JOSHUA "JJ" VALLOW, TYLEE RYAN, TAMMY DAYBELL, & CHARLES VALLOW: State of Idaho/Arizona vs. Lori & Chad Daybell *GUILTY*

1580704661510.png

Police seem to be no closer to finding 7-year-old Joshua “JJ” Vallow and 17-year-old Tylee Ryan than they were when this story began months ago.

Since that time, the story has gained international attention as it’s taken twists and turns involving a purported cult, dead spouses, delusions of divinity and preparing for the end of the world. Despite all the angles, and the ever-growing number of people related to the case, the facts remain essentially the same as when it was first announced.

The two children remain missing and the parents, Lori (Vallow) Daybell, and her new husband, Chad Daybell, refuse to disclose their whereabouts to police. Both have been named persons of interest in the disappearance of the children. Law enforcement is also investigating the deaths of the Daybells’ previous respective spouses, Charles Vallow and Tammy Daybell, though neither Chad nor Lori have been named suspects in those cases.

So both Chad and Lori are appealing.

I'm not going to read the links due to time and my day but I will say good luck with that one on Lori as things were stayed each time until she was deemed to have returned to competency. I didn't buy that she wasn't to begin with but who knows. She sure sat through every hearing and trial competent and gave her little speech at the end of hers. Now some may say that shows she is delusional but I don't buy it. No way in hell did she think Tammy was her friend and no way in HE77 do the three of them all talk to her. It was intentional. Maybe this kind of appeal was the plan all along as she put on no defense...

As far as Chad, that's totally standard for anyone in his position and in fact, I think they don't even have to ask. it is their attorney's job to start it and then an appeals attorney gets appointed. He'd possibly have to fight to NOT have such (an appeal) which I think is ridiculous. If they don't want to and want to die, LET THEM. I'm not sure but I know these days they all get given an appellate attorney.

Details in Chad appeal.

ST. ANTHONY, Idaho — An attorney for Chad Daybell has filed an appeal, asking the state supreme court to evaluate his trial and verdict.

According to East Idaho News, Daybell’s attorney, John Prior, filed the appeal on Monday.

East Idaho News reported that in the Daybell appeal, Prior asked the Idaho Supreme Court to consider:

  • “Did Judge Steven Boyce make a mistake in not granting Daybell’s motion to dismiss the grand jury indictment in the case?
  • Did Boyce err in ruling Dr. Davidson’s report and testimony would be inadmissible in the case?
  • Did Boyce err in allowing the prosecution to amend their indictment after they rested?
  • Did Boyce err in denying the defense’s motion to dismiss the case?
  • Did Boyce err in providing to the jury the most current jury instruction of reasonable doubt at the guilt stage?
  • Did Boyce err in providing the jury the most currently instruction of reasonable doubt at the sentencing phase?”
On May 29, a jury found Chad Daybell guilty of murdering three people, as well as conspiracy to commit each of the murders.

Prosecutors charged Chad Daybell with killing Tammy Daybell, his late wife. The state also charged Daybell with killing two children, Tylee Ryan and JJ Vallow. Their mother, and Chad Daybell’s current wife, Lori Vallow Daybell was also found guilty of murder and conspiracy.

Lori Vallow Daybell was sentenced to life in prison.

On Saturday, June 1, Chad Daybell was sentenced to death for the crimes.
Okay, apparently not reading the link and not reading further, I didn't realize this wasn't just the standard start and issues are raised or asked about specific to CHAD'S case already. I figured that would come after the appointment of an appellate attorney. Is Prior allowed to do so throughout or is just commencing such until one takes over...

BOISE — Lori Vallow Daybell’s new attorney has filed an amended notice of appeal and is asking the Idaho Supreme Court to take a closer look at over a dozen issues in the case.
Craig Durham, an appellate attorney based in Boise, is requesting transcripts from 35 court hearings between Daybell’s initial appearance in May 2021 and her sentencing in July 2023.
District Judge Steve Boyce sentenced Daybell, 50, to serve three life sentences without parole after a jury found her guilty of murdering her two youngest children, 7-year-old Joshua “JJ” Vallow and 16-year-old Tylee Ryan, as well as conspiring to kill Tammy Daybell, the spouse of Chad Daybell, whom she later married.
Jim Archibald, Daybell’s prior attorney, filed an original notice of appeal in September raising questions on multiple issues, which are also listed in the amended appeal. They include:

