He go around saying we all p** because most of us in here for shooting someone and killing them. My brother was chosen for a jury, and before they went out to the jury box the judge walked in and told them they wouldn't be needed because the defendant accepted a plea agreement. He told them that often it won't be til the first day of trial that a defendant will decide to plead guilty. Many people suddenly realize "Hey! This is really happening!!"
 
I expect he'll get a life sentence. But there's potential he could be out before he hits 40. :oops: (Doubtful based on circumstances and his behavior in custody, but...)

Without a trial, the case is now in the hands of Circuit Judge R. Lee Smith, who will rule on Fucci’s sentence.

Because of his age, Fucci is not eligible for the death penalty but faces 40 years to life in prison. Under Florida law, he can request a review of his case after 25 years with a chance of resentencing.

In court, Fucci and his attorneys waived the right to appeal this part of the process by entering the plea, but they could still appeal the sentence if they feel it is not fair.

So far, Smith has not set a sentencing date, but when it is set, it will likely take about two days. The state and Bailey’s family are likely to outline the heinous details of the case as they push for a strong sentence.
 
They are fools if they don't give him anything less than life without parole. These pleas are B.S. Sooooo sick of it. So plea deal that's not happening. O.K. at 40, He gets out. He will still be violent IMO.
I have a feeling he'll never see the light of day because he will continue to be a predator behind bars. That is, unless times keep changing the way they are now and criminals keep being released early out of pity's sake.

That's happened to me twice now.
 
With you, it was probably regret that they let you on the jury, and cancelled the trial. Just a mostly probable guess.
Our courthouse at least has a number you can call on the jury card so you can at least tell if it has been cancelled before you leave that morning. I never had to even leave the house. I am sure some cases aren't decided up until the moment it is to begin, but both times on mine it was decided before that morning.
 
I've never been called for jury duty. Maybe they already know. My parents have been called and served twice. I would hate to serve in a case like this. I stand by my opinions and beliefs. But you can't change others.
 
I can't be a juror anymore due to my medical problems. I was called, but had to get a doctors note. I'd love to serve on another jury.
 
I couldn't serve due to that now too. Oh it's for a guy flashing fire hydrants. Habitual huh?. DEATH PENALTY! Dismissed. That's what I thought. And mission accomplished.
 

Prosecution, defense list potential witnesses in Aiden Fucci’s sentencing hearing​

Having pleaded guilty to first-degree murder in the death of his 13-year-old St. Johns County schoolmate, Tristyn Bailey, Aiden Fucci is awaiting a sentencing hearing.

News4JAX has been told the hearing could go several days, and now we see that 41 people have been listed as potential witnesses.

The prosecution has 19 people on its witness list, including the lead investigator for the St. Johns County Sheriff’s Office, the medical examiner, a psychologist and two juveniles identified only by their initials.

The defense list has 22 individuals, including four members of the Sheriff’s Office, eight juveniles identified only by their initials and Fucci’s juvenile probation officer. His parents are not on the list.

Neither of Tristyn’s parents is listed. One of the juveniles does have a last name that starts with the letter “B.”

The scheduling hearing is Feb. 23. That’s when a sentencing date could be set.

During the status hearing Thursday, Judge R. Lee Smith set a tentative sentencing date for Fucci for the week of March 21. Smith said he doesn’t plan to “drag out” the sentencing process and will likely make a decision the same week as the hearing.

Fucci will be back in court for another status hearing on March 8.
 

ST. JOHNS COUNTY, Fla. – A St. Johns County judge said Wednesday that the sentencing hearing for Aiden Fucci will begin in two weeks.

Fucci is facing the possibility of life in prison with a minimum sentence of 40 years after pleading guilty to the stabbing death of schoolmate Tristyn Bailey last month. Bailey, 13, was found stabbed to death on Mother’s Day in 2021.

At a status conference hearing for Fucci on Wednesday, Judge R. Lee Smith affirmed that his sentencing hearing will begin March 21 and could last at least two days. Judge Smith said he plans to hand down the sentence on March 24.

Both sides will call witnesses during the hearing. At least 40 are expected.

In court on Wednesday, the judge ruled a probation officer who interviewed the defendant in jail will not be able to testify at sentencing about what Fucci said about his mental health.

State releases text messages Aiden Fucci sent to parents while in jail​

In these text messages, Fucci, now 16, refers to his jail cell as his “bat cave” a couple times and often talks about playing video games on his tablet.

In one message from Fucci to his father in August 2021 — just a few months after the murder, he wrote:

“Hey I gonna go back to my batcave and call y’all so love you bye. The tablet is about to die. Its at 7″

In early September he wrote this to his mother: “I was playing Candy Crush but I gust I ran out of lives”

Fucci also told his mom that he cannot play online games, only offline.

A couple days later he texted his mom: “playing candy crush, day going real slow, I guess no commissary came in so I figure Ima just play some candy crush”

We previously reported that Fucci reportedly extorted commissary items from inmates by “using fear.” There was an incident in January 2022.

When officers attempted to obtain the commissary items that Fucci extorted, the previous report says, “He became highly agitated and made threats against the officers’ lives.”

We reached out to the Bailey family attorney for comment Monday. He told us: “At this time, they do not anticipate making a comment about the case until after sentencing.”
