If I recall correctly, the cops came to the house to talk to him and on talking to him took him to show them where he walked with her, saw her, etc. It was THEN that mom washed the jeans and someone else was present who I believe told LE (I doubt they are friends any longer). And then they were able to back it up by taking the home security footage.

So it is possible, just slightly, that she didn't know from her son BUT when she saw cops and heard what he told them she checked his stuff and room when they left with him. It is though also possible he told her OR when he saw or they knew cops were at the door panicked and she got a clue from him or something... It certainly does though show she didn't stay calm and relaxed and do nothing, certain her son was innocent. Either way she new or suspected at some point is the way I see it.
it definitely was to save him and not just to be innocently deciding to wash his dirty clothes.
 

Exact start date of Aiden Fucci’s trial could be announced in December​

Aiden Fucci, the teen accused of killing 13-year-old Tristyn Bailey, was back in court Tuesday morning for a pretrial hearing.

Fucci’s trial is scheduled to start in February after a judge announced in August that he is giving Fucci’s defense team more time to prepare for the trial, and the judge said Tuesday that the exact start date could be announced next month.

On Dec. 2, there will be a status hearing for Fucci. His trial period could be released by then.

Defense attorneys for Aiden Fucci, the teenager charged in the murder of 13-year-old Tristyn Bailey, have filed a motion, requesting the court transfer pre-trial custody of their client.

The attorneys make note of 29 points in their motion, filed Friday, which they hope would lead to their client being moved out of the John. E. Good Pre-trial Detention Facility in Duval County. The document notes that Fucci “has been in a form of solitary confinement” for over 400 days, with exceptions where he was in the general population for 129 days.

It adds the Duval County jail has held Fucci in confinement, alone in a cell for 24 hours a day, saying he’s “denied access to any form of group recreation either indoor or outdoor; he is denied access to group education, he is not allowed to eat meals out of his cell; he is not permitted to participate in congregate religious services or jail programs.”

Attorneys write that Fucci will occasionally have a video call with family members and that he will meet with a member of his defense team a few times of month. It notes the defense team is trying to increase that to weekly visits to provide Fucci “some relief from the lengthy period of solitary confinement.”

The motion contends, according to the defense’s education, that Fucci is held in solitary confinement for threats against him within the jail — and previously for other reasons.

“It is not uncommon for Defendants held for pre-trial detention to be moved between county jails for safety where there is a threat of violence or other considerations,” the defense writes. “It is unknown why Child/Defendant Aiden Fucci is treated differently when a remedy absent tortuous conditions are available for his safety.”

According to the motion, the prosecution has refused efforts to resolve the issue via a negotiated plea. It says that the decision to keep Fucci in confinement has amounted to psychological punishment. On Tuesday, the State Attorney’s Office responded to what was in the motion that said the prosecution has refused many efforts to resolve this case via a negotiated plea, saying, “The state has not offered any term of years on the case.”

Maybe I shouldn't be so judgmental because he is just a young boy who didn't mean to stab a young girl well over 100 times right...He has no recreation well boo-hoo. She can't cheerlead any more or even awaken to another day. Poor little boy with a mommy who rather than have him face his deeds and consequences and maybe learn from his murderous choice would wash his bloody jeans.

Hey he's got free room and board and never worked a day in his life. Why would he want group recreation and group meals etc. anyhow? This little teenage sh*t wants to eat with the general population? And recreate with them?

I more suspect it is a roundabout way to again say only if not charged as and held as an adult will he have access to such RIGHTS as group recreation and religion, etc. because after all he should have these things but if he does among the adult general pop he will be in danger, hence he needs to go elsewhere?

I have no idea and may be wrong, just speculating. And such isn't a RIGHT so tough. Imo.
 

Sheriff argues Aiden Fucci should not get to choose where he is housed as he awaits murder trial​

The St. Johns County Sheriff’s Office filed a response to Aiden Fucci’s request to be removed from the Duval County jail.


Fucci’s defense motion states that the teen is held in solitary confinement 24 hours a day, is not allowed to eat outside his cell or participate in group recreation or religious services.

In the response motion, Hardwick concludes that Fucci does not get to pick what jail to be held at, as he lost those rights when he was indicted by a grand jury for first-degree murder.