  • Whether District Judge Steven Boyce erred in finding Daybell competent for trial after she spent 10 months in a mental hospital.
  • Whether Boyce erred in denying Archibald’s request to send Daybell back to the mental hospital rather than proceeding to trial.
  • Whether Daybell’s constitutional rights to a speedy trial were violated by the prosecutor’s requests for continuances.
  • Whether Boyce erred when he allowed prosecutors to present evidence of crimes in the pending Arizona case concerning the death of Charles Vallow (Daybell’s fourth husband) and the attempted murder of Brandon Boudreaux (Daybell’s former nephew-in-law).
  • Whether Boyce abused his discretion by sentencing Daybell to serve three consecutive fixed life sentences without parole.
  • Whether Boyce abused his discretion by ordering Daybell, who is indigent and has a public defender, to pay $165,018 in fines and court costs.
Durham is also requesting all sealed filings in the case, including Daybell’s mental health records.
The appellate process can be lengthy and may take several years. The Idaho attorney general will assign a lawyer to represent the prosecution, and that attorney, along with Durham, will prepare written briefs and likely present oral arguments before the Idaho Supreme Court issues its decision.
There could be some delays in Daybell’s appellate case as the state of Arizona plans to extradite her for conspiracy to commit murder in relation to Vallow’s death and the attempted murder of Boudreaux. Daybell has been at the Pocatello Women’s Correctional Center since Aug. 1.
The trial for Chad Daybell is scheduled to begin April 1 in Ada County. A status conference in his case will be held via Zoom on Tuesday at 2 p.m. EastIdahoNews.com will livestream the hearing.
This article is dated October of 2023. AT first I thought it was amended recently and both Chad and Lori recently did filings.

You know, I have said Boyce has grown on me and he has but also has gained more experience since all this started when he had little BUT reading these things raised as issues, puts me back there. It was NOT only the prosecution who ran out of the speedy trial times and hit the deadline, it was BOYCE and no one will SAY that. Not the defense, nor the public, nor other lawyers or talking heads about the case but it WAS. I said so many times in this thread I can't count. He scheduled a hearing to schedule a hearing to hear a motion and then another to schedule a hearing or briefs before deciding with EVERY SINGLE LITTLE motion and issue.

Because of it he ended up HAVING to sever the trials and remove the DP for Lori. And despite him growing on me as he has learned, I have NOT changed that opinion and it still irks me. She should be on death row as well and they SHOULD have been tried together.

I'm also not sure about how much they allowed in on the death of Charles and shooting of Brandon in both trials. I don't recall what was said but he had reasons and case law that he felt it could come in I am pretty sure as he does nothing without such or checking first but the scope went fairly wide and I"m not sure there could not be some possible issues with that, hard to say.

Wow, wow, wow Linda. A must watch. I WATCHED all of these things and caught a lot but she took it all and between her seeing what she sees, her seeing it while other things re going on and even the tech knowledge it took for her to put these things up side by side or point to them it is just wow.

First, anyone who has watched every hearing and everything all along AND trial knows that Chad never shows one bit of an emotion or reaction. In all these years. He is buttoned up and still like a freaking statue. Maintained the same through trial until this ending so someone like him even a head shake or nod, eyeroll, or SMIRK of which he did do a few times over theyears is significant. For someone that shows emotion it might not be but he was a stone cold emotionless in his opinion superior being and he IS showing sh*t for the first time ever over closing Arguments, etc.

And Linda as she somehow can do packs SOOOO much into 25 short minutes, I still can't understand how one can do that. She's not always first with the news, she probably filmed and edited this and in the meantime the verdict and then DP came down but wow.

I watched ALL of this ending stuff after it was live of course. For anyone who has not and I am sure there are some or many who did not, watch this, just for a taste of Emma on the stand just for one on the wind direction and how Lnida pulls everything about this at different points in the trial to compare... It will also give you a very good taste of what a scripted automaton Emma was.

This also sorry to say is not a "listen" it is a must watch the screen for 25 minutes as she shows Chad's reactions at different times and pulls all the things together and shows his frame while Lindsey Blake is saying something... Man she is on fire lately. She is never first and I saw today at break she had one out and WHY after all these years do I think well in this case, I watched all of the ending stuff and watched Nate, the jurors, etc. and what more could she have to add, I still think that, wasn't like I have to watch this but then did tonight and I SHOULD KNOW BY NOW she always always brings something and puts things together no one else does in a very short period of time.

I'm not sure and neither is she of the reasons for the most reaction he has ever shown which is still not much like most of us would but significant for Mr. Stone Face chin up to even HAVE any. She learns towards it is because he wants the facts RIGHT and was shaking his head when they did not have the facts right, etc. For me it could be that at this point he was in his weird way thinking it would affect the jury if he disagreed by shaking his head or agreed and so on. Not sure. I agree with her on his evil is beyond what most know and he ENJOYS the grim details like a serial killer would, like BTK relished in and wants it right. He does do dupers and he does RELISH in it.

Don't just LISTEN to this while doing other things WATCH what she has put together. And sometimes she says it and you have to wait for his reaction, it is not immediate always so watch for it.

