than three years after the remains of her 18-month-old son, James Chairez, were found.

Chairez’s family said they are frustrated not only by the delays, but also by the lack of communication from the Bexar County District Attorney’s Office.

“I’m tired of them not telling me what’s going on with this case,” said Marisol Benavidez, the child’s aunt.


Benavidez said she had expected a trial date this year, but the case was once again delayed during a hearing this week.

According to Benavidez, she has received minimal updates from the district attorney’s office and often resorts to checking the case status online. She said her last direct communication with the office was in May.

“When this is going to trial or anything, I don’t know,” Benavidez said. After learning of the latest delay, Benavidez attempted to contact her victim advocate but was sent to voicemail.

In a response to KSAT, the district attorney’s office said in part, “we maintain regular communication with the relative in this case, including providing notice of the August, October and November court dates.”

Benavidez told KSAT 12 she has kept a log and record of all communications and the response is inaccurate.

“I don’t know what else we can do to get this going,” she said. “James is not here anymore. I get it. But let’s give him the justice he deserves.”

D’Lanny Chairez is currently serving a five-year sentence for tampering with evidence in the case. If the injury to a child case goes to trial, she faces up to life in prison if convicted.

Meanwhile, court documents indicate that Chairez is requesting a new attorney and a new court date has not been scheduled.
 
Strikes me much like Megan Boswell, all these delays, nothing scheduled, little explanation, for years.

Lack of communication with the family, although they claim otherwise--I would note, they may only be in contact with one or some and not all and for reasons, however, based on their lack of communication overall, I'd believe the aunt.

The only hint here now is she is wanting a new attorney but it just seems like all has been in limbo throughoutt, with little explanation. Because of the quiet, neither case is big on the public stage although both cases had quite a bit of attention at the time of the child missing in both cases, and until found, etc. Otherwise I'd think a hue and a cry would be going on in coverage as to WHY has this been at a standstill for this long??

Jmo. Not fresh on all the facts but think I recall all the delays, lack of trail scheduled, etc. and little to no info on such.
