A Frye hearing on March 28th.



Suspected Gilgo Beach serial killer Rex Heuermann returned to court Wednesday on Long Island, where a judge set a March 28 date for what's called a Frye hearing to determine whether DNA evidence will be admissible during trial.
Heuermann, 61, has pleaded not guilty to murder charges in the deaths of seven women spanning from 1993 to 2011.
Investigators say they matched hair fibers that were found on the victims to Heuermann through a process called nuclear DNA testing, which has never been used before in a New York court. While Heuermann's defense team calls the process "magic," prosecutors say it's used throughout forensic science for things like preventing disease and identifying remains. They want the judge to accept what they call ever-evolving and advanced cutting edge DNA techniques.
"The burden is on us and, in laymen's terms, we have to establish that the science we are seeking to use is generally accepted in the relevant scientific community," Suffolk County District Attorney Ray Tierney said.
"But all the scientists we speak to, the whole genome sequencing has absolutely no business to be used in a forensic, meaning a criminal, court," defense attorney Michael Brown said.
Both sides are expected to call a total of eight witnesses, including a doctor and other experts, over the next few months. They will be pre-trialing hearings before a judge, and there will not be a jury present.

Will there be 1 trial or many?

Heuermann's defense is also pushing to separate the case into five trials, saying it may influence the jury to have so many allegations presented together.
"You never want to use evidence that is unrelated, which would prejudice the jury's determination," Brown said.
Prosecutors, however, say there is overlapping evidence and call it a serial killer case.
"This is an individual who had the specific intent to kill, identify, locate, lure, obtain control over, and murder multiple victims," Tierney said.
The judge is expected to rule on that matter in the coming weeks.
 
I know NY is generally a no camera but if I understand it correctly, a judge can choose to allow? I'm hoping for trial they will do something that way... Such a huge case.

Tierney does as you say generally come out after and do a presser.
I'm hoping he will. A couple Podcaster are present reporters are present just no camera in courtroom live
 
DNA fights are being made an issue in more than a few cases I follow at least right now.

Of course it's one thing a D has to go at, along with trying to get all thrown out based on illegal search (claims), interrogation, etc. it's the basic ABC of the D, then when that doesn't work, they go after the individual things...
 
So if they do one at a time, let the first one be one where the POS called the victim's family.

TBH if they do these ones first with the cell phone evidence, they won't need DNA.

Just get him life without parole for these three then they can take their time with the others.
 
17.Judgement of divorce - proposed.

Yeah, that's been going on for awhile but I think they temporarily early on ensured things were protected... No time to really look into but here there is generally a temporary order and then a final one in a divorce...

I've said it in other cases, like in Delphi, she'd be smart to move to protect assets and file... That guy too that killed his little boys and tried to kill their stepsister, etc. Doerman i think the name is. Many a one. I don't want the victims screwed but the wives staying or not doing such is not smart of them. In THIS one Asa knew exactly what she was doing, still does and they were weirdly ready for it... I also don't understand a wife staying by their side but in this case she has profited from doing so...

I'm just without words, that all are probably thankful for lol.

This is not finalized in my opinion for a few reasons...

Yeah and they may go on to never even exploring others as the yrs go on. Administrations will change, as will prosecutors/DA's, etc. which i am starting to see is a big issue in our system.

BUT I agree. Get him put away. Kind of like Lori, she is already sentenced but thinks trying to undo this next one will help her. It's mind boggling. I think every family of a victim deserves answers not that they can always come, but all deserve that if possible.

So daughter and mom were there.... Did they have their TV entourage...