WHY do I not know by now, because I do, that she always brings something different and puts things together in her own way? I KNOW this. But she has been absent a lot until recently and more.
Many THINGS, including him carrying JJ upstairs got a reaction. Not a huge one by our standards but huge by a man that never has shown any in all this time.

And she touches on Emma and Joe Murray and more. So if you did not watch all these, get just a glimpse of what she pulls on it all to hear it for yourself and not reading tweets. Not knocking the tweets they saved me as I sure couldn't watch. But I needed to watch the kids, the closings, etc. and did.

Man was this excellent. And yet short. it takes her some time, she isn't always first but ALWAYS pulls more things together in the fast paced rush of trial and trying to keep up with all as reporters do, etc.

@Kimster I know you will be watching it.

Linda is on fire lately. She is back.

This is the eighth or ninth juror I think that I have seen. We had younger guy one with Nate who then came back with was it 5 or 6 (I think 5, he was part of the 6 right?) then I saw one on Court TV the other day and now another Court TV one so 8 or 9 now.

So both Chad and Lori are appealing.

I don't find Chad or Lori appealing!! :bigtongue:

I don't find Chad or Lori appealing!! :bigtongue:
Nor do I. Lol.

Each apparently appealed to the other but both would be hard put imo to find anyone else that saw the appeal of either...

Even if we didn't know what they did or what we know about them, I don't see the appeal of either. They are both flat out weird people. Shallow. Fake. Her flirty and baby talk at her age. Him in this calm monotone. ODD DUCKS.

Of course now we know they are murderous and more but aside from that, they are unattractive and STRANGE.

It is so weird to see something so heinous as his but to see the people behind it are people that never adulted in their lives. I think that is true of maybe most murderers and am coming to see that so clearly. They commit the most serious acts ever one could but they are like children who think live should be unencumbered, they shouldn't have to work, just live on a beach, eat out, and vacation and all should be as the want it or dream of it. It's shallow and they probably wouldn't have lasted either. Isn't that truly the goal of many a murderer. A new life with a hot gf, money, fun, sex, etc. Kids and people are interfering with that and hey let's make money from getting them out of our way as well in this one. Most just kill the wife and kids like Watts, here they combined both things. Rid selves of spouses, kids AND profit to pay for the lifestyle they want.

To whoever watched Summer with Nate, compare how she looks to how Lori looks today. I'm not saying I agree with it or that image should be everything but Lori no longer has access to Botox, hair products or a calm life and she should honestly GIVE UP on the hair. It is out of place with the haggard face.

Chad--well who can see what any woman would have ever seen in him. Sorry Tammy, that was not a slight. And I mean the inside as well as the outside. He is WEIRD.

Ten days to two weeks before each instance, murder, attempt, etc. and she said prosecution and FBI etc had the timeline broken down and shown SO WELL... The one juror said Agent Hart was the rock star witness...

They ROCKED this case. Prosecution side and witnesses. Defense well, as is often the case, put up a few liars and a bare bones defense as this one has even thought not a lot of DIRECT evidence, way beyond enough circumstantial evidence that no one could miss the dot to dot and the dots were within less than a centimeter of each other and a ton of them and then quadrupled form many other things imo.

Justin isn't a Nate yet but he is GOOD. Both men were very important to this case.

Nate with yet another juror. Been doing other things I need to do, just came across still live it has been on for 15 minutes...

Nate with the same juror as Justin Lum had on. Most nervous shaky one I've heard yet in both interviews. But good. Finally made clear what a presiding juror is and that is the foreperson I wondered and don't doubt others did as well. Not sure why terms have to be changed from what the public knows but what else is new.

HTC is so not my favorite YT channel or show. Nothing wrong with them but just not my cup of favorite tea. But she has attended both trials and family members and others have gravitated towards them and this is a more in depth juror talk with juror Blake and I don't hate them or anything and am not going to ignore an actual juror interview or family member interview, etc. and that's how I end up watching them. And this is a juror interview and so yes I have to watch it.

I am so not a huge fan of Lauren and Dr. John. For various reasons. No real bad ones or any reason no one should watch them, just not my cup of tea for various reasons. I watch however when they have someone like this on and I am listening to it right now and this expanded talking by Juror Blake is worth it. When I watch, I watch for the guests they have on. And he is talking of how sorry he felt for Garth however he thinks he lied. A lot of further expanding in this, etc.

Also felt bad for Emma BUT he says how scripted AND how her only emotion was crying when video of her with dad at cop car was played but when talking about mom emotionless and damning her about playing Candy Crush and eating McDonalds like some loser or slacker (I am paraphrasing totally) but WHO does that about their dead (murdered by dad) Mom???... THAT is dead on right about Emma. He put it MUCH nicer than I just did.