Last week, attorneys for Aiden Fucci — the teenager accused of killing 13-year-old Tristyn Bailey in St. Johns County — filed a motion, asking for their client to be moved out of the Duval County jail.

Now — they’ve filed another motion, this time for a change of venue, saying their client cannot get a fair trial in the Seventh Judicial Circuit, which encompasses St. Johns, Flagler, Putnam and Volusia counties. The attorneys also said an impartial jury can’t be found in any of the neighboring counties in the region.

One reason they list is pretrial publicity. The attorneys want the trial moved to an alternate Florida county.

What does his defense team have? As far as we know and imo nothing. Yah, a change of venue may well be warranted until you figure any jury that knows nothing about the case isn't going to find this young evil perp innocent or just having lost it with what was it, something like 140 stab wounds and overkill? So what good does a change do? They don't have a case.

Of course in nowadays world, it was overkill because his mommy refused to wash his jeans the day before for him and told him to wash his own clothes so he was just overburdened and that is also why she washed them after he got blood on them. Sorry, sarcasm very intended.

I am so sick of seeing our system falling apart. I actually wonder how good it ever was and if it just more noticeable now that light is shown on it.
 

Documents obtained Friday by News4JAX show that the motion was filed Wednesday. The St. Johns County Clerk of Courts on Thursday informed the lawyer that the motion does not meet the requirements of confidentiality and gave the attorney 10 days to seek a hearing on the matter.

Notably, there was a confidential filing last year and that remains under seal.

Fucci’s trial remains scheduled for Feb 6. His next court appearance is scheduled for Jan. 20.
 

State files motion for 6-member jury in trial of Aiden Fucci, teen accused of killing Tristyn Bailey​

The State Attorney’s Office for the Seventh Judicial Circuit has filed a motion to impanel a six-member jury for the trial of Aiden Fucci, the teen accused of killing 13-year-old Tristyn Bailey, according to St. Johns County court records.

In the motion, the state says that while Fucci is charged with first-degree murder in the stabbing death of his St. Johns County schoolmate, it is not a capital case because of his age. He is not eligible for the death penalty, only life in prison.

The state goes on to say that given that reality, state law allows for a six-member jury, not a 12-member jury.

Lee Lockett, a criminal defense attorney not affiliated with this case, says state law allows for this jury size reduction in very specific cases.

“So, naturally, the defense would prefer a 12-person jury because that is going to be a more diverse jury panel,” Lockett said. “It’s going to be more people to convince, there’s going to be 12 people that they have to convince versus just six. So that’s why the state will naturally prefer a six-person jury.”

There has been no response yet from the defense.

“It’s difficult to think of any defenses that the defense attorney is going to have to that motion because a lot of the case law that you read on this issue seems to be mandatory, meaning that the judge is probably going to be obligated to grant the motion because there’s just not a lot of discretion in these situations,” Lockett said.

Fucci’s trial is set for Feb 6. He has a pretrial hearing on Jan. 20.
 

Judge grants state’s motion for 6-member jury in trial of Aiden Fucci, teen accused of killing Tristyn Bailey​

During Friday’s hearing, Judge Lee Smith sided with the state on the jury decision, granting the state’s motion for a six-member jury and rejecting Fucci’s attorney’s motion for a 12-member jury.

State law requires anyone that’s facing a death penalty case to have a 12-member jury, but this is not a capital case because of Fucci’s age. He is not eligible for the death penalty, only life in prison. So, because the death penalty is off the table, the judge said a six-member jury is acceptable.


Most of the motions discussed Friday focused on what should and should not be shown to the jury. Fucci’s lawyer said certain pieces of evidence are not relevant to the killing and would unfairly influence the jury’s opinion.

For example, Rosemarie Peoples, Fucci’s lawyer, only wanted the jury to see the autopsy photos that have lethal wounds in them, arguing that those are the only wounds relevant to the charge of first-degree murder filed against Fucci. However, while 108 of the 114 wounds Bailey suffered were considered non-lethal individually, the medical examiner said they would be lethal when suffered collectively. The judge ruled that the autopsy photos could be shown to the jury.

In the other newly-filed defense motions, Fucci’s attorney asked the judge to prevent the state from showing the jury satanic drawings that detectives said were located in Fucci’s bedroom during their investigation, as well as several knives that were taken as evidence from bedrooms in Fucci’s house — not a knife pulled from an area pond. The attorney argued that Fucci was not the artist of the drawings and that during a deposition, one child said they were responsible for them and gifted them to Fucci. The state on Friday agreed not to use the drawings in the trial. As for the knives, the judge ruled that the collection of knives that were found in Fucci’s home is not relevant to the case but that photos of two knives said to be on his person — including the knife found in the pond — are admissible.

In addition, Fucci’s attorney requested all cellphone evidence be suppressed. That motion states that six cellphones were seized during the investigation, and Fucci’s lawyer argues the court should prohibit “text messages, images, photos, music, videos, and song lyrics, because the items are unduly prejudicial and would be used by the State for the primary purpose of inflaming the passions of the jurors.” The motion goes on to propose: “In the alternative, Defendant seeks an order to have the State of Florida identifying what precisely they intend to introduce into evidence from the individual cell phones in evidence.” On Friday, the judge tabled this motion. The state will narrow down and disclose what specifically they plan to bring into evidence from the cellphone content.

Finally, Fucci’s lawyer has been trying to interview three people, including two teens, but all three are refusing to provide information. She asked the judge to be able to order them to cooperate. The judge granted the motion for the adult but held off on deposing the two teens until necessary at trial.


A docket sounding is scheduled for Feb. 1, and jury selection is set to begin Feb. 6. The date of the final pretrial hearing has not yet been determined.
 

Documents: Aiden Fucci got into jail fight, has threatened to kill inmates, officers, their families​

Jail reports obtained Thursday by News4JAX from the Jacksonville Sheriff’s Office show Aiden Fucci, the teenager charged in the murder of 13-year-old Tristyn Bailey, has been involved in multiple disturbances while incarcerated at the Duval County jail.

Records reveal, among other things, he’s gotten into a fight and threatened to kill inmates, corrections officers and their families.

According to documents, on Dec. 25, 2021, a corrections officer witnessed Fucci hit another inmate — and the other inmate punched him back multiple times. Police said the other inmate was stun gunned and that Fucci told JSO he was being extorted for his commissary items and bullied. When asked why he didn’t inform the officer, the report says Fucci stated, “I ain’t no snitch.”

The report states no officers were injured. After that fight, the report states, Fucci was placed in solitary confinement.

A report that was filed Jan. 25, 2022, makes note of threats that Fucci reportedly made while in the jail, and mentions the fight that occurred on Christmas Day in 2021. The report reads that Fucci “has been relentless in his threats” against two inmates.

One of those inmates told police, the report reads; “Fucci been saying he gonna stab me up when he gets back to GP. He be telling everyone in the dorm that when he get out, he gonna find my people and stab them and take pictures. He go around saying we all p** because most of us in here for shooting someone and killing them. He says he real because he stabs a b** face to face and take, they life, it’s like he get high off it or something.”

Further investigating, according to the report, shows Fucci made several threats against other inmates and staff members, including when an inmate told police Fucci threatened someone, saying “When he gets out of the box, he’s going to stab him up.”
 
I just watched this video. This guy is the worst kid I have ever seen. Wow! And after seeing what his mom did to cover the crime? She didn’t help him at ALL. Was she afraid of him? Or is she just the biggest enabler in the world? I’m so glad they caught this guy.

I believe this trial starts on Monday.
 
They need to make sure this already psychopath NEVER gets out!!! He is evil. At that age, He knew what he was doing and is STILL threatening to kill or stab etc. Someone else. They take into account once they serve so much time to release them when convicted as a teenager. No way with him!!!

I think as more information comes out during the trial, people are going to be totally floored. I sure was when I looked into it.
 
Stabbed her 114 times. Try making that motion all over that many times. My aunt was murdered when I was 11. Stabbed almost that many it still baffles me how many times that is. Extreme overkill. My aunt's killers were 3 strangers. But were angry she had nothing much to steal. As many as 114 times is a frenzy. This kid planned it and was very angry and violent from past incidents he had shown an escalating pattern. it doesn't take many to kill someone. A strategically known place, It takes 1. That poor girl must have suffered.
